this is what I want to show you he didn't die let me guess said that we done it she did day this is Brian Greenwell a coldblooded killer who for the past two months has had no idea that one of his victims survived his attack faced with this shocking realization he's ready to try to lie and manipulate his way out of the interrogation room but can he I do this every you think if I put a guy who's paralyzed from the neck down on a ventilator with an interview like this they're not going to sympathize with him instead of you on May 13th 2016 in Louisville Kentucky Jennifer Kane was supposed to be off to a new start a mother of two who struggled with addiction she was scheduled to begin a new job in an attempt to get her life together unfortunately she didn't get the chance when Jennifer didn't show up to her shift a friend entered through her apartment's unlocked door to check on her what he found was something no one should ever have to see Jennifer was on the floor of the bedroom rendered unrecognizable by three gunshot wounds to the face her partner Daryl Wilson was in a pool of red after having been shot in the head miraculously he was still breathing after he was rushed to the hospital police went to the apartment next door to question Jennifer and Daryl's neighbors Brian Greenwell and jod Cecil they hoped that the two would have heard something that would help out the investigation oddly they were nowhere to be found hours later when police tried to question them again they discovered that the apartment had been hastily cleared out cleaning out your apartment the day your neighbors get murdered is a great way to make law enforcement suspicious of you about a month after the initial attack police had another reason to be suspicious of Brian and jod Daryl had finally recovered enough to be interviewed and he told police that it was Brian who had shot him at that point Brian was in custody on an unrelated charge with no idea that the person he tried to kill not only survived but was recorded in a police interview pointing the finger at him however you're about to watch him find out hey Bri What's happen man What's happen takece take H sorry it took me a little while to get over here was finishing up talking to jod mhm how she she's a little upset about what that's what we're here talking about she's a little upset um I will tell you that she I'm trying to remember her exact words but it was more long lines of I don't want tell him I don't want him to be scared and I and to talk to us anything else on along that because I want I want to go talk to him I said I can't let you do that said I may be able to let you do a recorded statement or write a note but so you do one now I have a recording I also have another recording that I'd like you VI as well but I can't ask you any questions yet because you're in custody for something else I don't know I know it's some kind of dope charge you had some stuff there so before I actually ask you anything or tell you or show you anything I need your rights you those read before correct no you've never had your rights read no okay let's go through I mean when I was younger yeah right I you know what I'm talking about okay I want to go through this listen I brought a picture of your kiddos I I gave her I gave her a picture of it too that was a pretty slick move by the detective and clearly it's paid off Brian's immediate reaction to the photo of his two daughters who were both under the age of five shows that there are already cracks in his armor at the time of the murder Brian and Jody's children weren't in their custody very soon you'll see why but I'll give you a hint now this definitely isn't Brian's first time having his Miranda rights read to him I don't want to law this time and understand know what I'm doing no promises or threats have been made to me and no pressure coercion of any kind has been used you understand what coercion means right okay um and I'm guessing you might have an idea what you don't have an idea what what you might want to talk to me about or what I want to talk to you about okay and it has to do with the apartment you guys used to live over on Shelby Street oh well yeah does that ring a bell and that incident okay what do you know about that incident far as I know they was they was supposed to been us far as my understanding cu the guy that uh he was supposed to sent somebody over there to talk to us something like that I don't know cuz they used to have de I mean I know the guy too you know they used to have dealings or something something like that I'm not even sure if it's him you know what I'm saying I'm just going by what I've heard that he got ripped off for some dope a few times he got upset about it only reason why he wouldn't come confront her by herself you know what I'm saying cuz of me but she never ripped him off on no dope anyways it wasn't her know it was so this was it was geared towards J what you're tell me yes and far as I know that somebody was supposed to send some people from Chicago some black dudes said it's not about the money now it's not about the do is about the principal and he Terry pay told me this and I told him I said well you better go back and tell them you're right it's not about no money it's not about no princi if anybody com my my fiance then had P me you know what I'm saying I'm involved and he said well sorry too the been made that people from 4 say New Orleans or something like that Louisiana is up here looking for and that's when I noticed that started being followed and I'm like hold up you know maybe this shit's true I'm thinking it's all you know you know how people talk and we just try to scare somebody and I kept no people F me I kep noticing people foll me I'm like hold the hold you know so I made a phone call and I was like dude what going on he said man said I told you he said I'll try to go talk to him I said dud you better do more and try to go talk to him and for the past I don't know month and a half something like that every time I walked out the door I was being followed and and for the life of me nobody believed me I mean I told everybody I said man somebody is following us somebody's following me or somebody's following you somebody I got locked up the reason people may not have believed Brian's claims of being followed could be because of why he was locked up for methamphetamine possession one of the most notable side effects of using methamphetamine is paranoia it's not unusual for people who are on binges to spend several days thinking that people are out to get them in Brian's case however we have to give him some credit there were people out to get him the police however when they tried to initiate a traffic stop to take him into custody he decided to lead them on a wild Chase instead what happened with that I'm not the dope police you the South End little tour and uh yeah burn I mean not one time that nobody ever say police nobody said I meant the whole time that I told everybody I was being followed I mean i' had people run up on I'm like I take off nobody ever said cops you know so I don't know if it's the cops or if it's them or whoever whatever you know what I'm saying I'm like [ __ ] so I've done what I know to do best protect myself and get the hell out of that situation for a moment but that situation it was same thing two cars whipped up on me then once I took off yeah he hit his lights I'm like you know I got a set of them lights which I do you know what I'm saying I got a flashlight that turns you know what I'm saying you click it one time it says her flash is red white red blue them light you know what I'm saying I'm like so nobody's ever said stop police this L this is the feds this is the whoever you know what I'm saying so I'm I didn't stop you know even when we got back to the house we were staying at not one time did anybody say police it's police it's whoever blah BL they just told me get down blow my goddamn brains out I'm like well here's a chance I got to take either they're police and then once they all started coming up on me I noticed it was always cuz I seen all equipment [ __ ] like that you I was like well maybe it's so I got who who all did you get AR wrestle with that me jod uh laa and Chris does laa have a real name everybody keep saying La I'm like I don't know who she is I'm not the dope police but I'm just curious for it's l I know it's l i don't know it really doesn't matter for me I'm just curious everybody says La La on kid TV show this incident which the detective is using to loosen Brian up resulted in Brian and jod being arrested for possession in addition jod was caught for a trafficking charge it's likely that they both suspected they would be questioned about what happened to their neighbors after they were taken into custody but neither of them had any idea just how much evidence was already stacked against them all right let me take you back to that that apartment on Shelby how long did Jo stayed there man I came I just out of jail and I don't know if she's had that before I went in or before right before I got out or what I think it was only I was on there like couple weeks maybe something like that maybe a little longer I know it's like between two about two weeks two or three weeks something like that and you guys never went back to that apartment yeah we went back you did yeah we went back and got some of our stuff I mean we' seen the landlord nothing was ever said we seen cops sitting there nothing was ever said to I was thinking well this ain't got nothing new with us I hope did you know those neighbors y talk to them you ever saw before yeah what you say if I show you a picture of them would you know who they are I'm pretty sure yeah I think yeah it was her now guy now this is a little bit older picture I think he had probably just gotten his hair May been a lot longer yeah if you put long looks like yall didn't have any interaction with them no other than uh passing do the what do you actually know about what happened over there what have you heard what do you know I just heard that somebody got shot got killed or something like that and then we stayed away for a couple days so that's when I found out that supposedly they was there for her andin us you know what I'm saying they supp us I was like you know we made decision you going stay away for a couple days cuz I mean h and you know there was two victims there you know that no both of those two people no just they told me it was just uh the lady well both of them are shy and uh this is what I want to show you he didn't die do you remember do you know your neighbors [Laughter] [Music] that pictures neighb know they [Music] were were your neighbors involved in [Music] that your neighbor so that's just the start of it but okay let's finish it I got I've got a couple followups here okay when I showed Jody this she lost she lost like ball broke down let me guess said that we done it she did you've just seen someone realized that drug charges are the least of their worries no information about the shooting was publicized for two whole months Brian and jod believed that both Daryl and Jennifer had been killed in the footage the detective showed Brian Daryl is unable to speak or move anything below his shoulders due to the severe brain injury he sustained in the attempted murder all of the information he conveyed to the detectives had to be done through blinking mouthing words and nodding well you know and before you know I'm going to tell you the same thing I told her I said you all have some important things in front of you I said bad things happen to good people sometimes people get put into situations and [ __ ] didn't go as plan um I believe that's what happened here I don't believe there was malicious intent going in I think [ __ ] escalated and went bad I told her I wanted to help her try to get to the good side of this to not paint her into a negative light on it and I said I I told her I said I will give you that same opportunity and tell you the same things and I told you both exact same things and that's how I want to present I don't [ __ ] people you I'll tell you what I got I me fair enough I've got a living victim who puts you there I've got Jody who said you were there now I want to hear from you what in the world happened like I said I think something went wrong I don't think you got there on I want to hear the rest of it what jod had to say what jod had to say I don't have jod on the video thought said you had her on a I have her on audio recording I just did it I don't have it on a disc yet I still have it on a actual recorder can I hear it I don't know let me see if I can do that I don't even know if I can do that I mean it's on it's on this recorder that's in my pocket right now the same one that I have on right now well let's find out if we can do that because I mean is that Gonna Change no I mean I want well you know I'm not going to play it word for word so you can mirror your story off been doing this a little I don't expect you to do that either but I would do like to know what she's saying what she's I can give you I can give you the details of I guess the general of what you said is that and he goes on to say it as well that they involved in a domestic situation apparently you know he might have been getting the best of her she came over for help you guys go back over to their apartment it happened inside their apartment U said you guys intervened honestly on the good side of this to start with trying to help her out and things went bad from there does that sound is that a fair statement of how things may have occurred no I mean it's not no I had no yeah I know these people I don't know them personally you know I'm saying I know from that apartment and yes we did go over there but that's it I mean hell is you fingerprint the place you find my fingerprints on a couple of things is where I would walked in the room [Applause] I mean other than it Brian's first attempt to outsmart the detectives hasn't gone as planned asking for his girlfriend's story so he can align it perfectly with his own didn't exactly fly under the detective's radar and immediately trying to formulate an innocent excuse for why his fingerprints are all over the apartment is going to have about the same effect I know right now you're trying to figure out where to go with this because but I don't want you to start digging yourself a hole no what y'all want me to do is commit you know saying I don't need I don't need you to I've got him and I've got jod statement I've got enough to walk out of this room right now what I'm trying to do is give you an opportunity to do the same thing that she did which is go at it at the we were trying to help and things went bad it's a whole lot better than we went just not give a statement and me going off of him I mean you think if I put a guy who's paralyzed from the neck down on a ventilator with an interview like this up to 12 people on a jury they're not going to sympathize with him instead of you I'll take that all day long twice on Sunday well you know I'm looking at it too I'm like yeah I mean as it stands right now I mean regardless of what I say I'm in this situation and I'm trying to say that there is a little bit of an out here to make it better on you to not make it look like I don't believe you're a cold blooded killer no I don't believe that at all nothing suggests that to me I think you're a smart guy and I think you got involved in a situation that you probably should shouldn't have well not to say you shouldn't not that you shouldn't help somebody out but I think [ __ ] went bad real quick and I don't think anybody should be judged on just one thing alone there's a whole series of events that happened here to get basically where we are right now and I just want you to you know think about a lot of different things and I know i' throw a lot at you at one time you know and I can't can't say I understand where you're at right now because I haven't been there but I can empathize with you I do this every time what you mean you do this every time I always try to protect everybody you check that record for minutes I can ask you a question been recorded right I don't know about this room because this is a correction room so i' have to say you know I don't know what happens if I go I mean I know the story there you know what I'm saying I know the whole thing what happen what was that guess I just got an email because this is not actually working comp look how can I get jie off of all this I mean I think I think she is the least culpable of of any anything that happened you know I think she was just there um and what he says and what she says really job in line with the support they support each other learn their statements um but I mean it's honestly just going through the story and I think I know the story if I told you the story that would it sound anything like what I started it off as a domestic thing that you guys got involved in you end up in a fight with them with a gun it goes off and I can't tell you any more than that because that's what you know by any chance does that seem like a story that of what happen Kentucky is one of the few states that doesn't legally require cops to record custodial interviews thankfully for us this department did anyway obviously the detective is well aware that the interrogation is being recorded in the room but turning off the handheld recorder gives him a great opportunity to gain more trust from Brian who is definitely way too trusting to be sitting in that chair without a lawyer and see we can work with that because the beginning part of it changes a lot there is a difference between you going in and saying I'm GNA kill somebody and you going in I'm trying to help somebody and then [ __ ] goes bad there that's way different things there that we're talking about one's a whole lot better than the other I mean the end result was that some that people lost their lives yes but it's a whole lot different when it comes to talking to juries talking about charges you know those type of things that is that is a night and day situation see yeah it's yeah yeah like you say y'all can me out to be I mean as it stands right now with just them two saying that [ __ ] y'all got enough evidence I'm not going to [ __ ] you I told you that said I got enough right now I can walk out of the room but that's not what I want to do because I believe I'm getting everybody a fair shot at this I've been doing this 18 years you know I I don't [ __ ] when I talk to people I don't play that whole mind game where I run around in circles and we talk for six hours I tell you what I got I tell you how how good I you know I'm not gonna lie if I got something this week I'm going to you know be like hey this is what I got here's your chances 50/50 this is not a 50/50 chance kind of thing right here tell you that right screw me all the way around so that's what I'm trying to give you I want you to see the how I'm trying to let you get out in front of it and tell your part of the story on it can smoke a cigarette I think we can probably make that happen we let her we let her go down to the basement and smoke one you come back and finish up the story we can do that TI for see we can work for you regardless of what happens man y can't I mean I think I know what you're trying to get out and that's to me you don't want anything to happen to JY on does that sound about right yeah and I really think that's going to depend on a lot about what we talk about what you tell me on this I think I think I can minimize her involvement well I mean she is there I mean have you ever heard have you ever heard about uh doing a bank robbery yeah you're the you're the robber you go in and Rob the store I'm just the driver we both get in a car chase and get caught down the way you know what charge did I get accessory much charge you get It's a Robbery I still getting robber I mean she's there with you so she is a compli you know she is complicit in this and not call the you know she didn't there was nothing done on her behalf to help or stay or call or anything so that's that's her little bit of a problem but her involvement is minimal kind of she did tried to what you try to do try to help after they were shot when did she do and this helps H about calm down okay give time you know get your stuff in order see set up that cigarette while it's true that a statement from Brian could lessen jod sentence she's already dug herself a pretty deep hole with some things she disclosed during her interrogation like the fact that immediately after the murder she claims that she and Brian went to a nearby casino for several hours just to be somewhere that doesn't exactly paint a picture of someone who was trying to help but Brian is sure going to try to I've talked to some other people I know it's been bothering you everybody said that acting different it's really bother you so it's been noticeable to other people take that weight off throw it on me get it off your shoulder man you ain't going to try hit me with no deathy or no there's no aggravating circumstances we're g try to get this done as quick as possible yeah I'm beon which I can't sit in that jail understand Joy didn't have nothing to do with it she did try to get help in there I mean I even tried but she come over she said uh he's over beat so we walked over we didn't even walk in an apartment at first I was like you know what's going on y first I said yeah you know so I walked over her dude was over her breaking [ __ ] throwing [ __ ] cing her all three of us was standing outside the girl was standing outside you know what I'm saying I was like we just leave or come over here do something I'm saying if you want to let G call the cops she went back inside he grabed hold up or something like that like you got help so I walked in there and I separated them this and that and that's when be honest with you I don't even I can't even remember how the gun came into play for real well we started uh kind of wrestling around and that went off and then it went off again how many times do you think it went off honestly man I don't even know I was I was I bled out or something like I don't know it's like I'm guessing two or three times three something like that I remember hearing three gunshots do you remember which one you shot first no I I don't I was just freaked out I was like man to help somebody this [ __ ] happens I think I know it went off once I thinking she got hit first I'm not sure and then me then was still struggling and it went off again I do remember it and that's when he fell on the bed and I I didn't I mean I didn't know what to do I over ition going over jod and Brian's stories actually align here they both claimed that they went over to help and then got into an altercation with the fighting couple resulting in Brian and Daryl fighting over the gun though jod and Brian's stories align the crime scene told a completely different story Jennifer cane was shot in the head three times with all the bullets having been fired from Less Than 3 ft away at least one shot was fired at her head while she was lying on the carpet by her bed the single shot that paralyzed Daryl is believed to have been fired with the gun pressed against his head even more troubling the shot was fired from above with the as salent standing over him remember about what time I I know this happened on Friday the 13th is when we were there and it was later in the afternoon we got there when do you think this might happen happened was it on that Friday I'm not mistaken she was supposed to start that new job Friday morning at noon does that sound right do you know that Jody knew that that's why I don't know I mean after it was all done and everything I I might have heard Jody say mess you supposed to start a job day or something like like we do didn't even one of us know what to do she was like let's call the cops I me I mean like you said overs of help not hurting somebody you know and she never J never entered the apartment whatsoever far as I know of she told me that she did she said she got she didn't go into the room that you guys room was is the back bedroom but she said she made it into a part of it you said she tried to help him afterwards so I mean she was like if she it doesn't matter to me if she came in that's if you're attempting to she came in that's fine it's not that doesn't get you in trouble that makes you a normal human being that wants to come in and make try to help yeah me we was both you know what I'm saying she was like you know I'm saying well actually I was like standing turned around looked at her at the door I was like what do I do you know I I didn't know I still I mean until this day I still can't tell you exactly from start to finish what happens you know I'm saying I just know that I was the one standing in the room both and was like know are they they still breathing or whatever you know what I'm saying I was like I don't know how do you check somebody if either of them had actually checked to see if the victims were breathing they would have realized that Daryl was and that he was in desperate need of an ambulance didn't know what to do I mean I still don't know what to do I I don't know what happened to the gun you do destroyed it it down it down that a lot of heat yeah I know well actually the gun didn't get melted down it got took apart and bur that melted down I was like man I gave the gun back to the person that I don't it you know saying me borrow and I can't tell you his name I don't so did you destroy it or did you give it back to the guy no I took itart most of the gun went back don't [ __ ] me I mean this is not that's not a big issue there I'm just trying my main thing honestly is yeah I would like like to recover but I just want to make sure you just didn't toss it somewhere some kid find it that's more what I'm worried about I made sure yeah I made sure was no kid or no innocent bystander like that was kind pied up yeah what what model was it I know what caliber it was I'm just wonder what model hor I think I think it was a tus pretty sure was you know I know was a 40 I I'm just curious honestly I block out and if you try to it's eventually come back out it's I mean I can tell how upset you are melting a steel gun down can only be done at temperatures between 2500 and 3000° F which means it's a really good thing for Brian that he abandoned that story as quickly as he did his next story however is just as bad because the gun was eventually found in a place where an innocent person or a child could absolutely find it at a pond in Jefferson Memorial Forest else is there anybody else there with you guys I know I know this happened in the back bedroom were they fighting in the back bedroom and you got in the middle of or did you know you trying to you and him got in a fight in the back bedroom I just want to be clear about it well they was fighting we Wasing outside in the hallway and we're talking about physical fight not arguing yeah talking about physical fight I was like you know just when you got to help her you know that's when I went went in her everything just happened so fast rest but I mean she she did try to help him I mean I I didn't know what to do to help I mean I just I freaked out still freak out I tell you what this whole thing this whole situation I mean sucks and I mean I was right was I not right from the minute I came in here and how things went down you know and I still believe you know bad [ __ ] happens to good people all the time but uh this series of events doesn't paint you out to be a cold blooded calculator I don't give a yet there's nothing we can do about that now but the way that we have presented it as you comeing over to help you know there's a big difference I mean correct me if I'm wrong would you see a big difference between somebody who doesn't give up and coming over and and just shoot people as opposed to someone who was there for a purpose and I can confirm that purpose was there was a domestic fight going on and you get over there and [ __ ] goes back yeah there's a big difference there yeah a big difference man I didn't even should have just went with my gut and just stayed out of it but I'm not that type of person I see some need help try to help I'm take this picture with you too I don't know if you have any of your kids with you because I think I think because of the way we talked here tonight that getting to see them is going to come a whole lot sooner than it would have been if you didn't told me no I'm not talking more they could have happened either way and man I still had enough you know so that's what I really I could I that was what I was really worried about is that you wouldn't understand how important of a chance that I was trying to give you to get out I that you were in a hole I mean and you're still in a hole but it's definitely not as deep as it was was it with your story out there that goes a long way with prosecutors and defense attorneys and judges and jurors so we got to look at it is it's a bump in your road that bump is sitting back on the backside you had cross it yet now we're across it now we're going to figure out from here where we're going to go you're going to get your life back on track do sound like a good plan here nothing the future in front of you now don't be wrong you're going to take a little bit of it here but it ain't all of it and what you do with the rest of it is up to you see people I talk to I've heard you say that and I disagree with that you got remember where we are unable here D County T to be a little bit more lenient bit more liberal a unfortunately for Brian that wasn't the case at trial it took the jury just an hour and a half to find him guilty of murder possession of a handgun by a convicted felon attempted murder and tampering with evidence he was sentenced to life in prison jod did indeed get a more lenient sentence she was sentenced to 20 years for complicity to murder and complicity to attempted murder
