I want everybody to see. >> On May 31st, 2024, Fort Lauderdale police responded to Sway Nightclub after reports of an intoxicated woman involved in a physical altercation. What began as a routine disturbance call escalated into charges for battery on a law enforcement officer, possession, and resisting arrest without violence. This footage examines the officer's tactical decisions and the subject's conduct during this volatile encounter. >> Says that you I bet you it's not evening on. >> Is it on? So it shows you not doing. What's your name? What's your name? No. No. No. No. No. As a as a citizen, it's my right to know your full name. No. Nick what? Nick what? A 23-year-old woman is visibly intoxicated and agitated. Notice the officer's positioning as he approaches, maintaining a safe distance while attempting to assess the situation. The subject immediately begins speaking to the body camera, aware she is being recorded. Here we see the critical moment that leads to the battery charge. The subject pokes the officer's vest and body camera. Under Florida statute 784.0 to7, battery on a law enforcement officer occurs when a person intentionally touches an officer without consent while engaged in lawful duties. The touching doesn't need to cause injury. The intentional contact itself meets the legal threshold. This single action transforms a potential citation into a thirdderee felony charge. >> No. And I can't wait for you to lose your job. Oh god. >> Yeah. My y'all. My mother works for Border Patrol. You >> No. And I want others to see that they just saw that he did not protect me. No. Move your arms. Go ahead. Move your arms. >> Wow. God's not allowed. Everybody saw that. No. Don't touch me. Are you doing what you're I'm asking you. Just calm down and relax. Okay. >> The officer attempts to gather identifying information. Standard procedure during police contact. The subject becomes confrontational, demanding the officer's name. While citizens have a right to know an officer's identity, the aggressive manner combined with her intoxicated state escalates the tension. The subject's behavior becomes increasingly hostile. Making threats about the officer losing his job and referencing her mother's border patrol employment. Family connections to law enforcement provide no legal immunity from arrest. Having witnessed disorderly conduct, battery, and escalating aggressive behavior, the officer decides to arrest her. Can I ask you to do me a favor? Can you go grab my stuff? >> Hey. Hey. >> Hey. Ask gra stuff on the >> This is why you're acting ridiculous. >> That's not mine. What are you >> Hey, relax. >> What are you talking about? I've never had >> What are you talking about? Please, please go home. One person got mad at me and other than that, I don't know what happened. Please go home. Please. Please, I just want to go home. I've I've never ever ever been arrested before. Please just go home. I went to Fort Lauder High School and I did criminal justice one and two and I did EMT one and two and I did firefighting and do >> I just want to go home. I just want to go home. Can I just go home, please? >> The arrest becomes physical as the subject resists handcuffing. Under Florida law, this constitutes resisting an officer without violence. Notice the contradiction. She repeatedly states, "I'm not resisting while actively struggling." This is common in arrests where subjects believe they're cooperating while their body language shows otherwise. Officers maintain reasonable force using control techniques rather than strikes. Once secured, the subject experiences emotional distress about clothing exposure. During search incident to arrest, officers discover apparent contraband leading to possession charges. Her claims of innocence and request to go through my purse show a misunderstanding. Once probable cause exists, officers aren't required to conduct searches to disprove guilt. The subject experiences an emotional breakdown, stating she's never been arrested and expressing confusion. While a clean record helps during sentencing, it doesn't provide immunity when laws are violated. Her statements about criminal justice training suggest someone who should understand legal procedures, making her claimed ignorance inconsistent. During transport, the subject continues pleading to go home. Officers maintain professional demeanor, showing appropriate emotional intelligence with intoxicated subjects. However, once charges are filed and arrest made, officers cannot release someone based on promises of good behavior. Proper procedures require a female officer for thorough searches of female subjects, protecting dignity and preventing impropriety accusations. The subject's compliance improves once physical struggle ends. Typical as reality settles in and adrenaline subsides. In the patrol vehicle, the subject expresses regret and confusion. Her criminal justice education background creates irony. Someone with legal training should understand battery consequences. This highlights how alcohol impairment overrides judgment and training. >> We got to let the team officer search [music] really quick, right? >> For what? >> Got to check your bra and all that. You have nothing. You got nothing else on you, right? >> My watch. Stay down. [music] All >> [music] [music] >> right. [music] [music] Did you prop it? Okay. Okay. Following this incident, The subject was charged with possession, battery on a law enforcement officer, and resisting arrest without violence. Battery on a law enforcement officer is a thirdderee felony punishable by up to 5 years. Resisting without violence carries up to one year. Combined with possession charges, she faced potential penalties of 6 years prison and $6,000 in fines. All defendants are presumed innocent until proven guilty. The Fort Lauderdale officers receive a B minus. They handled a difficult situation with appropriate restraint and professionalism correctly identifying battery and maintaining reasonable force. They showed patience during the breakdown and followed proper female search procedures. However, earlier deescalation attempts might have prevented escalation to physical resistance. Enhanced deescalation training could improve outcomes. The subject receives a D+. Despite emotional distress and inexperience, her actions violated multiple statutes. She committed clear battery, physically resisted arrest, and engaged in disorderly conduct. Her intoxication explains, but doesn't excuse criminal behavior. She deserves minimal credit for eventual compliance and showing remorse. Her criminal justice background makes this particularly troubling, demonstrating how alcohol overrides education and common sense. Let us know if there's an interaction you'd like us to discuss.
