Jerry Hinshaw allegedly killed 17-year-old Marquis Smith outside of a cemetery on Plants Lane Henshaw is now charged with murder as well as evidence tampering in the case 23-year-old Jerry Lane Hinshaw Jr was known locally as a source for various drugs he usually limited his own use to certain periods when he had excess money especially after a run-in with the police on February 5th 2019 Henshaw agreed to meet seventeen-year-old Marquis DeQuan Smith also known as little red at a nearby Cemetery to make a sale Smith had stolen drugs from Hinshaw before and Hinshaw wasn't about to let it happen a second time he carried one of his father's guns with him most likely only meaning to intimidate Smith the confrontation turned ugly and Henshaw ended up shooting Smith multiple times killing him he then made a poor effort to hide the gun but it was easily found in his home when the police made their search before you sit down and take those upstairs foreign a little bit away he'll be here shortly all right can I get a phone call because that was supposed to be at work man um and I ain't about to call out or not are you arrested what you got going on it's got a warrant okay um I can't give you a phone call right this minute but as soon as you get over there get processed it now it appears that it might have a warrant for your arrest let me uh check on everything for you and yeah I'll let you know I'll come back here within the next few minutes and let you know what's going on all right I'll look into I'll pull up that number and I'll I'll call them so there's somebody damn all right all right bro so they said I'm arrested now there is a warrant for your arrest I haven't looked into it because it's not my case so I don't know anything about it I just know that your name is Jerry yeah all right um he'll be here he can explain everything to you I don't know anything about it we worked in six different teams and he's not on my team so I have no idea okay and he's gonna be a good little minute you said it'll be probably about a half an hour anyway I can get a cigarette home no you can't do that he might be able to help you when he gets here but I can't do that house was shot um and I don't know a lot about it so I'm not trying to get into all that but uh during the course of that um investigation the detective Levitt said they uh they uh searched they got I think they got maybe some projectiles or something out of the out of the wall and it was it shot into the house yeah one went through my window and doing his refrigerator and somebody got hit two girls got hit they but they're obviously living thankfully critical oh they're Incredibles okay a new she relationship to you uh not really I just knew her from a buddy of mine that was standing with me at the time okay okay uh what was her name thank God Alexis not girlfriend 100 okay well I wasn't trying to finish it I was just asking um now I'll go crazy without a model later oh yeah what because of the shoes I had to wrap the Band-Aid over her head yeah he said you were trying to help her and that happened like when you guys were standing outside I had a baby in my arms who's your at you all shoot they shot up at the car okay were you in the car no I was standing outside with the baby in my arms okay so you're in the driveway right right you're holding the baby and so people shoot at you a couple they were following the girls in the car oh and you had you been in the car no no okay okay so you were just at the house you were at your house yeah I was at my house okay gotcha you're at your house hanging out they pull up and you came outside yes sir and then they they shot at the girls the girls do you think they were shooting at people that were in that car or do you think it was just random or you don't know I probably don't know have you ever been shot at before no sir never I mean like deployed in the Army I know you're 23 so you probably got to go to the military shoes yeah well um and you weren't even home when you're um when your friend a few years ago got shot no I came home from I came home from work he was there and then I went to Best Bet in Orange Park so was that was like a robbery or something like that and my whole house was around that uh holy cow and he was shot was he staying he had been staying with you or you were staying with him we were both staying together um two different rooms in that house who lives with you now there my dad okay your dad um Junior so you're that's Jerry Henshaw senior okay okay um so that's crazy yeah and he was living in the living room so his stuff was in my room we had stuff all together okay clothes and all together yeah yeah no I don't and I don't know about the clothes whatever was there you know there's um there's different stuff that I know they want to get but I was just going through like the gun so I can get yeah I need to make sure that gets back so what gun's that uh shotgun shotgun uh some other kind of rifle rifle okay uh AR-15 style rifle yeah okay and I circled the one there's a 22 caliber revolver yeah I guess okay all right um a 357 revolver that's my dad's your dad's gun is this one yes sir okay uh 380 auto uh pistol with magazine I don't even know about that son okay so it's a Smith and Wesson bodyguard if you don't know I couldn't tell you okay so I can't release that one to you because you're not sure okay so unknown on this one um but you do know the the shotgun the rifle 22 caliber I don't know about 22 and what's the 22. that's yours no I don't know where oh you don't know this one either I don't know that one okay so I'm known on the 22. so you know about the 12 gauge shotgun yeah okay step dad what's his name Melvin Gilmore Henshaw claims he doesn't know who the weapon belonged to but it is clear that he has access even if it wasn't his Milton Gilmore m-i-l-t uh-huh oh and okay get more g i l m o r e okay Milton Gilmore uh the other rifle the DPMS yeah I knew about that one and whose is that I was me and my buddy just sharing it okay so I can release that to you Jerry and the 357 revolver that's my dad's own yeah I had to talk to that was in her name this is the girl is that the 380 yeah that looks like a 380 so you think that's the girls yeah what's her name oh my god well she's one of the people that got shot yeah okay the police said it was in her name but it may be but that doesn't mean it could heal their reporting yeah no no no no no it just says it may be in the report this is just a property I think because when they brought me down here to talk about what happened right the police officer was putting it in his trunk okay well it's in the property room now so in what's this one was that that one yeah 357 all right who and who who you said your stepdad or your dad stays with you over there does your stepdad stay over there no that's his uh whose house my stepdads all right I'm confused okay yeah my stepdad you rinse out the house your stepdad yeah okay and every now and then you know sometimes I need help yes you know what I'm saying things to hit so sure and the house ain't rented out right I'll stay there you'll stay there yeah and your bio dad stays there yeah right now he does right right so when you were saying dad and stepdad two different people got it Milton Jerry who's my dad I got it I'm going to do with the processing is um they'll swab all the guns um just because they want to make sure this is a standard procedure even civilians know will occur when guns are involved pinchaw admits to having several guns in order to distract them from looking for others that they weren't involved that's just standard practice everybody does that so you're either Prince or DNA is going to be on this gun yeah okay so you'll have your your stuff on this gun and you're saying that's the only time that you've had when have you have you ever had any of these other guns at any other time other than that night this one of little boy had no Apartments my homeboy took it wrong and it was just been at my house this one yeah and if it's sitting out where I don't want it I'll move it okay but Carlos calling them they hang arounds so so many boys at a time in London time but do you hang out in London Town you don't well yes changed a couple names okay um do you know where this is there's a very isolated Cemetery on the west side off of Old Middleburg Road here is so like this is 95 Old Middleburg comes down here and then it comes up then this is a it's a very isolated Cemetery that's off over there you know where that is this is okay here this is a mint right here I printed this one out to show you um or to show anybody that I can try to here's Wiley on Middleburg Road it goes um you know across 295 and then you would you would turn down this road here to try to get to get back there there's a lake over there you can see it from 295. there's a church right here and it I mean it's very very isolated over here I have no idea about the cemetery but I know there's a little farm right there when you go over the overpass a farm that looks like a farm like oh no I explain it okay I don't know if you coming from her alone per se and go over like yeah yeah yeah yeah yeah yeah right hey guys so her long would be like right here it's the next one up so if you came down like West Side Baptist Church is here you came down her long Middleburg over there yeah do you know have you been Have you ever been to the cemetery now you've never been to the cemetery sir anytime ever when you take pictures that's at night time okay so you never been out here no okay so I'm I'm working um a homicide that occurred um here at this Cemetery in February okay back on the 5th of uh of February this year where this kid here this this guy I'm hearing that he does all kinds of stuff he's into dope and he tries to rob people break into houses all kinds of kids are crazy and all whoever hangs out with Carlos this guy that's their image right there okay so you know who Carlos is yeah and you but you you've never seen this guy has this guy this guy that has he ever tried probably because I think Cross Creek but I don't remember him this is Cross Creek right right like that would this guy have ever contacted you I mean probably through Carlos but we haven't like talk talk okay has what has he ever reached out to you in any way at all through somebody to try to meet with you to has this guy here ever tried to rob you no no okay so this this guy's never tried to run has this guy ever tried to I can't do nothing to me this guy has he ever tried to use a gun on you yeah he never did nothing to me man never tried to shoot you never tried to Jack you Hinshaw gives a rapid lie repeatedly about knowing Smith proving he has something to hide and informant has stated that Smith has previously stolen drugs from Hinshaw and um yeah you bet yeah it works cool are you the only person I'm talking to yeah unless you've got someone else I'm talking about I'm just I'm wondering because I had so many guys yeah yeah well those guys were so we'll run to the restroom we'll come right now your phone's Running Man oh I don't know it's probably mine yeah probably my wife's going are you ever gonna come home no the answer is no never yes it's just a few minutes actually yeah before we finish a couple things all right your phone number um how long have you had that phone number to be honest okay um [Music] you do not know how long six months year a week um yeah so your all the um cell phone stuff because that's just the investigation too is to find out where people have been because all they're all all the cell phones say that um any of the past numbers that you trying to put me in this position man I'm not playing with my life I promise you I'm not here it's got me terrifying right now because you don't even know who you about to get me mixed up with you got me snatched up from the streets like I did something Henshaw is trying to deflect their questions while at the same time fishing for information about why they chose to bring him in for questioning yeah yeah it's pretty serious yeah and so and that's what I'm saying that's why I'm trying to give you a chance to talk to me so and and here's where we are with this so this I'm TR I've been I can't put any words in your mouth because I don't want to do that because I don't want to speak for you and legally I can't tell you what to say I would never even remotely do that with anyone I can't do that I've been trying to give you afford you the opportunity to tell me the truth that's it the truth about this I didn't have nothing to do with that and you need to stop putting that on my name man it's just you and I here what are you worried about your name because it's me and you I'm not going out there and telling anybody I'm not going out the street I'm asking you to kill somebody uh I'm trying to ask you about this because here's what here's my concern okay this is cell phone ain't gonna go to it okay none of that nothing will ever come back that will put you here in the cemetery no sir and this kid trying to rock you hang out with okay okay so what I'm saying is if anything ever does I don't get a chance to come back and talk to you again this is my chance and your chance all I really only honestly in my job all I do is I um I just find facts uh wherever the facts are wherever they lead me to I find the facts that's it I talk to people um there's a lot of things forensically that happen that you can't manufacture you can't make up you can't um you can't enhance they just are what they are and so what I do I try to get ahead of all of that stuff and talk to people and give people the for the people the opportunity that I would want somebody to give me their side of what happened there is no side to my story okay there's a story for me do you know why then and I'll just ask you this and then and if you want to rethink and tell me something that's fine if not and there's really nothing else for me to ask you can you tell me why you're you're gun and what gun the 357 that's not mine okay do you think your dad killed this guy no okay all right can you tell me why then you just give me anything give me an explanation that gun killed this guy there is no doubt there it's it's at a hundred percent it's a provable commodity so that gun that's in your house that's in your possession it's not in my in your house that that 357 revolver is in your house and that kills this guy now what's that it's a house that we ran out okay so let's knock it technically so what we're going to do is and we're going to find that all of that is I'm gonna find who's at that house on this day that killed this kid at this Cemetery that's easy that is that is like the easiest thing that I do and so are you telling me and that's what I want to know is that's why I'm asking I'm not trying to pin anything on you I'm trying to ask you for an explanation because I don't know I don't know this kid you know being mean to you bullying you you're saying you don't you've seen him but you don't know him you've never been here this kid never tried to rob you this kid never ever ever attacked you did anything to it but yeah you're a gun you're a gun my gun kills this dude you're seeing my gun but it's not my gun the gun that's in your house at 357 that's in your house and always got friends that stay over so you think that's what I'm asking you so are you telling me that one of your friends none of my friends did nothing Hinshaw has placed himself in a difficult position he denies having anything to do with the crime but can offer no other reasonable suspect in his place if he does try to pin the blame on someone else he runs the risk of them giving the police more evidence that would solidify his guilt well you are saying you're gonna have to because I'm gonna I'm gonna I'm gonna find out who was in that house it's a very simple procedure we'll find out exactly who's in that house that day I will find out everyone who's at that house would it would it surprise you to tell me and not having to carry around the 357 never would I never even think about even dealing breakfast on my dad and taking his gun my dad he's an elder he don't get about the bed yeah okay yeah yeah and I'm not I'm not saying your dad did it um that's why I'm asking you but would it surprise you to know that I've that in the last few months that I've already talked to several people okay would that surprise you no it wasn't the whole year what's that you said a whole year right this was February and it's now August so half a year roughly six months that I've been working at this since I got called out there that evening and that and that in doing cell phone searches and in doing video surveillance and doing all the other things that we do on our end would it surprise you that I've already come in contact with other people and they've told me what happened would that surprise you surprised me about what about what happened I don't don't want to tell me what happened I don't know what happened I mean honestly you you don't know how to explain that you're at this Cemetery this kid gets shot and killed with your gun come on now one thing give me give me I haven't how did that happen you're playing with my life right here I'm not playing this ain't playing I'm not playing yeah I'm taking you I'm just I'm not saying man-to-man I'm asking a question yeah how does your gun how does your 357 kill this kid give it explain it figure out who was at the house done what I'm telling you when I'm saying I'm gonna do those things the reality is that's already been done okay that's already done I've already I've already accomplished all that I did all of that before I was ready to talk to you that's why I didn't step to you a week after this yeah when I knew what was going on well did you know that I have been watching you since February did you have any idea you have no idea you have no idea I know that because I'm really really good at my job so I'm telling you you don't you can't offer any kind of an explanation as to how your gun the gun that you say isn't yours but it's in your house that your dad who is an elder who is doesn't move around and I ain't did nothing and you didn't do anything and you didn't do that and you can't can you I mean can you even imagine how it happened what do you mean like give me something who took your gun and went out and did this I couldn't tell you right and then it's not my gun who took the gun that's your father's that's in the house that you live at and that you were living at that you were happy and that you were at this place and that you went to the cemetery and then you came back home how did that happen it's somebody in your house I'm not there here's a way to verify if you're telling the truth because this I know I have a I I have this information on February the 5th who was staying in this house this is the easy way right now for you to tell the truth who is staying at your house I'll give you an
