frauds what you are witnessing is real the participants are not acting so this is in the matter of the people of the state of Michigan versus Casey Michael McKenzie file number 23- 21324 FH as salvator malaro appearing on behalf of the defendant and I have Dave mccre appearing on behalf of the prosecutor's office um this is the date and time I just have the probation no um why is this just a violation of probation today yeah judge I just noticed that myself um had kand back in April that got bound upstairs thee transcripts probably due next week I think like middle of July at which point we would be looking at motions to file so why don't we move this over to the September 4 date do that if you get transcripts mid July that gives you six weeks to do your motions well I think Mr McKenzie wants things to move a little faster is that correct yeah very 180 days I didn't have a preum for 90 some days AR so you're waiting on your transcripts correct so I they come when they come they have a time period that they're allowed to get those done by and they're not going to be done till July and so you really you know your attorneys probably advise you that you don't want to proceed to get those transcripts so in order to file a motion for my prelim being pushed back three separate times due to a the prosecutor F bad rits or however I think I just would oh I can't argue the merits of that today because I gota wait motions and your attorney will file the Motions so so that means I can't have a tri days that's correct do you want me to s you for trial now yes your honor without your yes M tesy this is a whole separate probation violation from his new crimes like this is a probation violation from him being from treatment it has nothing to do with his new crimes so the only thing we're here for today is your probation violation if you want to plead to your probation violation I'll be more than happy to sent you on that on your probation violation you're actually facing up to let's see so in your probation violation alleges that you absconded from the Eaton County R program um and that requires is that right Miss tesky no he was terminated from the r program right so that's an automatic prison term is that correct Miss tusky that is correct your honor so only thing I can do for you today Mr McKenzie because we're only here on the violation of probation your violation of probation has nothing to do with your new charges so if you want to plead to your violation of probation from being terminated for getting into uh a dispute with another inmate in the program I'd be more than happy to take your plea but understand you're automatically have to go to prison on this judge um when I spoke to Mr McKenzie about that he indicated you wanted to separate here wants to se all right can set you a trial on this so miss tesy how long do you need for a trial to get your Witnesses from Eaton County on this um your honor I would say two weeks two weeks all right Miss Miss um Adams I need probably an hour for a violation of probation trial in your honor for the record I'm sure Mr McKenzie would oppose any testimony by Zoom oh is that correct M yes okay can he do that your honor yep so um I mean yeah it's just someone that works there that's all you need is someone that works there right so um all right so miss Adams I'm looking for about an hour yeah are you GNA call us I'll bring the book judge I'm not finding an out okay and Mr malaro your client would testify potentially and then who else will you be calling as a witness and discuss that you have some Wun tamama yeah tamama Dillard was he there no she's lady that runs it they never took a statement or nothing from me they don't have to they don't have to well judge I yeah I've spoken to her in the past she I think she runs the program all right she does and she was who I would be calling for a witness as well okay okay so are you're definitely going to call her Miss tusky yes so I would not have to subpena her then no all right you okay with that yeah I speak for second no I'm looking for a date so you got to wait a minute yeah I talked to your attorney before speaking up to the judge but that's just me I'm sorry what' you say I told him I know what to say I he I can't be he can't be my lawyer I can't do this with then you are more than welcome to hire an attorney but I I need somebody that's going to do so Mr McKenzie here's the deal you ask for court appointed attorney you get a court appointed attorney listen to me all right you are helding contemp so I'll bring you back next week thank you give me two years of cont you're actually looking at five years oh please don't oh like that's the worst thing I've ever been called me call by that the worst thing you Evert no all right sorry about that your honor not your fault Mr M all right so I'm going to set you control please I'm sorry that is control all right so Mr McKenzie hopefully will be in a better mood so I can't set a trial date now he's left the courtroom so I'm going to set his next pre-trial over on this to you're gone July 31 I'm Gone the 25th through the 33rd all right how about July 17 okay do you want me to set the other file for pre-ra could we yeah so miss miss Adams I'm going to set both of Mr McKenzie's files over to July 17th um I don't have the file number is that right M Adam number I can give you yeah I have it I have it oh she has it and can you doation violation correct no I'm going to set his other file for pre-trial can you do it um you want the number no Miss has it okay all right um can you do the step and order to adjourn this trial from September to July 17th at 8:30 okay all right so we'll give him a little thinking for the record judge I'm down 30
