You got a gun in the car. >> Put your hands together. >> The stop was constitutionally valid. Under when versus US 1996. Any observable traffic violation authorizes a stop even if the officer's real interest is investigative. Window tint qualifies under Ohio Revised Code section 45132. Requesting the front passenger's identification was also lawful. A seat belt violation is an independent infraction under Ohio Revised Code section 4513263, giving officers separate authority to demand that occupant's identification. Rear passengers had stronger footing. Ohio has no blanket passenger identification law. Absent independent reasonable suspicion specific to that individual officers cannot compel a passenger to identify themselves as confirmed in Hyel versus 6th Judicial District Court 2004. One occupant alleged officers had deliberately waited for their car to move under when that claim carries no fourth amendment weight. A stop is constitutional so long as a real traffic violation exists. Oh, thank you. >> You guys got guns on you, too, >> man? What? >> That's another reason. >> Oh, I didn't. >> Well, there's an open bottle right between her legs. >> I'm legal, though. >> He got CCW. >> He's going to get arrested for a CCW. >> Oh, for what? >> What? >> Because you didn't tell us >> initially. I >> Right. >> It was, but I tried to tell you when I first You didn't try to tell me >> at all. At all. We ain't playing stupid games. You still going up there? >> Like, dang. Come on, man. I've been being cool the whole time. I'm trying to tell them that you didn't say a word. But what I'm saying is, you know, you got a gun in the car. Like, you said, "Hey, dude. A lot of times when we pull over a lot of people like that, they they tell people where they're at and then a bunch of people come and get involved that don't need involved. That's why we take the phone. >> I need to go. >> We'll get you out of here in a second. >> Well, ain't even no curb I can sit on cuz I'm getting [ __ ] draw. >> Can I get some lip gloss in the car or >> Can he do it? He He said >> He said something to him in the car though. >> No. No. Yeah. When we No, he didn't say nothing. They He had opened his door and then the police rolled up to us. They rolled right up to us. They looked No. >> at the corner down there. They They rolled up on us. They looked in the car. They probably And then the thing is we you know that corner that's literally right there. >> They set one that car right there. Jesse's for you. >> Do it like that. >> Please don't do it like that. >> She came up with that, >> bro. Cuz he been [ __ ] with my sister, bro. He been [ __ ] with my sister. >> I'm not saying two words to your sister. I don't LIKE THAT [ __ ] STOP PLAYING WITH ME. All right. Please don't do it like that. wasn't even here on that cop. That was our surgeon over here. >> Can you touch me? I don't want to walk up on a I don't want y'all to do her like that. They always got her back. They are women. And then on top of y'all know how our women is like and our black women strong. They not, you feel me? They going to always have our back no matter who. If boys in blue, whatever they especially her, bro, she always got her back. That's how she is. She's not going, you feel me? Especially that's the same way I was trying to talk to him trying to figure out why I'm getting out the car. You know, she trying to figure out why the hell is y'all putting me in cuss and trying to figure That's all that was. I mean, she probably was being open with it, but she wasn't really being disorderly. Like, I mean, I can't say she wasn't cuz she was acting out, but I mean, damn. >> That's I mean, you can only get we can only warn somebody so many times. We told her over there like 10 times to relax. Just relax. Trying to talk to her. No, [ __ ] you. I don't want to talk to y I got that. >> She's an adult, man. >> She grown like she got kids to go home to and everything. >> What does that have to do with anything? You acting like because you got kids when you're a black female, you can't get >> No, I'm act I'm acting like that. We, me and you, us three, we mature. >> I get it. >> So, we should understand when somebody acting out sometimes they might not just be on our level, you know? >> I get it. But like if she would have just got out of the car and started acting up and she would have calmed down, that's fine. But once my sergeant's here and he's telling her how she even acting out and I'm sitting here trying to talk to her. >> Mhm. >> That's not That's not her problem. That's why I'm saying that's something she has to only here to help. Why why >> going on and they're interfering with what we're doing? That's why she >> Okay. But she don't got to go to jail, do she? >> Did I say she was going to jail? >> No. No. I'm asking though. I'm saying I don't know if she's going to jail or not. I can't I can't tell you. >> Can I talk to you, sir? And out of everybody out here, I don't know why I know your face. You mustn't be out alive. You just be out here. I just know your face. But uh we all say Yeah. Please with my cousin, please. Please. >> I'm going to talk to the guys whenever. But she's been cool now. So >> yeah, cuz she she just really always just got her back. I know. I couldn't get her to calm down cuz she got her back. She just >> No, I get it. >> That's how she is. >> But I get it. She got to go out and if you guys bless her, I really have a long talk with her and everything. Like, man, when we get in situation like that, y'all [ __ ] got to chill. Like, I'll talk to her and everything, please. >> We [ __ ] got >> No, not y'all. Hell no. Hell no. Hell no. I'm talking about her and her. They [ __ ] acting out. Just let me talk to you. Just give me that chance. And it'll be straight. Y'all never had them run into her. Like, they don't even be out here. They don't even come outside for us. Like, we got them out the house. They in this and she all they know is just being defensive about us. They don't, you know, and she she probably damn near don't even care to go to jail. I do. You feel me? So I just I just please, you know, just please >> give me give me a couple minutes and then I'll get with you. >> Okay. He I actually know him though. He said he walked up to me and said he know I don't know you. So I like where it was though. But I do know him. He actually is a cool offer. So they let they talked to me one time. They they got me right. So yeah. >> That's the thing. No one here is trying to escalate the situation. >> No, I know you guys like that. Y'all been cool. The dudes ain't saying nothing. >> Yeah. >> And you're saying but that's no excuse. >> Yeah. It's not. It's not. That's why I'm asking you know. >> I see. No. I I listen I understand where you're coming from. >> Yeah. Yeah. >> I got I got family that do the same. Obviously you don't do it now. >> You don't got to worry about it. But I got family that's the same exact way. I get it. I get it 100%. >> Yeah. Everybody got >> Yeah, I did. I was watching. I was trying to talk. >> Just calm down. Dennis Dennis. [ __ ] y'all. We don't want to talk to y'all. Y'all weird. This. Okay, that's fine. But going to be acting like that. You want to get >> I saw I saw and I appreciate you guys for not even escalating cuz I know I seen it. I'm like, "Wow, baby. Please stop." So I appreciate you guys listen extra paperwork for us if we do something you know we do something we just trying to calm down. >> He said that's extra paper. I must hate that [ __ ] paperwork. >> I'll be hearing that paperwork so bad. >> I'm not the one that handcuffed her. I didn't say two words to her. >> [ __ ] You ain't putting no cuffs on me. You need to leave. >> Say one word. Man, >> you need to leave. Why is he still here? >> Cuz your sister's in the back of my car. We'll get her out and let her go in one of their cars or something. Then >> there's a dog in the other one. Don't want to go in there. >> That dog better not bite me or I'm suing y'all for a free ticket. >> Let them let them conduct your business and then ask question. >> But this is for me to learn. This is for me to learn my rights. Okay. So, for the next time I get stopped and they try to just yank me out the car. Why the car? No. I'm saying y I'm saying just get out the car, you know, just walk up. Get out the car. What if I let the next officer do now I just don't now I'm a person. I don't know my right. This actually I be knowing my rights and stuff like that. What? Yeah. >> You grow up in acting. >> Yeah. Let me tell you something about us as a police department. Regardless of what you hear or what you think you hear, the Akran Police Department is one of the best police departments in the country when it comes to uses of force and citizen complaints. Which means we abide by the law more times than any other police department or most of other police departments in the country. Okay? Nobody that wears this patch, I can almost guarantee you is going to violate your rights for no reason. >> Okay? Now, outside of the city, I can't speak on that, but inside of the city, we got a lot of good dudes that wear this uniform that are just trying to do a good job, and they're going to treat you more fairly than probably most people will that wear any other uniform. Okay? So, I'll start with that. >> But, but I would be mad at myself if my lawyer sit there and look at me like, "Okay, so boom, boom, boom." And you like, "Well, >> you got a case to worry about a lawyer." >> No. Yes, I do. He knows. But >> not now. >> Yeah. Not today. >> Oh, yeah. Not today. Yeah. But I'm saying though, you know, I You'll just be mad though. You know, and then this where my next time I get stopped. What if I just let y'all pull me out? Then y'all not and y'all not teach me that like how basically I'm learning that you was basically still allowed to pull me out because of the tension or whatever. Like okay. No, actually I do need to know what was the reason for me allowed to be getting out the car. They said they smell marijuana or something. >> Soon as we smell marijuana in the car, >> I don't know how y'all smell marijuana in there. >> Oh. Oh [ __ ] I ain't see it. I ain't know. >> And you see Officer Ray here. If we didn't smell it, his puppy's going to smell it. >> Oh wow. Okay. Have the dogs ready? >> Yeah. Well, we we don't get them ready, but they're just around. >> Yeah, they in there. Yeah. So, uh here's my what I'm going to say to you. >> I'm going to let her go. No, she can walk with you. >> As long as you promise me next time, you'll be a little more cooperative with that. >> I promise. And I'm about to talk to her. She's going to be more powerful, too. >> Now, I'm a sergeant. So, if you got a guy that wears this patch that feels like treated you like an [ __ ] you call me and I will handle that. >> And I asked Sergeant B. >> Yes. >> I was like, but if you got like these guys or some other dudes where you feel like, all right, they're not being an [ __ ] They're trying to do their job. Just just comply. >> I'm a both side person. I was that's what I was seeing. I was seeing y'all was doing your job and [ __ ] but I just be want to learn what learn. I be trying to learn off my expenses, but I ain't I don't take classes. So, I'm just trying to learn off my experience with the police. >> You taking >> He's cool. I hope I hope that I get to talk to him again in the future. You're flexible, by the way. >> You should be a dancer or something. You just had it all your >> That's why you do that. You know it. >> Are you all right? >> No, don't drink it. >> I don't [ __ ] with you. I do not tell it to be with >> I don't [ __ ] with them. Get you something. I do not [ __ ] with them. Especially your gay ass. >> When the driver was ordered out and asked for a reason, officers had no legal obligation to explain. Pennsylvania versus Mims, 1977 established that ordering a driver from a stopped vehicle requires no individualized justification. Maryland versus Wilson 1997 extended that authority to passengers. Once a lawful exit order is issued, sustained physical refusal is not protected conduct. Under Ohio Revised Code section 292131, it becomes obstructing official business. Officers cited the odor of marijuana as probable cause for the vehicle search. Ohio courts have held consistently in state versus more and since that marijuana odor alone is sufficient for a warrantless vehicle search, a large bag was also visible in plain view. Under Coolage versus New Hampshire, 1971 evidence immediately apparent during a lawful encounter may be seized without a warrant. Combined with the odor, officers had layered probable cause. Ohio Revised Code section 292312 subsection 9 requires any CHL holder stopped by law enforcement to promptly notify the officer of the firearm. Promptly means at first contact before any commands are issued. Failure to provide that immediate notification is a first-degree misdemeanor in Ohio, regardless of whether the license is valid. The duty is unconditional. No exception exists for not being given an opening. A second firearm was recovered from the trunk. Under Graham versus Connor, 1989, any force applied must be objectively reasonable from the perspective of an officer on the scene at that moment. One officer seized an occupant's phone to prevent a crowd from gathering. Riley versus California 2014 held cell phones require a warrant to search. Seizing a phone to block calls raises unresolved first and fourth amendment concerns. Obstruction under Ohio Revised Code section 292131 requires purposeful conduct designed to impede an officer performing lawful duties. Verbal objection alone does not meet that standard. Sustained physical refusal of a lawful exit order does. No court records for this incident were located at time of analysis. Probable charges include obstructing official business failure to notify under the CHL statute and marijuana possession. The Akran officers receive a B minus. The stop was lawful and positioning was sound. They lose ground for the phone seizure and for failing to communicate probable cause early which extended an avoidable standoff. The driver receives a C plus. He understood passenger identification rights. However, failing to immediately disclose a concealed firearm under Ohio Revised Code section 292312 created criminal exposure entirely of his own making. The female passenger receives a C. Her initial refusal to provide identification was legally defensible. Once probable cause was established, continued physical resistance crossed into conduct that justified detention. Her release came through discretion, not legal. Right. The Akran Police Department receives a B. The sergeant's deescalation and discretionary release of the female occupant reflected sound judgment. Training gaps around cell phone, seizure law, and early communication of probable cause account for the lower mark. This encounter produced five lessons that apply to anyone driving or riding in Ohio or in states with comparable statutes. Lesson one, if you carry a firearm under a CHL, your first words in any stop must include that disclosure. Ohio law provides no grace. Period. Lesson two, Ohio passengers are not required to identify themselves without individualized suspicion. That protection only works if you know it before the stop, not during it. Lesson three, verbal objection is protected speech. Physically refusing a lawful exit order is not. That line is the difference between protected conduct and an arrest charge. Lesson four. In Ohio, marijuana odor gives officers warrant-free authority to search the entire vehicle. If that risk exists in the car, probable cause is established the moment it is detected. Lesson five, supervisory discretion is not a legal right. Relying on goodwill instead of compliance produces an unpredictable outcome every time.
