Why am I being Because you're not allowed Emily, you're not allowed to ash out the window and two I'm I'm going to have you hop out of the car cuz this is her vehicle and she's allowing me to she gave me a consent search to search the vehicle if there's anything illegal in the car. If there's not then we'll go from there, okay? She can't really explain to me what's going on and can you tell me where you're coming from? Okay, where at in Philly? She's not really making any sense. So I'd rather you be up front. I'm I'm going to be super respectful to you, okay? I'm just trying to figure out what's going on. So she can't even comprehend what I'm asking her right now. So I'd rather you guys be up front and tell me what what's going on cuz it's not like a routine traffic stop. There's several indicators right now that are telling me that either you guys were partying or there's narcotics involved. I got I'm I'm just trying to figure out what's going on. She can't really understand what I'm I'm asking her so I'm going to ask you, too. Do you know where at in Philly you guys were? I don't have to tell you anything. Okay, all right. She's all over the Uh the one that's a kid. The one that's a match. Erica. Erica. Yeah. Emily's Emily's a passenger. Erica. Erica, is this from the night? Uh Smirnoff raspberry. What's that? It's not from tonight. You guys weren't drinking at all? Okay. Listen, can you just stand up for me real quick and come over here? Yeah. Thank you. So, just because of the way driving behavior, how you've been acting and stuff, the way that we've and obviously with alcohol being found half drank right behind you and where you'd reach to put it back in, I'm just going to run you through some tests, okay? So, here's the thing. I'm going to run you through and I'm going to explain it all to you, okay? Uh if it's deemed that you're you're good to go, obviously I'll get you out of here. Drive away, all that good stuff, okay? All right, so we'll just start with that and then, you know, we'll go from there. Yeah, if you Yeah. I'm just going to have them turn the lights off real quick. Listen, you don't have any like medical issues, right? You haven't been hit in the head, no concussions, anything like that. Okay. All right. I'm just making sure. I just want to make sure cuz obviously it's all going to be taken into a factor. You don't have anything that affects your balance or anything like that, no existing injuries, pre-existing injuries. All right, so listen, for the first test The first exercise was the horizontal gaze nystagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test Erica did not touch heel to toe on each step and failed to follow instructions. The final exercise was the one leg stand test and she failed to follow instructions once again. You're going to follow the tip of my pen right here, okay, with your eyes and your eyes only. Don't move your head. Keep your head still, just your eyes, okay? And then I'm going to get you in the starting position, too. So, you're going to have your feet together, hands down by your sides like this, all right? Perfect. Now, just follow the tip of my pen with your eyes and your eyes only, okay? The tip of my pen right here, okay? Just Just your eyes. Not your head, just your eyes. All right. Just the tip of my pen, okay? Just keep following the tip of my pen, okay? Keep following the tip of my pen. I'll instruct you when we're done, okay? Just Just keep your eyes on tip, okay? Just your eyes, all right? Don't move your head. Okay. All right, so listen, for the next test it's going to be the walk and turn, all right? So, like you said, you don't have anything that affects your balance or anything like that, right? No pre-existing injuries? Okay. All right, so I'm going to get in the starting position first, all right? So, you're going to imagine a straight line right here, okay? Just a straight line. So, you're going to put your left foot on the line like it'd be like this. Your right foot in front of your left foot touching heel to toe. You're going to keep your hands together down by your side the whole time, okay? You're going to stay in this position until I instruct you to begin, okay? So, I'm going to now run I'm going to explain the test to you and then I'm going to tell you to begin and you're going to do the test, okay? You can stay in the starting position. Left foot on the line, right foot in front of your left foot, heel to toe. Hang on, don't begin. I'm going to That's just the starting position, okay? All right. Left foot on the line, right foot in front of your left foot, hands down by your sides. Stay like that until I instruct you to begin. All right. So, when I instruct you to begin, you're going to do nine heel to toe steps, okay? So, it's going to look like this. One, two, three, so on until nine, okay? When you get to nine, all right, when you you're going to do a series of small steps keeping your lead foot planted and your your rear foot, you're going to use it to pivot back. You're going to do nine heel to toe steps back, okay? Once the test is started, don't stop until the test is completed, okay? Count your steps aloud, keep your hands down by your sides, all right, and make sure you touch heel to toe, okay? All right, you can begin. Okay. Yep. All right, so listen, for the next test it's going to just be the one leg stand, okay? All right, so for this test the starting position going to be feet together, hands down by your sides like this, all right? You're going to stay in this position until I instruct you to begin. All right, when I tell you to begin, you're going to pick either leg of your choice, whichever one you prefer. You're going to raise approximately 6 in off the ground keeping your foot parallel to the ground. All right. You're going to keep your eyes down at your foot that's lifted, okay? You're going to count 1,001, 1,002, 1,003, so on until I instruct you to stop, okay? So, for this test, make sure that your leg that's planted on the ground is straight the whole time. When the test is began, don't stop until I instruct you to stop, okay? All right, you understand the test? All right, you can begin. I'll instruct you when to stop. Continue, I'll instruct you when to stop. Okay. All right. Where's the Soviet? 329 That's fine. Based on higher indicators of impairment and the open container inside her vehicle, Erica was placed under arrest for operating under the influence. Her passenger also had a warrant for her arrest, so she was placed under arrest as well. All right, listen, just based off my observations, you appear to be under the influence. Okay? I have two New Jersey warrants. >> So, you're going to be placed under arrest for suspicion of DUI. What's up? What? I just explained it to you. You're going to be placed under arrest for suspicion of DUI. Based off all the tests that I just performed, you appear to be impaired. No, how? I just explained to you. Yeah. So, what's what's what's going to happen now? Hang on, hang on, hang on, hang on. I got to put you in the cuffs. It's okay. Put your hands behind your back for me. Put your hands behind your back for me. All right, you can come back here with me, ma'am. You can come back this way. You have a warrant for a thousand bucks. All right. You don't have anything on you, right? Is your Listen, I I have to tow your car based off this, okay? So, do you have anything in your car that you need that you need me to get for you? Okay. Get Where's your phone at? Do you have a phone? In your car? Okay. Do you know where it is? I know. I know. In like the center console? Okay, I'll I'll look for it for you. Do you have anything else? We're not doing that. >> They're my clonazepam. >> Okay. So, you're chugging you're taking them when Does it look a little suspicious that I'm walking up to and you're shooting pills down your throat? Because I'm about to go to jail, I'm taking my stress pills. >> Jail for for a thousand dollar traffic warrant? You're not going to jail for a thousand dollar traffic warrant. Oh, okay. I'm sorry. Now I feel like I need to get up. What what is this? Clonazepam. She just tried to swallow this. What is it? Clonazepam. She just tried to take Is this the only two that you had or do you have more on you? They're in my pill bottle. Okay, but what what was your reasoning behind doing that? I'm in a stressful situation.
