[Music] welcome to facts or [Music] frauds time to go back to trial Jamal Steven are you ready what you are witnessing is real the participants are not actors we're back on the record on come all first Jamal tbon Sanders Vladimir otherwise known as Jamal TB Abdullah Bay M6 Perry Court number 2181 CR 00361 and Stephen Perez otherwise known as luuka L for liad docket number 2181 c366 par please identify yourselves for rec also good morning H Danel Thompson for Jamal president Cil with good morning attorney Thon morning attorne rone morning Mr L um I'm aware of two logistical issues that we need to take up before the jury comes in one is the defend motion requesting certain Court recess times during the month June um and currently we are breing at 12:35 having trouble understanding the motion in the sense that at what point are we is basically June hasn't changed from May basically thetion so the prayer schedule is determined I think by where the position of the sun is during the day and so it shifts by by one minute every few days yeah um the U the source of that I'm doub I just want sure understand are you basically asking that I continue to break at 12:35 yes it's just like a one minute difference I didn't see a reason to go 12:36 no we'll stay at 12:35 and till if if we're still this gets in the second just discuss but depending how long we go if it shifts by five or more minutes when I go to 12:40 but I don't I think predictability for the jury is important I don't think that'll happen by the time I expect the jur get case very good which a juror I don't know which one asks rep off this morning if I she's a female jur if her employer wanted to have a sense of how much longer she was expected to be here um and so I guess I'm looking for a sort of a best guess or best estimate as far as how much longer we're exped before the jury gets the case just and I that way I can tell them before on schedule and them I only give them update so I originally thought Thursday I think probably Tuesday okay Tuesday sorry Monday Monday and then understanding that each defendant has a choice about whether to testify and I don't ask you to tip your hand on that at this point but aside from potential both defendants testifying how long does each defendant anticipate presenting evence aside from their clients should they decide Mr doesn't plan on presenting any additional evence besides 42 we're in the same position okay so if the Commonwealth is thinking sometime on Monday um uh I think we could tell them they can probably expect the evidence to be included by Tuesday and then get case next Tuesday or Wednesday that um one thing that may alter that analysis a little bit is in my computers Lobby IDE is somewhere else um I think we are only going to be able to go a half day on Wednesday go to1 on Wednesday uh because it's matters are in session I'll know better in a few minutes but it's possible to the afternoon um let me know if that poses a problem for anybody because I may have some flexibility to go say three there going to go I have to leave to getting down to but I might have some flexibility problem might be able to split the difference still do you remember what it is it's in the back of my mind we have on Wednesday at two uh um I think it's a sentencing that's what it is sentencing it too but we might be able to work around that might I don't think that's a tremendous amount of time so maybe like or so that we go to our maybe was about an hour right anything else we should discuss before the comes in have one question for the court um everybody's favorite topic during trial which is Court close so uh the trial um has been taking a little bit longer than we had anticipated and the court may be aware there's a kind of a general policy of dropping off clothes at the jail not at Fort for dependent store in custody which we had done prior to this trial starting we're now in a position where I have um one pair of shoes and two addition shirt that I would like to Mr luch to be able to wear for the rest of the week during trial and I did speak with the port officers downstairs to see if there was any way to avoid the several hours that will take me to drop them off at the jail um and they said the only other option would be to address it to the court to see if there was Court permission to provide with those items um let me in the past and I could be wrong about this past my understanding has been that even if our court officers are willing to to take Cody of them that they'll be rejected they're sent back with the prisoner on the B over the jail so he would essentially just wear them here for trial come come into court wearing you know what whatever he's wearing change into the new top and new shoes um here in the courthouse and then ref into the jail and what you had come in that's the way I've had that work before and I'm asking today because if um that request is Deni then tomorrow will be my data take care can I can I speak to the cor hey ibody I just spoke with Pro say he's going to speak to the deputy chief it it seems to me that the issue as I understand it is one of security and apparently the sheriff's office is more confident in their own ability to for example exam shoes than than they are our ability which maybe a training issue or something I don't know in cling to um I don't have any problem with it but I also don't want to create a situation in which um the jail correctly feels that items aren't being proberly sege before they're sent to jail as I understand it they changed their clo when they arrive at the jail so it's not as if I don't I guess I don't totally understand the concern since I well anyway you don't need to my mus on this but I'm I'm i' run it by run by the prop and see if there's a way to make this work where you're not having drop off I appreciate it and I I understand all of the issues and just wanted to raise it in the event I could avoid those additional three hours tomorrow I guess the the short answer is we're working hope we work great thank you anything else thank bring you want the witness on the stand yes please always my it's always my preference to the witness on stand just when the jury gets start and correct me if I'm wrong but I think R you were it was your turn for cross Nation left right yeah morning welcome back good morning members of the jury I hope everybody enjoyed beautiful weather this weekend let me ask you has each of you been able to comply with the instructions that I reminded you of at the end of the day on Thursday okay um couple of logistical um I had a chance to speak with lawyers this morning um and what they're telling me is that the expectation at this point is that you will finish you should and this is just an estimate so they're thinking at this point that it's likely that you'll finish hearing evidence by the end of next Tuesday and therefore you will then begin your deliberations either next Toth there and explain thing thing is we don't ever you can ever say how long liberation but for anybody who want to know the status that's that's which means that we're on schedule maybe even slightly ahead of the longest SCH people mayens um remember tomorrow we are not sitting so you have a day off tomorrow on Wednesday it's likely that we're going to finish a little on the early side probably around 3:00 so you'll have extended that um after Wednesday and bar F don't sit on Fridays so for this week we have interrupted week with no tomorrow slightly early this on Wednesday then the will Frid um and I think where we were uh we had left off with PC uh and it was uh opportuni on right a couple days since we were here but I'm going to try to just pick back up where we left off okay and I'm going to start by asking a couple of questions about the people that you interacted with when you were on the side the highway that early morning on ju okay um you just bear with me for a moment okay I um have just put up on the projector what was marked on Thursday as exhibit 11 can you see that or do you want to step down to see I don't know whether you know how to do this but that screen very high very technical solution poweron thank you um so feel free oh do that help your okay great so this is what was previously marked as exhibit 11 um do you recognize this uh as an still from your body warn camera from July 3D yes okay so um I just want to go over with you who the people were that you've interacted with so um I'm pointing to the individual um in the center of the photo whose body is most visible uh you identifi that person as Mr Abdula Bay is that right yes okay and then to the left of Mr abdulla Bay there's an individual wearing a black v mask right yeah and that person you identified as being saki right yes and that's a black male okay and then to the right of Mr abdulla B um there's another man who you referred to as having a buzz cut is that right yes I think you also use the term Whipple Whipple that's yeah okay I'm not familiar with that term is that just another term for buzet yes okay um and you said he had glasses yes and that he appeared to be Hispanic uh okay and then um the last person in that photo to the right of the individual we were just speaking about you referred to as the um tall person right yes and you also identified him as Mr Aaron Johnson yes okay and I'm now putting up on the screen what was previously marked as ex didit 8 and this individual you identified as um somebody you spoke to when you were trying to figure out who had driver's Li right yeah and you identify that person as Mr Robert rried yes and now you also um again when you were trying to figure out who was driving the cars whether anybody was licensed you said you interacted with somebody in the driver's seat of the van right yes and that person gave you a um traveler ID card right yes and the name on that card was littlea yes okay and then finally you mentioned that there was um sort of in the background standing on the passenger side of the van another individual with what look to be a camera filing is that right and that was also a black man I I don't think I [Music] any do you recall if that was a black uh I wouldn't be able to tell I just saw like a shadow fure a c with light okay so you essentially could just there was somebody standing there and then yes okay and um so that's so those people we've just been talking about that that seven different people that you interacted with in some way some more some less that right yes and out of those seven people um you testified on Thursday that three of them you believed had fire right yes Mr Abdula right yes um the tall guy Mr Aaron Johnson yes and the guy yes now um backing up a little bit you pulled over because you saw this van and thought it might be tough right and there's actually a police term for that Community caretaking right correct and um you had never seen that band before had you you hadn't heard any reports related to that no one had called in to report that a b was pulled over in the break down right no one had called in to report that anyone was outside walking around in the breakdown right certainly no one had called in to say someone was outside walking around firearm right you just wanted to check on the van and make sure everything yes and um it was I think 110 when you pulled over and Bre down right yes and even though back late or early um there were still plenty of part going by right and even in the um video we watched on Thursday you hear the traffic going by while you're in the breakdown yes and um it was darken a little bit bra you pull over right yes you had to use your flashlight to be able to see outside right yes okay and when you pulled over um when you first pulled over how far behind the van did you so about 15 ft and when you pulled over did you uh have any of your police lights on when you were pulling over I did and um that was the blue light on top of the top gr is that right yes okay and did you have your sir on at all when you pulled over no okay um and again you were just kind of checking out what was going on wanted to make sure everything okay right yes okay um and so when you stopped your car um before you got out of your car did you call in your location to the station or anything like that okay so did you do anything before you got out of the car other than activating my light fall to the bre okay and when you got out of your car uh those blue lights on top of your car stayed on is that right yes and your front headlights were on right yes and I think you mentioned um some was it just your regular rear lights or were there rear police lights the rear uh blue lights okay um so the light bar being the bar on top of the car the were there there were blue light re light on that light bar were there also light um shining forward or just and when you got out of your Cruiser at that time you had only SE the van right yes you had that there was another car and you first saw Mr Abdula Bay when you were walking on the up the passenger side of the van right yes um so you didn't see him get out of the car right no okay um and Mr Johnson you saw kind of right behind Mr Right yes you of see him get out of the car right and when Mr ABD got to you he put out his hand to shake hands right he did he introduced himself as Jal yes within that first minute of speaking with Mr Abdula B he asked you to call a supervisor right yes and you did right yes um and right away Mr started explaining what he's doing right yes in terms of that he was um on his way Island right yes and uh that he was trying not to make any unnecessary stops in that um he told you that everybody with him in that group from rhod Island right yes and at some point during the interaction he started showing you documents and um kind of getting into a legal conversation with you about why he was allowed to traving through Mage that right corre um so you're trying to figure out what's going on right yes and uh Mr Abdula is really the central person talking to you right yes um answering your question right yes and giving you these explanation we were just talking about yes and um he was respectful right yes um it was immediately clear to you that he was in charge right I would say the spoke direct of the grou okay and earlier on well early on during this was about 45 minutes to an hour said that total that you were on the um side of the highway before you moved back right yes okay so earlier on during that time period um you had already gotten Mr AB had already written down some information for you right with his name and uh phone number I said yes okay and you at some point were trying to get um buz buz information right yes and you actually went to h a notebook in P right um and buut was reaching out to take it and Mr kind of stepped in right yes okay um and he told buut he didn't have to give you anything right sorry sure so when Mr Abdula B kind of came into that moment um he told cut we didn't have to give you his information right yes and you said the camera through you don't have to give me your information right now yes okay um and so in fact didn't never take thatb or right you didn't get any other information at that time and um when you went to speak to the driver of the Ford van you let Mr P know that's what you're going to do right were going to talk to that driver yes and Mr AB came with you he did and you actually asked him to Da by the um further in the breakdown Lane you were worried about the traffic right yes okay but he came with you right and he was standing next to you the whole time you were there interacting with now when the other it was the other three police officers who arrives about 25 minutes into your stop on the highway um right was it three three additional officers corre early on yes okay um Sergeant Burnham Trooper Orlando and M yes okay um did they par did they each come in their own Cruiser yes and did they park behind you or some behind my okay and when they arrived did they have their police light on I would imagine if they at least put their very lik on but I can't see definitively okay and do you recall that they had I don't recall so at some point after the other officers had arrived you guys were all um the four police officers and several of these individuals been talking about all standing kind of behind in between the van and the police and your police right yes okay and at some point um you asked Mr down God right yes okay and uh said I'm going to stay armed for my safety just like you were going to stay armed for yours um and you reference to Second Amendment right yes and he said that he was not going to put his gun down and wouldn't tell his v g down is that right yes and during this conversation again Mr D is the person you were talking right correct and in fact at some point during this interaction when you were asking him to put down his firearm he started explaining to the other men with him what was happening and why he wasn't that right yes and so I think you said it was about 45 minutes to an hour in um all the the four police officers moved back right correct your Cruiser stayed where it was yes and the other three Cruisers moved back I don't recall the the Cruis move back okay just the people I know for a fact my Cru didn't move but it was most of the people okay and um so how how far back did you move to that point and at that point you said Sergeant mcdevit um and Mr Abdula Bay were still communicating but atance right yes and it was around this time that the stop team started to arrive yes right an additional state trooper started to arrive right yes um and you justed on Thursday a number of different specialized units that came to the right so you were still on theme when all of these other units started arriving is that right yes okay and uh you said you never seen that many police cruisers that police right corre um it was a pretty huge police response right yes some Troopers and people from those specialized units were even called back vacation right I I don't know what their status was okay but pretty much all of this Le that that's where all right yes okay um and around this time around 2 a.m. is this when that perimeter started to be set up around the two cars and the grou yes okay um so were you on scene at the point where arrest happened in no okay um do you call kind of what the last thing is you saw when you were there on scene at the point that when I was on see the seat start to get bigger and bigger as more Cruisers started to arrive all those units so again um doing the apprehension I really wasn't fall um so moving further and further back um there weren't really any other events of know other other than seeing the uh the crisis unit negoti negotiating that's it okay so the fair to say that as these like more specialized units came in like stop team they kind of took over and I think you can use this yes so the first 30 minutes of your time on the highway you were the only one you were the only police officer there right yes and um no one ever phally hurt you right no one ever pointed a weapon at you right in fact Mr Abdula B repated said he wanted a peaceful solution yes after you pulled over um behind the van the van didn't drive away right and you said at that point you hadn't yet seen there was a another car up in front right yes you notice that later yes and the Honda was actually pretty far in front of the van right yes you have an estimate about how far in front of the van um so you when you pulled over the Honda Al right yes didn't drive away want to talk to you a little bit about your side War CA okay so you started in the in 2019 is that right yes and when you first started in 2019 did you have a body camera um that program was rolled out in 2021 yes around March 2021 yes um do you remember when you got bya I don't recall exactly camera but I remember it was still fairly new on this day July I would say I said yes I had it month that point you had it about a month and was it um so I know you said it the program was rolled out in March 2021 so kind of on a rolling basis uh the police officers and troopers were getting that is that right yes okay and uh there's also so we've been talking about body born cameras there's also a cruiser mounted camera right my cruiser at the time uh wasn't equipped with okay um but when I say mounted camera do you know what I mean yes and that's a camera um well you get two cameras that capture video from inside of the cruiser and also from the dashboard okay and so I understand your Cruiser didn't yet have one um but fair to say that this program of rolling out the body horn camera simultaneously a program related to uh cameras for yes you just didn't have it yet my cruiser was an old Cruiser I'm sure they didn't want to equip it with you know probably expensive system years okay um and so you you received training about the body work right yes um we talked a little bit about how it works on third day and you told us that um the body War camera has audio right yes and in fact there's a whole St Le policy about body right and you were TR on that right and um in that policy it explains what situations you have to activate your camera in right yes and one of those situations is during vehicle stops and what's called motorist right yes like what happened in it right corre um and so that's why you activated your camera right yes and they're ruled out um when you can turn your body camer off right yes and there's requirements for how to document any issues that happen your body right yes it's showing you a document um super Casey is that a copy of the State Police policy on body warn cameras and Cruiser mounted cameras yes um your honor I just moved to uh Mark that for it um is going to be j j j I'm sorry j purpose behind this new program and policy around body warant cameras was to um help with transparency Department right yes and increas public TR in have 40 m launchers for our lethal PE ball systems that same caps it so we're just unack a minut ago um what is a less Le system and what are some of the items you describing connected to that so oural is designed to impact a suspect instead of using ilal Force as a firearm or able to engage a Suspect with a ammunition that is not going to kill the person it's going to hurt but it's not and prescribe for the jury called as um what every trooper and also pretty much carries on their belt the same as a spray just comes in form I say the name Sil C somewhere along that line and um essentially like pepper spray kind of um so the how many times you think youve um been deployed to actually respond to events in the capacity that's work um and uh were you working on July 3rd 2021 yes sir um was there a point at which uh you were asked to respond somewhere that one yes sir about 0 1:30 in the morning the page came out through the uh Team paner and they informed us to respond to 95 Northbound I believe was around the 58 mile marker that's all the information we receive did you go to that location I did um when you arrived um around what time um I little bit of a drive so probably around 3 3:30 okay um still Yes okay and uh what did You observe at that location so when I first arrived on scene we report to our Command Post who's ring the whole situation uh they just pretty much tell us to get what year we need they gave us a quick brief and um through our Drome at that time I was shown a feed they were having up and it was two individuals standing in the middle of 95 Mar pound holding a right flag Could You observe anything near those ingredients on the side of the road there were multiple vehicles oh I was the breakdown and were these two individuals alone or with other with other um You observe how the individuals You observe on the video feed how they were dressed um they were in camou utilities most wear body armor and some kind when you describe clothing as utilities uh what do that mean it's a basic you know military term for your uniform your combat um and when you responded there do you have a sense of how many uh police vehicles were there you got there there was 4 okay and are you responding on the in the northbound lane but south of where the event going um when you got there with there other stocking officers there or first there um and so uh you describe what what uh you did with the stop team after respond so once uh once we got there once we got our information that slowly trickled up into the uh we parat set up in the northbound lane just south of their vehicles um probably like 75 to 100 yards from where they actually stopped and uh so we man those positions and we had people outside the vehicles and people inside the vehicles and think when I first got there I was going little outside and few hours in we rotated out just it was a range full day for July we TR to stay up right what is it there it's our armored vehicle that we use for numerous situations um it's an armored vehicle that can handle to a 50 caliber round which is quite a large round it's a military round um and so the stop team has some right yes we have two how many were position on I95 Northbound that we had two of ours south of their location and I believe n had two or three above on the North side their location it's the I don't know the honestly it's a group of towns in the NorthShore that's all support each other understand and they have all units inside themselves from swy investigators so not every town is have their own SWAT team correct andols and create these team each for multiple departments yes um but obviously you being on saf saf yes all right so uh looking at this um event on the road are you able to observe it with your eyes or oculars or just Dr Fe or what we were close enough to uh just use our eyes and see them and um as you move north to sort of form a line across the uh where were the remaining police officers um so the majority our team was just south of their position majority of the command post was further I guess South L excuse me he also had like I said the N up north he also had in the southbound Lanes two of our Cruisers that arrived on seene very early they were in south bound L I believe another cahoe and then eventually our large bear things also in the South B Lane with New Hampshire bear as well okay so as this is happening around what hours in the morning are all these different Vehicles being positioned on the highway um it progressed from when I arrived on scene probably until everyone was in position total of five hours um during this time what happened to the normal motorist traffic on the highway it was what was do you know what the purpose was in blocking the highway north of the incident and south of the in two containing individuals that on High um as you're watching the uh incident itself um do you recall the the vehicles on the side of the road one was a black van um they were in about that b a lot and to my knowledge there was another silver SUV style truck ahead of that one and you would already described the clothing of the individuals um and there I think you mention flag as well as uh what is your memory appearance of flag red with a white star and this see counil and um the individual holding the flag Would You observe clothing by they had the same utilities on the wood style they also I first two people I can see up there one had a gray head or a brown head covering and a green head covering and they both had of either tactical V or um was it always the same people holding the flag or did that change no they changed out like I said it was a cold rainy day for them as well and you see they getting so they were changing out as well ago you use the phrase as tactical best PL carrier um could you describe first of all how it is that you're familiar with what those with those prices um for one my military service we more them all the time I didn't had to wear that constantly but also for the Stop team we had a our Cent issue is a Dr Precision T vest um so soft body armor in them that's for your Small Arms fire like that in our front and our back we also have aist plates and those are rated up to including Small Arms uh AR STS um in your experience wear things um when you say soft body armor describing Small Arms um what what would soft body armor do with respect to fire from small arm and you be specific small so the soft body I'm referring to same that we wear on control pretty much so you're inv your issu when you graduate the academy and slowly get issu again that is stop um handun rounds and all the way up to a 12 gaug shotgun um it will stop round obviously stopped around and then the the plate that we also have in RS they're designed to stop to an AR caliber AK-47 um there are some rounds that can penetrate through those those rifles there's obviously arm Pier around PRP rounds which are do a lot faster they can get through those plates but they're designed pretty much to stop back small arms and and the difference between soft body armor and the place that can stop the the rifle rounds things like that how do those how do those pieces differ in appearance and um so appearance you're going to see the soft body armor will you know War to your body more tight under a shirt so you know that's how we do our normal control um the plates they're a little more bulkier they're a lot heavier especially as you start to go into the different level different levels of ples you can buy you know your standard level one up to subtle 3A and that will stop um you know the higher caliber rifs but it is a lot heavier now um when you're observing individuals who are holding the flag where are they standing in relation to two vehicles that are on the side of the road um so where we were south of them they were directly in the middle of 95 north and just to the left of um and uh you take note or did you observe any other um individuals uh walking around the road near whoever was suppos to play yes uh there was one individual you could actually hear him talking a lot more than everyone else he would walk to the center media in back um every once in a while like I said they would switch out so some people that were along the breakdown Lane by the vehicles would come over take over holding the flag and they would walk back the uh the individual that you he uh what hear from that person place um it was hard I said it was rainy and windy we had someone trying to talk to him one negotiators I really wasn't working out that time because of the distance between us U see like the two of them were not really on the same P I could hear and is that occurring you know just shouting back and forth or is that by telephone that was they started off first just by shouting back and forth um and um so you describe getting there after at 3: in the morning um how long did you remain on site uh would be the barcat south of was on about what time was that I believe it was around yes um and I take it during this time you were not um could you the individual that was um Tri hearing his voice atation with negotiators you see whether that individual was carrying holding yes what did You observe um in his hands specifically with a cell phone um and he also had a did you make any observations about the appearance uh it just appeared to be an AR sty rifle but um have an undergrip on it for better support and when you describe a rifle as an AR s what is that oh it's it's a basic platform that the United States has used the Vietnam War it's a gas Opera syst what you know the b style um did youir any other individual walking around that also have RS yes what did You observe about those RS tonight um we noticed one had a very large capacity look like a drum magazine on there you know usually 75 to 100 rounds for the amunition of the drums okay um and earlier you were describing U some of the head coverings and uh or head gear of some of the individuals um did you know any other indidual yes so those was one of the ways you're able to distinguish them they mostly had all the same clothes on and either brown and black vest the easy way to extinguish them with their head coverings we had multiple with we had one with a green Bo one with a helmet one a black and white scarf another brown one a black B SC and um head going on were you cognizant were you aware of whether um you and other officers were also paying attention to the tree line along 95 so we had our 1 and they so if you leave 95 area very there neighborhoods right there so they want to make sure those are protected so sir which is our special emergency response te which is group of Troopers um they handle the wood line with n and the Outer Perimeter um and looking North you're standing on 95 the you're looking North looking past two vehicles Could You observe whether there were other vehicles further off uh north of you cross p we had three Bearcats up there stage as well that were blocking and so uh around uh 10 o' in the morning um we were given the the order to move up so we closed our distance probably from about 175 to 100 now at 25 30 yard range and um we started to nail them with the l r first it's our longrange trable device just grab their attention very loud high pitched noise and then we initially started to try to communicate with that between the time when you responded in this 10: a.m. movement north towards them uh were you did did you know whether the negotiators had remain in touch with one of the IND we were told that negotiations were happening could you ever hear that on B either orally you know back and forth through the through the air or by so once the initial yelling back and forth by one of the negotiators wasn't working they started negotiations back at the man post which was out of range of bus but we were being they were talking to all right so and and during what hours of the night morning you aware of that uh we were aware pretty much from the beginning all the way to the end um by the time you moved up around 10:00 in the morning to be closer to them um had any uh pepper spray L equal systems been us nothing have any shots that fire no um uh were you aware of whether anybody had been arrested that we were but two of the individuals apparently left most of their equipment on seene and walked through the vo B the knowledge I can refr okay um on the roadway on interstate had any individuals been arrested between when you arve around something morning and 10:00 a.m. you describe the s team no um had anybody uh have you seen anybody put any rifles or other weapons on the ground no had anybody from those two vehicles tried to or walked for the police um a couple so initially I believe it was two of them started walking Northbound towards three barricades barcs that were Northbound and then every once in a while you know one one individual would kind of make his way towards us wouldn't come into very close proximity then he go back to the B did you ever ever observe any of the individual's uh attempt to surrender prior to 10 a.m. no so you described moving the barcat a little bit closer to the group at 10:00 a.m. using something called an L yes okay and uh an L so the technical definition long range CR device it's essentially a loud speaker and um is it attach to one of the top of the Bearcats we're able to mount them outside on the roof of the beat CL the hatch and be able to talk to them from inside so you can use it for to communicate you can also use it to make allow yes all right so how was it used around 10: a.m. so we it was about a I would say a 30 second verse of the loud um noise from it sounds like a high fix wheel we use that pretty much try to get their attention let them know we're moving up and then after that we used it with voice for the about first five minutes okay when while this is going on are you able to observe the individuals by yes um you describe where the individual were in relation to the vehicle so the majority was in between the black van and the uh silver truck slsv they prob angry about some had already at this point started placing their their Weaponry into the vehicle the black v and then uh at one point uh one of the individuals walks up to the silver car and two people exited that from the back seat one of them which we did not know was there the entire time and another person the passor side of that vehicle also got out okay um and the the individual who have been communicating the O where was that at this point he was uh he started at the median he slowly walked over towards black van and sitting on a bucket like f down yes um could you see whether that individual had any kind of U rifle with that he did still have a rifle as was sitting at the B so what happened around that time around that time we kind of stopped with the lad with verbal commands at that point we had come up with a plan to walk people back in between the two bearcast we had them side by side blocking the roads and we had an arrest team behind those two and one person to give that to them as they came up how were those commands Del uh just verbally you know we were telling put all the weapons down pretty much come to us hands in the air no further movements anything like that so where were you when when these uh individuals are in the road as the instru be so the two their cell phone I'm on the back side of the one on the left in the uh just by the med of the highway and what did you see the individuals do after after the instruction So eventually um they to apply one of the individuals went over to the person sitting at the bucket and took his rifle he was very cautious of letting us know that he was taking it off of him and putting it into the vehicle once all the weapons they had were inside the vehicle they kind of joined arms and slowly started walking towards us believe there was one person straggling in the back as well but he eventually started to come up as well one of uh we had them PR lay down face down on the ground hands up by their sides and then individually called up person by person put them in custody and to the next one called them to us put them in custody and so on and so for and um so as I understand direct to lay down one by direct stand on the par the officers hands in the air correct and um as that happen as they arve where the off standing did you see what was done first not individually no I had my focus mostly on the people that were still on the ground obviously they're dealing people white weapons yet they may have put most of them in there but we don't know if we still have any on them so we also have cover element there were there other nonstop te officers sort of um in that area yes we had I believe it's 13 the H C te and also our show you some photographs um sure the group uh kind of joining arms or locking arms something like that yes was that in response to an instruction pretty it down take a minute look through those tell me if you recognize what those are [Music] is each of these photographs Fair an accurate depiction of what as the uh suspects are moving from the vehicles towards where the police are positioned uh as a group yeah um with respect to these two look at the one on top and the one behind it you describe how one relates to the other so this is the closeup still of this picture right here this was like I said the initial group and then you had couple back okay do I would offer this is the next exhibit perhaps A and B okay uh so objection sorry shot next two the wi shot and the closeup will be is it l to [Music] one1 21 no it's not it's oh I'm sorry you know why so exhib 21 a 21 st together actually IND follow along with us 21A can you uh see that on the on the television yes okay then I'll put 21b which you described as being a zoomed in still see that next two yes how are they related to each other so this is stting it down to the position that we were to get do you see the uh time stamp in the top left corner of the shot yes sir what's the time stamp 109 the the second thing you're holding in your left hand is that a zoomed in that the zoomed in portion of I would Mark the the wide shot identification to the sidebar conference and offer the zoomed in photograph as the next so the uh wider angle will be exhibit cation and closer angle will be now we descried a little while ago um we call a boon yes that's a what it's a usually a it's a military issue though but it's there break up even form of is anyone in the photograph I put on the projector exhibit 22 wearing a boon maning the one who oned with s on yes next two photographs tell me if you recognize those and how they're related to each other please once again this is just a continuous the process of taking them into custody you see two of them now have gone to the compeition for how is one to the other one the in the wide shot can you see one of the vehicles um from the break downland you can see the black what's the time stand wde shot 1095 seconds off pass Mark wde shot we discussed and offer the zoomed in version so the wi angle photo be L for identification and in [Music] por3 in exhibit 23 what do You observe about the or what if anything do You observe about the garments worn by the various individuals I'm pointing out they all the uh the uniform is the utilities the wood utilities they're wearing and they all seem to wearing best when you use the term V what kind of V you refer that's photographs please yes when they started walking towards us and uh what's the time stamp in the white shot you having your right hand 109 14 second okay and um the one on your left hand to the white shot zoomed in on the and there appears to be somebody let me ask you this uh fair and accurate depiction what you saw yes Mark the wide shot identification them wide angle photo will be exhibited M for identification and the closeup will be exh ex 24 put Z 24 on the projector now there you see there that um this figure here here's the on one knee what do you recall about the movement of that figure as the group approached the line where the officers were so that's the individual started on the bucket he had his uh individuals help him get up and slowly walk towards us and as he was walking towards us he glap through knee and then collapse through the stomach what's the time standard sh 10927 and the other photograph is uh Mark the wide shot idation shot ex to the ground is that right make sure you exhibit 21 a earlier you described an individual getting out of the pickup truck or the vehicle that further you would not previously been aware of correct is that picture you're holding to pick that individual yes it does where is that individual he's always the left so it's the gentleman all the way at the far left here yes sir the individual sort of in the top right between the group and the back of the dark vehicle up here had You observe that vehicle that that individual prior to the the uh call the surrender yes could you Des uh describe for me where you observe that individual most of the time he was spent on the uh the guard rail between the black van and the silver car um if you could using this Photograph give us an idea where you are watching this from so I am even more to the left of this so you see they're in the breakdown Lane where theer is they're in the right travel Lane in the center travel Lane you go a little further to the left travel Lane right on the the media side I'm pretty much on that line right um and when the uh laid down um remember uh did any individuals not get up ultim follow instructions to walk for I believe there was two that eventually did not get up and where were they laying um were they the last ones there that ultimately yes you where they were lay uh directly in the center of 95 L okay does exhibit 22 depict one of those individuals yes it does which individual does that ultimately did not stand up this one with speed right here tell me again I put exhibit 22 back in the projector what were we talking about so you can see the beat of the third individual in on the right this one yes next to the gentleman with the the dark the black yes he does not get up and the person in a red hat I guess you call it is he eventually lays down and does not okay so after all the other persons have stood up and um walk towards the officers as this is happening are you able to tell what's happening one by one with those yes we can hear uh behind us they're putting in custody give me a quick P make sure they don't have any more Firearms weapons on any of that and they're turned over to I believe the Ser team or the cat team the Troopers that were behind us and I think as well with the night staff there they were also given a quick eval now let's go back to two individuals who are still laying on the roadway uh were you able to observe what if anything done with those doing yes I was actually uh involved in the um the entertainment of the first individual that was laying down how did that um once we had the people that were listening to us in compliant we formed a pretty much a lion cross we gave a couple more commands to see if they would actually stand up and come to us we had no response from either one then we slowly pushed on the line up to them a little pass so we can get the both individuals and then I came around on the side and dealt with the one that was first in line laying down while other Troopers covered off on the bid just in case there was other people in there and and uh as that happens be deal with that individual are you able to see that individual's face yes that individual here in the court today yes would you indicate where describe that uh he wearing withs and the beard and a white shirt record um were you alone in G Mr L that I was not who with you uh TR M he's our team man and uh what if anything uh did you and TR OPP do with that point we tried to get a response out of him um any kind of knowled that he was still alive he was breathing seem to be just fine uh TR took some quick make sure five okay uh we still can get room so we uh we roll him over at that point I believe might cut his cut his best off his equipment off just we do a better evaluation of right there and what happened uh he was taken behind once again pretty much where right behind the be gas and I believe at that point he was given an evaluation by our Medics that travel with the team you know I know um with respect back to Lad Fest described a minute ago um make any observations about it from yes sir he uh had a body camera attached to it we uh we took that off first put over in the breakdown Lane and said I believe my cut is best you know why the best was cut off as opposed to being removed in some other fashion it's an easier and faster way to get off for purp show this [Music] subject um it's substantially today it was when you offer this the next I would ask to Mark the bag came in Fr body body One camera will be to the 26 the bag associated with it will be show not going to pass it to I'm show your other item sir tell me do you recognize please that is the best that's how do you recognize uh because of the batch itself actually you read this you are within range surprisingly enough uh we used to run that our vehicles when we over Iraq soot what do You observe about the U one of the shoulder scraps apart from that the same as it was when youed it back on July 3D this next no objection no objection objection be marked to 27 honor wants me to keep going uh a little bit but probably less time when don't we finish direct Rec let me right then um jurors were sort of debating whether to go another say 10 minutes or so would anybody prefer that we break now please I encourage you if you prefer to let me know difference nobody's raising their hand continue so I'm gonna hold this and actually you maybe stand out so you were describing vest and soft armor think you use the term tactical tactical V I think you might use the term PL car so can you be more specific as to what this is this is really a plate carrier so as you can see on the side very little armor right here this is could possibly be soft armor but it's not much for you so it's called a plate care it's essentially carrying your plates for you to you can see standard vest radio magazine pouches AB Bic stand all right and do you wear vests like this either when you were the police or when you with the Marine yes sir um with the intent of trying to stop what level of RS right um and there are other types of vests where you can swap out the plates is that right you can probably swap up these plates as well most you can see right here on the back this onel comes right out take a minute the only other thing I would ask is U maybe one of the Court officers could show this the jury and then nothing further when you say show to the jury do you want the jury to actually handle it or just watch it front uh handle it but it doesn't need to happen right this point right schedule that'll be fine and then you're that yes okay members of the jury will take our morning reest now uh going to try to keep it to 10 or 15 minutes although give everybody the chance to attend any need and try to as close to 11:15 or 112 all R you're exi in front row follow my back follow me folks Mr R I spoke to deputy chief Fort officer in the building about the requests regarding the closing and what I'm told that I didn't know until just now is that um at the jail they have equipment that does I guess I don't it's x-ray or you know what technology but it's technology that's designed to scan clothing and identify if there's anything Contraband um and I'm told that relatively recently there was some Contraband to enter the jail they believe through a court essentially the same kind of system they same kind of what you're proposing I have ex that I have no doubt that you were not involv in nature um but the policy is the way it is so I I regrettably because I understand that it's an imposition not going to allow the order to for fire Court officers to clothing um I am sorry because I understand it's not nothing to go back and forth to jail with clothes but under the circumstances I think there's security reason to oppose toist policy the way is not over it thank you foring um all right uh so I think we're ready for the jury yes I think so may be seated back thank you so you testified that you're a member of the Stop and that morning you when you responded about 3 3:30 morning you were equpped in your stop uniform yes and that stop uniform that includ body armor but at some point before you went to the scene on the side of the highway you uh it out as it were you were stoping correct yes and to be Ked out that means that at this point would have had your body armor yes and rifle yes and this is a uh this assault stle correct yes this rifle would have been able to hold up to 30 of ammunition each magazine yes and you were wearing a t helmet as well correct and how many other by 10 o' that how many other sof troopers were there on probably all in total by 20 25 and that's just with the state Poli sto and it's fair to say that other uh call swap teams were pres yes there was yes I heard you say that New Hamshire was that New Hampshire SWOT team yes and so they had their own right there's also Metro I don't know know there are SW but you don't remember whether no so how many SWAT or swop officers are there total by 10:00 I don't know off top my head go through probably 7 and we talked about you talked earlier about the basic person right how many police officers or St inside a driver a driver so about seven eight right police sters for police officers yes I'm putting exhibit 14 up on the monitor uh Trooper if you need to get off to get a better view let know do you recognize what's depicted up on the monitor it's exhibit 14 that'se 95 North Area and so the uh on the left side on the exhibit that that thick gray line that's essentially I95 128 CRCT and is it fair to say that uh where where we call the surrender happened that was towards the uh top of the photograph there on what you just described as I95 right so on that uh how many Bearcats were uh north of where the uh surrender occurred three and how many to the cell uh two and then you had the number of stop and SWAT off that you just described no so testified I think a few minutes ago that there's about 60 to 75 stopping so all all together so not all of those officers and Troopers are on the highway correct right but there's also uh officers and not uh equipped for SWAT or not equipped in stop gear correct but they're in police uniforms with their firearms correct and uh local Wayfield police was present as well yes so you have State Police was present Wayfield Police New Hampshire and any other department that you and when describing I95 this section of i5 and 1.8 the North and southbound sides are divided with a a jersey barrier in the middle that's essentially a concrete wall that we all see and throughout the entire your involvement nobody from the group of suspects who surrender none of them crossed over that that middle concrete wall correct looking to the uh it's a fair that that three area to the right5 that that is the Eastern side of 128 and 995 yes now that's a did you ever go into that area no Did You observe what was down that area it just look like we were so you don't know whether that was that is that a mountain going up or is it more [Music] into so is it fair to say that somebody standing on the highway would have The High Ground as it were over anybody in the wooded area corre you testified earli this morning about the flag that uh the members of the group kept handing off back and forth to each other yesi that it was a a red with a white star how sure are you with that it's a white star not positive that's what m says so you sered in the military correct yeah and is it fair to say that at least in the Marine in the Army a red flag with a solid white start know it's a Prett dear General yes and you didn't think that these people were flag want to say that those photographs that were introduced towards the end of your direct examination those were from a UAV drone so that's the remote control helicopter would a is your memory exhausted as exactly what color that star was on the red flag I um would a uh excert of the video the Drone video repression recollection is be exactly what St was he's been asked with memor said with memor so the the surrender was captured on on the wrong video correct no need to ask Trooper I'm handing you a uh a computer with a a video you just take a look at that and uh look up at me once you've taken a look at that uh is that uh does that look like State Police drone video of the incident lining up to the surrender it and do you see a red flag in that uh that video yes can you see the color of the star in be white to yellowish white to yellowish is it a linear five-sided uh star it looks to me a black solidity uh is that a solid star or does it uh is it not a solid star you don't know the uh what that flag stand for I don't put exhibit 23 back up on the overhead do you see exhibit 23 up on the monitor yes sir do you see the shoulder patch on the uh the man on the ground who you said um had been sitting on the blue bucket earlier yes does that appear to be the same flag that was uh that you just described earlier but it's Zoomed In from a drawn that was up not closing up soon just that before the the El was deployed that uh somebody in the group and one of the triers were shouting back and forth other right so that shouting that was just for people to hear each other at a distance correct that wasn't anybody threatening anybody or shouting no so this was just shouting because of this is not because of so this is the so I'm holding the vest that you took off of Mr V now you testified as to what these different projects hold correct correct and when you were checking Mr I think you said bi science you were also checking him for weapons you didn't find any weapons on him by the time he correct now there were ammunition magazines on correct I can't you don't recall whether he had any um trer I want to start by just having a clear sense of where you were when you first arrived on for the first couple hours there okay at do you recognize that to be a photo of um the blocked off egit north of where the two cars and the people were when I got there there Wass like so did so you never saw what the block off like see okay um G Swit itk you can you take a look at this photo and uh tell me if you recognize that to be a depiction from July of some of theats south of the B yes this looks like as uh after staying back 75 mov up to okay okay and um is that a fair and accurate position depiction of what it look like after the bar started moving up closer to the everyone didn't show it to the comment that I without objection it'll be marked the 28 yeah no I'm just trying to see what type of photo it is aerial photo something or taking from yes okay and feel free to um step down or you can see it fine on the other screen that's great as well so in this photo um can we see in this photo the beat that you were in yes sure and can you um can you step down and point on the screen closest to you to which Bearcat you were in that right there okay um so par to say this Photograph that's the Bearcat furest south of the b in Honda yes okay and um you can have a you have a seat again and in this at this time the bear cats were moving the South be cats were moving closer to the van and the pickup right okay um and so before you started moving closer uh I believe they said you were about 100 yard away in the be 75 okay about 30 ft no that's 300 ft 3 ft I'm sorry I went the wrong way um and you were inside that bead 300 ft away most of the time we staying outside as well we had skirts set up or buet skirts so they hang out we were able toay on outside so you personally um were you both inside the Bearcat and outside the beat before itos yes okay and was it at that time that you say you first made observations of people walking around outside of Highway cor okay and um it was at that time that you were able to see uh people with different head covering people holding the flag yes and it was at that point you were able to see somebody um I think you said standing near the guard rail with the green yeah and how much how how long were you with the Bearcat having 300 we were there for a few hours okay because you started moving closer shortly before the arrest act right and that was around 10: a.m. around okay and you said you're arrived around 3 a.m. 3 3:30 okay um so the majority of your time you were in and around the barad about 300 viewers and um that's when you were making cation yeah okay and you mentioned already what thought team members were wearing um you mentioned you had a rifle right and you also mentioned on Direct exam about a sniper yeah I was trained as a sniper okay was there were you acting no s capacity on day we deploy any sers okay um so the other stop members that were there with you everybody had a similar style rifle to what you had and so if I can direct your attention back to the photo um north of the two cars that are in this photo there were the additional two to three be three three be okay and on the other side of the jersey barrier um is there also one or two be CS over there there there's the new one is the light green one and the black one is okay and so um when did all three all of the three you can see the photo that out of the van and Tra they all start moving closer at the same time yes okay and um how Clow did you get I would say 30 yards okay so in this picture you're still kind of moving Northbound correct that the BARC is facing across the highway is actually backing up at this point and the two that are lined up they're moving down walk room okay and so the bar cat that we can see in this photo that's um that's horizontal across the road is that a pretty accurate depiction of how close yes that that was the line we got to okay um and then at the same time you're moving closer the be C on the North side are moving south and getting closer to eventually yes can you take a look at this photo do you recognize that to be a depiction of um similar scene but with the barats both North and South having come closer to the van truck correct and is that a fair accurate of what it looks like at the time yes I will show it to the comment objection be Mark between them is that see how to describe that another okay so Trooper I'm showing you what was just marked as exhibit 29 and um in this photo we can see two of the bear cats that have now moved closer on the south side of the vanand in the Honda and the three Bearcats that are now moving closer on the North side is that right and um we can see that there are some stof team members out and around the Bearcats on the south side right and um is one of those Bearcats the Bearcat a bearcat you were in or were you still a little bit further behind those are one of the ones I was in and which one were you in so these people down here it's actually probably more than likely me that's where I end up this is my this is a perfect example of my final position right here okay and so in your final position you're pointing to the um the rare cat on the left side and once you got that close you got out of the be cut we started to just yes okay showing you one more photo you can take a look at that um and is that a uh fair and accurate depiction of the bear Cs on the north side of the um pickup and the van when they got as close as they were get before they arriv yes 30 okay so trer this is the photo um you were just looking at that shows the three North byed Bearcats having got their final resting PL and in this photo we also see several individuals outside right yes and um okay nothing you so before you moved closer when you were 300 ft away at time in the bead um you were getting update about a pric negotiator speaking to the person who was the leader of this grou right and um some of the and well let me back up for a minute you said you also made observations of personal observations of somebody um walking around on their phone um and and communicating with the police is that right we didn't know he was communicating with but he was one person on the phone and was that the same person who was later sitting on the bucket yes and was that the same person who um you helped kind of carry off during the arrest then onam identified yes okay and so while were getting some updates from the um crisis negotiators they were essentially filling you and other St team members in on what information they were learning is that right yeah um and so for example uh sometimes you would get information that Mr Abdula Bay was moving around or opening the car or something like that yeah we didn't need to get information to that we plve and doing everything you to okay but while you were watching weren't you getting update um about Mr that Mr Abdula would conveying to the crisis negotiator to avoid any thought that you might be about to gra a we heard you wish to be heard um yes while were um they made observations you've been talking about at some point you also learned that Mr ABD was making live reping that right correct and that was on a YouTube channel yes and you in fact watch of those live while you were also making your personal observation right and essentially um in those reportings Mr was talking about what was happening with police why it's not the same analysis well we don't have the to not ask for any specific specific right while you were in the Marat you learned and watch some live reporting by and um there were multiple reportings that you watch yes and you're also aware that throughout this entire encounter um the encounter itself the police response was also being reported on you Outlet and you said at some point um initially Mr Abdula and the police were kind of shouting across distance at each other right yes and then at some point that turned into a phone conversation yes and so for from the time you arrived on 3:30 until around the time of the arrest fa to say that um the police were having off and on time yes and you mentioned that there were Medics yes at the them and um I think he said there were some Medics like that are part of a stop team is that right yes and um were there other medic go there or were they all there so we have members of the team that are ENT and paramedic qualified but we also use um Worster their paramedic system and they with the and so just make sure I understand did the was there a special request to have medic come to the scene at some point they always do us do you know if there were any for addition medic I don't know me too redirect exhibit 20 if by understand your your testimony so the 28 sort of the BARC to get it sort of Cl the distance between Le on either end and the suspect vehicles in the middle yes you can see the two black on side that's our first east side of the highway that's our first down here yes okay so you're indicating the southern most Center and the one that's to the right by the state Le the moving up 29 is those those vehicles are now are they now down here at the bottom the picture yes these other ones up here came from for the nor exhibit 30 it's just kind of a zoomed in picture of the Northern vehicle top of the picture corre um now at this point exhibit 30 are you observing this from the inside the Bearcat or are you uh standing outside oh we probably stay outside at this point the um the YouTube videos or or online videos that you were just asked about yeah um did you recognize any individuals in that in any of those videos we recognize a person could one we can see him in Fall doing them after much watching you watch report it and you see the same video do I understand you mean that they're basically recorded in like the selfie style where the person's holding the the camera out I saw Yes recognize that's still IM that photograph yes I who's that Mr you seen that image before yes where um one during his videos and okay um you recognize that to be from one of the videos yes is is it a fair and accurate still from one of the videos it without objection the ex 31 so what's the um the left of the exib 31 sticker that black object you recognize that body camera and do you recognize the higher wearing yes what is he also helmet on no recross from you next witness con called Paul is he Sergeant Sergeant the testimony about to be the truth to help you guys yes I do mayed uh nice clear voice give the jury your name spell your name my name is paulan spelling my last name h o r g a n you sir by m police and how long have you had that over 30 years um when did you become City police bars that was 1992 and um for how long have you been assigned to the State Fire markting uh since 199 1994 over 30 years what are your uh duties and responsibilities in uh in the n as a member of the on Squad we work with uh federal state local law enforcement fire departments mitigate any type of fire explosion or explosive type incident has needed and U in the event that determin that this event was caused byde continue to work with those BS to identify and prostitute the person of person explosible so dealing with explosives and then also pars and investigations that's correct um and uh were you working on July 3rd yes I was come a time that morning where you responded to the uh the area of Wakefield on Interstate 95 yes sir well what time you tomorrow I got the call at 3:00 a.m. and I sped immediately arriv USC probably to at 3:30 a.m. and um when you responded was there uh sort of a command post area where officers were meting yes it was that uh primarily at 148 Northbound just prior to the north AB exit however they all set up I came sou bound on 128 they were also set up across the highway on 148 sou okay now at that point uh what what could you observe on on 95 from where from where you resp respond okay so I responded to where the s team was set up and they had vehicle set up walking the remainder of the highway that would go no further there were officers from State Police on scene there were also a couple of larger Vehicles bear cat type Vehicles down range and uh did you go further up to where the the saf police stop theme in the Beast for I went to as far as the command post of swan which was prior to the Beast so I was right there where they were uh monitoring uh draw so and uh there come a time later that morning after 10:00 a.m. you something yes at that time we were asked to go down range to inspect the vehicles that were down range included a pickup truck and a minivan and we were asked to arcades as well as other bondtech tools if you will to determine if there were any explosives or explosive precursors anything of that nature in either of the vehicles at that point did you know what the contracts two vehicles were I do a little bit not much okay and did you do this by yourself or with other officers other officers state federal and okay um as you approach were you able to get were you able to view both the van and the uh the silver pickup truck vehicle in front yes I was um terms of checking what was done to to check out the first thing that we did is uh through visual inspection as well as with the use of explosive detection canes we expected the exterior perimeter of the vehicles um at that time observed a dog in one of the vehicles yeah so what was on the dog so there was a dog inside the minivan and uh I would say in my opinion less than friendly running around inside the van baring growling uh running up and over the seats and all that stuff so myself and another Trooper entered the van in order to subdue the k i were you able to get out out of the yes were you able to uh look at the contact of the B I did a grocery SE at that time and uh there was a lot of materials in there now at that point I so far you're not there to collect firearms that that's correct okay um what do you do with the Conta of the van that so we uh what's full the exterior of the vehicles were uh examined determined to be safe if you will we then entered the van and we began removing some of the contents from the van in order to get a better look at what was inside the van and um ultimately what was done with those contacts after you check out they were they were laid out on the roadway in lives at that time we deoy the K9 once again over some of the item incl backpacks it was camping materials other materials in there there were no alerts by the K9 at that time that time where it was needed we conducted hand entries some of these bags and U packages if you will that that had laid out and when you do St after that once all the materials have been examined on a little they all then went back subsequently went ended up back inside the same to the pick upu as well so same same process with contct with the exception of not much came out of the pickup run we were able to examine what was inside the pickup run without pulling it out L on the and with respect to the contents of the vehicle anything from one vehicle get put back into into the other vehicle or vice versa no is everything that came out of whatever vehicle went back into that same that's screw these show you these tell me each photograph is either a different doorway or a different view into that be ACC that's correct fair and accurate depictions of what you saw when you looked through the V yes H would offer these either stapled as one exhibit or sequentially it's the next several exhibits any objection no objection no objection without objection be Mark unless there's a reason to stable them that's fine so it'll be how many them 7 so that'll be exib 32 through 38 I'm just go through these with you quickly putting of a 32 on the projector can you see it on the monitor yes sir okay where are we looking at 32 that' be the front of the B background here to the right of the photo yes sir 33 what are we looking at exhib 33 that's another another view of the van from the driver's side door open the uh an interior photograph of the front portion of the van seats this is exhibit 34 we're looking in almost as if we're getting into the driver's seat correct and um you make out this this object here the end of the large capacity fire 35 now on the projector this is uh what's the view taken from this Photograph that's a view from Taken outside the C side of the same van and now you get a better look at the fire that's leading against the C to 36 is what that's the side of the van with the sliding door open just another view of the van and it 37 that appear the interior of the van that's a look from the passenger side once again shooting back towards the rear of the B if now see all the materials they piled up the back and exhibit 38 see that yes sir that's St from the passenger side rear of the van through the sliding door shows some of the items on the floor you see some items here in the center see that Pi that up it looks like a fire let me hand it first of all here com what you can okay that's another U part basis be heard yes J we've gone over our stop so we're going to stop here recess at 135 all right s the r back please bring all items for back session um when you first join the state you receive any training in using any types of firearms yes I did would you tell us summary twoe course in how to handle and shoot various Firearms including at that time is 9 mm hand gun and also shortgun um and since then have you received any additional training in that area yes I have uh with the state police you have to qu F anually and over my career we handled four or five different Firearms various calar um and did you have any experience uh or training pertaining sometimes group at long guns with long guns yeah no not specifically so you primarily you're you've been trained in use essentially pistols yes and um I think you're at a police officer you have a pistol that is issue to you that's correct now is that one of be type pistol where there's a cylinder that you put the rounds in like a a revolver or is a different type no just semi-automatic with the two a c or that most the bus where is that loaded you repeat that how that Howes that magazine it fits into the the grip of the fire and the Feats the fire is um and that something that's removable yes okay now the the pistol that you've been issu before um the handles of them um uh what can you tell us about uh the texture of those are they smooth and slippery or they have some kind of texture they have texture I want to direct your attention ofes at 38 on the projector if it helps you can stand up by the television help you see better you see this item up here in the pouch of the the seat you see that top right corner yes um what if anything does that appear to you that is is the back end of a pistol fire tuck into the back of the okay and down here behind the uh this EMP plastic just above that next to the red line see the that object right there right here yes yes and uh baseding your training experience what does that appear to be that would be a grip or a rle okay when you use the term grip what is a grip that's the grip part that you would thank the take a look at those go through them please tell me if you recognize what they are these are a of other that the one that was parked in front of the van correct okay fair and accurate depictions of the way it appeared to you when you uh and the other officers checked it out and check contents yes sir um you're right off of these that's the next that no objection objection without objection they'll be marked testing my math here 39 through 45 um yeah let me have these Mark and we'll through one the time um Sergeant maybe just so it's easier for you to see maybe stand telion uh exhibit 39 I'm putting on the projector what are we looking at here sir this is the photo the D side of the silver pickup okay and um back exhibit 4 putting on the projector now what are we looking at this again pass driver side of the pickup truck uh now getting into the truck itself with and can you see this black object in the passenger seat I'll point it out everybody can see what I'm pointing at this item here that's next to the home uh sleeping hole you see that yes what that that's the back end of a firearm objection I can rephrase the question no objection sorry the jur will disregard the last answer it's the stri it's been Sten the record does that appear to be some type of long gun yes exhibit 41 which I've not placed on the projector are we now looking at basically the other side of the vehicle looking in okay and there's a back hack in the se you see that and appear to be some type of long gun here put exhibit 4 on the projector you could tell us from what position this is taken outside the this also taken from the driver's side now looking into the rear seat of the vehicle okay and um 43 but this a couple items on the floor you see that yes sir okay and closest to the camera you can see the black and gray object that be long yes sir there's another black object sort of above that towards the top right of the picture you see that we point it out see this object right here yes sir let me now put exhibit 43 on the pro excuse me I'll do 44 first we now looking into the back seat basically from the other side yes and you see some objects on the the floorboard area of back seat black objects now go to exhibit 43 same side your re same side of the vehicle yes slightly a different angle yes okay lastly exhibit 45 what are we looking at here now looking into the rear compartment of the pickup truck the open bed with uh some containers of gasoline as well as another here just can nothing further for sergeant cross examination Mr Thompson so the time that you arrive on scene at the highway to the you didn't hear any done corre that's cor putting exhibit 33 up on the mon do you uh you remember that photo from before the recess yes I do see red item draped over the driver's door yes what does that appear to be to you what does appear to be yes it was flag can you describe what you can see on the flag and you can get off this hand if you need to to get a better look at it do you see what appears to be a flag right here yes the simple one yes does that appear to be a five-sided linear star in green I'm not sure you see a a green symbol in the middle of that field of that flag with a red field a green symbol yes say green uh so way what color do you think that is looks White looks white to you do you have any idea what that FL symbolizes you can take a seat again I'm putting exhibit 34 back up on the screen if you remember this from before the launch break yes U if you if you'd like you can get off the window again you said you you pointed out what you believe to be a high capacity rifle there correct yes sir right so at no point did you ever examine that weapon to test its functionality did you no I didn't I have no F question witness thank you so theit you are that was deployed on I third stop the AR explosion Investigation Unit yes that's corre okay um under the state police under the state police sign the State Fire okay and um you were working in that capacity when you responded to 95 yes okay and how many people are in that 1 well squad 13 it's probably approximately 32 Troopers in the entire year okay so what's the difference between you said 13 in the bomb squad what's the rest of that unit that get they are explosion investigators you have the investigators I've done it all done all of it I still do certified uh so we have the fire Marsh's office which under the the FireIce the EV is in the bond squad 13 Bond dechs and then there's the rest of the group is fire explosion investigation minus a couple of Command Staff rights okay so when you responded 95 on July 3rd you were responding in your capacity on the bomb spot right that's correct okay and when you got there were there other um troopers from the bomb were be there I was the first one there but I made calls calling others okay and so by the end of your time on 95 had all 13 members of the B Squad arrived no how many people right I thought it was over we had six from the B Squad and then I called in Outside Agency as well ATF FBI and um going back to you and your response when you arrive um I know you mentioned you you come with special equipment right correct and um did you arrive I know other people from the box Squad also arrived at some point but did you get there on your own in yes okay and did you have special equipment with you or is that something you got yes I special and did you also have um a special9 with you I did and um that the ke9 specifically trained related to detecting explosiv and exposive devices okay and the other thck members of the Box sad who arrived did they all come with K9 also um pretty much yes okay and other than the canines that were there with the bomb squad were there also canines there with other of the State Police other no I okay and when you first arrived where did you go I went to 128 Northbound with the CP for the SWAT te force and um from where you were when you first arrived could you see the TR I could see L dist yes but how far away were okay and um how long did you stay in that area 100 yard away from until there 3:30 10: a.m. with the exception that's when the incident pretty much done with the exception of to go U investigate a potential suspicious page okay so with the exception of that time that you went somewhere else you and until the arrests were effectuated you were about a couple hundred yards away yes okay and so you mentioned you went somewhere else at some that was in response to a call about a backpack sorry um and you you went to investigate right yes which was that part okay um and in fact uh it was a hat right not a backpack that's um you remember what that I never saw the already collected okay so you got there and found out basically F alarm yes okay um and I you may have said that directed who called you into the scene that day that morning the call went from the theer headquarters call I was on call that we did so I call okay and when you got that call um you got a little bit of information about what was going on yes I did okay and then you got to and got more information about what was going on yes okay and um from the information you were given to uh respond and and once you were there um there was no information that anybody on the highway made any B threat right basis that information there's no information convey to the okay um and essentially as you understood it you were called in as least we're trying to figure out what was going on and kind of a precautionary measure is that right yes in some of the specialized equipment I have such as robots robotics is a good uh tool for Gather additional information what are those special tools I'm sorry what is the special tool that you're talking about robotics can you I car two robots um okay and are those robots meant to sort of be remote control going into scenes but that's okay um to look for what might be an device or exposive t be exposive twice be I what they're looking okay and what do those like well we have all different types give you a littleway I'm not sure how significant issue this is case but way generates information so what those so I have a medium platform robot that uh basically it's got wheels on it if you will and it's got a gripper so you can pick things up also has four cameras on it uh three in the front one that goes 360 up to so he got good for gather intelligence picking things up moving things around and then I have another smaller platform that has four cameras on it both sides front rear that we would operate just for use to as for their cameras along just together intelligence oration okay and and while you were on scene did you use either of those they were both deployed that ready to go but not use that the okay so you uh spoke on Direct exam about basically looking over the scene and those two cars after the arest happen right and um you did did a prettyy thorough search of those two cars looking for any sort of explosive device or explosive C right yes okay and um you remove stuff from the van right correct the van was packed right yes there's a lot of stuff in there there were backpacks right yes there were T yes leeping bags yes bags of food yes and so during your search you described removing these items laying them out and then eventually put them back in C corre and uh some of these items you um did a little bit more of a hand search in some of the backpacks is that right yes okay and who besided you was conducting over well there were several offices from various agencies the FBI ATF the state police few few my own guys that's pretty much it we're all blond techs all Bond technicians and how many people would you estimate in total that was doing those eight n and how many K9 we had six total SE that and what about when you were actually doing the searches of both cars where the can9 with you during they were all um they were on scene I I don't think we didn't need all six to do what we needed to do with the equipment coming out of the B okay but you had a few who were um entally sniffing around the cars and the items that you out of the cars right that's UTI okay and um no exposive rever found right correct uh no explosive pieces or components ever found right that's correct and um that means they weren't found at on the highway or in the cars right correct and also you did some searches in other areas like in the woods right we did and also did some searching um in a different area where uh two people were kind of separately arrested right right basically for the location where the vehicles were discovered from that location approximately a mile away okay um and so uh in those areas as well no Clos right we did not find a these as as if we did not find any of those Sly W area we did not it okay and when you say shell casing explain what you mean shell casing being a fire bullet that's fired that has res water whatever power bullet okay so so the Dos didn't find any shell ping or Firearms right that's correct okay and um in fact you know uh well I'll RR that um no nobody was shot that day right that's okay um did you have any uh direct contact with any of the men who were ared nothing further thank you redirect further for sergeant Sergeant thank you very much than testimony nextt by the way while we're switching Witnesses it be a good time to want to pass the exited or maybe the end of the day that's fine um Christopher ke please B can we be like or five pointed star in the middle so because I take judicial notice of it you must accept that that is true that is that the flag of Morocco is the red flag green pagr 5 Star May proceed C you the testimony the truth the whole truth and nothing but the truth well may proce thank you good afternoon sir like to keep your voice up hear you could standing next to the gentleman with a black garment on and the gentleman you're pointing to kind of has both hands up with his palm space that be accurate yes yes um earlier I asked you about the specific date of birth from the booking I I think your answer was you didn't call the exact data that do I have that right that's correct okay when you do when you book a person is there some kind of document that's created with the booking information book sheet okay and um the information you to book the person that go in that sheet corre we're looking at that refreshing memory as to what data uh I'm approximately 5 years um and so I think you graduated from the academy you grad when you first state yes sir were you working as a trooper on July 3rd 2021 yes sir okay um what was your assignment that morning uh that morning I uh so saying I was not do and um I was sent to a federal time that okay where were you s uh I was sent to uh ran closure uh it was at Route 28 to 93 Northbound in stone uh and how long were you there approx uh approximately uh 3 and a half hours and around 10:00 in the morning did you go someplace else uh yes sir where did you go I went to um a large um and were you direct for a particular area uh yes sir uh there were line of Cruisers that were there to transport uh numerous Ates okay and uh did you take note of any particular entes at this point uh yes so there was one that wased to transport um his name was a these individuals how were they dresss uh they dresss in military fatigue so they had top and bottom that were like hand FL uniforms um the one that I had sign they had on okay and um when in terms of where they were when you arrived they Road or Med uh the only one I know about is the one that I wased transport he was in the road uh he was right by an ambulance at the time I was taking control of and um what did you do with that one uh so at that point um he was escorted uh to the rear of my cruiser um the ballistic B series of standard question the with from um to take the photograph as well as you take their fingerprints joh you um you booked or began the booking process at correct okay part of that process involved uh photograph yes was that done with Mr Johnson you this yes that is who took that I fair and accurate depiction of the way he looked at the time yes so smart OB like to be exhibit T foration I'm showing you you see these appear to be two sets of booking documents yes sir you see at the bottom says a true copy of test yes and um each of them on the front of them has a photograph yes sir who's the individual photograph that individual okay um and um Mark foration T and for application part of the booking process were you able to get the date of birth and uh an address you recall off the top of your head with that address uh compound and then same objection from earlier well second half the question okay umras compound address and data R both I think you're you remember the thing top your head I when you booked Mr Johnson was there a document that was created memorializing the information OB came during the booking process yes and is that process based not only on talking to the person but also Mak pring yes um would it refresh your memory to review that document yes you can please read this to yourself take as much time as you need to tell me if that refreshes your memory is to first of all the address Mr Johnson what address were you able to discover uh 12 what about yes may9 um and the uh Mr Johnson's clothing and and ballistic vest that came with him to the end Barracks uh what did you do with those things sir that was all placed into EV now while you were at Andover was there a second individual you had occasion to do the booking process for yes first of all let me show you the first three recognize the photograph had placed before you yes who is that that is up how do you know that uh that is the other individual that I B while I was at the end of par okay um and uh is that a fair accurate depiction of how he he appear during that process yes objection think I have an objection with see which okay and be Mark exhibit and you two photographs with respect to first of all before we talk about Respec to Mr Johnson um during the booking process what was your vantage point to yes was okay and how long do that process take uh anywhere from a half hour to an hour so long depending on how cooperating objection please to deping oner OBC the part we said depending on how oh and it's indoors right um going to hand you exhibit 22 can you tell me if you recognize any of the either the two two individuals that you V in ex 22 yes sir both individual which individuals uh Aaron Johnson and and then I'd like you to stand by the television so you photo with the red yes sir and you indicated second person you recogniz yes where uh down here AB that's the person it's almost like he's looking at the bottom of the photograph yes bottom right and the spot can we get a spelling for uh you recall spelling off the top of your head I believe it is a b a n e l space c u r r a g h and I'm going to put one more exhibit on um I think this is 21 B Mr K elat in this photograph of let me show you the photo itself um and uh what if anything You observe about his clothing and garments in this Photograph uh the ballistic best has own it's uh and it's the only one the webbing style um stps okay um when you interacted with Mr Kar during the booking process in Handover um again same booking room that you described earlier with Mr Johnson yes same lighting yes okay same distance in terms of uh between you and Mr Al Rock yes um show you just a couple before you two documents uh can you see that they appear to be two sets of booking documents yes sir you see at the bottom they have the stamp that says a true copy of test and there's a signature there yes sir there's a photograph on the first page of both sets of documents you see that yes is there do you recognize the individual in that photograph I who is it okay I would ask to Mark these to identification at this point they will be exhibits B and W for identification uh when you did the booking process with Mr Aon elar part of that process entail date of birth and an address for the person yes okay um you call the DAT to process objection same objection yes and um looking at the the book sheet you generated fres memory that point yes read to yourself look up you're ready what was the uh date of birth it was April sorry did your memory remain exhausted after having looked at the book yes when you generated the booking sheet did you do it at a time that the information was fresh in your mind yes did you do it accurately yes um okay um I'm going to hand you back a booking sheet you could just read us date of birth let me take that back now did you also discover an address for during the uh working process yes sir um you recall what that was yes what was it show you more than first thing I'm putting for you see this appears to be Suba yes who's the directed to uh New York State Department of and you see that it's got a packet of documents attached to it yeah but have to mark this forication p uh to be clear who's the DMV information sear okay what's the DAT and um put before you some documents taken out of that larger packet of documents yes you see that they have various points certifications for the New York State DMV yes um on the driving extract as well you see that yes sir okay I would offer the as the next exhibit s protction is ort and objection as well objections noted they be exhibit n subject to looking at the first two pages of exhibit 49 there are two photographs one listed as taken in 2015 in May and L is August 12 201 you see those yes sir you recognize the individual pick those photographs I okay and you see the driving abstract from the New York State DMV for that person in the photographs you give us the name L with New York stmv yes sir the name Led Aaron okay what's the address the address is yeah and um what's the date of is on the this is the fifth page at the bottom it say address history you see another address besides that marshu Hardway address yes sir what's that address that address is har uh New York New York same address you had in B yes then you see the last two pages appear to be handwritten application yes um the now you're describing on the picture the vest and the peculiar webing on the side of Mr Leon Al's vest uh during the booking process what was done with that test I was placing that okay um and ultimately uh you know where it ended up uh I don't know certain I believe it went with M uh and um the uh the content of the vest do you take anything out of the V put anything into it that hadn't been there uh when you it was first presented to you no sir during your time in Booking uh did you locate for Mr Aaron Johnson uh any um Firearms ID card or L carry firearms in or on person no sir what about from Mr nothing further examination n for Mr good afternoon goodno me booking for Mr Aon El um he did have some identification card on right uh yes sir I yes ma'am sorry um he had a morish national identification card right yeah and a uh morish National identification and tax card uh I don't recall what cards were on there I wasn't the one who located them they were handed to me during process okay so somebody else located them and then handed them to you yes Ma I was chines um do you recognize those to be the two ID cards that you handed in relation to mron Al yes um again definitely the mor I don't recall I had seen the tax card but if it was handed me then this is the accurate depiction well um so it sounds like you remember seeing the morish ID card the morish national okay and you do you remember whether you were handed a second ID card and you just don't remember what it was I the second part okay your honor I wouldve page one of no no objection without objection and um officer when you did the booking for Mr Aaron Johnson he also had some identication cards on hand is that right he had a uh ID card from the LA Heritage three that and he had um a travel card yes that photo could you please take a look and um just look up with your done officer are those copies of photographs the identification cards that Mr Aaron Johnson had on him same name Little T black out can't okay so are you so whatever your answer is is what it is are those um accurate depictions of the cards that you received or you can't tell from the book everything looks accurate except it is the okay so I'm just got to ask you in as clear way as I can do you recognize those to be copies of the identification that John objection that objection um is it a pack group that you were controlling yeah um where I nor you go to I went to the G light which was located at 480 put a map on the projector you could just get it located you just indicate the jury where that is we show you the map up CL first so wor so let me know you're ready on theor put on the proor you just you can walk in the television showes where we're talking about so you've indicated the bottom right border of the screen there's a long sort of rectangular building along a road there that's yes correct you said that's the the Light Building G W fi gas okay you can resume the St okay um what did you do with that location I was just in the air I'm looking to see if anyone put the description that was po out anyone the side streets okay um so you're keeping a look at correct okay they com a time around 6 a which something drew your attention yes what happened at 6 a.m. uh two individuals were jogging me as I was facing the description okay um can you describe how the two individual progress yes one male had a long sleeve green armor fatigue sh shorts and the other individual had on a green armor fatigue we haveen green fatigue one for sure is green fatigue would you say what does that mean terms of physical description describe go all the way around and sort of a flexible correct um where did these two pass by you in relation to where you how far were they from you and are they running you know perpendicular to you or diag they were probably about 40t from and they were running in that map still on the projector it looks like there's a whole series of buildings parking lots along there so were you kind of backed in off the side yeah was um when these two individuals uh jog p and their their hand CL were there other people on the streets at that point there were not um so what did you do with that at that point uh as they Dro by me I slowly made my way out of that driveway right nor but kep my dist you're still on your Cruis correct yes okay um now further down North Avenue uh were there were you aware whether there were other police officers yes how so the command post was set up probably from that left okay and is a police post State Police or what I believe it was and post right so that's that's a it's a group of multiple cities and towns that are all part of one organization correct so they had their command yes all right so as you pull out what do you do with that again I keep I kept my distance and I made a call and a dispatch two individual dring inbound North and then um at that time I turn on my lights short verse of my sty get attention Okay Did You observe any change in the individual movement after I that they they stopped what did you do I I did in my cruiser and I told keep hand I see them okay did they they are they still facing away from you at this point and what did you observe about their appearance in addition the clo youve descri um male female upness okay um can you uh recall their their uh their hair any descriptions about their appearance um w shov at this point um were you still by yourself police yes um did you give any instructions I said just keep your hands I can see them don't where were you stand in relation to I probably up by the front but the front left right behind and did you have your um Department issu um you that yeah where was it at that time then what happened after you gave that inial structure I asked um where they were coming from how long they been out uh and what if anything you told one individual St they J they hour um what happened after that at that time IED them to keep the hand right see them don't move in one individual right hand to come down towards at the right side of the body which individual was that that blue shorts or the other person blue shorts and so observing that what if do that time I my the the description who looking for they were close to what the internet was taking place poly armed and I wased so at that time I drove my fire drew it in position already if you could stand up and just give us an idea of what it means to have your uh your service weapon at the low rate so it's essentially pointing down and what happens with that at that time I told them to keep hands can see them and I advise them to sit down on the curve uh at that point did you become aware of any other person moving toward you uh off from the command post were you no was you wer I was not inside that was um when uh so as you're standing there what happens as the officer say bothos to you as officers made their way towards me um I had one individual at a time stand up keep hand in the turn around hand and that happen with both individuals yes okay and um did you do anything to discern whether you know whether either individual was armed did you do anything to discern whether either individual was ared what does mean take your hand and um down which individual do first um shorts um what if anything you know fire did you note anything about that individual's upper body now at this point there another officer assisting you yes is the blue short individual with his front or his back um so uh how is it that you discovered the the volume she um and then what if anything did you do after was discovered that uh this person um he I was with the officer he brought him down his knees in that time that's when I my side pocket was a magazine port radio now the other individual is still right your right correct um what was done with the body armor from the BL short and um did you transport that person to the police station I did who did that um did you wait that individual while state police came what the other individual also detained with um what about that person you see whe there any garments or or taken off second I believe behind or next to as these things are being removed from the two indivisuals being taken away from the SC sort of right were you st it was and were you there with the officers collect these individual and yes the uh the magazine you cover go with with the individual reced from M on proor this green area stand by the telion this green area between 95 Northbound and we North is right here that um are you familiar with the the any of the terrain in that green area meaning you know is it you know field is it a forest is it a swamp what swamp right land yes okay you um the um when you were on control at 6: a.m. um you would you testify earlier there are no individuals walking around from the two that pass okay um were you aware whether that road was open at the time at time um you know why that Ro was out that a Shel Place correct nothing further for uh off examination no cross examination from Mr AB be heard going to pause your testimony here the day uh ask you to be back with the sorry did
