What is your judgment for due to part for you to feel that way? >> You have slur speech in order. >> I don't have I don't have slur speech. I don't have alcohol. >> On August 17th, 2023, a police officer was called to conduct a traffic [music] stop after observing a vehicle traveling at a high rate of speed and weaving in and out of traffic. The driver, a woman, was initially cooperative, but later displayed signs [music] of intoxication. The situation quickly escalated when the officer attempted to conduct a sobriety test. >> Hello. >> Hi. >> How are you? Officer in the Cape Police Department. Reason I pulled you over is you passing 51 on Delpra and then you're going about 65 on veterans driving in and out of traffic. Do you have your license registration on you? Any luck on that registration? >> Yes, I have my registration. I got to put one. I'm sorry. >> It's okay. You're sorry. >> I DON'T KNOW WHERE THE [ __ ] I put it, honestly. It's in my a book or Oh, wait, wait, wait, wait. >> Where are you coming from tonight? >> I picked them up. >> Who's them? >> Friends, family. Thank you. Just inside for me. Okay. >> Thank you. >> I have a number. >> I have a number. Order. Yeah. Um also when I asked her for her registration, she completely forgot. Had to reass. Okay. Um, >> the officer initially observed the driver speeding at 51 mph in a 35 mph zone [music] on DellP Boulevard, then saw her accelerate to 65 mph while navigating Veterans Parkway, weaving in and out of traffic [music] lanes. The vehicle was stopped for these traffic violations. Upon approaching the [music] car, the officer asked the driver for her license and registration. Tango 41K, which I've used. You seen this? >> Yeah. Have you used it on DUI investigation? I don't know. All right. So, the way this works is, so you're going to ask her to step out of the car. She's out. You're explain to her that you're the best smoker. DUI investigation. She asks what you're talking about. You could say, "Hey, we got odor of alcohol coming from you." Speech. >> Slide across the eyes. >> Did she have blood across the eyes? I mean, I didn't have a perfect look of her eyes, but her her speech was slurred and then I had to keep her eye during the registration. And then you can just say that there's a few other items that that I'm seeing. Um, you don't have to go into great detail cuz I think argument. >> Yeah. Um, but at least you have two you have two indicators, right? >> Um, and then, you know, you know, your driving is a little aggressive as well. You know, also there was a a time there that she was crossing the lines. Do you remember that? >> Yeah. Here, she hit that. She moved over a little bit. Yeah. So I have that. Um so when you get her out you say hey I want to start UI message. Are you willing to participate in site field? Yep. And then from here you just started. Do you have any physical right? The only one that I would there's two doctors. All right. And then when you say physical limitations your hips, your knees, your ankles, your legs, anything like that. All right. See are you seeing a doctor or anything regularly type of stuff? Um, and then right here, >> is it just yes or no? Where do I get their name? >> If they have info, go ahead and drop it. You can write whatever you want on this. You're right next. Eyeglasses, contacts, are you blind either eye? And then from here, we'll do this. All right. Um, I'm going to have you do and then I'm going to do it and check it. >> Okay. So, I'll explain once you do that as then we'll move into walking turn one hand. So, and then we're going to go ahead and put The officer noticed several signs of potential impairment, including slurred speech, the strong smell of alcohol, and the driver's erratic responses. Based on these initial observations, the officer suspected the driver was under the influence [music] and decided to conduct a DUI investigation. He asked the driver to step out of the vehicle for a field sobriety [music] test. The driver questioned the request, asking why she needed to exit the car and appeared hesitant, [music] visibly uncomfortable, and resistant to complying. >> Hold on, man. Would you step out for me? >> Why? >> I'm asking you to, please. >> No, I I need to know why. >> Well, I don't have to tell you why, but I'm going to. I sense some signs of impairment. Let's just all get out. >> Hey no, no, no, no, no. Sure. You stay in. >> Oh, okay. >> Just ask her to come out. >> All right. >> Why does he make everything relax? >> Step up on it. >> But why? Can I ask why? >> Yeah. Step over once out here. >> Okay. Step over here. So the reason why I haven't come out seeing signs of impairment, we want to start a DUI investigation. That means you participate in standardized field evaluations. Are you willing to participate in standardiz? >> No, I'm not impaired. I'm dropping them off over here. I'm going home. I live right off of Nicholas. >> So the So only way we can go forward from this is if you participate. If you don't participate, we have to make our judgment based off the observations we've seen so far. >> What is your judgment for due to part for you to feel that way? >> You have slur speech in order >> I don't have I don't have slur speech. I don't have alcohol. >> If you don't participate in sight field ride evaluations, then you can't dispel our fear of your own. >> Okay. So, you want to participate in high field. >> What does that include? >> We're going to check your eyes and then we're going to have you do the walk and turn and one leg scene. >> Whatever. >> Okay. Should everyone participate? >> I'm not blowing, but you can do whatever the [ __ ] you want to do. Yeah. >> Step right in front of the car real quick. >> So, we put you in front of the light so you can feel impaired. Fantastic. >> Well, why would the light make you feel impaired? >> Because it switch your children off, obviously. >> All right. I still have some questions for you. Okay. Are you sick and injured at all? >> But why did you pull me over? >> Why pulled you over? >> Why Why was I pulled over? >> First off, you you passed us going 51 on Delpra. We followed you on veterans. You're getting in and out of traffic. You're going 60 mph on veterans. 66 mph on vet. >> What do you have your proof of that? >> Yes. >> Where? >> Our observations. >> Observation is proof. >> Yeah. >> I don't I don't >> Do you want to participate? >> If I don't, then what? >> We have to make We have to make a judgment. >> What's your judgment? >> It's up to you whether or not you want to participate. >> I mean, I'm not drunk. >> Okay. I'm if I were or weren't speeding. I'm not saying either or. >> The question. >> Okay. So, my question for you is, would you like to participate in some field soriety exercises to dispel my fear that you may be intoxicated? >> Am I allowed to like research first? >> No. >> Just yes or no. >> The driver, however, denied having been drinking, explaining that she was simply dropping off friends and heading home. Despite her claims, the officer [music] insisted on administering sobriety tests. Reluctantly, the driver agreed to participate in the field sobriety tests, but refused to take a breathalyzer. As the test continued, [music] she became increasingly agitated and began arguing with the officer. >> Just yes or no? >> No. >> You don't want to say anything? >> Okay, fine then. Yes. >> No. Then yes. Yes. Yes. >> We're not going back and forth with this. >> Why? >> Okay. Stop. Stop resisting. Stop resisting. Now I'm resisting. Oh, that's tensing up. STOP TENSING UP. >> STOPING because this is a normal DAY FOR FLORIDA. OH, I'M RESISTING. OH. Oh my god. I'm 100 pounds. I'm resisting. >> Stop resisting. >> What the hell? I'm resisting. What did I do? What did I do? What did I do? What did I do? What did I do? >> Stop resisting. >> What did I do? >> You're tensing up. Stop. >> I'm okay. I'm tensing up. Okay. I got three cops on me and I'm 130 lb. Not even. I'm tensing up. Okay. What the [ __ ] is this? >> Stop. [cheering] >> Really? This is like This is Okay. Okay. But I need my phone and I need my wallet. >> Do you want to arrest me >> for doing nothing? >> Mommy, you want to blow? You want to blow? You want to blow? Come on. >> Let's do it. Let's do it. Let's do it right now. >> Let's do it right now. Right now. Let's do it. Let's do it. >> Really? You're grabbing me like that? >> Well, you keep tensing up. >> Oh, okay. >> You know what's funny is you're over here for me. Come over here. Stop pulling. >> Face the car. >> [ __ ] you. >> Stop catching up. Are you [ __ ] TRYING TO WHAT ARE YOU DOING, BRO? Are you trying to like assault me? I know. She's grabbing me. >> Stop tensing up. >> TENSING UP. SHE'S [ __ ] GRABBING my tent. What am I? What's on me? Look at me. Back out. What's on me? What's on me? >> Sit down. >> I want my wallet and my key. >> GET IN THE CAR. >> WHERE'S ALL MY [ __ ] >> REALLY? OKAY. YOU'RE GOING TO GET SUED. YOU'RE GOING TO GET SUED. You're going to get sued. You're going to get sued. Thank you. >> Just come back here. Back of the car. Step out for me. Yes, sir. back of the car. Sir, >> sorry. I we just met her tonight and we were just trying to get to the next car and that's all that was happening and she said, "We'll take you to the next car and that was it." That that was all that happened tonight. >> So, you don't know her person? >> We just met her at >> Yeah, we just met her tonight. We were only at resties for like an hour and then we went to the back. We had lunch right there and then we were on our way here. As the officer began the arrest procedure and instructed her to place her hands behind her back, the driver resisted by [music] stiffening her arms and pulling away. The officer repeatedly warned her to stop resisting, but she continued to struggle, loudly, protesting that [music] she was being mistreated. She accused the officers of using excessive force and repeatedly [music] shouted that her arrest was unlawful. >> And she really like, "Would you mind chopping this off?" And then she was like, "Yeah, I just hit you." And then we didn't know she was doing this like I heard scene one minute and yes I know it's illegal double like double passenger she was just going to drop us off here and we were going to do emergency >> you guys have licenses or ID cards >> yes yes I have IDS I didn't want to cause any issues I don't know why she's being like that overreacting she was already going through a lot because uh the owner over at the tech was like on her cuz the last three times that I heard from him she was he's saying >> with this last thing I need people to deal with. >> Yeah was trying to like get out and like be able to like stand up because I was like you know >> you guys have anything else inside you? >> Oh no no no nothing like that. >> You have all your property on you?
