my name is Randy rling I work full-time in Northeast Wisconsin Technical College I'm an instructor in use of force issues we're reviewing a report of an incident at the Milwaukee Police Department April 12th of this year at approximately 11: p.m. officer ratzman and his partner were on duing the downtown area taking a theft report at this time they heard over the police radio that a Pursuit was in progress and it was nearing their location Sergeant Johnson the Milwaukee Police Department was the pursuing officer they then observe ered a vehicle that match that description they saw the sergeant Johnson's car in pursuit of this vehicle and they realized that that was the suspect vehicle it approached their area in a short distance they ran to that vehicle where it was now stopped in a parking lot being is there was the end of a Pursuit they're justified in doing what is called a high-risk vehicle contact officer's approach or the guns drawn the suspect in the vehicle refused to get out he drove away he made a sharp U-turn came back right at the office this in itself would have Justified use of deadly force the officers jumped out of the way subject stopped his vehicle and this time they did open the door of the car and begin to extract the subject get out fck car out subject reaching into that Council still a serious threat he was extracted as he was brought out he was reaching toward his belt again appearing that he was reaching for a weapon trying to escalate to a higher level of force the officers were obligated at this point to protect themselves they directed a subject to the ground in a prone position on the ground hands under him still looking to reach for what may have been a weapon the officer was trying to pull his arms out he was resisting this resist at that time the officers are justified in using any level of protective alternatives and this time they used what was simply called a focus strike striking the subject in the upper right shoulder area there was question on the video if that strike actually hit the the subject in the face well it did not you can clearly see in the video the subject's face is in full view as the officer's hand is impacting in that upper right shoulder area upon the two Focus strikes to the shoulder the subject complied Subject Was Then stabilized and restrained and that was the end of the contact sub was transported to the some type of holding facility later on shows some redness on the right hand side of his face which would indicate probably something abrasion from the street and no bruises you can hear the impact of the officer's hand officer ratman's hand as he's impacting that person's shoulder stop resisting resisting at that that level of impact would have hit that subject's face very likely based upon my experience in training and 28 years of being a police officer that subject's face would have probably suffered some serious structural damage so he didn't hit him in the face taking a closer look now at the position of the sub of the subject's head and face and shoulder in relation to the officer's Focus strike and you can clearly see that the officer's hand is in the background of the subject's face and head that the strike is not impacting the head it is not impacting the cervical area of the spine and it's not impacting the face but rather it is in that background in the area of the upper right shoulder regarding the second strike to me the video is even uh clearer in this of pointing out that the subject's face nor his head and nor the cervical a the spine are being impacted it's quite clear now on this one there's less reflection that the officer's hand is in the background impacting the upper right area of the shoulder not on the spine not on the head and not on the face I think we should also keep in mind that the officer would have been totally justified to strike this subject in the face in the head in the neck if that have been his only target area a protective technique delivered by the empty hand May be impacted on the face the head the neck in this situation I think the officer showed good restraint when he selected just the target area of the upper right shoulder
