I have probable cause to search a vehicle. >> have probable cause. >> Step out of the vehicle, please. >> have probable cause. >> Do it now, please. >> You're not allowed to search my vehicle. >> out of the vehicle. >> getting >> If you do not step out of the vehicle right now, I'm going to take you out of the vehicle. >> I saw her chuck things around Oliver's seat, and I said, "What are you doing?" And she's like, "We're fixing it." Get pulled over. >> On July 6th, 2025, a traffic stop in Santa Rosa County, Florida, escalated into a dual drug arrest and raised three legal questions that Florida courts have not fully resolved. The stop itself is legally sound. The deputy documented erratic driving on camera, crossing the fog line twice, the center lane once, and cutting across traffic. Under Terry v. Ohio, 1968, that pattern satisfies reasonable suspicion. Hi. >> Hi. >> How are you? >> Good. How are you? >> I'm good. So, my name's Deputy Nave with the Santa Rosa County Sheriff. >> Hi. >> Please put it in park. >> I thought it was in park. >> Are we in park? >> Yes. >> Okay. My name's Deputy Nave, Santa Rosa County. All right, the reason for the stop, when you pulled out in front of me on Berry Hill, and then you took that sharp right turn, all right, you went over the dividing line to make your turn, all right, then we came down to 90, you turned took a right off Shavers, and I watched you bounce over the right the fog lane twice and the center lane once, then you cut across traffic to get to this parking lot, where I actually had to stop and let you pass me. All right, all of which are giant red flags someone's driving impaired. >> I'm not impaired. >> All right, so you've had nothing to drink? >> No. >> Nothing, no prescription meds that would uh uh affect your >> I am on um I haven't taken any, though. >> You're on what? >> Pain medicine for um my mouth. I just had surgery. >> Okay. And what uh about when was the last time you took your prescription? >> You're good. Go ahead. >> Okay. >> It's been a couple of days? >> Yeah, it's been a few days. >> Okay. All right. Do you have your driver's license, registration, proof of insurance with you? I appreciate you. I don't This was stuck to the back of your license. I don't want to litter. How you doing, ma'am? How you doing, ma'am? >> I'm fine. >> I'm good. Have we met? You look familiar. You don't know? Okay. It's probably a good thing if we haven't. You still living over on Legend Creek? >> Oh, yeah. >> Okay. Appreciate you. >> I'm not sure about my registration. It actually just expired on the 3rd. >> So, this is like yeah. >> I have a policy card. >> Okay. So, you just haven't put the new cards in? >> Yeah, I just haven't gotten it. They're I have them on my email. >> That's fine. I can take it on the I can take your insurance on the phone. Do you have the registration with you? >> Um, I thought I did, but it's in my old >> I could have sworn I just saw it in your hand. >> Did you? >> All right. So, while you're looking for that, if you go back through my body camera, I ask everyone the exact same questions. 17-year-old kids, 98-year-old grandmas. I ask everyone the exact same thing. All right. Any knives, guns, explosives, anything in the vehicle? >> No. >> No? Is there anything in the vehicle that's not supposed to be? >> No. >> No? Do you use marijuana? >> Um, I do. >> Okay. Have you smoked marijuana in this vehicle? >> Um >> I know it before you answer. I do not care about a little bit of weed. I can smell it. All right? Cuz over the perfume >> There's a joint. I have a joint in here, but I didn't smoke it in here. >> No one's in any trouble for a joint. All right? That's No one's in any trouble for a joint, okay? I can promise you that. All right? If that's all it is, then it is no big deal. All right? Um I appreciate your honesty, but it's just a joint. No methamphetamine, no cocaine. Do you have your prescription pills in the car? >> No, I don't. >> You don't? Okay. No problem at all. Um do you have the registration? I do still need to see that. >> Here it is. >> Appreciate you. Okay. So, I'm going to hand these two back to you. All right? Make sure that you get the insurance card updated, okay? Um and I'll be right back with you. Do me a favor. Um just stay in the vehicle. I know you you want to go to Walgreens, but just stay in the vehicle till we're done, okay? Easy search for weed. >> That's I just found some weed. >> Yeah. Um All right. I'm going to add her to the car real quick. I haven't ID'd the passenger yet. Um and then we're going to pull them out. All right? >> 333 >> I have my driver. If you could link a run her. Also, Milton PD is out with me. All right. What was your first name? >> Lana. >> Lana. Okay, Ms. Lana. So, I'm someone who I I like to explain things so people know what to expect, okay? So, I appreciate your honesty about the joint. I am going to take your joint from you. All right? Don't reach for it. I'll We'll get there. All right? But what's going to happen now is because you do have marijuana in the car, I'm going to have you step out. You're going to wait with this deputy uh this officer back here. I'm going to have your passenger step out. He's going to She's going to wait with the deputy back there. >> I actually don't have marijuana in the car. >> You told me you did. >> No, I don't. It's not there. >> You told me it was in your hand. >> I did I left it in the porch. I don't have any marijuana. I thought I had a joint right there, but I don't I didn't I never said I'll ever bring >> Let me explain it to you a different way. The reason I asked you I asked you about marijuana is cuz I could smell it. I can still smell it. So, that's why I asked you about marijuana. You were honest >> 233 >> You were honest with me about it, and I appreciated that. >> Well, >> But, let me put it to you a different way. What is in this car that you don't want me to find? >> in this car. >> Cuz I'm searching it either way. So, what's in the car? >> There's nothing in my car. >> Okay, then you have nothing to worry about. I You told me you had weed. I smell marijuana. >> in the car. I thought there was a joint right here because we were sitting >> I'm going to have you step out and wait with this officer back here, please. Please and thank you. You This is a lawful order. It's not a question. It's a lawful order. It's not a question. Step out of the car, please. >> You're not allowed to search my vehicle. >> I have probable cause to search your vehicle. >> cause. >> Step out of the vehicle, please. >> have probable cause. >> Do it now, please. >> You're not allowed to search my vehicle. >> Ma'am, step out of the vehicle. >> If you do not step out of the vehicle right now, I'm going to take you out of the vehicle. >> Okay. >> It is that It is that simple. >> car at all. >> Then you have nothing to worry about. Step back with this officer back here, please. 233, go ahead and start me another normal. Okay. So, I asked you about marijuana. >> I >> And I said to you on camera, recorded, that over the smell of the perfume, I could smell it. And then you said, "Well, I do have a joint here." >> And you could smell it. She really thought that there was a joint left in the side the >> But, what I'm trying to explain to you, just so you understand, is that the smell alone is enough for me to >> just trying to be honest. >> And and I'm totally cool with that. But, I'm just explaining to you that the smell alone is enough for me to search that car. Okay? So, I ask you again, is anything in that car that's going to get you in trouble? >> No, there's nothing. >> I ask this on a more important note. Is there anything in there that is going to poke me, stick me, or hurt me in any way? If I get stuck with a needle, I'm going to be pissed. >> That's ridiculous. >> It's not ridiculous. It's something that I've seen. >> job, but no. >> Yeah, well, I don't >> Okay, well, I don't give you permission to search my vehicle. >> You don't I don't need your permission. >> Yeah, you do. >> No, you don't. >> Yes, you do. Yes, you do need my permission because you have >> You want to explain probable cause to them? >> No, it's not probable cause. There's nothing There's no >> I've tried three times to explain it to you. I'm I'm searching that vehicle. >> You're not I'm not giving No, marijuana is not cuz I have a medical card anyway, but there's no marijuana in my car and you don't have permission to search my vehicle. >> Okay, I don't need it. >> You do need it. >> I don't need it. >> Okay, well, I'm not going to search my vehicle. >> So, >> marijuana in the car to be honest with you because I thought that I put it in my car because I was sitting there >> And I appreciate And I appreciated your honesty. >> And there's not any marijuana in my car. That's the problem. >> So, if there's nothing in your car, what's the issue? >> Because you're violating my rights. >> If you have a problem with anything I've done, I will give you my business card and that my sergeant will review the body camera. >> I'll call Chad right now. >> Chad's a personal friend. Call him. >> You're not Yeah, you're not >> I am. >> right. No, because I got pulled over before and they searched my vehicle. I had nothing on me. >> Okay. >> a whole bunch of cops. And >> Yeah, 10-4. You want to do your thing? I got it. >> No, you're not >> going to We're going to hold on for a second cuz either way, I have PC to search this car right now. >> I don't have PC in my car. >> Hold on. Hold on. Hold on. >> But I do have a camera in my car. >> That's great. >> You're being ugly for no reason. >> I have been nothing but polite to you. >> You're pulling me out of my vehicle when I need to be at home. >> You just pulled into a Walgreens CVS. >> I know because I'm getting cleaning supplies. I own a cleaning company and I'm I work >> we can we can remove you from the vehicle for our safety, right? It's called Pennsylvania versus Mimms. It's case law. We can pull you out of the car. We have the authority We can do that. It's all lawful. >> For what? >> For any reason. >> What do you mean? >> We can pull you We can ask you to step out of your car for any reason. >> that and I don't >> I'm not going to I'm not going to stand here and have court on the side of the road. >> you to work. >> All right? You're going to sit on that bumper. You're not going to move from the bumper. >> I need to get my phone, please. >> You're not grabbing your phone right now. All right? Don't go Don't go near that car. >> I'm not trying to do anything. >> You're You're good. I'm letting you know don't go near that car. >> to search my vehicle. >> I don't need it. >> Yes, you do because I've done nothing wrong. I've done absolutely nothing wrong. >> So, we're just waiting for another deputy to get here just so cuz there's two of them and one of you. >> Okay. >> I don't know if you just heard me or not, but I asked you to sit on that bumper and stay there. Thank you. So, what I just told him is that we are just waiting for another deputy to get here because there's two of you and one of him. That's the only reason why. All right? Copacetic? Cool. >> Do you have your medical card with you? Your Remember what I told you? >> It's expired. I have the >> Okay. >> Yeah, the It expired actually on the 3rd. >> All right. So, last chance. I'm searching the car. Is anything in it? >> There's nothing in my >> Cool beans. >> You're not I don't give you permission >> I don't need it. >> Yes, you do. You're violating my rights. >> Then, file a complaint that someone will review the body camera and you'll be fine. >> The search is where this case gets complicated. The deputy invoked marijuana odor as probable cause, citing State v. Betts, the Florida Supreme Court's 2002 decision holding that odor alone authorizes a warrantless vehicle search. The problem is Amendment 3 in November 2024, which legalized adult recreational marijuana possession up to 3 oz in Florida. Since then, marijuana odor no longer necessarily signals illegal activity, and circuit courts have begun challenging whether Betts still controls. No Florida Supreme Court ruling has settled this post-amendment 3. Betts is technically still on the books, but any competent defense attorney will move to suppress on that exact argument. If that motion succeeds, everything found inside goes with it. The second issue is the exit order. Under Pennsylvania v. Mimms, 1977, officers have clear authority to order any driver out during a lawful stop. No additional justification required. Refusing is not a protected >> act. >> It is a separate criminal offense. That offense is resisting an officer without violence under Florida statute section 843.02. The refusal did not stop the search or create any suppression grounds. It added one more charge that otherwise would not have existed. >> So, now you can put the cigarette down, turn around, put your hands behind your back. >> What did I do? >> do it right now. >> What did I do? >> Drop the cigarette. >> What did I do? >> What are those white crystals on your driver seat? >> Um I have no idea. >> Mhm. You're not under arrest right now, you're detained. Sit back here. Put your butt on the bumper. Can you read her, please? >> Yep. >> Just give it. >> Yeah, I got them. >> Important. >> Yep. >> Good forks. It's really good meth. >> Ugh, I don't know. I don't know which. >> I'm going to say. You want to speak with us? It's a yes or no question. >> Yes or no. What do I do? >> It's a personal yes or no question. It is a personal yes or no question. Do you want to speak with us or not? >> What do you want to talk about? >> It's It's not like that. It's a yes or no question. >> I don't want to go to jail. >> Nothing is decided yet. I'm going to test these, but before I talk to you, I need to know whether you want to speak with me or not. >> Do you want a lawyer or do you want to remain silent? Yes or no? >> Yes. I I don't mind >> I'm going to ask you one more time, and if you don't give me a yes or no, I'm going to take >> with you. >> You what? >> I don't mind speaking with you. I don't >> I'm going to take the I'm going to take that as a yes, then. What are these? >> Um It looks like methamphetamine. >> It does look like methamphetamine. I appreciate your honesty. Thank you. So, how much more meth am I going to find in the car? >> I don't know. >> Appreciate that honesty, too. >> I was asking her to put her purse on the trunk. Um You find narcotics in the vehicle. >> Mhm. >> So, she was in the vehicle with her purse, correct? >> Yep. >> So, put my purse in the car? >> Isn't it I mean, I don't know. It's mine I'm This is not my car. It's not my personal whatever. >> Yes, but you were in the car where narcotics was found. >> So, you assume >> Oh my god. >> It's just what it is. >> Okay, that's fine. You can put it on the >> Just give it to Deputy Auto here. >> Okay. You have nothing >> Um for sure. >> All right. So, she was sitting Is that a roach? >> Yeah. >> Okay. >> I knew why I smelled the pot, man. >> I don't know. >> And an open container. >> Yeah, that's what we need, too. Um >> Here. >> Here's one driver's license. Here's an ID card for someone else, Jeffrey. Um she only had these prescription pills and >> Are they prescribed to her? Can you copy two? One by Florida DL, one by Florida ID. >> Yeah, ti- Tiffany >> Yeah. I'm pretty sure that the reason that they're on the seat is cuz they tucked them down the front of their pants. >> did. >> Yeah. Well, I got enough to 10-15 both of them, so. >> It's simple. I haven't searched anything right here. >> I did this door so far. >> Okay. >> Um but if you want to hop in, I I haven't touched the glove box yet. >> Um I think it's PR I don't know what they >> I don't know. If they do >> I wouldn't doubt like 100% they got stuff. >> Oh, yeah, 100%. >> Damn. >> Click, click. Click, click. >> Okay. I know you heard Officer Oldfield read her Miranda, okay? But it's an individual thing, all right? So, I'm going to reread these to you and then ask you the same question at the end. >> Okay, that's fine. >> Okay. You have the right to remain silent. Do you understand these rights as I've explained them to you? >> Yes, I understand them. >> Having these rights in mind, are you willing to speak with me? >> I mean >> It's a yes or no. >> Yeah, you can ask me questions. I'm not worried about myself. >> So, between the two of you, all right, I have three meth shards that presumptive meth shards that are found on underneath where you were sitting, and I have two underneath where you were sitting. >> Where is it? >> Okay. >> Shards underneath where I'm sitting? >> Yes, on the seat. >> That's not me. That's not on the seat. >> Yes, that's the one from the front seat. Oh, okay. So, here's here's Both both of you. Hold on a second. So, can you kill my take downs, please? Um Stop. Just stop for a second. All right. Here's here's what I think I'm like 80% sure is going on. All right. Y'all saw me get behind you, all right, which, believe it or not, is what I think changed your driving pattern to the point where I thought you were honestly intoxicated. So, are you You were driving. Honestly intoxicated. That's why I I pulled you over to begin with. All right. I think that while I was behind you, you were shoving meth down your pants, thinking that your females and that we're not going to be able to >> Don't you have gloves on? >> Hey, whose chip bag is this? >> Stuffed in between the center console and the passenger seat. >> Whose bag of Ruffles is it? >> I have a Mountain Dew and nothing to eat. I've been drinking alcohol. >> So, you're saying it's hers? >> I'm not saying it's anybody's. I'm saying that's not mine. I just got in the car and rode with her. >> Okay. >> Got it. >> Oh, that's my son's and my daughter's ashes. >> Okay. No problem. We're not We're not We're going to be respectful with it. So, I retract my previous statement. You didn't shove it down your pants, you shoved it in her [ __ ] bag. Copacetic. Um You're both going for methamphetamine possession. All right? When you get to the jail, you're going to be Stop. When you get to the jail, we'll Stop. When you get to the jail, you're going to go through a body scanner. You're good. When you both get to the jail, you're going to go through a body scanner. Okay? The body scanner is going to be a giant x-ray. And if you have anything on you that you are not telling me about now, it's an additional felony. A misdemeanor in the streets is a felony in the sheets. Okay? Have we separated out the chips? >> So, she's saying it's not her She So, it's not her chips, but it's her car. So, it's not her chips and it's not your chips either. So, there's just a bag of meth. >> I just got in the car. We were eating cookies. I have The only thing I have to eat is cookies trying to absorb some of my alcohol. >> That's not how that works, just for It's not how it works. >> That's not how that works at all. Deputy Carey, I'm going to solve this real quick. You're both under arrest for PLC. Hey, LT, how you doing? I'm sweaty. You want to see something cool? >> Yeah, I'm at 233. >> Huh. >> Yeah. >> That's a pretty good size rock. >> Yeah, and they They have Nobody held it out there. >> I did not know they sold them >> [laughter] >> Uh I think it's Lace. I think so. >> Wish you didn't dump it in a drink or something. >> I would charge her with the entire weight of the drink. >> That's what you do. You You just made meth all over your shirt. >> Yeah. >> [laughter] >> Well, I mean >> There might be a few little chip crumbs mixed in here with them. >> It'll be all right. After you eat it, you'll know the difference. >> I'll I'll get back two different test results. >> Inconclusive on one. >> [laughter] >> Cheddar sour cream. Sour cream and onion flavored or cheddar and sour cream flavored Mountain That's That's That's one I'm not Blana, you and I are going to have a conversation. Let's go. I'm going to use your car, old Phil. All right, he's over there. Lean on the push bumper right here. Okay. So, now that we know we're caught, right? Talk me through it. From when I got behind you where was the meth when I got behind you to where it ended up in the rough with the bag? >> I don't I don't know about the [ __ ] that was in there. I don't know where it was at. >> I thought you said the that the meth was yours. >> It I cuz I don't know what's in the car. I've had so many people in the car. I just got back from Vegas. Like I haven't even cleaned my car out yet. I just got back and I >> I would like you to know that is close to $300 worth of meth, maybe more. >> I don't know. I don't know. I had cookies. I don't know where where it is. >> 233 worth of tampon. Okay. So, if >> But if it was in the seat >> Did you tell that officer that the meth was yours? >> Yeah, because I don't want her to get in trouble because I don't >> So, are you saying it because you don't want her to get in trouble or you saying it cuz it's true? >> Um It's true. >> Because it's true. So, you knew the meth was in the vehicle then? >> I don't >> Let's jump on the Right >> right now right now we're running alongside the truth train. I want to jump on the truth train. >> know about the bag. I don't know about the bag. >> Okay, so you don't know how the meth got in the bag. >> I don't. I don't have people. I don't know what's in it. I don't know what bag it >> Let me ask you this. Did the Ruffles bag, the Ruffles chip bag >> I get I mean I get that >> Miss Lana, you're already Miss Lana, you're already you're already caught. Just the truth the truth shall set you free. Okay, it's yours. How did it How did those those mesh shorts get in the bag and the chip bag? Cuz that's a hun- that I know for a fact when you bought that meth it was not in a chip bag. >> I guess it was thrown in there. >> By? >> Uh I'm not sure. I don't really know. I just don't want both of us to go to jail because I don't >> Miss Lana, the reason I'm asking you to tell me the truth right now is cuz you're both already going to jail. It's already done set. >> She didn't have anything to do with it. >> There was meth directly under where she was sitting and >> She didn't have anything. I just picked her up. She didn't have anything to do with it. I just picked her up. She didn't have anything to do with it. I just picked her up. She didn't have anything to do with it. >> At all. I just literally just >> Well, then you set your friend down a bad path. All right, because I have no way of believing you right now. >> going She had I really I picked her up cuz she's going to help me with my house inspection. >> Okay. So I'll ask you again. How did the meth get in the bag? Because what I'm what I'm getting from this our little conversation here is that cuz I feel like if you threw the meth in the bag and the meth is yours, you would say, "Oh yeah, I threw the meth in the bag cuz there was a cop behind me and I wanted I didn't want to get caught with it." >> All right, there you go. I'll go >> Okay, but hold on. That's an example, all right? But from your initial statement to me "Oh, I don't know how that meth got in that bag." leads me to believe that you have threw it to her and said, "Hey, here tuck this in tuck this in that thing." >> how it got I don't know what you're talking about. I don't know about the bag. >> So, as of right now you're both going. All right? I just want you to know that. >> Do you have nothing >> Deputy Carey, if you would be so kind as to >> Can Can you >> I don't play I don't play the Chad Floyd thing. >> No, I'm just saying like can you >> Can I what? Let you go? >> No. >> With a with a with a almost close to trafficking amount of methamphetamine in a neighborhood that's already struggling? You want me to let you go? >> I don't know. I I have a lot going on right now. I do and I know >> Deputy Carey, do you have a lot going on right now? >> I just >> Yep. >> I had just had surgery. My daughter broke her foot. I just got back. I I have cancer. >> I'm close to $20,000 in medical debt right now. >> I'm sorry. >> I'm not out here driving around with meth. >> Does she admit to that? >> She's She's back and forth on it. >> No, I don't know where the I don't know where it came from. >> See? >> No, I don't know what he's talking about. I don't know what bag he's talking about. >> Please put your foot on the bumper. Thank you. >> I What was in the seat? I >> You want your sheet? >> No, I don't know what the >> She's been right there if you want to try it on the ground. >> So you don't know about the meth in the car is what you're saying? >> Okay. So right now, what's your first name? >> Tiffany. >> Tiffany. Right now, I swear we've met before. >> I don't know. >> Your dad is? >> I'm just kidding. I love my daddy. It's David but it's been a little controversial in the last few days or few months. It's been a little controversial. >> after. Um So right now, Ms. Tiffany, we are running alongside the truth train. All right? The truth train is right beside us, but I want to jump on it. Okay? Truth train. So >> All right. >> what happened in that car? Cuz that meth was not in that Ruffles bag. >> I don't know what happened. What do you mean what happened in the car? >> How did the meth get in the bag? >> I don't know. >> How did the meth How did the meth get in the bag and then tucked directly next to your seat? >> I just got in my seat. >> Okay. >> Which is her seat in her car. I just got picked up because I wanted her to pick me up. >> Mhm. >> I don't know what to tell you about the message bag and the chip bag and the whatever bag. >> Okay. >> I did not get in the car until just a minute ago and I literally just was taking a ride with her. I had to get out of the house. You don't >> Where were you going? >> What? >> you going? >> Just get the hell out of my house. >> Just to get the hell out of your house? >> Yes, I just went through a breakup bad. >> Okay. >> So, I don't know what to say. I had her pick me up. I've been at my mom's, I've been at my daughter's. I needed a break, I needed her to come and get me. >> Okay. >> She just picked me up. I just got in the car and then >> Where do you stay at? >> I stay over in Milton. >> Where in Milton? Where in >> East Milton, but I'm not staying there. I was at my mother's house. >> Over on North Airport? >> No, I stay on North Airport. >> You stay on North Airport? >> Yes, usually, but I haven't been there in a week. >> Okay. >> I just left there and I've been at my mom's and my daughter's. >> So, where was she picking you up from? >> My mom's house. >> Which is where? >> In Pace. >> In Pace? >> Yeah. >> Okay. So, when I got behind you on Berryhill, where were you coming from? >> The house on Berryhill you pulled up behind us on. The house right on Berryhill Road, right across from >> Ms. Tiffany, I mean no disrespect. You're making my head hurt. I'm >> Berryhill's what pretty much road. >> I'm done with it. I'm done. No, I didn't. Try again. Oh, okay. Yep. See, now that makes sense. My head doesn't hurt anymore. >> It doesn't matter. I don't know her. That's her friend. That's why I stayed in the car. She went inside and talked to her. >> Talk to her? >> Yeah, she just got back from Vegas. She brought her something and went inside. I stayed in the car and then we left. >> Scarlet something? >> Yeah. She just brought her something from Vegas. She had a bag, a gift bag. She said we have to stop by Scarlet's and then give her something and I said, "Where is that at?" She told me where it was and so we went there first. It's because she's the one involved in whatever the she's got going on. I just got in the car. >> going back and forth saying that it's yours, saying that it's hers, saying that it's her yours, saying that it's hers. >> She just picked me up and I was just going to ride with her. I needed to get out of the house. I can't do this. It's not my >> So, what happened in the car? >> Nothing happened in the car. >> Nothing happened in the car. She didn't hand you the math and say tuck this. You didn't see her grab that bag and tuck it. >> I am looking at her do a lot of things. >> Start listing them. >> Just putting it all around on the floor. She's putting it on her on her in her seat. She's putting her seat belt on. All of that. >> Okay. Did she tuck anything? Did you see her put some in her bra? >> I saw her tuck things around all over her seat and I said, "What are you doing?" And she's like, "We're fixing to get pulled over." She knew for sure. >> Yeah. >> Over. So, I don't know what she was tucking. I don't know what she was doing. It's not >> Uh if you don't mind. Cuz I'm going to I'm going to I'm going >> she has something going on, then she needs to own it. >> Okay. >> That's not even cool. >> Okay. >> I'm not taking a rap for somebody >> Drew, hold on for 1 second. >> You talk to me. Be honest. >> I am being honest. >> her tuck something in her bra? >> I don't know about her bra. I She was grabbing, tucking, and pushing things everywhere. >> Start listing places. Slow down, take a breath, visualize it. >> of her seats. >> Sides of her seats. >> Yeah. Around the seat. She was putting stuff in the seat. She was putting stuff in the console. She was opening the the glove box and putting clothes in it back. She was freaking out. >> Okay. Okay. And at what point did you see the Ruffles bag? That Ruffles bag. >> I don't know. She had it wadded up in her lap. >> And then she put it where? >> I don't know. >> Do you know where Did I have I told you where we found it? >> it by my seat. >> I know. That's what I was trying to tell you. >> Thank you. >> I asked earlier. Is it what? More meth or is it glass? Okay. >> I'm telling you the truth. I don't know what she took. I just know she took. I'm telling you she took. I don't know what she took. She wouldn't tell me. >> Okay. >> Did you go through my [ __ ] anything yourself? >> No, I didn't. I swear to god. I don't have anything tucked at all. I I will consent to search. I do not care. I'll wait for somebody to come and search me. I don't have anything tucked in my I don't have anything tucked in my bra. I'll shake my bra out. I don't care. And since when can't y'all search us? >> We can. We choose not to because as females and we're males, it doesn't never looks good. So, usually we try to have a female deputy or a female officer come and do that so that there's no impropriety. >> so they know that you don't have anything tucked. It's kind of one of those things. You know what I mean? >> Okay. I know. So, I cannot give you any legal advice, all right? But tonight you're going. >> Why am I going for her drugs? This is not okay. >> I don't have another choice here. >> Why? If she had a bag and she tucked a bag >> No, we're not. Go with him. >> Glenda, what are you doing to me? >> Stop talking to her. Stop talking to her. And then 2 seconds later she's going to say I have no idea what meth you're talking about. >> She's not telling She's telling you the truth. I didn't. >> You're going to >> She had her bag. She had her stuff. She tucked her stuff down where she needed to do it in her car. >> You're going to go through a scanner. You don't have anything on you? >> No, I swear to god. And this is not my stuff. That's not fair. This is her car. It's her drugs. It's her stuff. >> Only the only thing I can >> had it tucked. >> thing I can do right now is suggest you have better friends in the future. You better step back over here because >> this. She said she's got it tucked. It was her stuff. Her deal. Her things. Her stuff. She said that to you. >> seat. >> WHAT IN THE HELL? WHY DID YOU SAY THAT AND THAT'S NOT >> It's all over her shirt. And she said it was all over her shirt this entire time. >> [laughter] >> I'll do it yourself in the front. >> All right, I appreciate it. >> I she's already loaded up and she's pissy. God sent, man. >> The third issue is Miranda. Both subjects were individually advised of their rights under Miranda v. Arizona 1966 and both waived. What they said after that waiver is the most consequential set of decisions either person made in this encounter. The driver's account changed multiple times. She denied knowledge, then identified the methamphetamine on camera, then claimed ownership to protect her passenger, then walked that back. She also estimated its street value near $300 approaching Florida's trafficking threshold under statute 893.135. Once you waive Miranda and speak, every word is potential evidence. Inconsistent statements do not cancel each other out. The ownership claim created consciousness of guilt evidence. The retraction replaced it with evidence of dishonesty. Neither provided any legal benefit. The passenger was arrested under Maryland v. Pringle 2003, which holds that contraband in a jointly accessible area gives probable cause to arrest all occupants. But her post-Miranda account described the driver tucking items around the car after spotting police and saying we're fixing to get pulled over. That statement goes directly to knowing possession and it is the evidentiary pivot of this case. Now the grades. Deputy Nate receives a B+. The stop is documented, Miranda is individually administered, and de-escalation holds throughout. The deduction is the Betts reliance without awareness of the Amendment 3 shift. That is a training gap and it puts every similar search at suppression risk. The driver receives a C. Refusing the exit order added a charge that did not need to exist. The post-Miranda statements were extensive, inconsistent, and self-destructive. The correct play was to exit the car, invoke the Fifth Amendment, and challenge the search at a suppression hearing where the Amendment 3 argument might actually have had traction. The passenger receives a B minus. She cooperated immediately, consented to a search, and gave a specific consistent account that credibly separates her from the driver's conduct. The deduction is speaking at length post-Miranda without counsel. Likely the right call here, but a risk taken without legal guidance. The Santa Rosa County Sheriff's Office receives a B. Coordination was solid, search protocols were followed, and the body cam record is complete. The institutional issue is the training gap on post-Amendment 3 probable cause standards. That is a department-level problem, not a one-officer failure. This stop produced five concrete lessons, each grounded in a decision made here, and each backed by a law that applies wherever you drive in the United States today. Lesson one, know what probable cause requires in your state right now. Marijuana odor alone may no longer be enough to authorize a search. In Florida, post-Amendment 3, that is a live suppression argument. Know it before you are ever in that seat. Lesson two, comply with the exit order. Under Mimms, you must step out when ordered during a lawful stop. Refusing adds a charge. It does not protect your rights. The place to fight an unlawful search is a suppression hearing, not the car window. Lesson three, Miranda is not a formality. Waving silence and then giving inconsistent statements across multiple officers builds the prosecution's case for free. If you are in custody and uncertain, say nothing and ask for a lawyer immediately. Lesson four, constructive possession requires knowledge and control, not just proximity. Being in a car where drugs are found does not make you automatically guilty. Document your lack of knowledge through an attorney, not through an unguided conversation with the officers who just arrested you. Lesson five, claiming ownership of contraband to protect someone then retracting it is the worst of both outcomes. A guilt admission goes on camera then gets replaced by evidence of dishonesty. You lose the loyalty play and your defense at the same time. Loyalty is not a legal strategy. If there is a stop or a legal topic you want us to break down, leave it in the comments.
