Uh the passenger originally came up to me after I was I was still working in Philadelphia. We were delayed 4 and a half hours and I was trying to get him out of here. He came up to me, approached me here and started yelling at me immediately that he was demanding I help him immediately. And I said, "Hey, I'll try to help you, but I got to see my Philadelphia passengers out first." And once I said that, he started screaming at me, saying, "I demand help right now." And then uh I told him, "You need to respect me. need to be quiet and once I'm done with this flight, I'll come help you. Um I had to walk away from him at that point. Came back up here. He wasn't he wasn't available to me, but I got called by my colleague that he had approached her screaming at her and with a camera recording her. Then I went to go meet a plane and he ran up to me to take a video or photo of me. I asked him not to. He said, "Sir, you keep this up. We're going to have to not allow you to fly with American Airlines." And then during the initial boarding, I stood behind my boarding agent to monitor and tell him to step to the side. So I said, "Sir, he step to the side. You're not going to be able to fly with us today." And he persisted to try to scan a 40 pass. So I put my hand on the scanner. Then I tried to turn to the side and then he tried to have pass around him. He was still uh when I did that I had physic I physically got hit on my hand because he was trying to access the scanner with my hand over it. I he never did scan but then it just went on down and at that point I figured I should get ahead of him and shut up my shut my secure door and when I went to lock the door and I tried to shut the door he ran through my arm and I was still kind of feeling the numbness in my fingers. So he actually physically press charges. Mhm. >> You want to press charges for battery? >> I think I do. >> Okay, you can do that. >> I don't know why this >> You You have a clear problem with listening. >> You have a very clear problem with listening. >> I'm a vocational. >> Okay. >> So, what? >> I'm not here to to get a problem. >> Well, you already are a problem clearly. Why am I here talking to you? >> Let me see the your boarding pass or your license. >> I'm waiting. You can wait all you want. It's not going to change anything. >> You're making this a lot worse and [clears throat] a lot harder than you have like a 2-year-old. >> 2-year-old baby. >> Because you're acting like a baby. Why am I like a baby? What a dude. You think you're going to just walk onto the plane after they told you no? That's like a 2-year-old. >> Why would they say they can say whatever they want? >> I said call the cop. >> No need to know. >> I need to get You're not going on the plane. >> I'm flying today, man. flight. >> Okay. Thank you very much. >> No, not thank you very much. >> You're done. >> Thank you. >> You're welcome. We're here to help you. >> Bought a soul. >> We're here to help you. >> Sir, he's going to go for battery hit him trying to get down to the gate. >> All right, stand up. >> The passenger bypassed gate agents and proceeded down the jet bridge despite being told he would not be allowed to board. Under federal law, airlines have broad authority to refuse transport for safety or operational reasons. Once an airline denies boarding, the passenger has no legal right to force their way onto the aircraft. Doing so constitutes criminal trespass. The passenger claims discrimination, but the appropriate remedy is through the airlines complaint process, the Department of Transportation, or civil court, not self-help. The officer attempts to obtain identification. The passenger requests a translator and lawyer, but at this point he is not under arrest and is only being asked basic identifying questions. The right to an attorney attaches upon formal charges or custodial interrogation. The passenger's English appears functional enough for basic communication. The airline employee explains that the passenger approached her aggressively while she was handling a delayed flight. When told to wait, he became loud and verbally abusive. The captain hearing the threatening behavior denied him boarding under standard safety protocols. When the passenger attempted to board anyway, the employee blocked the scanner. During this confrontation, the passenger made contact with her hand while attempting to scan his pass. This contact forms the basis of the battery charge. Under most state laws, battery is intentional unwanted physical contact. The level of contact does not need to be severe. Even minimal touching, if unwanted and intentional, constitutes battery. The officer's frustration becomes evident as he compares the passenger to a 2-year-old child. While unprofessional, this does not rise to a constitutional violation. >> Put your hands behind your back. >> What? >> You're being arrested for battery. Stand up and put your hands behind your back. >> What happened, sir? >> You're being arrested for battery. >> What happened, son? >> Take this off. Take it off. >> Take it off. >> Put your hand behind your back. Take this back. Don't put your hand behind your back. Take it off real quick. >> Your hand behind your back. That's all you got to do. >> I got it. I got this. >> I got your phone. >> She's holding my my arm. >> Put your hand behind your back. >> I'll put this. >> Okay. Stop. >> Okay. I I just want to take my >> This is what's going to happen. You're going to go to the ground. >> I just want I don't I just put you behind your back. >> I got You're not You're not okay. Okay. Okay. >> Okay. What? Hands behind your back. I'm in the ground, man. You sure are. >> Put your hand behind your back. Stop resisting. And put your hand behind your back. >> I got I got it. >> HELP IT. >> I got [screaming] it. Help it. Help it. >> Help it. Help it. >> We're okay. >> WE'RE OKAY. >> HELP. [screaming] >> WE'RE OKAY. OH MAN, WHAT ARE you doing, man? I'm on vacation, man. What are you doing, man? >> Have a very hard time. >> Okay, I mean listen you. I ask you for another. >> All right. >> Wait, it's too tight. It's too tight. >> It's too tight. >> Help me. >> Yeah, this one. >> Somebody help me. >> It's too tight. >> Okay, relax. Stop yelling. [screaming] >> Move your hands. >> It's the time. >> Wait a minute. I can fix it. Stop moving. >> Help me. >> No. >> You see that again? >> He's catching everything, man. >> No. >> Catching everything. >> What are you doing, man? >> I'm trying to fix. >> I'm not afraid. >> I asking for a lawyer. I ask YOU FOR A LAWYER. STOP TOUCHING. >> STOP YELLING. >> I ASK IF YOU >> I CAN'T FIX IT WHILE you're doing this, sir. >> I can't get to it. >> We should stand up. >> You stand, man. Why we tie? Just that. >> No, that no one wanted this, buddy. >> You couldn't go on and you thought you could just get right on it. That's what's really >> I say I said call the cop. >> It's like a 2-year-old. >> I said just call the shots. >> They're the man. They could tell anyone not to fly. They could tell me if they don't want me to fly. All right. >> Just don't get it. >> I just would like to know what they tell you guys. >> You don't get to ask us questions if you ask for a lawyer. Okay, you can you can let me >> It's necessary. I I don't go anywhere. >> You resisted up until 2 seconds. >> I don't resist, sir. >> Sure you did. >> Well, of course. Not the camera. >> You know what? No means. No means. >> The camera says >> no means. Oh, it's all on here. Absolutely. You're right. >> I did resist. >> When you say come again, buddy. I say put your hands behind your back. It doesn't mean you start reaching for stuff when you say put your hands behind your back. Is that what that means? >> Does that mean you start? >> I was just trying. >> It was fine. You didn't have to do it. All right. >> On my back. Just that. Based on the employees statement, the officer informs the passenger he is under arrest for battery. This is the critical moment where compliance becomes legally required. Rather than complying, the passenger begins removing his backpack and reaching for items. This is textbook resisting arrest. Under Graham versus Connor, officers may use reasonable force to overcome resistance. The officers use control techniques to bring him to the ground and secure his hands. The passenger yells for help and claims excessive force, but the video shows measured control tactics. He is not struck. No weapons are used and officers focus on handcuffing. The passenger complains the handcuffs are too tight. The officer eventually adjusts them, demonstrating appropriate concern while maintaining security. Even after being handcuffed, the passenger continues resisting by attempting to access his belongings and refusing to walk. This extends the encounter and compounds his charges. What began as a boarding dispute has now resulted in two criminal charges, one of which is a serious felony. The passenger's assertion that he requested a lawyer does not prevent the officer from explaining the charges. The fifth and sixth amendments do not prohibit providing information, only interrogation without counsel. As officers prepare to transport the passenger, they conduct an inventory of his belongings. This is standard procedure and does not require a warrant or the subject's presence. Officers confirm the charges will be battery and resisting an officer with violence. The passenger's decision to resist transformed a minor situation into a serious criminal matter. >> I just want to know what I may have in a cusate. Just that >> you touched them. >> Lady, you could you tell me what I I don't >> battery. >> Battery >> battery. >> Battery. >> Battery. What is it? >> Means you touched somebody that you shouldn't have. >> I touch somebody. >> Yes, sir. >> I didn't. Right. >> And the camera will show it. Yes, sir. >> I can go with you and do the ECR. I just I need info. It's all okay. So, I don't know how you want to do it. >> No, that's fine. >> So, I should I should watch what you're doing. >> You are a mess in my things and I not in my presence. Not in my presence. >> Want to go on the outside? >> You should mess my things in my presence. The camera is filing. >> All right. >> Everything's on camera. Everything's on camera. Look, his camera is on, buddy. You need to mess my things in my presence. >> I don't have >> You don't need to You You don't You don't >> Everything's recorded. >> This This >> just with a warning. You have a warn. >> You have a warning. >> I don't I don't need one. You're arrested. >> Okay. You You don't need >> All right. We're going the other side. We're going in the car. All right. Okay. >> Everything's recorded, my friend. Everything. >> I'm afraid. >> The whole encounter. >> I I I will weigh you all the time, >> my man. You take it off. No, we're not taking it off. You have to ride with it. >> Default. >> Nope. >> You want to uh go outside and put this on? >> Yeah. Yeah. Yeah. >> Yeah. You should have the victim's information. >> You want me to go with Garrett for the transport? >> Yeah. >> All right. I'll call him if you think so. >> You got a battery and you got resist violence? >> Yeah. >> Is he resisted from the second we tried to put him? >> Is there any type of charge for um going on the Jeeps when you film it? No. >> It's not like a Yeah, it's kind of I figured that. >> All right. >> Battery and resisting. >> Okay. >> Following this incident, the passenger was charged with battery, a misdemeanor punishable by up to one year in jail, and resisting with violence, a felony carrying up to 5 years in prison. Court records were not available at the time of this analysis. The officers receive a grade of B+. They had probable cause to arrest for battery and their use of force was reasonable and proportionate to the resistance encountered. However, repeatedly comparing the passenger to a 2-year-old child was unprofessional and unlikely to improve cooperation. More professional language would have better represented their department. The passenger receives a grade of D. His decision to bypass gate agents, make physical contact with the employee, and resist arrest was counterproductive and illegal. He demonstrated no understanding of legal processes. His claims of discrimination do not justify forcing his way onto an aircraft or resisting arrest. His continued resistance after being told he was under arrest showed poor judgment. What could have been handled through proper complaint channels became a criminal matter with felony consequences. The airline staff receive a grade of A minus. They handled a difficult passenger appropriately by setting boundaries and calling law enforcement when those boundaries were violated. The captain's decision to deny boarding was well within airline authority. The employee maintained composure and exercised her right to press charges.
