relax and enjoy narrative on august 11th i lions was traveling southbound on government way when i noticed a vehicle northbound on government way the vehicle was the only vehicle on the roadway and appeared to be moving at a high rate of speed i visually estimate the speed at 60 miles per hour i confirmed with radar at 57 miles per hour in a posted 35 mile per hour zone i immediately activated my emergency lights and conducted a u-turn the vehicle continued northbound on government way without any indication of slowing down the vehicle maintained its speed but what a reasonable person would have seen the emergency lights and heard the siren which was activated after approximately a half mile the vehicle came to a stop i noticed as i spoke to him his speech was slurred and his eyes were red and bloodshot i could smell the strong odor of alcoholic beverage coming from his breath in person as he looked for his documents his movements were very slow he admitted to having several drinks earlier in the evening how's it going good how are you good you know what i'm stopping here no 52 miles an hour and a 35 sorry jay do you have driver's license with you uh your friend there got a driver's license with him or any form of id not sure does he acknowledge that somebody's knocking on his window yeah um you're not allowed to yeah that's fine yeah i do but you don't need that what's up with your boy hey this is your enhanced weapons permit you got a driver's license not on me no okay how much you had to drink tonight man uh yeah yeah we're fit shaped mike you can film him all you want mike you need to produce identification what wait what you wanted to but not you might hey let me see yours my stop please city's out with me but i'm not code for you've been drinking tonight sir citizen but i'm in jail i like it here it's nice i like it what i said i asked if it's real too on the passenger the one with the alerts from ffs19 we check and see if he's a felon what is his name you guys she's got it yeah yes you want me to run in piece of meathauster yeah what yeah the one sitting on the ground there okay [Music] hmm and that's all passengers i'm guessing mm-hmm sitting in between his legs uh taking them on obstruction and then oh we got a track if we go and run a criminal history on it take concealed carrying concealed while talks as well yeah as it is in most states it's illegal to carry concealed when you're drunk or high in idaho well it was then it's in the bag to my understanding that still would count it was in his lap yeah still concealed he's still drunk hi this is mike gravlin from law talk with mike and i'm going to offer my opinion here on this stop i think it was an interesting clip um yeah you know i do civil practice i don't do criminal stuff but that doesn't mean i'm not entitled to an opinion [Laughter] anyway they pulled this guy over for speeding i think the initial stop is good that's that's not a problem at all uh a lot of the stuff you can't see but you but i see enough to to say i think this is an absolutely good stop all the way around um and both arresting the driver and passenger here's my justification for it uh they pull him over for speeding when he has some produce a license he produces a weapons card that gives me all the probable cause i need to investigate this for two reasons one it could be sort of considered a threat in and of itself but it certainly leads you to think there might be a weapon in the car and two it's not responsive to the request for a driver's license so it makes you wonder a few things the passenger was belligerent the whole time and they asked him to get out but now we've got somebody who is speeding when you ask for a license they produce a weapons card and they have the odor of alcohol assuming those things are correct now i'm you know i wasn't there but that they really did get this guy on radar speeding the initial stop is good assuming that they really did smell alcohol then then it makes sense to get him out of the vehicle and do that and also the one thing i did see on video is him handing over that weapons card that's enough to to search that whole vehicle in order to search that vehicle you need to get the people out of there it also does not help their cause uh the defendant i'm thinking specifically the uh passenger here doesn't help his cause that he's belligerent given the totality of those circumstances and then being belligerent it it gives the officers good cause um but both of these things i mean i think if you know if you really had to justify it you're going to look at pennsylvania versus mims and terry versus ohio my many thanks to law talk with mike for helping us out and getting his thoughts on this clip yeah in any state when you're
