If not, bro, I need to put my contacts on so I can see. >> Where are your contacts? My contacts is in my thing. That's what I was trying to do, but you grabbed my hand. The officer begins with verbal commands, the lowest level of force beyond mere presence. When compliance does not follow, he deploys his Taser. Under Graham versus Connor, the reasonableness of force must be judged from the perspective of a reasonable officer on the scene based on the information known at the time. One officer, four active combatants, failed verbal commands. Industry standards classify the Taser as intermediate force, appropriate where lesser options have proven ineffective. In a mutual combat scenario of this scale, the immediate threat factor under Graham weighs heavily toward the officer. Once the fight stops, the officer transitions immediately from force to control. Backup units arrive. The four combatants, an older man and woman and two younger women, are separated. Separation prevents re-engagement while officers assess injuries and begin gathering accounts. The older male subject continues shouting threats even after separation. Under Georgia Code Section 16-11-39, acting in a violent or tumultuous manner toward another person, placing that person in reasonable fear for their safety, is a misdemeanor offense. His words alone independently satisfy the statute. Okay. Go inside here in the room. Hold on. Okay, ma'am. You have any ID on you? It's in my bag, like Okay, I'll get you. I'll buy you a sandwich. Let me I have my passport. Okay. What color your bags are? It's the It's the blue. With the thing. Can I see your ID, please? What what What you What's What city do you live in? I live in New York. That's my friend. Come here. That's my friend. Have a seat in a minute. Take these shirts off of me, please. Have a seat. Have a seat. Huh? No, no, have a seat. Have a seat, ma'am. Ma'am, have a seat. Ma'am, have a seat. Hey, um Allison. What color What color is your bag, ma'am? It's the blue with the seahorse. Blue with the seahorse. Okay. All right. Sir, can you take these off of me, please? we'll do it in time. Do you have ID on you, ma'am? I I have to get it. I can't see. I need to I need to see first. I cannot see. I don't even know if I have my wallet. That's what I'm trying to tell you. Bro, get these shirts off of me, please, bro. Just relax for one second. >> having anxiety, bro. Please get these shirts off of me. No. At the precinct, the officers begin interviews with the parties involved. We were just trying to help the bus driver out. That's all we was doing. No, as soon as they calm down. Tell me what happened. So, we was trying to get on the bus. Okay. There were two young The one young lady the the smaller young lady was holding up the bus. And she was fighting with the bus driver. Fighting as physical or fighting as verbal? >> with other people, cussing them out, telling them she wasn't getting on the bus. She then told her friend to get off. >> Well, do you know why the bus driver told her to get off the bus? >> There wasn't enough room for all of them. Okay. Wait for the next bus. >> Yes. So, we was trying to wait for the next bus. The next bus couldn't pull up because they were in the middle of the argument. The young lady who also works with the transportation came over to try to assist to get her off the bus. She then got off. The young lady who we were fighting with got off the bus, called her friend to get on the bus as well. And the bus driver was trying to get them off so that they can get rowdy. >> And they still want to come off. Hold on. So, then now we like we trying to get off the bus. Like you holding you got a whole line. He said there's another bus behind you. Just get off the bus. Then they went to shut the [ __ ] up all up to to us. And which And if you shut the [ __ ] up, that's how it all started. So, then she jumped in his face. That's my man. I'm not going to let nobody jump in his face. So, she started swinging. Swinging on you? Yes, she started swinging on him. So, I then I don't want him hitting no female. She grabbed his shirt and tried to pull him to the ground. So, that's when I grabbed her. Her friend tried to grab started grabbing me. They both were just pulling my coat. Neither one of them landed a hit on me. And then she's on the ground with him. So, that's when I got on her to get her off of him. And I don't want him hitting her. I'm staying My hand is My hand is broken. You got a broken hand. I'm not even supposed to But again, I'm not going to let nobody jump on him, especially a female. Okay. So, you know, in the in the heat of rage, when I heard your taser, I stopped. Right. When you said get up, I stopped. But I'm still I I I'm working and I'm I'm still yelling. I didn't physically throw any more hits, but I'm yelling. And then I went I went over to pull her and then you grabbed me. Well, you have to understand, I see all of you guys fighting. >> to grab her. I understand, but I see everybody's fighting. But when I grabbed you to pull you off Hold on, let me finish. If I grab you and I pull you off, I need to stop. If I get involved, I need to stop. If I I wasn't doing anything. I was holding her. I waited till you finished. I I went At that point, the girl kept coming. The girl was coming at her, right? And she was just grabbing back and forth. I went to grab her and said, "Come on, let's go." Then you grabbed me cuz I'm trying to pull her. I don't know the relation. You understand that? So, what? I don't know the relation between you all two. >> I'm grabbing her to tell her let's go. Then you grabbed me. And then but I want to grab you, I told you to step to the side. >> No, no, you grabbed me and said everybody's under arrest. No, no, no, before that. Anyway, Do we need a pull for anybody? So, you Do you still need You still need a a medical to come check you out? >> You know, I would just want to come and look. At this point, police aren't deciding who's right. They're documenting how it escalated. The younger women were also asked their side of the story. And as you would expect, they told a different story. She spit on my friend. Her name Then against what I got asked we we self-defense, bro. And if you have a camera, you you could replay the camera. Did it happen Did it happen on the bus or it happened off? >> No, it was We was coming off. I was waiting Hold on, Aaron. I had a seat for myself cuz I was being respectful. So, we had to get on the bus. >> Right. So, my friend was on the phone call cuz she didn't want to be you know, in people's business. So, she stepped off the line. Right. So, I'm telling the guy so now Now nobody can get on the bus cuz you know, everything is full. So, I'm like, "Hey, listen, like you know, that's my friend. We're traveling in pairs. So, cuz you just let her in on the bus because everybody Everybody else is in pairs. So, nobody else can get up. And then if I would have got up, I would have basically been giving my seat away to the next pair. So, I'm like, "Can you just let my friend on? She's right there, you know, she was handling a phone call." At the end At the end of the day, we're 21. People were supposed to come pick us up. So, we're trying to let them know, too, like this is what's going on. And we have to travel in a pair. We're young as hell. And kidnap us. We're not grown like these grown folks over here [ __ ] 40 and 50 where we can't even know our own. So, then I'm getting off the bus. We both got off. We both get off the bus and now I'm just like, you know, I'm mad. So, I'm like, "Yo, like this is not fair. Like I'm not about to give up my seat to give another pair." So, then the girls the ladies start coming like, "Oh, I don't give a [ __ ] about none of that. Get the [ __ ] off the bus." All all this [ __ ] So, I'm like, "Bro, what you mean get the [ __ ] off the bus? You can't even get on the bus yourself. He just said he's not letting nobody in because of all the luggage." And I said, "Y'all have more luggage than we did, bro. Most of our [ __ ] is theirs. We only have three luggages." All right. They have like five luggages. So, I'm like, "Bro, you can't even get on either. So, what do you mean?" And then now she's [ __ ] arguing. She's getting rowdy. She spits in my friend's face. In your face? Yes. She spits like deliberately spits in my friend's face. AND THEN HER [ __ ] JUMPS And then her husband jumps in front of her and swings at my friend. So, of course now we all go back and forth at it. I MEAN, IF YOU HAVE TO FIGHT RIGHT. RIGHT. from from a female Two females against one [ __ ] and one female. Right. One female and one I'm I'm fighting a whole I'm fighting a whole grown ass man that could be my father. >> what you're saying. I don't I don't understand what you're saying. I understand what you're saying. And then y'all sitting here arresting us. So, like we I didn't I didn't I didn't get here. I don't know WHAT HAPPENED. WE SELF-DEFENSE. WE GOT OFF THE BUS. It's not even like we were sitting there trying to hold up the bus. Right. Got off the bus about to get on the next bus and this [ __ ] arguing with us for no reason. They're old. Why are you Why are YOU ARGUING WITH US? YOU SPITTING IN YOUR FACE, BRO. YOU TELLING ME YOU LIKE YOU LIKE 40 SOMETHING PLUS AND YOU SPITTING IN their faces? THAT'S COOL, BRO. THAT [ __ ] WAS GROWN ASS MAN. YEAH, LIKE BRO, that [ __ ] was started the fight. HE WAS TALKING so loud the spit was coming out of HIS MOUTH. NO, SHE SHE SPIT LIKE SHE DELIBERATELY spit in my friend's face. And then after after she spit after she spit in my friend's face, her husband or her whatever her significant other then came and swung at my friend. It's not going to jail just for spitting on somebody. That's That's personally violating me. SO, REGARDLESS SPITTING SPITTING IS JUST LIKE if you hit somebody. Yeah, [laughter] exactly. That's what I said. That's personal That's a personal violence. AND THEN YOU HAVE AND ON TOP OF THAT, YOU HAVE A [ __ ] THAT that's was hitting a female, bro. You see all that [ __ ] on camera. You have the And then you was outside. YOU HEARD HIM WHEN I WAS LIKE, "NAH, you No [ __ ] should be hitting a female." So, you see all that. So, I didn't I I didn't get here. I don't Like I don't even know their side. One of the younger women eventually asks to call her mother, who works at a correctional facility and whom she probably thinks could do something about the situation. Do you have any questions for me? Yeah, so what's going on cuz we don't live out here. We live in New York. Okay. So, So, you can't bring this to New York? No. So, here's the deal. Let me Taylor, just stop, bro. Stop. Cuz the more you get rowdy, I'm not getting rowdy. How old are you? I'm 21, but my mom's a correctional officer. So, she's she wants to talk to you because she was telling me that y'all could bring this to New York because I don't live in Atlanta. Okay, this is a state Okay, this is the state of Georgia. We can't bring the case to New York. I'm I can't make that decision. So, this is how it's going to go. So, I've decided not to take you guys to jail, all four of you guys, because of the fight. It's a fight. No matter who started it, it was a fight, okay? Uh we decide I decided to give you a a citation. Which means you get a ticket. You have a court date. And you guys get You guys get to release. Okay? So, we have to stay in Atlanta. What? >> Or it's going to come That's what I'm saying. That's what I'm saying. >> mean stay Stay Stay in Atlanta? You have a court date to come to court. Is it in New York or in Atlanta? Atlanta. It happened here. It's in Atlanta. to our speaking with? My mother. I know her name. Sheniqua. Hey Miss Hey Miss Sheniqua, how you doing? And Miss Drayton. Here is your citation and you all have the same court date, ma'am. What is April 24th? It's going to be on April 24th. And just make sure you have your belongings, your cell phone, your electronics before we take you from the precinct cuz you will not be allowed back in. So, make sure you got everything. Is that all your stuff? Take a second look. Make sure you don't forget anything. All right. We'll get you guys out of here. Got you. Yeah, I'm explaining everything to you, Miss Miss Robinson. Mhm. When is the court date? Okay, here's your ID back right there. Okay, the charge that we're going to forward for you is disorderly conduct, engaging a fight. And you all fall outside of the shuttle bus area. That's what we're going to go with. And you have to sign here by the circle X. You sign here, you tell them the state of Georgia that you're going to come to court. And he gave you a court date of April the 24th. That's like 4 weeks from now. It's going to be at 8:00 a.m. You all sign here by the circle X. Where do I sign sir? Right there. No, no, no, no. Good. You sign your citation. Huh? What are they doing? They're giving us a citation. You sign your citation. You sign your citation. My brother is with the Clayton County. Huh? My brother is with the Clayton County. Okay, he did what? He did what? Mr. Robinson? His sister. Same thing. Why was it? Officer Reyes is going to charge you with disorderly conduct, engaging in a fight in a public area. Who he works for? Uh I gave you the same court date as he gave um her. What what agency? He gave you a court date of April 24th. It's like 4 weeks from now. And you just need to sign here by the circle X. Yes, the sign And you sign here by You sign by the circle X. When you sign there, you basically tell the state of Georgia that you're going to come to court, okay? All right. With that being said, Officer Reyes and I going to take you all back out there. You said the belongings are all your stuff? Here is your IDs back right there. And you got your appearance to come to court. Huh? Thank you for guarding my things. You're welcome. All right. So, we can get up. All right. All right. We'll get you all back out there to the shuttle bus area to the Uber passenger pick up right here area. Meanwhile, one of the younger women accuses the older woman of taking her phone during the fight. The officer's priority is not resolving competing claims. It is maintaining separation. In mutual combat scenarios, credibility determinations are for the courts, not the street. Notice the shift in tone. Minutes after deploying a Taser, the officer is actively helping one of the subjects locate her prescription glasses. This is de-escalation in practice, separating the person from the behavior. The officer treats both realities at once. All four subjects are walked to the precinct office inside the terminal. Under Atwater versus City of Lago Vista, Georgia officers have discretion to either make a custodial arrest or issue a field citation for misdemeanor offenses. The choice will turn on the officer's assessment, the statements taken, and department policy. Inside the precinct, the two sides tell opposing stories. The older couple says the younger women held up the bus, and the older woman intervened only to protect her partner. The younger women claim the older woman deliberately spit on one of them, and that the older man then swung first. Contradicting accounts are expected in mutual combat cases. Here is the key legal point. In a mutual combat scenario, Georgia's disorderly conduct statute does not require the prosecution to identify a single aggressor. Each combatant may independently satisfy the elements by their own violent conduct. This is why in fights with multiple participants, it is common for all involved to be charged. One of the younger women asks to call her mother, who she says works in corrections, hoping it will influence the outcome. But this is Georgia, not New York. Jurisdiction matters. A crime committed in Fulton County, Georgia is prosecuted in Fulton County, Georgia. Residency in another state does not transfer venue. The officer announces his decision. All four will receive a field citation for disorderly conduct. No custodial arrest. No booking. No jail. In a case where probable cause clearly supported custodial arrest, the officer chose the lesser intervention. A significant exercise of discretion. Each subject is charged under Georgia Code Section 16-11-39 and receives the same court date. April 24th, 2023. Each signs the citation, acknowledging receipt and promising to appear. Failure to appear would generate a bench warrant and a separate misdemeanor charge. The lead Atlanta police officer receives a B+. His force progression was textbook. Officer presence, verbal commands, then intermediate force only when lesser options failed. His post-deployment conduct, from immediate separation to helping locate prescription glasses, reflects solid training and the kind of rapport de-escalation policies encouraged. The older couple receives a C. Their stated motive, protecting each other and keeping a bus line moving, does not erase the fact that verbal threats of serious harm and physical engagement with two people 20 years younger in a public transportation area independently satisfy the disorderly conduct statute. The younger pair receives a C-. Even crediting their allegation that the older woman spit first, the appropriate response under Georgia law is to separate, call law enforcement, and file a battery report. Not to engage in a mutual fight. Spitting is a battery, but the victim's remedy is the legal system, not retaliation. The fundamental issue is simple. Being right about who started it does not authorize reciprocal violence. The statute treats the fight, not the first punch, as the offense. Four citations, one Taser deployment, zero custodial arrests. No winners. This incident offers several lessons worth remembering. First, in any public dispute, the moment a confrontation turns physical, the legal system stops caring who started it. Every participant becomes a defendant. The only reliable way to stay on the right side of the law is to disengage before fists, or in this case, spit, begin flying. Second, frustration is not a legal defense. A canceled flight, a full bus, a rude stranger, none of these excuse disorderly conduct. If you believe you have been wronged, the correct remedy is documentation, witness statements, and a police report. Not escalation, not retaliation, not a fistfight in front of an airport terminal. Third, words have legal weight. Verbal threats of serious harm, even shouted in the heat of the moment, can independently satisfy the elements of disorderly conduct in Georgia. Saying, "I will kill you." in a public place, directed at a specific person, is not venting. It is evidence. Once said, it cannot be taken back. Fourth, never assume that your home state's laws follow you across a state line. This incident happened in Georgia, not New York. A phone call to a family member in law enforcement cannot change venue, reduce charges, or transfer a case. When you travel, you are subject to the jurisdiction you are standing in. Every single time. Fifth, officer discretion is real, and it is earned. The officer here had probable cause to take all four subjects to jail. He chose citations instead. That choice reflected the subjects' eventual compliance, the absence of serious injuries, and their willingness to cooperate once separated. Respect and compliance at the scene influence outcomes in ways that arguing never will. And finally, when body cam is rolling, every word and every action is evidence. For officers, this is accountability. For civilians, this is either protection or self-incrimination, depending entirely on the choices made in the moment. Assume the camera is always on, because today, it almost always is. Let us know if there is an interaction or legal topic you would like us to discuss in the comments below. Thank you for watching.
