Authority to stop rests on Terry versus Ohio. Reasonable suspicion is enough. When versus United States adds that the officer's motive is irrelevant. Running a stop sign under Illinois code 11-1204 is itself prosecutable. Probable cause is judged under Illinois versus Gates. The test is totality of circumstances, never a single fact alone. Driving conduct, impairment cues, voluntary admission, refusal together overwhelming. The exit order rests on Pennsylvania versus Mims. Officer safety outweighs a minor intrusion. No [clears throat] extra justification is needed. The voluntary admission of impairment is the most damaging evidence here. Under Berkemer versus McCarty, a routine stop isn't custodial interrogation. Anything volunteered before arrest comes in at trial, no Miranda required. Subsequent to an arrest for driving while under the influence of alcohol, other drugs or intoxicating compounds or any combination thereof, DUI or section 11-401, leaving the scene of a fatal or personal injury accident, you are hereby notified that as provided in section 11-500 of the Illinois Vehicle Code, you are a first offender unless within the last five years of this arrest for DUI or leaving the scene, you have had a previous conviction or court assigned supervision for DUI or a similar provision of a local ordinance. If you have not had a prior 12-month disqualification of your CDL privileges, your CDL privileges will be disqualified for 12 months. If you have had a prior 12-month disqualification of your CDL privileges, your CDL privileges will be disqualified for life. Any questions? Field sobriety tests live in a hybrid zone. An NHTSA validates three: horizontal gaze nystagmus, walk and turn, and one leg stand. In Illinois, refusing them pre-arrest carries no automatic penalty, but the refusal itself is admissible at trial. Post-arrest chemical testing works very differently. Illinois implied consent, section 11-501.1, applies the moment you drive. Birchfield versus North Dakota, Breath tests are allowed incident to arrest. Blood needs a warrant. Refusal won't block prosecution, but triggers automatic license suspension. 12 months first offense, 3 years for any prior refusal. Handcuffing is judged under Graham versus Connors objective reasonableness standard. No resistance, no escalation force stay at the lowest tier. The verbal insults implicate the first amendment. City of Houston versus Hill protects criticism of police, even profane criticism. Only fighting words and truth threats fall outside, neither applies here. Officer grade B plus. Clean observations, correct NHTSA sequence. Warning to motorist read in full preserving the state's authority. Only deduction, open-ended questions to a clearly disoriented subject. Driver grade D. Volunteered admissions, shifting answers, self-defeating conduct. The grade stops short of F only because there was no physical resistance. Four lessons every driver should take from this footage. One, silence is a right you must exercise. The officer will not invoke it for you. Identify yourself. Hand over documents. Then stop talking until counsel arrives. Two, know which test is being offered before you answer. Pre-arrest field tests are usually optional. Post-arrest chemical tests are not. Three, arguing at the roadside never erases probable cause. Defenses are built on procedural errors, not on protests. Four, phone calls, insults, and apologies all become evidence on camera. The law rewards composure. It punishes impulse and self-incrimination. If there's an interaction or legal topic you'd like us to analyze, leave a comment below. Thank you for watching.
