Stop. >> A man unconscious in a McDonald's drive-thru. Officers save his life. Then he fights everyone trying to help him. He ends up charged with two crimes, but does the law actually support both of them? >> He has blood on his hand. >> Okay. >> Okay. Thank you. >> You're welcome. Click the start car. >> Okay. >> Okay. >> Thank you very much. >> You're welcome. Thank you. >> Hey sir, if you can hear me, I'm going to get you helped out. EMS is on the way. Okay. >> Copy. Hey sir, if you can hear me, paramedics are on their way. >> Okay. >> Want any help from the police? She thinks she has a warrant. >> Stay with me, partner. Stay with me, partner. What's your name? >> Jason. >> Yeah. >> What's going on, Jason? >> What? You're at the McDonald's drive-thru. >> Hold on. You're not going anywhere. >> All right. >> Hi, sir. >> I gave uh two Narcans. He is now conscious and talking. >> People's conricted. >> What's that? >> People conricted everything. >> Haven't seen before. >> We just got all the snot coming down off of everything. >> Park everything. You're at the drive-thru. >> All right. >> You want to take this coat off? >> Here. I'm going to see what we got. >> I'm going to peel this coat off you here real quick. >> Do you know what's going on, Jason? >> Just relax. >> Jason, we got to get out. Okay. Um, just real quick, give him uh He was unresponsive. >> Yeah, he's got blood on his arm and stuff. He's not wanting to get out now. He's still kind of out of it. Um, I just didn't know if he was going to start fighting once I got him out. >> We don't know yet. Tell me if I get off. >> We're going to get him out. Make sure he doesn't fight and then we'll make sure he doesn't have anything on him and then we'll get him over the cop. >> All right. Hey, Jason. Okay. >> I'm not here to get you in trouble, but you're in a car. You're in the drive-thru at McDonald's. Okay. >> All right. >> Come on. Let's get out. >> Three charges are on the table. Unlawful detention, resisting arrest, and OVI. Each one demands a separate legal answer. On the detention, Jason was unconscious behind the wheel of a running vehicle. Under Brigham City versus Stewart, that is textbook exigent circumstances. The detention was lawful. No further analysis needed. Ohio's implied consent statute reinforces this. A person incapacitated by a controlled substance is presumed to consent to emergency medical treatment. Full stop. The OVI charge under Ohio Revised Code section 4511.19 is equally clean. Ohio courts hold that being behind the wheel of a running vehicle satisfies the operating element regardless of active movement. The injection site, prior unconsciousness and opioid presence establish probable cause. This charge survives. Conviction depends on toxicology and chain of custody documentation. >> I'm going to take this arm. Just relax. >> Stop. >> Just relax. >> Jay, calm down. >> Relax, man. >> Stop. Look, >> dude. Stop. >> Relax. Relax. >> Dude, stop. >> Relax. We're not going to fight with you. Okay, >> dude. Stop. >> Okay, >> dude. Stop. >> We're not going to fight with you. You have to get out of the car so the EMTs can look at you. Okay, >> DUDE. STOP. >> JASON, RELAX. >> DUDE, STOP. >> DON'T FIGHT WITH US. JASON, >> don't fight. Don't fight with us. Don't fight with us. >> YOU ALL RIGHT? >> ALL RIGHT. >> SEAN, >> HUH? >> I guess so. >> Jason. >> Jason. >> Jason. >> Jason. The squad needs to help you out. >> Come on. Just walk out, buddy. Walk out, bud. There you go. There you go. >> Just got over here on the cot for us. All right. Right here on the cot. Have a seat. >> Spin around. There you go. >> Have a seat. >> Set your butt. Set your butt up here. There you go. >> Have a seat. >> Swing your legs on. >> I'll help him out, boy. You're going to ride. >> 500 ammo. >> All right. >> Okay. >> He's fighting in the squad. >> What do you want? >> 250 academy. >> All right. No, dude. Dude, >> relax, Jason. >> Jason, we're trying to help you. >> We're trying to help you. All right. >> Okay. We're trying to help. >> Just relax. PLEASE PUT MY FEET ON ME. >> DUDE, PLEASE HELP. >> JUST RELAX. >> PLEASE. >> I'm not going to fight with you. Relax. >> They're helping you. HELP. >> 19. I need you in the squad. >> If you bite me, I swear. >> Do not bite me. Do not bite me. Do not bite me. >> Do not bite me. >> Resisting arrest is where the law gets complicated. Ohio Revised Code section 2921.33 requires reckless or forcible resistance to a lawful arrest. Reckless is the operative word. Recklessness under section 29 01.22 means conscious disregard of a substantial and unjustifiable risk that requires cognitive capacity. Jason's capacity is the central factual dispute. Paramedics administered 500 micrograms of nlloxxone, a dose indicating severe synthetic opioid saturation, likely fentinyl. Narcan at that level does not restore normal consciousness. It precipitates acute opioid withdrawal, extreme agitation, disorientation, and combiveness. This is a documented medical emergency, not a behavioral choice. A defense attorney will argue Jason lacked the men's RIA required under section 2921.33 at the moment of resistance. Published pharmarmacological literature supports that argument. The bite threat complicates the defense. That act constitutes assault under section 2903.13 regardless of impairment. It exposes Jason independently. Use of force evaluated under Graham versus Connor decided by the Supreme Court in 1989. Reason is judged from the officer's perspective at the moment of action. Soft empty hand control and restraint across 16 minutes. Zero less lethal weapons deployed despite a bite threat. That is proportionate. That is legally defensible. I got this. Do it right now. Okay. >> I got this. I got that. I got that. >> Just relax. >> I got that. >> Jason. Jason, calm down, bud. >> Relax. >> Jason. >> Jason. >> We're here to help you. >> You're at McDonald's. Just need to relax. >> Okay. >> Quit grabbing me. >> You ready? >> ARE YOU GIVING ANYTHING? 500 FIVE. THIS IS 250 and 2 and 1/2. >> Jason. Jason. >> 250. 250 and 2 and 1/2. >> Relax, man. Relax. >> They're They're here TO HELP YOU. >> OKAY. >> What do you want us to stop? >> JASON, >> STOP. >> DO YOU KNOW WHERE YOU'RE AT? JASON, do you know where you're at? >> Do you know where you're at? >> Do you know where you're at? Jason, do you know where you're at? >> Stop. >> Do you know where you are? >> Police. >> Streetsboro Police. Good. You're >> all right. You're all right, JASON. >> STOP IT. >> ALL RIGHT, WE'RE JUST LOOK, LOOK. Just relax. RELAX. >> NO, you're fine. You're fine. These are the paramedics. THEY'RE GOING TO HELP YOU. >> That was 250, correct? >> Correct. >> Just relax, my man. Just man, just relax. >> Just relax. 250. You're all right. Antonio, >> whenever you guys are ready, let's let's roll. >> Jason, listen to me. We got to get you checked out. All right, just relax. Okay, fight. Fight. Listen. Listen. Fighting's not going to make it better. Okay. >> You got to keep the mask on, buddy. It's giving you oxygen. Okay. >> Last few customers I brought down, he was causing trouble. So, last girl was peeing on the floor. >> Be back in. >> Was the car cold or on? >> No. Car was running. He was in the drive-thru of McDonald's, actually. And then when um unresponsive, someone put it in park, but then I, you know, turned it off. But um once he kind of came through a little bit, he was fighting to get out of the car. He's been fighting in the squad the whole time. >> Um >> especially for how much ketamine you get. >> Um so yeah, he is in custody um for uh for OVI. Okay. >> I'll let you guys and gals do your thing and uh you know, go over whatever I need to with them whenever um I'm okay to do that. Sounds good. Appreciate Appreciate it. Officer B+ Narcan administration was correct. Deescalation was consistent. Force was proportionate throughout. One failure. The resisting arrest affidavit. It should have incorporated the paramedic's onseene assessment of Jason's cognitive state at the time of resistance. That omission is the gap a defense attorney walks through. EMS crew a minus. Titrated dosing was sound. Pausing transport during peak agitation was the right call. Deduction. Unprofessional commentary made in the patients presence. Jason B. The OVI is unambiguous. An unconscious driver in a commercial drive-thru created real public danger. The resisting charge is a harder legal question given the medical context. Three lessons. First, when charging resisting arrest postnarcan reversal, the probable cause affidavit must address the subject's cognitive capacity. Paramedics on scene are your primary witness for that element. Second, Narcam precipitated withdrawal is an emerging defense theory. In opioid resisting cases, prosecutors need to anticipate it and prepare medical expert rebuttal before trial, not during. Third, in concurrent medical and law enforcement responses, use of force documentation must account for the subject's altered mental state. A gram analysis that ignores pharmacological context is legally incomplete. Let us know if there is an interaction or legal topic you would like us to discuss in the comments below.
