and they called you specifically to violate my right of freedom of speech yes they did minimal speech until you offend somebody minimum speech until you offend somebody no hi james this is sergeant scott with the bravo's police department how are you i'm doing good how are you sergeant scott i'm doing well well i got these guys uh running around with patches on their shirts that are that read new braunfel new braunfels police department okay and that offends me um they've got it written on their cars they've got it written on their shirts i mean it's it's just all over the place and it's i find it personally i find it offensive um is there anything that you can do about that can you arrest them are they police officers yeah they are but it's still offensive to me all right i don't care i'm done talking with you minimus [Music] today's video is coming to us from jason jensen on youtube and features the ignorance of the new braunfels police department in texas jason was having a civil dispute with camping world and decided that he would protest on the public sidewalk outside of the business police department why are you here [Music] no they can't read i'm pretty sure they called you because they don't like the freedom of speech [Music] have i done a committed a crime do you have a probable cause it might be entertained what's your sign saying that is asking huh do you mind just asking what your sign says says okay is that really what it says [Music] them all right if you want your camera's directly on me that's fine but i do like talking eye-to-eye if you're good with it okay so have you tried to talk to them and settle the whole issue uh-huh okay i made it all the way to the ceo okay so this is the thing all right we get a call we get a complaint you're holding a sign that doesn't have vulgar language no it doesn't work listen it doesn't i've held this sign in two states and three counties listen so now you know what it means right we know what it means that does not matter vulgarity is a legal term listen i'm not here it's a representation of vulgarity kind of like you know on tv when they go feet no is this a consensual conversation if we get further calls okay because now that we know what your sign says that causes a disturbance that actually is illegal no it's not going to be a nice work i don't care whether you disagree or not you can't you can't you can't convert you can't convert my freedom of speech okay yeah and it offends people especially if there's families and these are all examples if there's kids in the car i close the sign but you can't see it yeah i can i know you can't see it uh-huh how many people were in that car that just passed i wasn't okay no no no there is a car right there with two people in here and i was pointing the fact that you guys are here and they called you specifically to violate my right of freedom of speech yes they did minimal speech until you offend somebody no this cop has got it all wrong your feelings do not trump somebody else's right to freedom of speech besides that the debate here is completely off base it really doesn't matter if the sign does say the f word that is protected free speech here's a few audio excerpts from cohen versus california where the supreme court ruled that offensive speech is protected speech what this young man did was to walk through a courthouse corridor in los angeles county on his way to a courtroom where he had some business while walking through that corridor he was wearing a jacket upon which were inscribed the words [ __ ] the draft also were inscribed the words stop war and several peace symbols when he entered the courtroom he took off his jacket and held it folded when he left the courtroom he was arrested for disturbing the peace specifically engaging in tumultuous and defensive conduct in this respect it's no different is it from what it would be if you've been picked up out on the street in front of the building or in any other public place exactly mr chief justice i think that's right i think it's important at the outset to point out to the court that there was no violence no component of violence present pointing out as it does as it can do depending upon this on this court's decision the very vital distinction between dissent which may be offensive to people some people may not like it but non-violent dissent is terribly important we submit your honors that this court may clear that distinction that dissent by its very nature involves the right to be offensive if non-offensive dissent is almost a contradiction in terms because if it's not offensive it means you agree with it when you're displaying these signs and people are calling because it's offensive to them that is they know their crime say that minimal speech until you offend somebody no no sir yes no sir okay i did not there's no vulgarity no watch the language well you can go [ __ ] yourself okay okay well there you go say that's the freedom of speech we're gonna talk to them if you step on the property i have not touched their property line if you step on the property we'll talk to them if they want you to go to jail you'll go to chat well you'd have to trespass me first and then give me notification right which is going to be harassment since i never touched their property line well go ahead you go talk to them no problem i let your badge number 283 280 what's your badge number yeah so are you under oath here today did you no as long as you didn't take an oath no yeah i'll take a water if you really want to give me one what's that i'll take a water if you really want to give me one okay you sure you don't want sunscreen man i'm positive okay all right man you come back and arrest me we'll see if your your qualified immunity holds up okay no problem you gotta learn that definition first though no i know what qualified immune this right here is clearly established rights clearly established newport hey um i wanted to uh uh get somebody arrested here okay what's going on um the guy's got something posted on his vehicle some words on his vehicle that i find highly offensive okay i'll have an officer reach out to you by phone whenever they do it'll show up as a block your private number okay okay i can't i can't believe how offensive this is this is this is ridiculous all righty sir i'll like i said i'll have an officer uh give you a call okay okay i'll just i'll be here crying until i get a call back thank you this is james hi james this is sergeant scott with the bravo's police department how are you i'm doing good how are you sergeant scott i'm doing well i was returning your phone call to request to speak with a supervisor yeah um how can i help you today i've uh i've got an issue uh with uh some vulgar uh things that offend me okay and wanted to see if you could arrest anybody for that let's hear about it what's the complaint well i got these guys uh running around with patches on their shirts that are that read uh new braunfel new braunfels police department okay and that offends me um they've got it written on their cars they've got it written on their shirts i mean it's it's just all over the place and it's i find it personally i find it offensive um is there anything that you can do about that can you arrest them are they police officers yeah they are but it's still offensive to me i i don't care i'm done talking with you is that a no that's a no well sir it's offensive okay okay so they can just say whatever they want and and and you know display whatever words they want even if i'm offended i mr freeman i'm not concerned if you're offended by the word police that's not an offensive word look have a good day i decided it's offensive if it's offensive to me then it's offensive do you understand then you can just be offended what i mean isn't it illegal once somebody becomes offended though no it's not anything until you offend somebody so just because somebody's offended by a word does not make it illegal i don't i don't care that you're offended by the word police but the question is just because someone is offended by a word that doesn't make it illegal no that's not the case until you offend somebody that's not how the law works you're trying to lump in a whole group of stuff that's not not how it works what do you mean so i can tell that you're playing a game a play on words about what word is offensive to one person or offensive to another okay so you you've decided that you wanted to play a game i'm not here to play games if you have a collegiate oh this isn't a game i assure you this isn't a game the question is then is is the fact that i'm offended by a certain word does that mean that people get to get arrested or does it not i'm i'm not here to give you legal advice about that sir well i mean so you're not a lawyer are any of your officers lawyers then what's that do you have a legitimate question yeah that's a it's a legit why do you why are you uh just passing me off and pretending that my question's not legitimate because you're trying to play games i'm not playing a game okay the question is if i'm offended by a word that somebody uses or says or writes on something does that make it illegal no okay well i mean it was that simple then right okay so will your officers be telling anybody else that words are illegal because they're offensive it depends on the word sir it does not depend on like what kind of word mr freeman i don't have time to play games with you it's not a game tell me what words can be what tell me what words tell me what words are illegal if you have any questions about what words are illegal and what words are not you can call the new braunfels police department in texas
