similar argument before a different judge the defendants were detained july 3 after an hours long standoff with the state police on route 95 the group traveling through massachusetts to maine from rhode island were stopped from the side of the highway in the early morning hours when the troopers stopped to offer assistance according to reports the trooper found the men were wearing tactical official counsel others appeared on standby bases as several of the men have petitioned the court to represent themselves christian williams of the harvard law school criminal justice institute appeared for omar malik antonio l complained of the state's motion for continuance and said the state lacks good cause for delay while an ongoing grand jury criminal investigation is a factor in granting continuance it is only a factor not a prime reason for granting a continuance argued williams adding the state doesn't even have that just a date for the proceedings to start september 1st in presenting his argument to release the men williams likened the day's bench hearing to the start of a criminal trial the state he said appears woefully unprepared to proceed if the commonwealth doesn't have evidence it doesn't have probable cause williams argued adding that delaying the hearings allows the state more time to support its allegations the nfs reiterated his argument that the large amount of evidence has yet to be gathered reviewed processed and then released as part of discovery to the defendants and the representatives and representing himself in the proceedings jamal tavon sanders-latimer also known as jamal talib abdullah bay objected to the hearing claiming that the commonwealth of massachusetts does not have merit to move the case if this were about justice you would hear this as one case all of us would be detained together and we would be charged as a militia jamal talib abdul the base said via zoom the state is keeping the ten men in jail with no merit no cause and i'm ready to move today if one is innocent until proven guilty we are innocent and you must release us as there is no crime said jamal to leave abdullah bay we are not guilty of anything but we cannot see our families our fathers our daughters the state is taking its sweet time one defendant tariff sharif bay who was seeking to represent himself claims he has been denied access to mail which bar him from filing necessary paperwork he said including documents needed to change his name from the name listed on the court papers to tariff sherry fay there was no probable cause to begin with said bay in addressing the judge the trooper even said it was a courtesy stop the men have argued they were exercising their second amendment rights to keep and bear arms as well as the inalienable right to have a well-regulated militia at the time of their arrest the group has filed suit in u.s district court in rhode island challenging the state court jurisdiction in massachusetts over the criminal charges facing the men who claim they are sovereign citizens of moroccan descent and immune from state law the moore's filing sites from the treaty of peace and friendship of 1787 strong with each other they want us to come against each other said the man wearing a blue caftan we need to stand firm they don't have anything however the next court date will be september 8th
