[Music] Present in court attorney Mary DePuy for the state. I'm here by special appearance as the defendant. Please have a seat. Please have a seat. Mr. Jacobson is personally present and without counsel. Sir, good morning. Were you present in court when your rights were read to you earlier? Sir, I don't consent to this hearing because of lack of jurisdiction of the court over me. I'm not a 14th Amendment citizen anymore. It's in my documentation that no some No one ever reads. And welcome to Facts or Frauds. CR 16, both are titled State of North Dakota versus Michael Jacobson. Zach, give me a second. Your Honor, I'm I'm by special appearance on behalf of the defendant in this case. And what is your name? Michael Scott. Michael Scott Jacobson? My birth name is Michael Scott of the house Jacobson. All right. So, you're the defendant in this case, sir. You're not representing the trust. I'm not going to play your game today, Mr. Jacobson. Though there's three cases. They're filed 23s. Uh these are all set for dispositional conferences. Uh do you know whether you want to proceed with a bench trial or jury trial at this point? Wasn't this going to be a motion hearing? Did you receive the order denying your motion? No, I did not. Did you read the motion? Did you read the Oh, when was it mailed? I just got I just got uh the state's response to it uh yesterday the day before last Thursday in the mail. All right. It was mailed just on the 9th. I can print it for you so you can have a chance to look at that, I think. Give me a second. And I filed a brief in support of the motion. Did you read that? Yes, sir. I mean, there's this is precedent in this case. There's tons of Supreme Court and other high court cases that say I have the right to drive in the private in my automobile without license or registration. Well, I'll give you an opportunity to read the order that I issued. Did you read my affidavit, sir, about that I have changed my status? I've read what you have filed. Do you That's the law. That's your position and I understand that. And I've given you my order and you can read that if you'd like. Look to me like you did read that as we were sitting here. Uh the purpose of today's hearing is to determine whether you want to have a bench trial or a jury trial in the three cases. I don't think the court has any jurisdiction over me. I'm I'm not a 14th Amendment citizen. I'm fully aware I'm not a state citizen either. Or you know, I'm not even You have no The McIntosh County Incorporated District Court does not have jurisdiction over me. Yet here we sit. And you've read my order. I don't think you want me in court. That may be the case, but I don't have a choice in that matter, sir. Do you want to have a jury trial? You understand the difference between a jury trial and a bench trial, correct? A trial by jury. You And you would like a jury trial? A trial by jury. Okay. Uh the um Let me back up and look. So, precedent doesn't matter in this case then. So, it's been decided by higher courts. So, the three charges in 50 is driving under suspension and unlawful display of plates. In 16 it's just driving under suspension and in 36 it's just unlawful display of license. can you suspend someone that doesn't have a license anymore? I never renewed my license in September of last year. Would you like to have three separate jury trials for these cases or would you like to do it all in one day in one jury? Do it all in one day. State agree to that? Yes, Your Honor. All right. Uh how much time does the state need to be ready for trial? Um probably about three or four weeks, Your Honor. All right. Uh can you be ready in that amount of time as well? Can we wait till after the 1st of the year? Probably would be after the 1st of the year anyway. So, in January or February? Yeah. All right. Uh and you're going to represent yourself? Yes, sir. All right. Any other issues that you would like to take up today? I'm not going to get railroaded to this. All right. And that's what you're doing right now. Well, you've read my order. You can I'm going to issue a the Sir, there's precedent on this. It's been decided by higher courts than the Supreme Court. That I have the right to do that. That's why I became a state national. All right. I didn't want to be a 14th Amendment citizen. What happens next is that I will issue a pretrial order and it will set out certain pretrial deadlines including a motion deadline. If you have additional motions, you can file them and you're not required to. Uh but if you do have additional motions, I will consider those. Uh and we will go from there. So, once the when we convene for the jury trial, it's important that you understand uh that you need to have any witnesses you wish to call available at that time. Mr. Hansen, any other issues you want to take up today? Well, I did look at the three cases, Your Honor. I noted in case that ends in 16, I didn't see that the order uh denying the motions to dismiss was included in that case. So, I want to add and file a separate response just for that case to the motion to dismiss and I also cited in there the defendant's brief that was filed on the 9th and just made some additional comments regarding the fact that the quotes that are attributed to the cases he cites are not actually in those cases. Not sure where he got the legal precedent that he cites, but I couldn't find it in the first place. Uh there the the same order on the two files will be filed in 16 probably today. It was just an oversight administratively that it wasn't filed into all three. Thank you, Your Honor. All right. Anything else you want to take up today? No, Your Honor. All right. Thank you. We are adjourned from your case. You're free to go, sir. And so there you have it. Yep. It all worked out in the end. You think? And thanks for hanging out with us on Factor Chads.
