leave the story began in February 2023 where a few police officers from the Newark PD stopped Mr KB somewhere in New Jersey the reason for the Stop was a 911 call from a witness who claimed a man fitting his description was armed with a gun and walking around the neighborhood the officer talking the most is Sergeant Vasquez this is the recording from Mr KB what's going on work with the city of newk man kick rocks keep it pushing I don't know why he stopping me I'm on I'm working right now I'm I'm work for the city of nor we keep it pushing you wasting your time I'm out there the city of North yeah what you mean what it mean I'm under the official duties working you stopping me you don't have Reasonable Suspicion suspicion of a cry make sure you put your body cameras all right making sure yeah you don't have no Reasonable Suspicion of a crime to stop me and I just told you I was working and my idea in my my IDE in the truck you can't stop me just for having this stuff on man dispelled but we still need to identify the person we are speaking with the officer contends that Mr KB should be identified even after their initial suspicion has vanished relying on the power to detain based on Reasonable Suspicion however Mr KB's identification wouldn't contribute to addressing the 911 call concerning an armed individual and in New Jersey declining to provide identification during a Terry stop isn't unlawful as a result it's likely that a court would determine the officer's violated the fourth amendment by extending Mr KB's detention without a valid ongoing suspicion I'm I'm I'm willing to identify myself if I had committed a crime that's what I'm saying so so now so under no circumstances I'm not giving you my ID a crime inorder for us to identif you don't know what uh y' about to be under a federal investigations if you really believe that you can stop people without having articulable suspicion of a crime Reasonable articulable Suspicion of a crime the fact mean I a't got no gun you exactly so so that's where we at the point right now right see you don't have no weapons so you going to be on your way however because you were detain I could get the if I want to I can get like the police report or the transcript for that we'll give you a v number like I we're going to need your identification because you were sto Sergeant Vasquez explains that the
