I'm asking you to identify yourself >> and I am refusing to identify myself because I have not committed a crime and in New Jersey. This is a nonid state. >> That's why I asked you, right? >> But then you got smart with me to her. >> I wasn't trying to I'm requesting a supervisor. I'm requesting a supervisor. I want >> I did nothing wrong. >> No, no, no. >> This is against my first amendment. This is against my fourth amendment. >> Don't touch me. Don't touch me. I'm uncomfortable. Don't touch me. Why did you touch me? Do you want a male to touch you or a female to touch you? >> Lawsuit was filed after these cops from the Trenton Police Department allegedly detained and arrested a man and woman after they refused to identify themselves during a police investigation. >> Somebody else was riding a truck with you. Y'all just got out of the truck. >> Wait, you're saying somebody riding one? >> Y'all just got out of this truck, right? >> No. For a while. >> We are just sitting in the truck. I mean, >> yes. Right. You was just sitting in the chair. >> You just sit. >> What? >> I don't answer questions. I don't want to incriminate myself. >> You're not incriminating yourself. You're answering your question. >> Which can which can potentially incriminate myself. So, I don't answer questions. We We were here for a long time. >> I'm not I'm not worried about if he was here for a long time or not. It's pertaining to the call, but you're not in any trouble. >> We're here for a call for service. We're trying to see >> if you we my partner's asking you a question to see if you pertain [applause] to the call. If you don't, then you'll be on your way and we'll be on our way handling our job. >> No, it's fine. I understand. >> We're just >> There's no need to get smart with you. >> No, no, no. I'm not I'm not trying to get smart with you. I was just I was just saying like, you know, I don't want to get in trouble for doing nothing wrong. Okay. >> You know what I mean? I'm just standing here. >> There's no need to get smart with the police officer. >> I wasn't trying to get smart with you. >> Okay. >> Trenton police officers Denital and Yel stopped Mr. Daniel and Ms. Myra after officers were dispatched to a call involving a male and female in a gray Dodge Ram with Pennsylvania plates over a custody dispute. >> Keep it that way. >> I'm not trying to give you a hard >> Keep it that way. Can you give a description of the vehicle? >> Said it was a Dodge Ram truck color. He gave me a plate. >> You guys did a call for a Dodge Ram so you guys pull up here and >> you have a responsibility to check it out. If you guys are doing nothing wrong, then you guys are doing nothing wrong. >> That's fine. I'm just I'm just curious. guys have IDs just so I can see who I'm talking with. >> Um, I do, but I don't I don't feel like I have to give it to you. >> Well, you do. >> I don't. >> I'm telling you, you do. >> Um, in the state of New Jersey, it's an NID state. I haven't committed a crime. >> Dispatch or the officers did not say that the Dodge Ram was stolen, illegally parked, involved in a traffic violation, or otherwise defective. And without explaining anything, they escalated the situation. >> Committed. So, can I have your name and badge number? By the way, >> Daniel and Myra were apparently sitting in that matching vehicle, which caused officers to investigate them and harass them. But there was no official report or direction, which established that either person had committed a crime or that the truck itself was illegal, hence making all of this a bullying incident. >> That's why I asked you, right? >> But then you got smart with me. >> I wasn't trying to >> We have an obligation, right, when we're talking with people and we get a call. And I don't I'm not saying you two are doing anything wrong, but I'm going to call my dispatcher as you heard on my radio and I turn it up so you can hear. Male, female, Dodge Ram truck. >> That's it. Did I do something wrong? >> No. >> So I'm stay I'm asking you to identify yourself >> and I am refusing to identify myself because I have not committed a crime and in New Jersey. This is a nonID state. I refuse to identify myself. You asked me and I refuse. I feel like >> this is an investigation and I'm asking you so investigate. Investigate and investigate. I am not going to name myself. >> So now you're obstructing. So >> all of this was unjust, illegal, and inhumane as beginning with Terry versus Ohio, which allows police to briefly and only detain someone when they have reasonable suspicion of criminal activity. But there was none here. Truck was not reported as stolen, illegal, or anything. and the requirement of identification under highell versus 6th judicial district court of Nevada which upholds the state's ability to require identification during a lawful terry detention. But this from the beginning was an illegal detention as the New Jersey obstruction statute NJSA2C 29-1 is central which is only applicable if the obstruction is flight intimidation force violence physical interference or an obstacle or an independently unlawful act. But officers simply arrested Daniel for allegedly refusing to answer. State versus Pearl and State versus Camilo also explained that mere refusal to identify oneself generally does not satisfy New Jerseyy's obstruction statute without the required physical interference or independently unlawful conduct. And it is also evident in Florida versus Reyer for the principle that during a consensual encounter a person may refuse to answer questions and leave and refusal alone does not establish reasonable suspicion. Hence making Daniel and Myra on the right side of the law. Daniel was told he was being detained and the officers moved to arrest him after he refused to provide identification. Daniel protested saying he was not fighting and asked for a supervisor. The officers then treated the situation as an arrest, stating they would pat him down and search him incident to the arrest. >> I'm requesting a supervisor. I'm requesting a supervisor. I did nothing wrong. >> No, no, no. You're out of something, >> man. Back up. Back up. Back up. I'm going to be arrested. Back up. >> I'm arresting the supervisor. >> Do you notice? >> This is against my first amendment. This is against my fourth amendment. >> Why are you putting me in the Okay, I'll get it in the resistance. Stick it in my pockets. HE'S DIGGING IN MY POCKETS. >> WHAT ARE YOU DOING? >> I'M PATTING YOU DOWN. IT'S CALLED >> I WANT YOUR badge number. >> Okay. It's alter detail. >> I'm requesting your supervisor. Have a seat. I'm requesting a supervisor, man. >> You're intimidating. >> Oh, it's on the floor. >> Excuse me. Excuse me. OH MY GOD. DON'T TOUCH ME. >> OH, I DIDN'T DO ANYTHING WRONG. This is my legal right. >> This is my legal right. Don't touch me. >> Don't touch me. Don't touch me. I'm uncomfortable. Don't touch me. I'm not fighting. >> Is this your phone? >> I want my supervisor. Baby, what? >> I know. I know. No, I want a supervisor. >> This early person obstructing an investigation >> under the fourth amendment and Terry versus Ohio, Florida versus Reyer recognizes that during a consensual encounter, a person can refuse to answer police questions. More importantly, NJSA2C29-1 does not make every refusal to cooperate criminal obstruction. In State Verra Camilillo, the New Jersey appellet division specifically held that refusing to provide identifying information without the required physical interference or independent unlawful conduct was not obstruction. Based on the transcript, Daniel's position was therefore legally strong. The officer yet kept doing the opposite and told Daniel that because police were conducting an investigation, he was required to identify himself. But that was not automatically true under New Jersey law. told him he was being detained, didn't want to provide identification. Female started getting rowdy, started grabbing at us, trying to prevent us from searching him incidental to arrest. Both are under arrest for disorder person. >> So, Daniel, I want you to understand something. When the police are conducting investigation, right, doesn't mean you're doing anything wrong, >> right? >> But you have to identify. Okay? >> It's called search incidental arrest. So, I pat you down and I have to pat everywhere. >> All right? All right. But I'm being I'm being legally arrested because I haven't committed. It's called I'm not identifying myself. It's not illegal. >> You're obstructing the administration instructing an investigation because I'm not identifying myself. That's not obstructing. >> I'm just trying to explain to you guys that I don't have to identify myself. I'm letting you guys know. Look, >> I'm I believe I'm a strong >> I have identified myself. Yes. Of course, I'm being placed under arrest. So, lawfully under the law, I have to identify myself. Being suspicious is not a crime. I don't have to identify myself. It's not a structure. >> We gave So, remember how I was saying dispatch what what I what I said our dispatchers are telling us a male and a female >> in a Dodge Ram gray color pickup truck. >> That's fine. But you haven't observed any crime. I'm just standing. >> So, we have we have we have a right to >> investigate >> to investigate. Correct. That's not askident. >> Right. You can ask me for identification. I can refuse to identify >> and if the if the party refuses the police officer has an obligation to now if they refuse to give information we now detain if they still refuse it's an arrest. >> Can you detain not >> can we speak to a supervisor at the station? I just want to you're literally going to see a supervisor. Myra was then forcefully arrested as the officers claimed that while they were attempting to search Daniel incident to his arrest, Myra became rowdy and started grabbing at the officers, allegedly trying to prevent them from searching Daniel. The officers then placed both Daniel and Myra under arrest with Myra apparently being accused of disorderly conduct/obstruction. >> I want a supervisor. He did not get one. >> Please get away from me. Stop intimidating me. I want You're intimidating me. Well, it's on the floor. >> Excuse me. EXCUSE ME. OH MY GOD. DON'T TOUCH ME. >> NO. NO. NO. >> NO. NO. WHAT THE [ __ ] >> NO. NO. NO. STOP. [screaming] >> HELP. I said anything. >> 631 South. >> Help me. I'm not fighting. >> Relax. Relax. >> I'm not fighting. Help me. I'm not fighting. I didn't do anything wrong. >> Stop. I didn't do anything wrong. >> Stop touching me. >> Relax. >> I didn't do anything wrong. Stop touching me. >> Please let me go. I did not stand up wrong. >> Myra kept telling the officers, "Don't touch me." Because from her perspective, she was trying to document what was happening and believed Daniel was being arrested unlawfully. >> Sure. I want to super do anything wrong. This is my legal right. >> This is my legal right. Help me. This is my legal right. Don't touch me. Help me. I want to supervise her. >> Have a seat. Have a seat. Please. >> Don't touch me. Please have a seat in the car. >> I'm uncomfortable. Don't touch me. Please. I am uncomfortable. Please. I am uncomfortable. Don't touch me. Don't touch me. Don't touch me. I'm uncomfortable. Don't touch me. Do not touch me. I want a supervisor. I want a supervisor. I want a supervisor. >> You stand here. The officers however claimed that Myra went beyond recording and physically interfered with Daniel's arrest. Officer Dinatal later explained that she was allegedly grabbing Adam and his partner and trying to pull them away from Daniel while they were searching him. Incident to the arrest. He said that was why they put her in handcuffs. Myra disputed that characterization, saying she was trying to protect Daniel and get a supervisor because she believed the arrest was unlawful. Later for this illegal arrest, the two Trenton police officers were disciplined, fired, suspended, or criminally charged because of the arrests as they also charged Daniel and Myra, who are still facing criminal charges at the time, and now plan to pursue a federal civil rights lawsuit. >> A wonderful supervisor. >> Code 42 in custody. >> Code for now being called 631 South. Code for being called 631 South. took my camera. >> They took my phone. >> Is your body cam on? >> Yes. >> Is your body cam on? Is your body going since we talked to you? >> Is she going my >> Yeah, she's going your phone. >> We have We have her phone. >> I want a supervisor. >> Oh my god. Right now in the vehicle. >> I didn't do anything. Stop. >> I don't consent to this. I don't consent to this. >> I don't consent to this. I'm a pepto. Why are you touching my breast? >> Why did you touch me? Do you want a male to touch you or a female to touch you? >> Later previous year, at their first court appearance, the prosecutor offered to drop the criminal charges in exchange for a civil fine, but Daniel and Myra rejected that offer because they wanted accountability for what they believed were violations of their rights. And in June 2026, all the charges were dropped against them and both the cops were relieved of their duties. Whereas Daniel and Myra have not filed for a $2 million lawsuit against the department, which the city's taxpayer will have to pay.
