All right, good morning, and thank you for coming. We're going to discuss the fatal shooting uh early Saturday morning uh at Walmart in DeLand. So, the first thing we're going to do is we're going to show you a compilation of the videos that then lead up into the shooting. >> Put down your window. Put down your window. >> Stop. >> I'm on 116. I'm behind you. You pulled out of my street. 10-32 clear from here. That's DeLand. Black Ford Nissan heading westbound George That's 151 Bravo Romeo Oscar Whiskey. They're taking off westbound. No lights. It's a uh tan colored Nissan. >> 911, what is the address of your emergency? >> Hi, I'm actually driving. I'm in DeLand, and >> Okay. >> there was a car. He ran two red lights. He almost hit me broadside. Um I'm at East New York at Spring Garden. >> Okay. >> And he went south on Spring Garden. It's uh it's like a gold Altima. And And had a Tennessee plate. I tried to take a picture of it, but and it was a single white male. And it looked like he was drinking something. >> Sure. >> But that That was pretty much all I got. But >> You said Is it Is it South on Spring Garden? >> Spring South on Spring Garden, yep. From uh from 44, from New York. >> Okay. >> But I was pulling onto East New York from Florida and he went right through the red and almost hit me. And then he went through the next red at I forget if it's Amelia or what, but >> Okay. >> So, anyway. >> Garden, okay. I've got the call up to South on Spring Garden in uh New York last heading South on Spring Garden for that driver. Um what's your name? Uh they'll get out there as soon as they can and if you see anything else, give us a call back. >> Okay, thank you. I'm I'm going to head home, so. >> Yeah, of course. Have a good night. >> All right, thank you. Yep, thank you. Bye. >> We're at least going to get to Spring Garden just because he seems to be escalating in his driving. Uh this is the second independent caller that said that the same vehicle just sped through two lights and uh almost took out their car. So, we're at least going to get here. >> County has charges. >> County has charges. >> 5051 >> Still going westbound. Passing Chelsea. He just turned right on the Beersford, it looks like. West Beersford. And Delta 23 Central is shut down. No, he's still going uh southbound on Florida, past Beersford. Northbound on southbound? >> He's still in the Walmart. >> 54 get to 472 and >> Stay in the car. >> Two copies for me. >> SHOW ME YOUR [ __ ] HANDS. Show me your god damn hands. Show me your hands. SHOW ME YOUR SHOW ME YOUR HANDS. >> DELTA 23 SHOTS FIRED. Going behind the Walmart. GOING BEHIND THE WALMART. BEHIND the Walmart. >> He's behind the Walmart. >> He's still in the vehicle behind the Walmart. >> Behind the Walmart. >> Let's go. >> Get out of the car. >> Get out of the [ __ ] car. >> Get out of the [ __ ] car. >> GET OUT OF THE [ __ ] car now. Get out of the car. >> Same direction. >> Same direction. >> Same direction. >> I hear him I hear him rocking [ __ ] >> Show me your hands. Show me your [ __ ] hands. SHOW ME YOUR [ __ ] HANDS. SHOW ME YOUR HANDS UP. HANDS HANDS UP. Come down again. Wave it out. Wave it out. >> When he comes to work to kill anybody, but you have to look at how this whole thing transpires. This starts at 9:10 at night and goes on for almost 6 and 1/2 hours where this guy is driving through streets of DeLand. He's not stopping for police. He's driving without headlights on. You hear one of the police officers get on and say he's going northbound in the southbound lanes. And then obviously, you know, from the video, we don't know what the deputies want to say, but obviously the video, the car lunges toward the officer and the officer fires. Well, I'm sorry, the deputy fires one shot. And that's what got got us to have us here today. Uh the deceased in this is Brandon Joseph Brabin, b r a b i n. He was born in 1997. He's got a criminal history in Tennessee. He's got a criminal history in Florida, in particular in Lake County. Uh he was on probation at the time. He was he violated his probation. And a probation warrant had been issued for him a couple days prior to this incident. Inside the vehicle, um there was a bunch of uh Fireball. You know, we don't know uh what his tox or toxicology reports going to be. We'll find that out weeks from now. Uh as is standard operating procedure, the FDLE investigates. When FDLE's investigation is over, they'll then hand that off to the state attorney's office, who will see if the use of force was justified under the law, and then once that done that's done, it comes back to me, where I open up an internal investigation and see policy uh procedure and training what happens there. And in the interim, the deputy is in a non-patrol, non-policing status uh until the conclusion of all of those things happen. All these All these things are normal. We do these things all the time. And and then we'll take it from there. You guys got questions? >> What? I guess the six hours, from 9:00 to almost 4:00 a.m. I guess it was almost closer to 7:00. Was everybody looking for him? I mean, I guess that's what's kind of confusing. What was going on during those six hours? >> Right. That's a great question. In the beginning, yes, everybody's looking for him, right? Flees from the police officer, couple 911 calls come in, so everybody's looking for him. And then they can't find him. And then he resurfaces again around 3:40, I think it is. A DeLand officer sees him again blowing through a red light, goes to stop him, and based on the totality of the circumstances, and I don't and I can't blame the DeLand PD at all, they say we're not pursuing this guy. He's just out of control, and they make that decision not to pursue. The car is then caught up again, where you see where we're we do it. They're following it, and everybody's looking. Deputies are looking. Everybody knows the tag number, because they sit in the tag readers all around. And then that's when we go into this last phase, from 3:40 to 3:49 a.m. They see the car. Again, we're trying to get the body camera footage of where he's driving the wrong way on one of those streets, pulls into the Walmart lot. I mean, he knows the cops are looking for him. He fled from them three times during the course of the night. And you know, you got to remember, you know, and people don't want to hear this, it's his actions that led to this, right? It's his actions. If he stops when a DeLand police officer in Artisan Alley says, "Stop," we're not even having this discussion. >> What are they trained to do when they get out because you've seen them go in front of the vehicle? >> What we're trained to do is what we have done recently here and and the entire place has been trained on this is two maneuvers. Maneuver number one is the PIT maneuver, right? Pursuit intervention technique. I did it. We see it. FHP does it. Our guys do it. We're trained. That's when it's an active moving. The second thing we're trained to do is it's called VCT, vehicle containment tactic. That's where the car's pulling them along and you PIT maneuver them in. The only time you're really allowed to crash into something, the only two times you're allowed to crash where we got your back is the PIT maneuver and a VCT maneuver. I don't know why they didn't execute that. I don't I We don't have the answers to any of that stuff yet. That's what all this has to flush out. Because nothing good happens when you put yourself in front of a patrol in front of a car. It just doesn't. And that's why we authorize the use of your vehicle to block somebody in or hit it and disable it to prevent you from getting killed or prevent anything when all the when the legal lens done, it'll come back to me and we'll sit down and we'll break that film down piece by piece and see if any policies were violated, if any procedures were violated, if training was violated and we'll deal with those things accordingly. >> You said that Lakeland did authorize the use of stop sticks. Have they ever deployed those? >> I It doesn't seem It doesn't seem that way. >> Well, you just didn't get to >> They didn't get to that point. And just be you know, you got to remember something, we're the Sheriff's Office and the Lakeland's the one like Daytona Daytona, we had a pursuit on the other night on 95. Daytona said you're not pursuing and I had our guys say, "Yep, we're we're going for this. We're pursuing it stop sticks." So, just cuz one department says they're not going to pursue doesn't mean another organization it doesn't fit their policies. >> But it did fit their policy to pursue. >> It did, but we didn't pursue. That's the point. We It never got to that. You know, with the guy's got his lights out, you got to weigh that and I think the land made the right call. You know, the guy's got He's driving with lights out. Uh that's a danger to the public, a real a danger. But the other danger is letting them continue to drive. Yes. >> Going back to what you were talking about with the car just blocking in. When you're not in a pursuit anymore, you're just under what? Bolo? Would there be a different way of officers approaching the car as a bolo as in not a pursuit or pursuit being more hot like block ins or >> Well, a pursuit the the the the pit maneuver is the car's moving and you got to stop it. And you get up to it and you take it out. The vehicle containment uh, tactic is just what that's for. Somebody's wanted, they're in a parking lot, they're in a car, they can get mobile, you get in as quick as you can, you block them in, you crash into them, you do what you got to do to disable that vehicle. That would have been a perfect maneuver in there. Why I don't know, we're going to find that out. But that's what you're that's what they're trained to do. I mean, so. >> He could have just gone already gone. Is that normal? >> You don't know what he's You don't know what you have. Why is this guy fleeing? Is there a body in the back of the trunk of that car? Why is this guy driving like an ass and consistently avoiding police and yet staying in the same area? It's not like he It's not like he Well, we don't know where he went for 6 hours. But wouldn't you if you had a little bit of common sense, you'd say, "Well, I'm not going back there. The cops are looking for me." He he continued to be in the area wanting it like it was a game, wanting us to chase him. And unfortunately, he ended up dead because of that. >> Bottom line, if the vehicle is a weapon and you start moving a weapon towards an officer, all hands >> Vehicle can kill you just as quick as a gun can kill you. And a vehicle can kill you, you know, walking across the street. I mean, if he were to t-bone that first 911 call, that we might be having it might be a traffic homicide investigation. So, you know, it it's it's a tough situation, but you know, you can't come out on top when you're standing in front of in front of a car. You're not going to win. You're just not going to win. >> He started running with no headlights forever, running red lights, avoid you know, running from cops. It's almost like he was on a suicidal path. >> And that's what I said. All of his actions led to where we are now. Are we going to scrutinize what the deputy did or that's that's what you do. But at the same token you have to look back and say how the hell did we get here, you know, and you look at what happened and you look at all of these little pieces that we're putting together here. This wasn't like a you know, it was a shoplifting call where we happen to walk up and all hell breaks loose. This guy was riding around and by the grace of God he didn't kill anybody. I mean the Deland police officer police report says he almost hit a pedestrian and he almost hit a car when he was backing out of out of the alleyway. And then you have the 911 call or minute or two later saying what just happened. And then they said he in in the body camera footage you hear them say we had two other calls come in talking about this guy running red lights and no headlights on. >> So it almost seemed like he he just didn't care. >> That's what I think his his tox will tell us exactly what was going on here because he clearly he was not acting rational whatsoever at all. So and then like I said some of his some of his criminal charges are motor vehicle theft, simple assault, drugs, probation violations. So we're going to you know, we're we're going to look at everything. You know, you we this is serious serious business here and and we want to make sure we get it right. And right now like I said that first step is FDLE, second step is the state attorney, third step is me. But I think you guys know me ever since I brought body cameras into Daytona Beach, we don't shy away from showing the body camera footage, you know, we're not one of those I'm not one of those people that are going to sit there and wait for six or eight months or a year from now to show you what happened. I think everybody somebody's dead because of police actions and the actions of the suspect and I think it's fair for everybody to take a look at it and then we'll see where it shakes out from there. >> What are your thoughts on all this so far? >> Uh to be fair to the deputy and be fair to everybody I'm I'm going to refrain my thoughts. But I can tell you we spend a lot of time and a lot of money and a lot of effort on de-escalation, on pit maneuver, and on VCT. Vehicle containment program. And when you walk out here today there's a big building that we just constructed that we compile body camera footage from around the country of what was right, wrong, and indifferent, and you study that. Again, he made a judgment call, and we'll let the whole system play out from there. I I I can't I can't imagine, I could be wrong, I can't imagine under the law that deadly force is he could not have used deadly force. Under the law. There's There's two There's two things here. You have lawful, and you have awful. And my job is to look at the awful side. >> What's the age of the man? >> 1997. The deputy is a new a newer deputy. He graduated, I think, 2 years ago. I think it's about 2 years ago from our our academy. >> Do you know how long the suspect has been in Florida? >> Uh you know, his his printout shows him all over the place with different addresses in Lake County, addresses in Tennessee. Uh the car he was driving didn't belong to him, it belonged to somebody else. We're trying to figure out what the nexus is between that. Uh I think I could tell you at least since 2020 because we issued him a traffic citation in 2020, and I know he's been arrested since then in Lake County for motor vehicle theft and some other other charges. >> Thank you. >> Thank you for your >> Thank you, sir. >> No, thank you guys for coming out.
