on August 9th 2022 around 8:55 p.m. patroman Thomas Anderson with the eam Township Police Department was dispatched to the scene of a motor vehicle accident involving a 2018 niece on Rogue on tanum Lake Road when he arrived on scene around 900 p.m. he observed that the vehicle had struck the guard rails on both sides of the road and that the vehicle was blocking the roadway on a bridge in front of 199 tonon Lake Road patroman Danielle Torres made contact with the driver of the nce on Rogue as she was being evaluated by First Responders and she was identified as Marie Mendes here's a rout for the toe she's her glove box is like completely smashed in so she can't get all of her like insurance and registration I think she has a registration and you don't want to get checked out or anything no I'm fine okay where are you coming from I'm just coming from I'm just going home really I know but okay real quick can I just name my first name is Marie Elina spell me m r said it was capital e l were you headed I was heading this way you were going 273 yep towards my home like less and a half mile Marie declined further medical ATT attention patrolman Anderson spoke with two witnesses who claimed that Marie had tailgated behind their vehicle and that the observed the crash the witnesses also informed patrolman Anderson that they observed a bottle of wine inside the vehicle based on the odor of alcohol and the witness accounts the officers began their DWI investigation Marie told the officers that she was coming from her mother's residence and denied consuming alcohol but she was asked to perform field sobriety exercises and then I'm home so so you mean this way you mean no this way okay you y here's the key leave it that way I have hor I've lost several flat tires on this Hansberry started with the horizontal Gay's nagus hgn test during the hgn test Sergeant Hansberry observed the lack of smooth pursuit in distinct sustained NI stmas at maximum deviation in both eyes in the onset of nice stmas prior to 45° in both eyes the second exercise was the walk and turn test and it was administered by patrolman Anderson during the walk and turn test Marie did not touch Heel To Toe on each step failed to keep her arms at her sides and took an incorrect number of steps the final exercise was the one leg stand test and Marie failed to raise her foot in the proper fashion while displaying a lack of balance no not all right contacts or anything like that all right see the ti of my with your eyes your eyes only just follow the tip of my pen okay hours to keep your head for this test is with your right foot back put your left foot in front so that your heel and your tail were touching okay with your hands at your side so I'm going to ask you to get into this position now okay right here correct right foot back Left Foot In Front y awesome just heel heel to toe touching just like that right awesome so you just stay in that position until we begin the test okay what you're going to do is you're going to take nine Heel To Toe steps forward in a straight line okay with your hands at your sides heel to toe touching every step okay on your ninth step you're going to leave one foot planted take a few steps to turn around and you're going to take nine Heel To Toe steps forward again in a straight line okay okay so I'm going to demonstrate it for you all right I'm in my starting position heel the toe touching one two three four five all the way up to nine one foot planted here's a small steps to turn around one 2 3 4 5 all the way up to nine okay if you lose your balance uh step off the line anything to that effect just correct yourself and pick back up from where you left off okay okay do you have any questions about that do you have any injuries anything in your uh anything that would affect your uh balance or anything to that effect I don't think so would you agree that this is a suitable uh place in the road to conduct this test yeah okay prescription [Applause] medication based on the motor vehicle accident the odor of alcohol the witness account regarding the bottle of wine and her inability to adequately perform the field sobriety exercises Marie was placed under arrest for driving while intoxicated the trollman Anderson transported her to the IAM Township Police Department for further processing her vehicle was towed for a mandatory 12-hour impound as required by John's law I am going to ask you to turn around you are under arrest okay okay we're uh driving while in par I'm not in par okay to [Applause] do you have standard statement for motor vehicle operators and she agreed to submit breath samples her Alco test results indicated a back level of 0.19% which was more than double the legal limit of 0.08% after she was processed Marie was released to a sober adult pending her court appearance he signed a potential shery warning form on her behalf patroman Anderson issued her the following summonses operating Under the Influence careless driving traffic on Mark Lanes an open container Central 22 189 22 189 transporting one adult female in custody from the MVA to 220 starting mileage 478 28.8 transfer to the station at 2132 hours what's that it is 9:40 [Music] court records indicate that on November 26 2022 Marie was arrested again for DW IIM town ship New Jersey on March 16th 2023 Marie was found guilty of careless driving a and her license was revoked for 90 days the other three citations were dismissed as part of the plea agreement on the same date Marie was also found guilty of the other DWI from November 26 2022 while the other citations for traffic on marked lanes and reckless driving from the November DW were dismissed as part of the plea agreement in total she had to pay $1,130 in fines the following month Maria Lena kyman as passed away on April 24th 2023 Central 22 189 22189 arriving 220 ending mileage last three 31.9
