Don't say [ __ ] to me. Don't touch me, and don't say [ __ ] to me. I'M NOT PLAYING WITH Y'ALL. >> WE HAVE AN INVESTIGATION HERE. >> STOP TALKING TO ME. I DON'T GIVE A [ __ ] >> STOP. >> [ __ ] YOU TOO, TALK. >> STOP. >> STOP TALKING TO [screaming] ME. >> HELL. >> [ __ ] Y'ALL, GIRL. [ __ ] I DIDN'T COME HERE FOR YOU. >> ON NOVEMBER 23RD, 2023, officers responded to a domestic violence call in the Cleveland metropolitan area, Ohio. Two individuals were arrested. This analysis covers only the legal framework. >> Guys, 290. So, I'll come back in a little while. >> All right. Um where did this happen at? >> At my sister's house. >> Okay. Where is that? >> Like three or four houses over. >> On Green? >> Yeah, the address is um >> She said no for medics. >> Address is 2647 Green. Me and my family had some words. >> Are you What is injured? >> Just my head. I'm okay. I'm okay. >> bleeding or anything from anywhere? >> No. >> Okay. >> Just got a little bump. >> Okay. >> Me and my family had some words. We exchanged words. And all of a sudden it turned physical with my brother's fiance. And she ended up putting her hands on me, and then it turned physical with my blood sister. I mean, her name is Laquisha O'Neal. And then it was basically like they was attacking me back and forth. And then everybody around them was laughing. I just walked out of the house. >> Whose house is this? >> My sister's. >> [laughter] >> So, it's between your your future sister-in-law, and then your blood sister? >> Yeah. >> You what? >> I just came out to the car. The moment is so irritating. >> Yeah. Do you want to describe in more detail what assault happened or how the fighting >> We got to get into it. We got to fight back and forth. >> Well, yeah, explain that. Explain that in in detail. You you're you're arguing with them or >> Arguing back and forth. >> What started the Start from the Start from the very beginning. >> So, we in the living room. I'm having a couple drinks. Remind you, I'm like the black sheep of the family. So, even if I pick up a couple liquor or wine, they always have something to say about it. That's absolutely correct, babe. Right. So, already I'm say- I'm telling them like, you know, I'm fine. I haven't had that many cups of liquor. I'm totally okay. And then all of a sudden, it's them in the in the kitchen talking about me. Saying, you know, bad negative things about me. And I just tell my brother and my brother playing around, I just tell them like, "Hey, you just think that's funny? Hey, you a bitch." Like that. He called me a [ __ ] back. We laughing back and forth. We chit-chatting. His fiance, remind you they have things going on in their relationship. She come up to me. She said, "Don't call him that. That's not his name. This is supposed to be your oldest brother. It's this, that, and the third." She's like, "I'm tired of you, man. You always have something negative to say about someone." And that's when I got to scooting back to the room. I said, >> You got to scooting back to the >> Going like walking myself back towards the room. >> Now, when you're saying you're doing this, you're not touching them. You're just touching them. >> at all. I didn't touch them. >> Okay. >> So, I said, "I don't have nothing to do with that. That's not nothing. You just want to get in and intervene in what we have going on. So, she like, "No, I'm tired of you." And I said, "Okay, well, I'm tired of you." Like, we just get going back and forth at this point. And then, all I know she hit me, and then we just hit each other back and forth. And then, my sister, my actual sister >> So, let's focus on you said she hit you. >> Okay. We were fighting back and forth. >> With a open hand, with a fist, what were at? >> In my face. They all hit me in my face. Then, my sister jumped in. She gets to hit me in my face. No, I don't care to talk to nobody at all. I don't want nobody near my corner at all. >> Do you know who is that? >> That's my little sister. I don't care to have the conversation with nobody at all. >> of these people you were fighting with. >> Huh? >> She wasn't either of the people. >> No. But she saw everything >> I wasn't there, and I don't know who done what. That's why I'm just trying to >> Let me just say, I don't mean no disrespect to you. >> No. I didn't I didn't take it that way. I was just trying to get Yeah. >> I'm sorry. We just They saw everything happen. Every Everybody thought it was funny. And then, all of a sudden, I called police, and I'm serious about everything, everybody want to justify. Justify. No. My blood sister, she hit she hit me in the face. Both of them since That's what Got me just not right here. >> Okay. So, you said the the sister-in-law hit you first, and then >> Yeah, and my >> your blood sister just jumped in. She wasn't involved in any of that. >> No, she wasn't involved in that first. >> Were you How have you been arguing with her? Why did she jump in? >> at all. We wasn't arguing at first. She want to get hostile because of her. >> All right. I'm Now, domestic violence, okay. >> Ohio Revised Code Section 2919.25 defines domestic violence as knowingly causing physical harm to a family or household member. Or Section 2935.032 goes further. Once visible injuries are documented and probable cause is established, mandatory arrest applies. Officer discretion is eliminated by statute. This is not a judgment call. The officer's statement on camera by the letter of the law we have to book her today is a legally accurate application of Ohio's domestic violence arrest mandate. >> Mhm. >> So, we have to document the incident at the very least. What what would you like to see done here today? >> I want to press charges against all of them in there. >> Well, it would only be people involved in the fight, okay? >> and them, too. >> What Now, what is their version going to be? >> Whatever their version is. You know, I got my version and my proof who I was on the phone with. >> Who were you on the phone with? >> screen recording everything, yes. >> Who were you on the phone with? >> I was on the phone with my boyfriend and I was on the phone with my friend that was screen recording everything. >> Two of them? >> Yep. Two of them. >> Were they in there together? Oh, you had a group chat. >> was on the phone. >> Okay. Did they let you know if there's anything useful on that screen record? >> They told me they have a screen record of of everything how it all started and everything. >> Okay. Did Are they able to send that to you? >> Yeah, I can ask them to send it to you. >> Let me start getting your information here, too. We got more people showing up out here, so. You don't live there? >> No. >> Okay. >> I came out of my place here. >> What's your name, ma'am? >> Mykayla Ward. M y k a y l a l a. Last name Ward W A R D. >> All right. Social for you? Is this car registered in your name? >> Mhm. >> Okay. What's the phone number? All right. Who were you Who's your boyfriend? >> I got to do my name >> If he's going to be a witness to this, I got to know who he is. >> No, I ain't going to give it to you. >> What about the friend? >> I got to ask you how you spell her first and last name. One second. She nice. She probably >> You don't know what her name is? >> Carnaya, if I'm not mistaken. I just don't know her last name. >> Got you. And who was the sister-in-law? >> My um Jasmine. I don't know her last name. >> She white female, black female? >> Black. >> About how old do you think she is? >> 27, maybe 28. >> And that's whose fiance? >> My brother's um DeCarlo Henderson. >> Do you know his birthday by chance? >> No. >> Okay. And then the sister that was involved in the fight? >> Moesha Offield. >> How do you spell that? >> M O E S H A and then last name Offield O F I E L I E L D. >> O F I E >> L D. >> L D. How old is she? >> 25. >> Is this her house? >> Yeah. >> What was that address again? Do you have it? >> 2467, if I'm not mistaken. 2647. >> Do you have a phone number for her? >> Um 216-507- 3490. >> Okay. All right, I'm going to take some pictures of your injuries if that's all right. And you're still waiting on a text back with that video. >> Mhm. >> Okay. I'll be right back. >> Call history area. Call history. Who is that vehicle? Come back here. Check out that vehicle McKela Ward out of Cleveland. Got me. All right, do you mind standing it up for me? Are you Yeah, you're able to just pain, you're not feeling like dizzy or anything like that? >> Just pain. >> All right. Let's get you. That one did not have any flash on it. All right, try that again. Um yeah, I was able to flash with it on and off, so. Get a closer one. >> She want to splatter it all? >> She does not. Yeah, if you're able to point to the area that hurts, just so Yep, that's good. Do you have any injuries on your hands or anything? >> No. >> Flip them over. It's taking a second here. All right, she says she's she was FaceTiming somebody that um was doing recording the screen that has the whole incident on video, so she's texting them asking for him to send it to us. >> Um who did she say that did that? >> Um sister, blood sister. >> My blood sister is mine. What is your fiance? >> Okay. >> So, that's uh Moesha Offield and Jasmine. >> What does she want done? I'm sorry. >> She She would like to press charges um for either of those people. >> They This is other sister and brother. >> That's my younger sister. She only 17. >> I don't know what their names are. >> Darnasia Offield. I mean Darnasia Reed. >> What We're asking is that the brother whose fiance is involved? >> not. It's her younger brother. I already asked that. Apparently, he's 16, so not the not the brother with the fiance. >> Um while we're waiting for that video, I can get a a statement form for you to fill out, for you to write down um again, your version of it here. >> 62 B. >> Um and that'll be a a court document that we would uh put into the case and it'll go to court. It's like a sworn statement. You all right? >> Okay. >> Writing that? >> Yeah, that's fine. >> Under Terry versus Ohio 1968, officers may detain parties for a reasonable period while building probable cause. Here, officers heard both sides, photographed injuries, collected witness identities, and requested FaceTime recordings before making any arrest determination. This satisfies the Fourth Amendment's reasonableness standard for a pre-arrest domestic violence investigation. >> No, she did. Did you hear back from anybody? >> No. >> I'm going to go find my extra pair of pants here. >> I already I already told my sister. >> Okay. I'm on the phone with my mom. I guess I'll give you this. All right. Now, I got to talk to both sides here and try to come up with whatever one is is able to have the most evidence and make the most sense to us. So, I I'm going to go talk to the other side here. We'll try to get a better understanding, but if you have video of the incident, that would be the best possible thing. So. >> Pat was going to head over to the house. Did you want me to go with her? Did you want >> me to go with him? >> Um whichever. Yeah, I guess if you stay with her, I've already heard her story, so I'll go go with them. Um and if she gets that video, if it's able to give us any >> She should be able to give you a rundown as to what >> Henry Roberts >> Her sister called her and said to, so walk my car here. >> [ __ ] there's dog crap in there. >> I already stepped in it once on the other side. >> thinking I'm safe, you know. >> Well, she >> She's going to her friend. Hey Pat, just be aware there's dog crap in the front yard. I don't probably the back, too. There's dog crap in the yard. There's a bunch of dog crap in the front yard, which we all stepped in. Probably in the back, too. Just Is it? Uh Sarge is on the phone with somebody and waiting to see if I guess we can see her if they get smart and >> I don't know. They're advocating for these guys and they go and act like this. That scared me. Hey, is she wearing a hat like a knit cap? >> No, that's uh fiance. >> I know then. The female? >> Um that's this the brother's sister that's the brother's girlfriend has the hat on. >> Oh, okay. No, that's I can't find her. >> We're looking for She's got That's other sister. Those are the guys who left earlier. Other relatives. That's the guy who was telling us she's not here. WE HAVE AN INVESTIGATION >> [screaming] >> SISTER THE LEFT. YOU'RE ONLY GOING TO YELLING AND SCREAMING >> I GOT TO PEE. >> WE UNDERSTAND THAT, BUT YOU CAN'T WALK UP AND push police officers because you have to pee. I understand. >> YOU ALL SAW HER PEE ON HERSELF. WHY IS THE HALLWAY like that? What are you doing? >> Because she's fighting with us. >> Please, so I keep telling y'all pregnant get the [ __ ] off my leg. >> This is the most legally significant moment in the footage. Graham versus Connor 1989 establishes a three-factor test severity of the crime, immediate threat posed, and active resistance. O'Field was actively resisting a lawful arrest, the third factor is met. The crime is a misdemeanor, moderate severity, no weapon was present, the threat factor is low. Force was legally authorized given active resistance. However, once a pregnancy claim is verbally on record, most use of force policies require technique modification, avoid prone restraint, apply lateral control, and ensure post-arrest medical clearance. No visible modification was applied in this footage. This does not automatically constitute excessive force under Graham, but it creates a legitimate Fourth Amendment question central to any civil claim under 42 USC Section 1983. >> Y'all just slammed your stomach, so I'm complaining about that. >> When you walk up and push police officers and yell and scream like this, there's nothing else we can do. >> She's pregnant, she have to go. What are you all doing? >> That doesn't mean you can walk up and push police officers. >> But that's stupid as [ __ ] bro. >> On her part. All she had to do is open the door, have her come out, we would be gone. She may be out by now. Everybody keeps trying to take it to the extra level, getting more people in trouble. Yeah. Just do what we are asking you to do, and it will be handled. >> This is Laquisha, we need to talk to her. >> Yes. >> This is Laquisha. Can you come out and talk to us? >> Can we come in and talk to her? >> We can talk right here. >> All right. >> I already told you how it how it it needs to go. Stop talking. We can have a conversation right here. I'm not saying I'm not saying that's the thing though is we can't do conversation anymore. It's time to go. That's the only reason that's the only reason we're still here. We got to go. What What I was telling you how domestic violence has all these restrictions and rules. >> Right. Yeah, all these variables, right? >> From the information and evidence that we have she has visible injuries and >> How y'all know it came from me? >> Because both you and her said that, okay? >> I didn't say that came from >> So, I don't I'm not saying it's it's right, but by the letter of the law we have to take you and book you into the jail today, okay? We don't have any other thing I've I've used we've talked it over, but based on the evidence we have we we have no option to do anything else. Does she have any other domestic violence charges? Then she can be released. Moesha, but here's the deal. You don't step out here, you're going to go with us, get released. You're going to have a warrant for domestic violence regardless. We don't need to talk to her. >> This is my situation. Let me call somebody and I'll >> It's not that easy. When you're being arrested, you don't get to do it on your terms, unfortunately. We've been trying to be nice. We've been trying to be as cool as possible. Not kicking doors in. We don't We don't enjoy this, but this is what we have to do. So, come on out. We'll get it over as soon as quick as possible. >> Do you have anything on you you want to give to your >> No, take your phone. >> Let's start here, okay? Appreciate you being cooperative. >> Watch out for some dog crap out here. >> Why do y'all have to put in cuffs if she could get in the car? >> Because she's under arrest. It's the policy, okay? Yeah, she'll she'll get some cough. >> I'm saying I want the process like >> We have to fill out paperwork. >> What she going in for? >> She was yelling and screaming and pushed officers trying to get inside. >> You are dog me. They want to shut up Darnay. >> They trying to say I hit them. >> I'm chilling. My phone and my bracelet. >> Your bracelet is coming out, okay? >> Get the [ __ ] OFF MY PHONE, [ __ ] [ __ ] OUT OF HERE. >> You saw that, right? >> Yeah. Yeah, we got it on the camera. You got We got Moesha. >> Yeah. >> Okay. >> Yeah. >> Thanks. >> They trying to say that she [ __ ] hit me on it. >> The First Amendment protects verbal protest of police action. Under City of Houston versus Hill, 1987, citizens may criticize and question officers. This is constitutionally protected conduct. That protection ends at physical contact. When bystander Melissa pushed an officer during the arrest, she crossed from protected speech into criminal conduct. ORC Section 2921.33 prohibits physical resistance to an officer performing a lawful duty. ORC Section 2921.31 prohibits obstruction of official business. Both statutes apply here. Intent is not a defense. Concern for a family member does not alter the criminal classification of a physical act against a law enforcement officer. No court records or news coverage were located confirming case outcomes. The domestic violence arrest meets the statutory threshold under ORC 29.35.032. The obstruction charge against Melissa is corroborated on camera. Case status remains unknown at time of analysis. Responding officers be mandatory arrest protocol correctly applied. Victim interview injury documentation and evidence collection were thorough. Verbal de-escalation was maintained throughout most of the encounter. Deduction: No visible modification of restraint technique for a self-identified pregnant subject. Crowd perimeter control was insufficient as the scene grew, creating unnecessary officer safety exposure. Complainant Mikaela Ward B+. Reported promptly provided a consistent sequential account pursued witness video evidence, submitted a sworn statement, and removed herself from the scene reducing further escalation risk. Meisha Ofield C+. Refusing to exit voluntarily forced a more contested arrest than the mandatory statute required. Active resistance against a legally unavoidable arrest directly increased the physical risk to herself. Verbal protests were protected. Physical resistance was not. Bystander Melissa Day Physical contact with officers during a lawful arrest constitutes criminal conduct under ORC 29.21.33 and ORC 29.21.31. No constitutional protection covers physical interference with a lawful arrest regardless of relationship to the subject. Department B-. Officers demonstrated functional knowledge of domestic violence law. However, the absence of visible training on force modification for pregnant subjects and inadequate early crowd control reflect gaps requiring supervisory review. One in mandatory arrest jurisdictions, visible injuries plus probable cause remove all officer discretion. Resisting an arrest the law requires adds charges, it does not prevent the arrest. Two, a pregnancy claim on record changes the use of force calculus. Officers must document it, modify restraint technique where possible, and ensure post-arrest medical evaluation. Failure creates civil liability exposure even when the arrest is lawful. Three, verbal protest of police action is a First Amendment right. Physical interference is a criminal act. The line is not ambiguous. Crossing it results in independent charges entirely separate from the original incident. Four, emotional distress does not create a legal exception. Intervening physically to protect a family member during a lawful arrest produces two arrests instead of one and does nothing to change the outcome for the person being detained.
