On March 27th, 2024, police in Milin, Michigan were dispatched to a closed gas station for a reported vehicle crash. At the time, the officers had no way of knowing that they had just encountered someone who would soon become a local internet celebrity. >> What's going on, man? How much have you had to drink tonight? >> That's not true. >> Okay. >> All right. M Michigan law requires you to submit to a preliminary breath test upon request of a peace officer. Fail to do so will result in a civil infraction. Will you take a preliminary breath test for me? >> Yes, >> you will. Okay. Stay over here, man. Hey, stay over here. >> You're cold. Well, there's nowhere for you to go over here, man. You got to stay over here. Come back over to the car. Daniel's breath alcohol level was measured at.130, nearly twice Michigan's legal limit. >> I can't rule anything else out. So, you have to come with those first. Okay. You can walk over to Miami. >> That's the old house. I'm happy about that. That was not bad. Doesn't feel like spring break, but >> No, it doesn't. It does in Florida. I've heard kind of a weird one. Kind of a weird location. >> Yeah. How do you interfere? >> I I don't know. He's not answering any questions. He's just like out of it. >> What's that? >> You're going to have to go to the hospital. >> I understand that, man. I understand you might think that right now. All right. But you've been drinking alcohol and you've got a pretty significant head injury. Okay. >> So, you're you're gonna absolutely have to get cleared at the hospital. >> Okay. Yeah. Leave. Don't take it off, man. >> Dude, >> don't don't take it off or we're gonna have to >> You're gonna have to sit down. >> Hey, Paul. You're going to have to sit down, brother. Daniel, either get on the stretcher on your own power or we're gonna put you on it. >> I need to understand why. >> Daniel, >> get on the stretcher. >> Answer the questions correctly. >> Come on, let's go. >> I've answered the question. >> Sit down. >> Have I not? >> Swing your legs over. >> You still have to go to the hospital. >> Why? There's a >> star in your windshield by protocol. >> Swing your legs up. Come on. Lots of seat belts. >> You need an ambulance. >> You good, buddy? >> Yeah. So, I think you started crap. >> I think you can just get a get a DI77 and go up there with the blood kit and get the blood. >> Got any open tox in there? >> I I haven't seen any open ones yet. >> Smells like it. >> Yeah, it definitely smells like it. Look, dude. Look at that chunk of hair. Is that the hole? >> Yeah, it looks like >> Oh, yeah, I see it. Y. Okay. >> Yeah, that is gnarly. >> As officers searched Daniel's vehicle, he was transported to a hospital for medical evaluation and a legal blood draw. Under Michigan's implied consent law, drivers suspected of operating while intoxicated must choose whether to submit to chemical testing. Before a consensual blood draw can occur, officers are required to read the DI 177 implied consent form. Upon arrival at the hospital, the officer read Daniel his rights from the DI 177 at 2:51 a.m. and informed him he was under arrest. Daniel refused the legal blood draw. So, the officer left Daniel in the custody of hospital staff to type a search warrant. Roughly 10 minutes later, staff informed the officer Daniel had fled the hospital. Nearby agencies were alerted and Daniel was located roughly 45 minutes later by Washaw County Sheriff's deputies. >> Please show me your Hey, >> stop. Please show me your hands. Stop. Stop moving. Stop. Put your hands behind your back. >> Your fingers for me. Put your hands together like you're praying. >> Like you're praying. >> Turn your hands together like you're praying. 16. >> Watch your step. 161 clear. I >> think this belongs to you. >> How you doing? Obviously been better, but those we'll call you back over there. Appreciate it. >> All right, let's walk this way. that seat. >> Try to be nice and not handcuff people to the bed and this is how they repay me. >> No, no good deed goes unpunished. >> Come on, bro. >> You better than that. >> I know. I know. Daniel was unceremoniously escorted back through the hospital to his bed. The officer obtained a search warrant and a blood draw revealed his blood alcohol content was.127 at the time of draw. Due to his injuries and the county jail's policy, Daniel was not lodged and a warrant was requested. But this was not the end of Daniel's interactions with Washington County authorities. On October 11th, 2024, prior to Daniel's owi warrant being authorized, Ipsellani city police officers were dispatched to 113 West Michigan Avenue for a fight in progress. Though they didn't locate a fight, officers found a man slumped over on the ground. At his side, a familiar face, Daniel Magcoo. >> Hey, Smith, get over here and deal with this, bro. Hold on. What you calling for? >> I'm sorry. Yeah. What? What are we calling for? >> Huh? >> Please. >> For what? Have you talked to him yet? >> No. Please. [snorts] Daniel was transported to jail. The other individual was released to paramedics due to extreme intoxication and no charges were filed against him. For the March incident, Daniel was charged with operating while impaired, third offense notice, DWLS, and escaping lawful custody. During his court appearances, Daniel went viral for his sovereign citizen prosay defenses. Ultimately, he accepted counsel and pleaded guilty to OWI third offense. He was sentenced to 134 days in jail with credit for 134 days time served, 2 years of probation, 480 hours of community service, and $698 in fines. The remaining charges from that incident were not pursued to conviction. For the October incident, Daniel was charged with three counts of resisting and obstructing. He pleaded guilty to one count and the remaining two were dismissed. He was sentenced in conjunction with the OWI case and assessed an additional $198 in fines. Shortly after these incidents, Daniel was charged for two other unrelated cases in Washington County.
