So, it's time for them to check out. I knocked on the door to try to, you know, see if they were going to check out. I heard the baby, so I'm like, "Baby's not being taken care of the baby." Officers may enter without a warrant when there is an objectively reasonable basis to believe someone inside needs immediate assistance. One child at risk of falling from the bed. That threshold was met without question. Detention of the subjects was lawful under Terry versus Ohio 1968 reasonable articulable suspicion of criminal activity. Hotel records, housekeeping testimony, and Dobson's own prior presence at the front desk collectively established that suspicion. Before any questioning, the deputy correctly administered Miranda warnings required by Miranda versus Arizona 1966 prior to all custodial interrogation. Statements obtained without Miranda warnings are inadmissible. The deputy stopped Dobson mid-sentence, restarted, and completed the advisement. That discipline is constitutionally mandatory. When Dobson stated he intended to obtain a lawyer, he invoked his Sixth Amendment right to counsel. Under Edwards versus Arizona, 1981, all interrogation must cease at that moment, no exceptions. Any statement obtained after invocation, absent voluntary reinitiation by the suspect, may be suppressed. >> From between Well, I got that already. >> Hello. >> There you go. >> You been here? >> Yeah, so did you get the story yet? You want to You want to get that on that first? >> Yes. >> Okay, we got this batch to She's got a lab, yeah. Hour here. So we get here some of the staff were taking care of the babies. Uh walking >> Staff was already here taking care of the baby. >> One of the the young lady I'm with, and she walked in, she knocked on the door at 11:05. She heard a baby, but everyone's supposed to be out at 11:00. >> Okay. Hey, how are you? >> So, she said she thought, "Well, maybe they're getting everything packed up and getting ready to go." She went on down, said she'd come back. So, she came back at 11:15, knocked on the door again, still hears the baby, but nothing else. >> Okay. >> So, she unlocks the door, checks to see what's going on. Nobody else is here but the babies. The baby's about to fall off the bed right here. The other little one was under a pile of pillows on the other bed. downstairs to pay for another day. >> Uh-huh. >> He then goes across the street to the arcade. A little while later, she leaves and goes over there with her baby. >> Walk in the door, there's a guy playing games. >> So, you guys went over to the arcade? >> Oh, yeah. >> Yeah, they're they're they're both in jail. >> never cared, nothing. Let's get um when Pierce gets here, we need to call um DCF and all that. Okay. >> No, can you call please call my brother? >> Maybe. We can try that, but we got we got problems, man. Do you understand why you're being detained? >> No, sir. >> Okay, I'm going to read you your rights in order to speak with you, okay? What's your name, sir? >> Uh my name is Aaron Dobbs, sir. >> Okay. You have the right to remain silent. Do you understand that? You you Listen, I have to read I have to In order to speak with you, I have to read these rights to you. So, I need you to acknowledge you understand. Okay. You have the right to remain silent. Do you understand? >> Yes, sir. >> Anything you say can or will be used against you in a court of law. Do you understand? I don't care who the blame is on. I'm asking is that this Is that the case? >> Just put all the blame on me. I don't want to have nothing to happen to her. >> Okay, I'm not >> Or my kids. >> I understand. And I I'm not I'm not I'm not >> Please >> We can work on all that. I have to get I have to understand though what is going on. You can't just say blame everything on me and let's go home. So, you told her that let's go gamble. >> I didn't I didn't say nothing to nobody, sir. I I I >> So, how did you leave the room with the kids still in the room? You made a conscious decision to do that? You. I'm not talking about her. I'm talking about you. >> I'm not Look, I just want the blame on me cuz I don't want her to get in trouble. >> Okay. So, that's >> She don't I don't see don't deserve to be in jail. >> I understand. That still doesn't answer my question. >> She doesn't deserve to be in jail. Just >> Okay. Was there anybody that was supposed to be in the room to babysit the children? >> Look, I'm going to get a lawyer. >> Okay. >> They can check the cameras. >> Okay. >> The court charged child neglect under Florida statute section 827.03. The statute requires a caregiver's failure to supply adequate food, clothing, shelter, or medical care. Four elements were satisfied on scene. No formula, no diapers, insufficient clothing, infant at fall risk. Without resulting injury, the charge is a third-degree felony section 827.03 subsection 2B carrying a maximum of 5 years in state prison. Dobson's attempt to accept sole blame has no legal force. Criminal liability in neglect cases is not transferable. Both adults in custody of the children carry independent exposure. The deputy correctly refused the tactic and investigated both separately. Mandatory DCF notification under Florida statute section 39.201 was triggered immediately. This obligation is not discretionary. Failure to report constitutes a separate misdemeanor offense. >> You see what what all transpired who came and bought this stuff and everything. You know, I know what I did. You know, and >> What's your name, guy? >> My name is Aaron Noble. >> Spell it. >> A A R O B L E. Last name is N O B L E. >> Hold on. I got your car. My boss is going to send you all that. >> Okay. >> I don't know how they got here because I don't see outside. >> any cameras outside? >> There's only one. I don't know what that shows, but he um >> Is it shut off? >> Yeah, I'm sending right now >> Do we Does he Does he know how to None of you know how to pull those up? Like you guys got >> He only has access. Yeah, he's the only one that has access. >> Does he have access on his phone? Like he can send it to me? >> Yes. I believe so. >> a way to talk to him? >> Yep. Hold on. He says, "Does he have an email address?" >> Yeah, M >> Hold on. Go ahead and type it in. Can't leave your child unattended. >> No, I was just walking >> To go play video games. >> no, but as you see as you was walking in I was going back to the room. >> matter. Housekeeping found them. 12-17 12-13. a riot out here female search? Do you have anything on you that's going to poke me, stick me, stab me, bombs, explosives, guns, knives? Okay, have a seat in my car. I'll take your phone. Where's your phone in your pocket here? In your right pocket? Have a seat in the car for me. All the way in. Anything on you? The lead deputy receives a B plus. Miranda delivered correctly, suspects separated, DCF called. The one concern, if questioning continued after Dobson invoked counsel at 12:30, that is a potential Edwards violation. Aaron Dobson receives a D. He was at the property. He visited the front desk. He booked another night. He left without checking on the children. That is not passive neglect. That is an affirmative decision to abandon. The female subject receives a C minus. Her departure was separate but concurrent. Her exposure mirrors Dobson's absent any delegation of care. Hotel housekeeping receives an A, identified the risk, reported immediately, and cared for the children before officers arrived. Their action likely prevented serious injury. Three takeaways. One, the legal duty of care is measured by the condition of the child, not the intent of the adult. Two, invoke counsel interrogation stops. Procedural errors here can collapse an otherwise strong prosecution. Three, hotel staff are de facto first responders in child welfare situations. Their training matters.
