So Allan, uh, are we making some amendments to the, uh, 50-4 if you don't mind me asking? >> You don't? I do mind you asking. And remember I said I wasn't talking to you. I meant that. >> And get back to work. >> Blow me. >> Phil. Oh, yeah. Below you, huh? Oh, that was real good. Did >> you say blow me? >> Oh, yeah. >> Meet Alan Merritt, making $115,000 a year as the supervising Tucson city prosecutor. I'm not sure if the words he just used there were a plea deal offer or if he's just demanding that the public orally pleasure him for free. I put contact information for the mayor and city council in the description in the pinned comment. Maybe you guys can ask them what Allan meant by this. In the meantime, I'm going to show you how we got here. Over the last 6 years, the Tucson police have arrested the same people over and over again for recording them. Then, when the same people try to document and record the process of being maliciously prosecuted for recording the police, they arrest them for recording the process. Over the last few years, the Tucson police have illegally arrested people dozens of times for recording their official business inside of city buildings. I'll link to a previous video that I did on this where Patrick was arrested inside of a city building for recording a police officer, taken to a cage, and tortured. He was charged with trespassing and resisting arrest. And since I was told that they get kicked out for doing business with the city, when he went to get his discovery from the prosecutor, I went with him to record it and see if they would kick me out, too. Sure enough, they threatened me with arrest if I wouldn't stop recording or leave. I published that video. About a 100,000 of you saw it and started emailing the mayor and the city council. And almost immediately, their embarrassing administrative order saying you can't record in their buildings was taken down from their website. When Mark and Roy went back to the city prosecutor's office a few days later to conduct some business, the city employees did call security and police on them for recording. But this time when the police came, they did tell them, "Yes, you absolutely can record while you're doing your business here." >> That's right. >> So, we can record in here and the public defender. >> Sure. As long as you have business here. >> Yeah. You didn't say you couldn't record. >> I did not say >> I put a link in the description to this full video so you can see the whole interaction. A few days later, I went back to the city prosecutor's office with Mark, Roy, and Patrick to do some business. The business is super boring. The only point in recording it is because government will actually lie about what happened in interactions, which is why it's important to always record it yourself so you can prove what did or didn't happen later. Upon entering the building, I asked Officer Schwin if I was allowed to record my interactions or not, just to see if he would lie to me. I know you guys are going to be super surprised, but he lied to me. >> I I haven't been here much. >> Sure. >> I heard that there's rules about recording. >> Yeah, there's no recording in here without permission. Written permission >> at all anywhere. >> Correct. Yeah, it's all we have victims here, things like that. People who have been assaulted, so they don't want any pictures, but you can go ask the presiding judge for permission. >> Not even in the public areas, public hallways. >> Oh, there's victims. These people could be victims. >> So, if you're video recording, we'll have to ask you to leave. It's not a big deal. Okay. Look, just do your business and get out. Thank you. Appreciate it. You guys are swallow your little walker there. I think there's a stop and arrest on you for threats. >> Yeah, the problem is I'll go check it out. >> Yeah, why don't you go check it out? Why don't you sir? You think I threaten people? >> I believe that's true. >> You think I threaten people? I I tell the truth. I tell the truth. I'm not going to threaten someone if I don't threaten the whole truth. Nothing but the truth. >> Okay, good for you. >> Got it. >> Yeah, I got it. You're very tough. I'm I'm just >> I'm not trying to I'm just I'm just letting you know. >> Well, I appreciate that. Thank you for your future. >> You're going to arrest me, huh? Just want me to check to see if there's a stop and arrest on you and then I will arrest you cuz I'm going to go get your name and your third birthday. We have it. >> Oh, I'll give it to you right here. Why don't you just come on down here? I'll give it to you. >> Come on, swine. >> Swine. >> After watching them get bullied by Officer Schwin of the Tucson Police Department, I followed them around to record them conducting their business. >> Quick, we got business here. >> There he is. How you doing, Wayne? >> How you doing? >> Oh, doing pretty good. Oh, you know my name, huh? I watched the video from last >> I didn't even publish you. >> No, no, >> okay. >> You seem a little more peaceful today, like you're ready to interact. I like that. >> At this point, it seems like for the first time in years, most of the staff at the city prosecutor's office have changed their attitude. They happily help Roy file the paperwork he needs to file. But don't worry, the guy who's in charge of this entire office who caused a disturbance the last time I was here. >> I'm telling you to leave. Mark, get your friends out of here. >> Alan Merritt is about to come out. >> There he is. >> Mark, what do you want to do? >> No, this is Roy, not Mark. I want to record Mark's proceedings and also wanted to talk to you about the 50-4. What you're doing with it, man. >> I don't want to talk. >> You don't want to talk to me? >> I do not. >> Oh, good. Then just do your job and I'll watch you do it. I don't need you to tell me what to do about >> I just did. What What are you going to do about it? >> What I need is uh my motion filed. >> Hey, Sweeny's here. >> Hey, Sweeney boy. Get in there and whip him into shape there, bud. So, Allan, uh are we making some amendments to the 50-4 if you don't mind me asking? You >> don't? I do mind you asking. And remember, I said I wasn't talking to you. I meant that. Then get back to work. >> Blow me, >> Phil. Oh yeah. Below you, huh? Oh, that was real good. >> Did you say blow me? >> Oh yeah. I love it. I love it. Wayne, you're no longer the star, sir. I like the smile. >> So tell Patrick Gonzalez he has a stop and arrest for our threats and intimidation. I got you confused with him. Okay. So tell him he needs to go down to the main police station, talk to them so he can have a ticket. We don't have to take him to jail. >> You You seem like a really good guy deep down inside. Like it's buried in there somewhere. >> Somewhere. >> You're a really good guy. >> That's what my parents say. >> I bet when you go home and you take the uniform off, you're probably a pretty decent dude. >> I'm still a decent dude with the uniform on. >> Oh, no. I bet on that one. >> As we exited the office, the court administrator, who we believe is the one who created and then removed the rules from the website about no recording, was outside in the hallway. >> How's it going, sir? >> Good. How are you? >> Oh, I'm doing fabulous. Thank you very much for asking, by the way. >> Good. Good. It's a weekend. Hopefully you have a good weekend. >> Absolutely. And you too. Likewise. Appreciate you, man. >> I'm going to have a good weekend. Me and Schwin, I think we had a really a good understanding of each other today. And I think maybe the next time we see each other, we might be on a better terms. I think >> you don't want to be a decent human. That's up to you. But I agree. >> That's the way it is. So stop with the I'm being nice to you and I'm being that's a bunch of crap. You know that >> if we had a better interaction the first time I met you. >> I tried even before that. Okay. That's that has nothing to do with it. If you keep your stuff together, don't jaywalk. I will never contact you. I will never be nasty. >> I'm actually going to jaywalk on my way out of here. >> Okay, good. I'll get you later. I'll get it on film and then I'll I'll mail you a ticket. How's that? >> You're you're easily triggered, Flynn. And I see that. It's not a good thing for a cop to be easily triggered. >> Well, that's why I've been here 30 years, right? >> Yeah. Well, you you probably have qualified immunity, I would assume, and that's the reason why you've been here for 30 years. So, >> throw up those buzzwords. You got it, buddy. >> Yeah. I understand that completely. Uh-oh. Uh-oh. So, um, the next time we have an interaction together, let's make it peaceful and I'll do my best to be peaceful as well. How about that? Can we Can we try Can we restart? >> I have tried. No, you can talk if you want, but I'm I'm done. Unless you have a specific question. >> You're triggered. You're extremely triggered, aren't you? You're extremely triggered. >> I am extremely triggered. You're right. I got it. I can see it. I can see it in your head. You're starting to sweat. You're beating up. >> Your nose is running here with you in the >> Your nose is running. Your head's getting shiny. >> Yeah. My It's shiny, sir. Oh yeah, >> good luck to you. >> Hey, good luck to you, man. >> I hope you don't get run over on your way across the street jaywalking. >> Cuz we all know that you're above the law and I'm not. So you could jaywalk when I can. >> You would ask for a copy of >> 504. Would you like it if we have one? >> You got a new updated one or is it the same one? >> It's it's the one that was was given by Judge Rios. Yeah. >> So it's the 50-4. Yeah, >> correct. Yeah, we don't we don't have anything updated from from when that was given. Although it is being reviewed by the by the court. So yeah, there will when there is something new, we'll >> put a new one out. >> You want a copy of >> No, I've got to put copy of it. I thought it was getting revised. That's the only reason why I wanted it is we are working on it and >> because of this year because of this year, right? Because it's >> No, no, no. Because look, cuz the the administrative order it's it's pretty pretty straightforward. It's about rule 122 and rule 122.1. >> Correct. Right. Now, whatever the prosecutor does in their space, that's that's up to them, their choice. So, it's it's about the court rule. So, that's what it is. >> So, yeah, but we are working on some rules. >> So, what they're talking about here with this administrative order is the order that I showed you last time where certain people within government arbitrarily decided they're going to write on a piece of paper that you can't record the government. And so, it is. But I showed you in the last video that these guys have actually always obeyed the administrative orders even knowing that they're unlawful and still been arrested even while complying with the administrative orders. And what it really comes down to is that government is just flat out never going to stop attacking people for recording them. They will always come up with some new rule for some new reason like safety, privacy, and victims to keep what they do from being documented and exposed. But I have to admit that I can't actually see their perspective. If I were in charge of this building with the lead prosecutor telling the general public to blow him, I wouldn't want cameras in here either. So, the guy in the white shirt you saw in the prosecutor's office was Wayne. And he was pretty nasty to Roy the last time Roy was here. Roy hadn't even published that video yet, but Wayne realizing how he acted, actually apologized to Roy on his way out of the building. >> Hey, have a good weekend, man. >> Okay. No, no, you're right. Yeah. >> No, you know what? The other day, the first day I I did come on strong, you know, and I was like, you know what? I kind of Well, you should recognize. Hey, you too. Have a good weekend, man. With such normal, decent human behavior like this, I'm sure that Alan Merritt will fire Wayne soon.
