tail light you're going to take her car God to adise you but then find out she's got a revoke license so she can't operate a motor vehicle in New York City do you have any evidence that she's operating in the commercial capacity operating in the commercial capacity yeah let's check the New York vehicle and traffic law section 502 right yeah that's the definition of a driver's license uh nothing about commercial all the way at the bottom where you can apply for a commercial driver's license she's in the driver's seat with the keys ignition of my she's not engaged in Commerce do you out of the car with me right now we got some paper why does she have to step out of the car because okay because that's not a reason right now she is what crime do you suspect her if haven't committed arrest we driving on a revoked license under arrest the paper under arrest yes yes sir she's under arrest write her a ticket oh my God come on you guys this come on you're putting her under arrest for a tail light out for a tail light out you're putting her under arrest more moments later you guys don't have to do this doing our job as I explain that's not your job you could have just told her there a tail light out you need to get that fixed that's all to do crime that's a crime yor right or a ticket no it's a misdemeanor sir meaning what so there's three levels of violation in New York State traffic in fractions are not crimes people versus Battle sir this is not a traffic infraction this is a misdemeanor so there's felonies two forms of crimes in New York state misdemeanor and felony this is a misc commmun offense so this is not a be AIC law uh violation where are her keys I don't know keys I believe they're still in the car all right well I'm going to take her car you're not driving the vehicle I'll get her permission unless you me with a valid driver what is this Nazi Germany what is this a communist country or something is this America I don't need to provide you with I didn't commit a crime you can't take the car you're right you did not commit a crime you can start walking what you no one keeping you here but you cannot take the vehicle why because you do not have a valid driver license you're providing with to I don't have to provide you a valid driver's license to get in this car state law agravated unlicense operation to second degree it's a misdemeanor uh we're required to to the car if you would have provided us that you're a valid driver in New York state our supervisor I don't have to prove anything to you guys again you're getting argumentative before I can even expl okay go ahead so again we're required by policy and law to tow this vehicle under certain circumstances our supervisor can let a licensed driver take the vehicle to save you guys some money on a to what law is this that's New York state vehicle and traffic law which one aggravated unlic operation to second degree which law New York vehicle and traffic law 511 section two specifically that addresses your driver's situation reading is good so that's what happens when someone's license is revoked it's not even suspended it's a step further it's revoked so we're trying to help you out by Saving you some money to not tow the car and the only way we can do that is by providing that a passenger has a valid license so we can let you operate the car and leave and that's up to my supervisor who is right here that's why we're trying to help you out a little bit here we're trying to be reasonable just let me take the car you you're taking her to jail no one's taking anyone to jail who said that why is she in the car then because we have to do a little bit of paperwork because it's a misdemeanor offense I don't know how we can be any more clear with you and again we're being respectful to you I understand that this is a lot did you put handcuffs on her no we did not and again we can't you guys just give her a warning sir sir we could have put her handcuffs but again we're trying to make this as least intrusive as possible but least intrusive would have been to just give a warning s the tail light out you guys are acting like Nazis again that's your if that's your opinion but or not this is America why is there three uh cars here again that's pretty standard whenever there's a Mis offense there is no offense who's the injured party so not every crime has a injured party so what's your names and badge numbers there's any officer razor badge 89 officer Star 86 so if there's anything in a vehicle you want to take out advise you to take it out now because we have a tow coming you're stealing her car we're Towing the vehicle you're holding it you're you're holding it to extort money to vehicle and traffic we tried to save you money but you refused to give us the bail of driver's license so we have to go car our policy I don't why do I have to um show credentials you this is not your car I you don't have to but if you want to take the vehicle you have to provide that you have a valid driver's why do you go to 711 and everyone leaving out of there has to show you a valid driver license to take their own property my partner already explained it to you so it's under New York state law that the car committ a crime now no it's it's a reason to tow the vehicle it's required under aggravated un license operation in a second de so again and that's our policy as well can you articulate that aggravated unlicensed operation second degree operates a vehicle with a revoke driver's license pending certain swich this verbatim or you paraphrasing no I'm paraphrasing can you show me the law you can look it up I'm sure you have a phone right there show you the law show you the law it's all you want show you the law 511 subsection two right there it's a law to look up the specific statutes what this is unbelievable you guys ruin people's lives like this every day there's been no crime this is a crime you're taking somebody's car against their wishes we're trying to do everything we can to help you guys out not take the car huh try to do everything they can not to take the car you're not helping that situation there that crime comes in it's a misdemeanor but it's still a crime and you guys want to take the car you know what's that going to cost few take the car well then then then then don't G you every option not to take the car but Go pass that what do you mean because I don't have a valid driver license to present to you yes well how do you know that care do they don't have a valid driver license driver wasn't arrested for operation degree that's the kicker here is that that driver was not arrested for aggravated unlicense operation the second degree which is you guys caused that we didn't drive on a suspended driver's license or revoked driver's license no we did not was there a collision I don't know I don't believe no there there wasn't 23 minutes this is an extended stop it's no
