An officer is stopped dead in his tracks by a security guard while trying to conduct a traffic stop. >> Open the gate. Open the gate. Open the gate. Open the Open the gate. Open the Open the gate. Yes, you can because I'm stopping that vehicle. Either open the gate or you're going to go to jail. >> Uh I'm going to go to jail. Okay, hold on, sir, cuz I do have to call my supervisor. >> I'm trying I was trying to conduct a traffic stop and you're impeding in that investigation right now. I'm a I'm a police officer. At this point, we're going to have a little meeting with my supervisor, too. So, go out and go >> Cuz I do I have to call my supervisor. >> Open the gate so I can turn around and be right here and get him up here now. >> Okay. >> Immediately. The officer calls his supervisor to the scene. As the supervisor is on his way, the officer has a chat with the security guard. >> Well, he was coming in and he was trying to, you know, he was trying to make a traffic stop. >> There's a very good chance that you may be going to jail. >> It's not It's It's a chance that I'm going to jail because I didn't want to let him in. >> It does not matter, sir. I was affecting a traffic stop and affect and affecting an investigation. You can't She can go to jail for impeding. >> Well, but you just said you was trying to make a traffic stop. But he >> Ma'am, were my blue lights and siren Was my blue lights on? >> I saw him trying to stop and I really That's what he was trying to say to you. >> Uh Okay. >> [clears throat] >> Hello. >> How are you? >> I'm good. >> So, I'm the on-duty supervisor. >> Yes. >> Is there a reason why you don't let an emergency vehicle on the road? >> It's [clears throat] just I have to like usually I can't just, you know, let anybody in, so I >> Anybody? It's a marked police car. Blue lights on. >> Not anybody, but Man, you're about to go to jail. You're about to go to jail. For obstruction. You don't have the authority to stop fresh pursuit in the state of Florida. >> She goes to get on you? >> Mhm. Wow. >> I thought about just going through it. >> He was already the the uh the employee was already on site. >> This is going to have to go to the top. Just clarify the vehicle came in here. >> Vehicle comes in here, runs a stop sign, follows him. My other traffic stop Dixie cut off, ran the stop sign. I come down all the way down Dixie trying to catch up to it. It turns off of here and I'm still a decent ways behind it. But I got stopped right here. And truck pulls through gate >> you get stopped right there? >> I If this gate would have stayed open, the truck would have been stopped right here. >> Oh, this this Oh, the truck was right here? >> Yeah. I got I don't have enough for him to be eluding. >> What's your supervisor's name? This is Corporal Lewis with the Suwannee Police Department. Yes, sir. Our officer was attempting to overtake a vehicle that was pulling into your parking lot. As the vehicle pulled into the parking lot, my officer was behind it with his blue lights and sirens and your security guard shut the gate on him and refused to open up the gate for him to effect the traffic stop. >> Do you have your ID on you? >> What's your What's your full name? >> Tatyana, T Y T I A N A >> No no no no she no no no no no no. No, she is. She's directly obstructing a law enforcement action. This is not NASA. This is not a facility that is that has restricted access during a a law enforcement action. This was a fully marked police car with its red and blue lights on. >> All right. Hang out right here. >> First name Tatiana, last name of >> Uh no, no, yeah, yeah, yeah, but yes, but you have to understand you still have to follow the law. A A A that's kind of common sense that you don't shut a gate on the police officer in performance of his duties. They had just let the employee in and which in the police car was just behind it catching up and then your your security guard shut the gate. >> I never shut the gate. It didn't shut and it's on. >> But you didn't open it for him? >> It Okay, so the person was already inside and then all I seen was like just come like here and but that's >> But if it was like a medical emergency or something like that, wouldn't you open the gate? >> I would still have to call >> I I don't I don't sir, I don't I don't think you understand. You have to follow the law. >> Yeah, if there was a medical emergency or anything like that, you wouldn't let us in? >> What's so important? >> So that that that's the issue, sir. Not you. >> So then here's the thing. You're going to need to somebody you're going to need a new security guard here in a second then to come to the gate because she's going to go to jail for obstruction. For doing for obstruction. >> Let me ask you this. What time do all your employees get here? >> This time all the time or you know, by chance? No. All different times. Only reason I asked is cuz they They speed a lot. Let me just say that. They speed a lot. >> No, that No, that officer with that officer has already ordered her to allow him inside and she refused. So no No, she doesn't have to that No. No, that's not how this works, okay? I will call you back. Let's go. >> All right, girl. >> Yep. >> Can you turn your back, please? Morning. Can you really let her sign the form? Step right here up against my patrol car. >> Ma'am, do you Is there another security officer that works here I've not seen? >> I'm sorry. >> Is there another security officer that works here? >> No, we're going to call him. >> Where Would anybody be coming from if they need to relieve you? >> Uh we got to get her ID cuz nothing's coming back for her. >> That's fine. >> There's There's two officers that usually come relieve me at 6:00. >> At 6:00? >> Yeah. >> Can you get back in there so you can call your boss back and we can get this figured out? >> How did you spell your first name? >> T y t i a n a >> Okay, well coming back for you. >> Do you have a Florida driver's license? >> Yes. >> Hello, this is Corporal Lee again. Is there any Do you have another security guard on scene that you can send to the gate? >> I'm the supervisor. I'm going to come in to relieve her in about 45 minutes. I'm away from her. I'm getting ready to drive out to come to relieve her. I'm supposed to be there at 6:00. >> Okay, so there's nobody else here? >> There's nobody at all. I'm the only one that can come over here to relieve her. >> Okay. >> I won't be there until 6:00. >> Is there anybody in here that can come up here and take care of this for you? >> Right, I just spoke to her. Um um the safety guy, the safety guy sleep We live in the same area. We both trying to get there as soon as we can. >> Okay, but there's no Is there a manager on site for right now? >> Right now, no. There's just the employee over there. And then um as far as like manager that can come and relieve her. I mean that I mean she really going to drive because of the position of her job. >> She She So there There's There's a way to do your job and do it in common sense. >> Copy. Tell the female she's valid. Negative on the license. Here with the victim. >> If you shut the gate and refused law enforcement entrance during a fresh pursuit. This isn't like we just showed up for an investigation. I would understand it like if we showed up for an investigation. This officer was actively following a vehicle into the property and she actively let the gate down and refused to open it for him to continue to his his law enforcement action. >> told because that's what That's what I was trained for. That's what I was told. I'm not supposed to let you guys in until I ask questions of what's going on. We have to ask questions and then we have to follow the protocol. Because if you tell me as a supervisor first that they get out, I'll have them do the same thing and then call the safety people or the HR people, ask them for green light and they'll tell me what to do to follow procedure. >> Okay. All right. We are going to work this out right now and then we'll get everything figured out, okay? >> Well, I'm trying to be there as soon as I can, sir. >> All right, thank you. >> As soon as I can. >> What do you think What do you think about a warrant? >> Uh not a warrant. You're going to NTAA her. You're going to NTAA her for resisting without for the obstruction. Okay, then we're going to let her go. So, get what you got down as quick as possible. Get You know, you don't have to do the the narrative. Get a her name, the charge, and then we're going to let her go. We'll go from there. >> Tell her I'm going to set her phone in the office. >> Ma'am, he's going to set your phone inside the office, okay? >> I know that these airport I've been saying for the past 2 or 3 days these airport people have been speeding up and down. I've been trying to catch them. >> About 4:30. >> 4:30 to 5:00. >> 5:00 to 5:30. >> 5:00 to 5:30 is why I tried to go >> I cannot fathom. Like, I totally understand like if we're coming on site to do an investigation, you can do that. You can't in fresh pursuit of a vehicle actively prevent us from doing our job. That's what like what if they had a car chase to come through so you just >> I'll be up. >> Safe. >> Are you safe? No, that's not how that works. Absolutely not. >> Is her manager on scene? >> No, he's 45 minutes away. >> Oh. >> You want to hear the good news? You're not going to jail today. You are getting a notice to appear. I'll explain all that in just a minute. >> Come on out. Can you turn off your phone? So, in lieu of us taking you through the whole booking process and everything, we're going to release you with a court date today, okay? >> Okay. >> We're going to step back inside so you don't get soaking wet and explain everything to you. >> So, in lieu of you going to jail, you're going to be getting a court date. Your court date is as stated here on June 18th at 2026 at 1:00. You have to appear for that. This is a in lieu of arrest. This is a written arrest. If you fail to appear, then a warrant for your arrest will be put out. Do you understand what I'm saying? >> Yes. >> Do you understand why this is happening? >> Yes. >> Have I been perfectly clear when I was sitting there? I think I believe I requested for you to open the gate three times and explain to you that I was trying to conduct a traffic stop. >> Mhm. >> You understand? And you said, "Well, I got to call my supervisor." Well, that's not an option. When those lights are on and I'm conducting my business, you don't have the right, no matter what, to interfere with that. Had you opened the gate, then we wouldn't be having this conversation, okay? Do you understand? >> Yes. >> So, I understand that if, you know, your your bosses tell you to do something that we all want to try to please our bosses, but you can't directly disobey lawful orders, especially with something like that, okay? So, what you're not going to do. Do you have any questions for me? All right. >> Do I need Do I need to leave my name and phone number or anything? >> Um I mean, you don't have to. >> I just didn't know if you needed if your boss needed it for anything. >> Nah, I think we're good. >> All right, thank you. Thank >> Have a good one. >> The suspect, 29-year-old Tatyana, was charged with resisting arrest without violence. However, the charge was later dropped and her case was closed. >> Now, it's difficult to determine who was legally correct here because for me it comes down to three things. First, this appears to be private property. And second, how much authority does security have at the gate? And third, and probably the biggest one, did this traffic stop legally qualify as fresh pursuit? Her supervisor later says she was trained to close the gate, so I can't really fault her for following the training she was given. That still leaves the question of whether that training applies when an officer is trying to continue a lawful traffic stop. Here's something most people might not know. Under Florida law, fresh pursuit isn't limited to somebody fleeing from a serious crime. It can also include an officer pursuing someone for a violation of Florida's traffic laws. And in this case, the officer had just watched the driver run a stop sign before attempting the traffic stop. So, on one side of the coin you have a security guard apparently following her training. And on the other, you have an officer who witnessed a traffic violation, and police believe he was lawfully continuing that
