police officers are required to act in a calm and respectful manner but what happens when they completely lose control and start behaving in ways no one would believe hold on get this on camera go ahead you can record Z in the car please being aggressive stop resisting no man okay you dude here are two insane examples of police officers losing control and getting sued after starting off in the morning of February 2023 Deputy Chris tier of the Keta County Sheriff's Office stepped up to Tyler Merkerson who just pulled into a gas station somewhere in Georgia luckily the incident that occurred was recorded fully on the officer's body camera take a look at what happened got got your insurance card you don't have a seat belt on so how about how about this let let's restart how about you don't give me a reason to stop you you ever heard of that before so wear your seat belt and you won't get pulled over it's a very simple task if you don't absolutely do you not just see it on I had it on in the parking lot awesome give me your insurance card I don't have it on me oh that's another one right back with you [Music] yeah 184 Deputy tier I just said it can you hear me Deputy tier it'll be on your it'll be on your ticket hold on one second Deputy tier gave Mr Merkerson a seat belt violation ticket at a gas station even though Georgia law only requires seat belt use for front seat occupants on public roads Mr Merkerson had unbuckled his seat belt while on the gas station property which is typically not a violation but it might be seen differently if he had done it while still on a public roades I can see it you said what I got as long as I need yes I do see in a minute hey stay in the truck stay in the truck and shut the door if I have if I have to ask you again you're going to jail hey he's being all have him step out sit on my car hey 95 I'm done with it 95 you ain't listening since I pulled you over go I'm going tase him put your hands behind your back watch out watch I'm T good I'm good I'm good I'm good real smart I wanted you to get a knife off of me so you because don't listen that's the problem cuz you don't listen me man turn off of me going to give you one ticket and a warning for the other but you can't follow directions I'm trying to get you to get a knife off of me no that's not how it works what I tell you I don't want yall to shoot me did I pull my gun or anything on y to be my what y just beat my Deputy Radford Brooks arrived as backup and questioned Miss Mr Merkerson about any weapons unaware that Mr Merkerson had a knife in his pocket initially Mr Merkerson followed Deputy Brook's directive to sit on the bumper of Deputy tier's vehicle however he stepped forward to retrieve his pocket knife leading Deputy tier to instruct Deputy Brooks to arrest him the officers employed physical force and a taser during Mr merkerson's arrest even though Deputy tier's statement didn't explicitly convey that Mr Merkerson was under arrest despite conflicting accounts and claims of excessive force the court determined that the level of force used was too minor to be considered unlawful over over me trying to get you to get a knife out of my pocket you beat stop come on talk to me like a man bro talk to me like a man y the biggest game you can't wa to count y the biggest game bro why yall got to be a game why yall got to be th why y'all and I fought with you that was completely preventable and I'll be honest with you if he would have been polite and tried to work with me I would have helped him out but you do not listen you got a lawsuit coming you don't me out of this apparently apparently I'm after him well I told him I said if you wear your seat Bel you don't get pulled over I mean but I guess window wrong too it's a hard concept but all right want take him to jail you okay oh okay well the thing is you violated 16104 which is obstruction in the state of Georgia two times actually you're about to learn today you did Mr Merkerson found himself charged with three misdemeanor obstruction counts stemming from his refusal to sit on the patrol car's Hood and his resistance to arrest by Deputy Brooks and Deputy tier following Deputy Brooks's assertion that he had violated George's obstruction statute multiple times during the encounter follow what know is all right brother just be quiet man listen since you're so hurt I need you to be quiet relaxed I don't want you to work yourself up okay I only slammed him down he got right back up now the her I I recognize I never recognize I recogniz her don't leave that oh I'm not going to leave it out um medic said the dude's good um but he said that he wants to go to the hospital cuz his right leg hurts or right knee because he's had a surgery in the past following his examination at pedmont hospital and medical clearance Mr Merkerson was brought to the Keta County Sheriff's Office for booking during this process allegations arose that Deputy tier had deactivated his body camera and issued a warning to Mr Merkerson threatening felony charges if he contested the case in court initially Mr Merkerson was charged with a single count of obstruction and a seat belt violation but after obtaining legal representation he was confronted with two additional obstruction charges in a significant turn of events on June 26th 2023 all charges stemming from this incident were dropped Mr Merkerson pursued formal complaints against both officers however he encountered difficulties in initiating an internal affairs investigation as an officer claimed to have reviewed the footage and found no wrongdoing this officer stance implied that an internal affairs inquiry hinged on approval from the head of the Traffic Division next up on January 20th 2021 Jamal Williams was eating lunch in his parked car in hasienda Heights California when deputies Bruno de Ola and Alexander tavali from the Los Angeles County Sheriff's Department approached him they were responding to an alleged nearby burglary involving two suspects and the interaction was recorded on both officers body cameras take a look at what happened next Hands on the Wheel what's going on you live around here he hey hey don't don't touch don't touch relax bro relax hey you match the description of somebody okay that just committed a burglary in the area okay you're on camera so don't step out the is your is your is your is your body cam on it's on yes it's step on out we'll explain everything to you okay just step out of the car step out the car I'm I'm not stepping out the car you're being detained for a burglary investigation okay sir so no no no no no no do you live in the area I'm not answering any question don't want my Lord okay step out of the car you're being detained right now all right step by of the car sir you're on camera dude so don't do anything dumb okay during the encounter with Mr Williams Deputy de Ola ordered him to exit his car and Deputy tavali entered the vehicle from the passenger side it's uncertain whether this action was justified as Mr Williams didn't seem to pose a threat and his reluctance to leave the vehicle may not have warranted such intrusion let's continue hold on I'm get the pH camera go ahead you can record St by the car please addressive hey resisting stop resisting why you no man okay get out of the car sir supervisor I want to talk to your supervisor call your supervisor call your supervisor you dude give me your hand I I don't give you consent to touch me I don't give you consent to touch me don't reach I don't handcuff Deputy Ola and Deputy tavali tried to physically remove Mr Williams from his vehicle but he eventually agreed to get out when threatened with a taser what's notable is that Mr Williams had asked to record the interaction on his cell phone and seemed to be complying with their request to exit when the officers resorted to force this situation raises concerns about whether the initial use of force by the officers was justified and constitutionally excessive especially since they had initially allowed him to film Additionally the threat to use a Taser against Mr Williams given his relatively passive resistance could be seen as excessive force as indicated by relevant legal precedents stop a little SL hey we got we got a supervisor coming hey you got anything on question hey can you record this it's recording it's all we all have cameras okay okay he these guys are ridiculous yeah we are I don't question you're on video is your name Jamal I don't ask a question okay all right cool makes it easy do we need that or you want to take that off and let's go ahead and just walk into a car yeah we just pulled up on the car I told him he G for you know Burger investigation match the description of the burger suspect and he refused to get out and all we did was just control holdes and try to pull him out once we had him completely out of the car then I just did a little take down ground cool and uh team H pretty much it so once he was on down that's when they showed up the officers detained Mr Williams thinking he resembled a nearby burglary suspect who had escaped on foot however there were notable disparities between Mr Williams and the actual suspect in terms of age clothing and location the burglary suspects were not discovered near the approximate crime scene a significant difference considering these distinctions a court might conclude that the officers lacked the necessary probable cause to arrest Mr Williams or even the Reasonable Suspicion required for his detainment let's see how things play out uh no I think they assisted I think black help me out I can't right there what you guys hey if we take these off are you going to cause a problem to kick any windows out anything like that I don't answer questions can leave them on then that's fine I don't give you content to go on my car and check my car you're violating my fourth amendment constitutional right we're going to sink him in a car has it been clear yeah oh I think we we can move forward and try at least get in the back seat yeah that's F why are you guys kidnapping I'll explain everything you just tell me your name so we can talk tell me right now find a car and put in there okay what well if he's not the 459 suspect then did you finish the 148 he's not de yeah know I know I'm going to research the vehicle and see if the mask that the suspect was seen on picture that was taken by the informant is inside the car upon realizing Mr Williams wasn't the burglary suspect the deputies charged him with resisting an executive officer a California penal code violation to secure a conviction physical resistance like Mr Williams exhibited could be enough but only if the officer was lawfully performing their duties at the time after nearly a year the resisting charge against Mr Williams was dropped following the incident he filed a complaint with the Los Angeles County Sheriff's Department which cleared the deputies of wrongdoing subsequently on January 17th 20122 he filed a lawsuit against the officers the department and Los Angeles County he voluntarily dismissed the case on April 15th 2022 after reaching a confidential settlement
