so you're saying you can't film from the grass you can't film from the sidewalk is it not a constitutionally protected right to be able to film is it not a constitutionally protected right to be able to film no Constitution not not the statutes the Constitution that supersedes it hey guys Florida has decided to pass a bill making it illegal to witness or record somebody else breaking the law in public that's right they have literally written down on paper that it is illegal to be a witness to certain traffic violations and that if you see or record such a thing happening that you will be subject to arrest this sounds like something that now fired former Chief Joseph Leon Valley tried years ago when he illegally ordered his goons to arrest almost a dozen alleged witnesses to an alleged crime since then Joe has been fired along with his buddy the city manager and a settlement was reached with the victims for a half a million dollars in this video West Palm Beach police inform Palm Beach free press that if he watches and or records people engaging in street racing speeding or stunt driving that he will be arrested they're referring to House Bill 399 which says that people are prohibited from spectating for the purposes of filming or recording street racing drag racing street takeover stunt driving Etc unless that person is a bona fide member of the news media the thing about Free Press which is supposed to be protected by the First Amendment of the Constitution in the United States is that nobody has to be bona fide anyone gathering information with the intent to disseminate it to the public is legally press in the United States this bill is unconstitutional on its face and is going to make a lot of people a lot of money via lawsuits while costing the boot licking taxpayer is it not a constitutionally protected right to be able to film is it not a constitutionally protected right to be able to film statutes no Constitution not not the statutes the Constitution that supersedes it so you're saying video recording entices people to drive recklessly gotcha I guess if there was a big crowd or something going on here stupid I was just riding my skateboard through and I found a shady spot to stand so I came over here and chilled in my Shady spot anybody being stupid yet today or they see you guys and don't be stupid today sure this is not public property is this not public property the mall owns this property where I'm standing right here makes sense so you're saying you can't film from the grass you can't film from the sidewalk um is actually a criminal citation what's your name about somewhere I already want he wants it okay so we're not gonna be able to stand here and watch otherwise the new citation this is the warning for right now is this a lawful order for standing on a street corner and you are the car no so I'm recording you I was recording your officer go over and pull somebody over you're also want to take a picture of that is this a lawful order it is okay is the First Amendment Constitution the Press not a legal thing anymore this is [Music] and this is a Florida statute correct sir I'm asking you a question thank you sir [Music] now there's no filming out here yeah anybody else wants some information you got it right yes sir what's your Bachelor officer officers so this is this is the description of what it is okay why this is considered this is the definition of like a race of exhibition all of those things okay and why we didn't really highlight well why out here filming is now against the law that went in effect on October 1st so we're just trying to out here be out here educated sure do you mind if I ask a question go ahead where is anybody doing any of the things listening so as they're coming out they start chirping tires they start squealing they're doing burnouts I want to be on the level with you guys because I don't want you guys so my question to you constitutionally protected activity First Amendment press freedom of press not able to record whatever he wants to do it no you're you're on public property are we not on a sidewalks that's why I passed out the information too yeah it's like I'm not recording any I don't care to record any cars I'm sitting here hanging out in the shade for that reason understand it I just know every everything so wrong hear me out for two seconds hear me out for two seconds this is a Florida statute the Constitution says that you have freedom of press so that's superseded that's what I'm curious about it that are leaving slowly I mean the reason being is so this is a weekly event called Cars and Coffee where people show up with their nice cars and have coffee together one officer Hatfield is telling these kids is that anyone anywhere near this so-called Cars and Coffee thing who's recording anything will be either cited or arrested for recording in public but it seems to me that so blatantly violating the right to Free Press in Florida could be incredibly dangerous for these officers Marbury versus Madison 1803 says that all laws which are repugnant to the Constitution are null and void which essentially means that it really doesn't matter what some ridiculous clown writes on a piece of paper if your so-called rule law or statute violates someone's individual rights or Liberties it is not a law at all couple that with the fact that Florida is a stand your ground state meaning that when somebody unlawfully tries to attack you you have no duty to retreat or try to get away and that the state recognizes your right to stand your ground and use Force to defend against Force up to and including deadly force since all laws are in enforced by force and violence this makes enforcing unconstitutional laws extremely dangerous for an ignorant cop who might try to force this on an actual educated member of the public a couple of weeks later Palm Beach Free Press did return to the same location to record again one officer immediately demanded that everyone put their cameras away but another officer told him to stand down I put a link to that video in the description and the pin comment below so go check that interaction out and make sure to subscribe to Palm Beach Free Press while you're there because it's only a matter of time before one of these clowns actually tries to enforce this Palm Beach Free Press and Acura Amanda will be doing regular follow-ups on this as they're local to the area
