sued after a brutal incident the story began when Timmy miles was stopped by Corporal Robert burino from the Somerville Police Department in August 20120 shortly after departing his residence in South Carolina the reason for this stop traces back to a package intercepted by the police which contained marijuana and was addressed to an individual entirely unfamiliar to Mr miles as a part of their surveillance operation officers delivered the package to Mr miles's residence and maintained watch from a nearby wooded area however when Mr miles left his home Corporal barino erroneously believed that he had taken the package leading to what we're about to see uh I know what you picked up I know what you picked up over there okay what I picked up yeah come on get out of the car I ain't getting what's going on what's going on corporal Marino used physical Force to remove Mr miles from his vehicle and resorted to assault when Mr miles demanded an explanation for the traffic stop however the legality of the stop might be in doubt particularly if the observations of the surveillance officer did not establish Reasonable Suspicion to detain Mr miles therefore Mr miles could contend that the traffic stop lacked proper justification rendering his refusal to exit the vehicle non-criminal where where go [ __ ] me my man that [ __ ] hurt man that Hur he was wrapping up so okay the nose thing willing to comply if the officers had provided an explanation he raises a valid argument even if a court found that Corporal burino had the legal authority to remove Mr miles from the vehicle the constitutionality of the force used could be questioned given the passive nature of Mr miles's resistance please and don't pay my tax if you would you you told me I get am I got my face you know gotcha got yeah if uh if we can get that TR close for yeah no all right I appreciate it thank you did they notify about send an EMS this uh to the traffic stop can we get one for blackmail approximately 30 35 complaining the head traa nobody notified them so they're coming y see the coming they're coming I confirmed it they're coming now we're go search this and anything else we find here secure his phone mhm so I could um do SE on it didn't admit to using no I did hey you know what just through the um inen your rest we'll um hand it over rather than tow it there this is stuff back behind here with the stuff but he got a corner cut and it smells like we in there so yeah he has a couple baggies in the front as well yeah I'll get photos of them we going charge even after Mr miles firmly refused consent to search his vehicle and the K9 unit failed to detect any illegal substances officers conducted a thorough search of his vehicle examining personal belongings with no Contraband discovered this case raises complex legal issues concerning the initial traffic stop Mr miles's potential arrest and the extension of his roadside detention for the K9 unit's involvement the officer's warrantless vehicle search could potentially be seen as a Fourth Amendment violation especially due to the lack of probable cause or immediate proximity to the vehicle that medicine bottle right there also belongs to him I didn't do the trunk yet they uh think City okay following medical treatment Mr miles was taken into custody but his original charges which included marijuana possession with intent to distribute and disobeying a lawful police order were dropped Corporal burino lost his job at the Somerville Police Department for assaulting Mr miles and he was later arrested tried and found guilty of third degree assault and battery resulting in a sentence of time served Mr miles initiated legal action in both state and federal courts with the federal case currently pending but temporarily halted due to his attorney's family medical concerns as of August 10th 2023
