reporting in a public building. I can record in here. >> No, you can't. >> I can. >> No, you can't. >> Yeah, I can. >> You're about to get dumped. >> Yeah, you're about to pull away from me again. >> What are you going to do? What are you going to do? What are you going to do, Bill? Man, >> stop. >> You don't have to do what you don't like being recorded, Patrick. >> Huh? >> I don't want you to be my fake. >> What do I care? Wait a Nobody's scared of you guys. That's what you want. You want people to be scared of you. That's what I want to do. >> Sounds to me like you're kind of scared, Patrick. Am I scared? >> Yeah. >> Yeah. >> Don't hit me. >> Don't hit me. >> Have a seat so you can put your >> Stop. >> Hey, your reasonable bar sit down. >> Your reasonable articulate suspicion is that you're arrested. >> You're arrested. >> Get up. >> Give me my shoes. >> Get up. >> I don't have to. >> I gave you an opportunity. >> I don't have to. I don't have to listen to you. Do you understand that? You're not my master. >> You are out of control. >> You're not my You're out of control. You're out of control. screaming like >> you're cuz you're in my face and you won't let me go. You're out of control. >> In November of 2024, Patrick noticed Officer Neper with the Tucson Police Department inside of a multi-purpose city building. A few years prior, Patrick was recording Officer Neper on the streets when Officer Neper attacked him and then charged him with assault. >> District two. >> Dude, get away from the back. Get away. I told you not to come out. Needs to smack me. I ain't smack you. Get off me, dude. >> What do you want? >> What do you want? Get in your camera. >> Put your hand behind. What do you want? Put your hands behind your back. >> What do you want? What are you doing to me? >> You just smack me that camera out. Come on, man. >> Behind your back. Stop resisting. >> Those charges against Patrick were dismissed, but Patrick vowed to record Officer Neper every time he sees him from here on out. So, in November 2024, Patrick sees him inside a city building and he records him. Officer Neper goes and gets an offduty police officer working security in full uniform in the city building and has that offduty officer arrest Patrick. Offduty officer Weingerrad takes Patrick to a cell, taunts him and tortures him for 2 hours, charges him with trespassing and resisting arrest and then releases him. >> You're supposed to call your your boss. That's your boss right there. >> That's your boss right there. You're off duty, >> Mr. Gonzalez. >> You're off duty. In the event number and case number, Mr. Gonzalez is here at city court causing issues. Causing issues reporting. >> You know the rules, Mr. Gonzalez. >> You know that. You know the rules. >> What you mean? >> It'll be on the arrest paper. >> Step ahead. Please. >> I didn't ask you to leave. >> I did ask you to leave. >> You didn't give me an opportunity to leave. I did ask you the link. >> I asked you the link as well. Huh? That's fine. >> And you already know the rules. >> The rules they're referring to say that you can't record members of the public without their express consent in areas used by the court. Now, whether or not a rule written by a bureaucrat that circumvents the legislative process is legitimate in any way in the first place, Patrick wasn't even violating the rule. He was recording a public servant. And he wasn't even in an area that was exclusively used by the courts. Again, this is a multi-purpose building with multiple different city services. The point is, the rule is questionable in the first place, but Patrick wasn't even violating the rule. >> You flipped me off. >> Good. I know. I want to see you record again. >> Absolutely. Please. >> I can't wait to see you recording. Is that your body camera? >> I do. >> My body camera is dead. Officer Neper's body camera is usually dead and he very often doesn't have footage of questionable incidents. >> Stop. Face that wall. >> You got your camera on? >> I sure do. >> Stop grabbing me or manhandling me like that. I can say whatever they want. You don't like >> wine guard grown up. >> Oh yeah. >> Spread your feet, Mr. Sorry, Mr. Gonzalez. Spread your feet. >> What are you doing, man? This is supposed to be a trespass or whatever. What are you resisting arrest? >> I'm not resisting arrest. >> You are resisting. >> I'm not. I'm right here facing a fall here. >> You are handling. I'm not resisting arrest. >> You could say whatever the [ __ ] This is illegal. >> This is illegal. Can you be arresting me? >> Yes. >> No. Security guard. You're off duty. I like your duty. >> You're on duty. [Music] >> Yeah. You're not on the payroll. You're security. You're working moonshining. >> It's called moonlighting. >> Moon lighting. >> Moonshining. Something totally different. >> You know what I'm talking about. This guy kicked me out of a public. Stop. >> Stop manhandling me. >> You're about to get dumped. >> Yeah. You're about to >> pull away from me again. >> What are you going to do? What are you going to do? What are you going to do? Been manhandle me. >> Stop. You're going to No, I'm not. >> You are spitting when you >> You're going to slap Why you slamming my face into the wall, dude? >> We slammed you. >> Get my face out of the wall, dude. >> Stop spitting on me. >> I'm not spitting on you. >> Spit on me when you're yelling. No [ __ ] >> did you guys assault charges. >> You guys are tyrants, man. Stop pushing my face into the wall, dude. >> God damn it. >> God damn it. You can't just grab me and manhandle me. >> Nobody's manhandling you. >> Yeah, you are. You be getting aggressive. You be getting aggressive. >> Spitting on me. >> Stop pushing my face into the wall, dude. >> Stop spitting. >> I'm not spitting on you. >> Yes, you are. >> You don't like it. You don't like being talked to like that, huh? You guys >> spit on. spit on you. I don't like being illegally arrested and slammed against the wall and manhandled by a [ __ ] and yelled at by a [ __ ] because I was finally >> turn around and sit down. >> Sit down. >> Exercising my first amended constitutional right. >> Sit down. >> No, I don't want to sit down. >> Sit down. >> Why do I have to sit down now? >> We're searching you. That's >> for what? >> This is your first road. >> You know what the first amendment is, right? I can record you anywhere, dude. In the public area. >> No, you can't. >> I wasn't I wasn't recording any individual >> and nobody You're the complaintant. >> Patrick, you know the rules here. >> Yeah, I know the rules. >> You know the rules. >> How many times have I beat you guys on this [ __ ] and you guys keep doing the same thing over and over and over again cuz you don't like people recording you. >> Sit up straight, please. >> You hate it, Neper. You got criers. >> You got You got criers, Deer. You see somebody with a camera, you attack them. You You manhandling me, dude. There's an on duty officer right here. >> Stop you, dude. >> No, you. Dude, you manhandled me for nothing, dude. Because I was recording and you guys bring me in here, strip me, and take my my fourth amendment with the first amendment right to record you guys whenever they want. Rule 1221. You real [ __ ] I don't have to sit down. You're not my boss. You're not my master. You're an offic security. Guard yourself. You You're not tough. The only reason you guys are walking out of here is because you guys are cops and I let you guys do this. >> Really? >> Yes. You guys shouldn't be putting your hands on me for recording you guys. I have a first amendment right to show the t I record you guys for the interest of the public because of the way you guys act. >> Are you done? >> No. You tyrant piece of you. I don't have to listen to you. You're not my boss. going to jail today. >> I don't give a house here. >> No worries. >> I'm sorry, Mr. All right. Are you on duty or off duty? >> Where are you living? >> Are you on duty or on duty? >> Okay. >> You Who's the Who's the complaintant? >> What is he? You [ __ ] No. You guys can tell me trespass, but I ain't scared. I'm going to see you in court. I'm going to be laughing my ass off. You have no reason putting your hands off me on offduty cop. Off duty cop. >> Uh, he's refusing to give me his birthday. That's Patrick Gonzalez. Can you try to run him? Did you run into him upstairs? >> Another trial for one of his buddies. >> Officer Neper admits that he first saw Patrick inside of a courtroom where Patrick was observing another trial. Since the rules do apply in that courtroom, Patrick waited until they were in an area where the rules don't apply to start recording Neper. >> Boy, come over here and look at me. I want to listen to you pretty. Hey. So, what's the rule? What What ver you arresting me for? >> I'm arresting you for trespass, Patrick. >> For trespassing? >> Yep. >> You know how this game is played? >> For recording in a public building? >> You know how this game is played? >> For recording in a public building? >> Foring an officer. >> Patrick, >> you know how this game is played. How many times have you been arrested for this? >> Huh? >> How many times have you been arrested for this? >> For trespassing in a public building? >> For doing what you're doing today? Step back. We we we need a pirate. >> You're a pirate. Sit down. We're going to record you. No. Sit down. No. I'm sitting I'm standing right here. >> What does that mean? I'm going to come find you. >> I'm going to come and find you and I'm going to record you like I recorded this dude. >> Some sort of threat against violence. >> No. I'm going to record you with [ __ ] I'm going to record you. I'm going to record you. What are you going to do? Hit me? Nobody's scared of you. Nobody's scared of you. I'm going to record you for being a tyrant. I ain't scared. I see you as food. You think? Cuz look at the way you're grabbing me. Let me go. You're going to beat me. Oh, nobody scared. >> Oh, no. Who's scared of you? Nobody's scared of you, dude. >> Sit down. >> No, I'm not sitting down. >> Sit down. >> No. I'm going to record you guys. I'm going to record you guys every chance that I can get. >> I need to get some pictures of your face when you ground it into the wall. >> I I'm going to give some pictures of you every I'm going to record you guys every chance I get. Every chance I get. >> Do it outside this building. >> And I'll do it in this building, too. >> No, you won't. >> Yeah, I will. You're not my foot. >> Sit down. >> I'm sitting down. Stay seated. I need to get some >> Turn your camera on, Neper. Neper, turn your camera on. This is the offduty cop. >> Mine is on. >> Sit still. >> No. >> No. >> Sit still. >> Stop manhandling me, dude. I don't want you to be in my face. >> Okay. Tyrant. >> Tyrant. Sit down. >> No. >> I don't listen to you. >> You're not wearing mask for you, punk. You >> Yeah, I said you. >> I said you. Ain't nobody scared of you guys. That's what you want. You want people to be scared of you. >> That's what I want. >> Sounds to me like you're kind of scared, Patrick. >> Am I scared? >> Yeah. >> Yeah. >> Don't hit me. >> Don't hit me. >> Oh, don't hit me. I wish you would. I won't give you that pleasure. >> You're not worth it. >> Okay. >> You know, even with these cuffs on, >> you're in trouble if you did that. >> Oh, you're in trouble. >> Officer Werad tries as hard as he can to taunt Patrick to violence. >> Who Who's testing Lander? You're his >> mine. >> You're not a cop. You're a security guard. >> Security guard. That's a clown robber. What's it say? >> What is that mic right there? What is that walkie-talkie? Is that walkie-talkie? Is that Is that a Is that from the police department? Is that Amos walkie-talkie? You're off duty. You're supposed to call him and he's supposed to put his hands on security guard. >> That's why I'm here, Patrick. To deal with idiots like you. >> Oh, yeah. >> Yeah. >> What >> exactly? >> To what? >> You heard me. >> What? People who who record you? >> People who are Yes. United. Yes. >> No. People who violate the law. people. Oh, what am I? >> You're trespassing, Patrick. >> Patrick, you're trespassing. >> I don't care. >> Patrick isn't breaking the law. But it's kind of good that Werad is the one who put his hands all over him because Werad is off duty, not acting in his official capacity, and has no qualified immunity acting as a security guard. In this situation, Officer Weingerdrad is nothing more or less than Mr. winerad and has put his own personal assets on the line in this particular lawsuit. >> Patrick, you know how this game is played, dude. >> Huh? Are you hard of hearing? >> Uhhuh. >> Are you hard of hearing? You ask me. Huh? Every time. >> I don't know. You tell me. >> Hey, how are you? >> Good. How many times? >> All right. >> What's that? >> I don't know. I just got here, dude. Step back, Mr. Gonzalez. >> Step back. >> So, you're arresting me for recording an officer in a public? >> Step back, Mr. Gonzalez. >> Have a seat so you can put your shoes back on. >> Have a seat so you can put your >> Stop. >> Hey, your reasonable bar. Sit down. Reasonable articulate suspicion is that you're arrested. >> Screaming like you're cuz you're in my face and you won't let me go. You're out of control. >> Let's get going, man. >> You're out of control. >> Hey, so your reasonable suspicion is that I was reporting an officer. Your reasonable articular suspicion is that I was recording in a public area. >> Get up. >> That your reasonable articulate suspicion is that I was recording in a in a public area. >> No, you're trespassing. >> Oh, what rule did I break to trespass? >> 13502. >> Oh, 131502. It says that I can't record a It says that I can't record an officer in a public area. >> You guys ready? >> It says I can't record a public I can't record officers. 13 what? Idiots. All right, we'll set you back down so you can sit in the car. I'm not going to sit nowhere. Okay. >> I'm not You guys are illegally arresting me. You guys are arresting me for recording an officer in a public area. >> Sit up. >> You guys are arresting me for recording an officer in a public area. >> Patrick, this is going to happen today. Okay. >> I don't care. Let's go. >> You're in trouble. Make sure you do the paperwork and make sure you state what rule that you're arresting me for trespassing. >> I'm not getting up nowhere. >> No. You think I want to go to jail? You think I want to go to jail because y'all recorded you guys? You guys are tyrants. Make sure you guys are all body cameras are on. Yeah. Your reasonable articulous suspicion is that I was recording a an officer, an on duty officer. I don't even think you're on duty, bro. >> I was recording an onduty officer in public. >> All right, Mr. Gonzalez, go ahead and get up and get in the car. >> Nope. >> Okay, then we'll put you in the car. >> You can do whatever you need to do because you guys are violating my rights, my first amendment right to record a officer in the public for the public of the interest. They have a right to record you guys. And if you guys are tyrants like this guy is behind me, then I get to tell you every time I see you whether you like it or not. I don't give a >> bad I'll get this one. >> Okay. All right. Let's go. Legs. >> Nope. >> Why you guys arrest for recording officer? Guys, you record cuz I record cops. Rule 122.1 states that I can. >> We told you numerous times to get in the car. >> I don't have to get in the car. >> Okay. >> I don't have to help you guys violate [ __ ] rights. >> You understand? I don't have to have I don't have to help you guys break the law. >> Sit up, Patrick. >> I can't. >> I don't have to help you guys break the law. >> Face forward. >> So, you're arresting me for recording an officer. What rule? Make sure you put that in the paperwork. The rule that you're recording me. You're being arrested for criminal trespass and for resisting arrest. >> Yep. So what? >> For what crime? What's your reasonable articulable suspicion? You Hey, what's your reason what rule? >> What's your reasonable articulate suspicion? >> I don't care. You could arrest me for 30 different charges. Matter of fact, you could put uh disorderly conduct. Put that on there, too. Hey, and uh uh >> cuz your reasonable articulate suspicion is I was reporting an officer. Sit back. >> I was reporting an officer. That's right. idiot. >> Bye, Mr. Gonzalez. >> The police actually ended up citing Patrick, giving him all his stuff back, and releasing him. I was at the Tucson City Courts that same day conducting business of my own, and at the time had no idea what had happened to Patrick. I was recording discreetly rather than openly, and my discrete camera devices aren't very high quality, and they don't always catch what I want in frame, but this is what I've got to work with. When I went outside, Patrick had already been released and was recording security guard winerad through the window. I had some squash that my boss Bow had asked me to bring into the courts to squash his warrants, but the courts didn't want the squash, so I went to offer it to the security. >> Anybody hungry? >> How are you? >> Good. How are you? >> Doing well. >> Go ahead. No, go ahead. I I just I brought these in for them and they don't want them, so I want to see if anybody else wants them. >> You guys eat squash? Okay, >> I guess I made a mistake and so I didn't want to let the food go to waste. I was told I had to bring squash in to squash a warrant or something >> and I went into the court and said I told them, you know, there's a lot more where this came from. I got an exclusive hookup. >> Um, anybody but but they don't want it, so I don't want it to go to waste. >> Not poisoned, nothing. Anybody? >> No, no, no. It's just I don't even know how to cook those things. >> Oh, really? I actually ate one of these a couple of weeks ago. My neighbor grows them. I don't like it though. Yeah, I didn't like it. Um, we cooked it with you cut it in half and then uh throw butter on it and a ton of brown sugar cuz they're they're really not But I didn't even like it like that. Nobody want to try them. >> And butternut squash. >> Okay. >> All right. Cool. Just hate to let a good squash go to waste, but >> the guys outside. >> Yeah. I mean, >> are these guy >> Are these guys homeless or something? >> No, they're uh they call themselves First Amendment auditors. >> The guys who are staring through the windows. >> Yeah, they're recording and they know they're not supposed to record in the building. I just arrested the other guy in a black t-shirt earlier this morning and he came back to get his phones and he was carrying on being an idiot. So, >> I only see the one guy there. Oh, I think I saw another guy when I walked up. walking back here. >> Are they recording me right now? >> Yeah. >> And you're going to be >> record. >> Oh boy. >> I uh I don't want to give the squash to them. >> Let's put you squash there. >> Maybe if I give them squash, they'll edit me out. What a bunch of clowns. Are you serious? Can I wait in here until they leave? >> They won't. >> They're not going to leave. >> Yeah. Just don't talk to them. >> Yeah. Don't engage with them. >> Yeah. Don't engage in >> Yeah. Just walk past them. They'll be okay. >> They're not violent people. >> They're not. >> Especially if they're recording themselves. They're not going to do anything. >> What? That's weird. What for then? It's for YouTube or something. >> Just to just like public for like those public freakout videos or something. Try to get people to freak out publicly. Those are funny. Have you seen those? >> Well, no. They're they're doing it to goat officers into doing or saying something stupid while they're being recorded and live streamed. >> I highly doubt officers would do or say something stupid, though. >> I mean, sometimes our emotions get the best of us. >> Yeah. >> All right. So, if I can I go out the way I came here? Okay. I'm going to run. Hey, if they try to beat me up, will you will you help me? >> Sure. >> Yeah. You have a >> right to defend yourself. >> Yeah. Can I shoot him? >> Probably shouldn't do that. >> I'm just wondering. I'm I'm just looking for legal advice. Don't shoot him. Tase him. >> Can I borrow your pepper? >> Can I borrow your pepper spray? >> Look, I'm I'm just a ginger, man. I'm used to getting beat up. But >> which way do you have to walk? >> I'm going that way. >> Yeah, you'll be okay. >> Okay. I've been getting beat up since grade school cuz I'm a ginger. So, whatever. >> Yeah, if you go that way, you should be fine. >> All right. Thanks. >> Appreciate the generosity. All right. Have a good one, guys. >> You too, buddy. Thank you. >> Security guard Mr. Benjamin Weingrad was so moved by our encounter that he even wrote a story about it and submitted it to the Tucson Police Department. He says a third unknown white male, possibly a male who uses the name James Freeman, was inside the public lobby area. He had a clipboard and a bag with two squashes inside the bag. This male was a white male, approximately 6t tall with a large reddishcoled natural beard and prescription glasses. This male asked me what Brown and Gonzalez were doing outside. I told this male. It appeared to me that Brown and Gonzalez were recording slashlivestreaming the interior of the building from outside. The male asked me if he was being recorded. I told him he likely was. This male told me he was afraid to exit. I told this male Brown and Gonzalez had not displayed violent behavior to me in the past. This male asked me if I could protect him if he left. I told him I would. This male asked me if he could shoot these males. I told him that this was not a good choice. This male asked me if he could borrow my pepper spray. I again told this male I would not loan him this item. The male exited the public lobby and ran eastbound on the north side of Alamita. I moved into an area of the court building to where Gonzalez and Brown could no longer focus their cameras on me. Brown and Gonzalez continued to record the inside of the building from the outside of the building. They continued to display their middle fingers at me and security staff from the outside of the building. I ignored the subjects and went about my duties within the court building.
