A bank customer says he came in to resolve a fraud alert, but officers detain him while employees report return checks and later present identification evidence. The key legal issue is not whether the allegation is true. The footage cannot establish guilt. The issue is when police had enough information to move from a temporary investigative detention to an arrest and how custodial questioning was handled after that point. [music] >> How you doing, sir? >> Good. Stand up. Unlained right now. We got a call that it might be a possible fraud for a certain amount. >> That's why I literally came in here. I've been coming uh you guys office like a few days. I got >> Yeah, we just trying to investigate. >> All right. Just step out real quick. >> All right. No weapons, right? >> No, I'm good, bro. So, you said you said that you were coming in here to find out about the fraud. >> Yeah, I've been calling these guys for weeks. It's been like >> I don't know uh a few. So, I haven't even used these accounts in months. >> Okay. >> I don't even I don't even have a point cuz I have other uh business accounts >> and I haven't I've had them for like years. >> Okay. >> And then I got like a notice. Oh, sorry. I tried to log in online. I couldn't log in online. I called over the phone. Um they basically told me I had to come in and like pay some fees. I came in. >> Let's um let's >> Yeah, let's let's walk back here. So this your wallet right here? >> Yeah. >> Your ID in here? >> Well, he has ID. >> Oh, you got it. All right. Let's walk over there. >> 616. Copy of Florida 27. Yeah, you good. >> Long story short, boss, I had some accounts with these guys that I've had for a long time. Um I tried to log in online one day. It wouldn't let me log in. Um eventually I found out there were just some fees that like cuz it was just old accounts. Yeah. >> And they asked me to come pay the fees. I wouldn't pay the fees. They tell me everything was fine. I got a few text messages saying like basically I use his cards basically. And um I didn't. But I had called and they told me basically the fraud department was closed. Um so I went back in the office. They told me basically I had to call when fraud was open. Um I called fraud. Basically they told me that I had to come back in here cuz they don't um they they basically couldn't help me over the phone and so I'm here now. Um I don't know even what the counsel is even regards to. They won't even tell me what the counsel is about. >> Okay. So you open the accounts and you haven't used it for years. You're saying that >> it depending on what account like some accounts not for months. >> Okay. So for months >> and you got some notifications that you got possible fraud with the accounts and now you coming in here because you had some fees related to some of the accounts. >> Well, no I already paid the fees. >> Okay. So you paid the fees. So you were just So what were you doing in here to find out about the fraud? >> Fraud? Yeah. Okay. To >> see what they think is fraud or whatever. >> Okay. Because you How did you get the notification through a few weeks ago? Yeah. >> And I This is like my second or third time >> trying to come in >> figure out. Yeah. Cuz the other time I went, they told me everything was fine. >> Did you go to this one or Tampa? South Tampa. >> Okay. >> All right. So, when was the first notification? >> Am I looking at my phone? >> Okay. All right. Let me um you mind signing up? Yeah. >> Okay. Say that again. Anthony, >> we're filing against Mr. Stalker cuz he presented several stolen checks that we had to pay back to the financial institution. So, Mr. Stalker owes us uh $29,731. I have also filed this with the US postal investigators, but the fact that he's back on our property, uh, we don't want him around. >> He explained to you right now that you're not currently under arrest, you're being detained. >> I'm just I'm sorry. I'm just a little shaken. I wasn't expecting any of this, though. >> Okay. It seems like when they arrange your name in their system, it it gets flagged for some reason that you're a suspect in a fraud case against GTE. >> Okay. So whatever that whatever they're investigating, whether it's an internal investigation or if it's something criminal, but as soon as as soon as he ran your name, it it popped and flagged. So >> uh so for for something like this, do you give the person like a chance to pay? Because he said he came in here um several times. He went to the South Tampa location to try and figure out like the fees. I guess he said it was fees that he had certain accounts opened up. Um, >> no. So, he deposited stolen checks that were that they were I mean they're easily stolen. Uh, he doesn't he's not a trustee for the trust account that he presented these trusts and he like filed a bogus filing on Sunbiz. So, I I've been working with the US Postal Investigators cuz he stole several checks. Um, so but I I called him. I spoke to his mother. I told him, "You owe us 29 grand and we're going to file against you and don't ever come back to GTE." Then he came and he opened new accounts. So we want him trespassed and we want our money like he he committed fraud for GPE. So do >> you guys have a a case open with with the police department or anything? Where did he deposit the checks? Which location? I >> think it might be time though. South Tampa and here >> in this in this location. >> Yes. >> So the amount that was So how much was the check that was that was done here in this location? >> Uh $29,7391. >> That was what he deposited here or with Junior? >> Yep. >> Okay. Cuz you said something about South Tampa. Was it all here at this location? >> Oh yes. Well, sorry. Yeah. South Tampa was the 29. That one was $11,529. And we have since then received the reclamation for that check. So both checks have returned. >> So he actually owes us 40,79130. >> Uh >> I mean I've been I was just in South Tampa BT for 3 hours. So I like everything straightened out. They told me everything was fine. >> So like why >> Okay. Listen, we we don't know either. We'll figure it out. >> Okay. Whether it's uh something that Tampa is investigating or something that they're internal internal uh internally investigating, we're not really sure yet. So I haven't used accounts in months. >> Okay. >> I was just trying to log in and see >> is it are you typically use GT for your financial institution? >> To be honest, I stop like this is ironic. >> I stopped. >> You still you still have active accounts here? >> Yeah. I just uh I just have like a few like neighbor most like neighborhood. >> Okay. >> You a veteran? >> No, my my dad and granddad are >> Okay. >> Yeah. >> We didn't get notification until June that the checks were um a a fake check. That's from Wells Fargo. I guess they were doing their investigation. >> You have video footage of the person who actually deposited the check? >> Yep. >> Okay. Yeah. Yeah, we need to see that and make sure it's the same person cuz if not then >> Okay. Yeah, hang on one second. Let me uh here. Let me attach that as well. Yeah, I have everything right here. So, it's definitely him. He's pretty uh >> It's all we really need. >> Yeah. Positive. >> We can charge him with whatever you want. We can trespass him. >> And you you want to file charges, right? >> Yes, sir. >> Okay. Sit forward real quick. No, no, just just sit up like move shift forward. There you go. All right. When I li I'm going to release. What is it? This one that hurts or this one? >> This one. >> Okay. >> Pause the check. >> Yep. That's it. >> Sure. >> You can print the picture out and check and all that. That'd be perfect. It's all >> Yeah, they're they're getting information now. So, we'll see what happen. What's going on? >> Currently, posit 11,000 in this location. >> So, they're at $11,000 from here, 29,000 from [clears throat] somewhere in South. There's no open investigation anywhere. >> Okay. >> It was just through the postal >> investigative unit or something that through the post office. >> Okay. >> So, we have 11,000 here in fraud. >> Okay. >> So, can we go off that? >> You guys think I stole 11,000? >> You deposit $1,000 check here? >> I haven't deposited a check in. >> I don't even know like >> happened in February 2nd. See, I mean, Feb. I don't know what. I get you. We'll make sure. Hold on. >> Huh? >> Yeah, we're 17. We have We have a picture of the positive check of everything. >> So, we're just going to get the evidence and charge him and all that. >> He's 10:15. >> So, is there there's two separate locations that he hit? >> We're somewhere in South Tampa, >> but they had not contacted TP yet about it. >> We'll let them know and then they can he'll be in jail already, so they can add charges. >> Any when when he deposit a check? >> February 2nd. >> Just a bad check. >> Yeah. >> Okay. 11,000 here. 29,000. >> He's like down 40. Down 40,000. >> Okay. >> They're printing everything out for us. We're going to give Axon link. >> Okay. >> And they're going to upload all He has a case file and everything. He's going to upload to Axon. >> Okay. >> Everything we really need. >> All right. Are you you transporting or is somebody else trans? >> We'll take. >> Okay. >> So, you guys need the the checks positive. >> So, as of right now, >> as of as of right now, you are under arrest. Okay. for check fraud. Okay. Basically, with the checks that you deposited supposedly that they're saying is are were bad checks back in February. >> One here, one down in South Tampa, they put money in your account that was not typically yours. >> So, they have video of you actually depositing the check. >> Yeah. >> And the checks are bad. >> Checks are bad. >> Good. >> But I mean, that's back in February. What was >> Yeah, with the check. >> They were they they got deposited in there wasn't was was bad. So, like they could they actually out of money. So, they actually down 40,000. I don't know where you got those checks from, but [laughter] >> those checks were from my business or was I >> Yeah. So, they were bad checks. >> Whatever whatever whatever account those checks are written off of to you was a bad account or was insufficient funds or whatever. So, fully agree. >> Okay. >> The pivotal moment is the decision to arrest under Beck versus Ohio. A warrantless arrest requires facts sufficient for probable cause. officers had a bank complaint, information about return transactions, and what an employee described as a positive identification that can support probable cause, but the transcript cannot independently verify the image, the records, or the employees accuracy. The next issue is what happened after custody began. Yeah, I'll um once we get to the car, >> once we get to the car, I'll I'll read it. And >> as for right now, they are the victim. I mean, >> they are the banks. >> Okay. since they lost money. I mean, >> if you receive money that we not supposed to mail, >> can you guys give me an update on I guess? >> Yeah. So right now they have you they have you on a uh depositing and withdrawing on a fraudulent check. So the check was cashed for 11,000 and change um it looks like the post office right here. Okay. um the post office uh flagged you for uh I guess using these stolen checks and then once they came back then because once we run your name it's flagged you see. So all right now I'm going to search you and then I'm going to read you your rights. Okay. Searching. No, no, no. Just your face. Yeah. All right. Have me sit down. Wait. Let me let me unbuckle this real quick. >> Try try not to lean on the cops or it's going to dig into your >> Yeah. >> Hey, sorry. Say again. >> Don't lean on the cops. So, just lean forward a little bit. >> You have you have the right to remain silent. Anything you say can and will be used against you in the court of law. >> Do you understand these rights? >> Yes, sir. >> Yes. >> Yes, sir. >> Okay. Are you willing to answer questions or make a statement without an attorney being present? That's a question. No. >> No. >> All right. >> The opening detention uses a lower threshold. Terry versus Ohio permits an investigative seizure when officers can point to specific facts supporting reasonable suspicion. The transcript confirms a call about possible fraud and shows officers telling the man he is detained while they investigate. But the dispatch information known before contact is missing. So the legality of the initial detention cannot be decided conclusively from the subtitles alone. Miranda versus Arizona matters after the officer announces the arrest. Its safeguards apply to custodial interrogation, not merely to arrest. Before the warning captured in the transcript, an officer says he does not know where the checks came from and the man responds. Whether that exchange was interrogation depends on context. The transcript also does not capture the full standard right to counsel warning, so the original audio requires review. >> Can I ask you a quick question? >> Um, can I call my mom? >> Uh, you're going to have that opportunity at at ORJ. >> Okay. >> All right. >> I was supposed to pick her up um from an appointment. >> Okay. Well, I'm I'm sorry. at like 9 uh >> I think somewhere between like 9:40. >> Is she Is she at the the place now or are you picking her up from her house to get to appointment? >> Um no, she she was probably at the um sorry this is just so this so much. Sorry. >> All right. So, >> um No, she's at the car repair place and so I just wanted to tell her or >> do you have sisters or brothers that could pick her up if she don't if she calls you? family. >> Family? >> No, she's I'm not only [music] >> that's your mom. You want me to answer? >> Yeah. >> All right. You have a few minutes just to let her know. >> Oh, no. >> All right. Hey, Mom. Mom. Hey, listen. >> I'm being arrested right now >> because let her let her know for a while. I know. I am. I'm being arrested right now. They think that I have some kind of check fraud situation going on and I don't know which jail are you guys taking me to? >> Or road jail. So I need I need you. >> Yes, mom. Listen to me. >> So I need you uh basically like BTE is saying that uh I guess two of the checks from like business checks or whatnot. Um like they didn't get the money back from it. Um and uh basically so they're saying that it's check fraud and they didn't let me know anything about like I guess like them not being paid. This is like back from February is what they're saying. >> So this one is from February. >> Yeah. I Okay. I I don't know um the exact dates. I guess they they haven't given me all the information. Um but yeah, I don't I wish they would have just let me know they the money wasn't there cuz I could have just paid [clears throat] them the money. It doesn't make any sense. >> So, what do you want me to do? >> I guess I was going to have to wait until I get out of uh >> All right. Just Just let her know you going to be there. >> I'm going to be in at Orian jail and I I guess you I need you to figure out how to get me out whenever the What is it like? >> Yeah, you have you have Yeah, you have opportunity to call her at the jail. >> All right. >> Still early, but it's possible we might be able to get out early if you see a judge today. >> Okay. All right. >> Thank you. The officers make investigative choices. They separate detention from arrest, seek transaction details, and ask for identification evidence before announcing the arrest. One statement that they could charge whatever the complainant wanted is legally imprecise because a complainant does not control the basis for arrest. The man remains cooperative and declines to answer questions without an attorney. A choice the transcript shows officers respecting. Two practical lessons follow. A detained person can ask whether the encounter has become an arrest and can avoid volunteering detailed explanations while [music] facts are still being investigated. Once custodial questioning begins, clearly invoking the right to remain silent and requesting counsel reduces ambiguity. For police, documenting what was known before each escalation matters [music] because later legal review focuses on the information available at that moment. The source establishes an arrest, not guilt, prosecution, conviction, or sentence. Important facts remain unverified, including exact transaction totals, the agency, the incident date, and complete Miranda audio. The legal takeaway is narrower. Detention and arrest require different levels of justification. While custodial questioning raises separate protections, careful analysis keeps those stages distinct and does not turn allegations into conclusions. s.
