On May 10th, 2026, an officer was conducting routine patrol near a local post office when he heard a man yelling for assistance next to a parked vehicle. As officers began speaking with the man, the encounter quickly became more complicated than a simple request for roadside assistance. >> and a half years ago. When I was here. >> 22 and a half years ago. Okay, dude. Like I don't understand what you want from me. >> Nothing. >> Do you want me to call you a tow truck? >> Yes. >> You would like a tow truck? >> Yes. >> All right. The cost of that's going to be on you though. >> Yes. >> What happened, sir? >> I have had issues with Key West Police Department 23, 24, 25 years ago. >> Okay. >> And when I yelled and screamed out he didn't respond. I yelled and screamed worse. He responded. And he's responding properly now. >> Do you have an ID on you? >> Yeah. >> So, what's wrong >> But >> Okay. >> I was doing the wrong thing. >> I pulled into the right. It just >> I rolled down my window. His arms are in the air. Then he started screaming and yelling. >> Sir, what's wrong with your car? >> Do you know >> It's not that there's nothing wrong with the car. It has issue when it starts. Sometimes it starts. Sometimes it >> So, it's like drivable, right? >> Absolutely. >> Have you been drinking tonight? >> I had a couple of drinks. Yes. Uh what time is it? My phone is dead. >> Okay. >> Literally, it's my phone is dead. >> Sir, can I get your ID? >> Yep. And I tried to get his attention. It didn't work. I got yelling and screaming and yelling and screaming and then I got his attention. >> Okay. I got you. >> And that's how we ended up. >> keys to this car, sir, in your hand? >> Yes. >> I don't Yeah, I don't want them. I just need your ID. >> Yeah. Those are the keys to the truck. It has not been started at all. Yeah. I live here. I work [snorts] here. >> 97012 >> It's >> Where do you work? >> My shop is at Robbie's over there in Key West. >> 7281 Front Road end of the road. >> Oh, is this uh Stock Island? >> I got Southernmost Canvas. I do sail repairs and >> Okay. >> biminis, dodgers, all that fun [ __ ] >> All right. So, like I was saying, if you needed my attention, you could have walked up and gotten my attention. Screaming and yelling is not going to do it. Car problem technically is your problem. If you needed to call a tow truck, you could call a tow truck, or you could come up like a civilized person and ask me for assistance, and I'm happy to help. But then when I roll my window down, when I realize something I hear a noise, something's going on, and your arms are in in the air like you're you're trying to >> Last time I asked for Key West PD's >> You're talking 22 years ago. >> at the 3-mile bridge in handcuffs. >> Well, there's no such thing as a 3-mile bridge. There's a 7-mile bridge. There's a 7-mile bridge. >> It's Oh, I'm sorry. It's 2.81 miles. But yeah, whatever. >> But anyway, that was 22 years ago. That's not right now. That's not probably anybody that's working right now. >> think about my own history. That's what you're saying right now. >> No, I'm saying think about it, but it's been 22 years. >> Which is why I pulled you. >> I understand. >> Copy. Thank you. Going back to 10-1. >> you my ID. Nothing in the trucks. >> So, um >> My experience with Key West PD has never been >> Sir, is it Is it common issue Listen, is it common issue when you're intoxicated you're acting like that? No, it is common >> Okay. >> when I'm dealing with QAS police officers. >> Okay. >> Because 3 and 1/2 out of 6 years I was in jail here for something that they gave me 30 days sentence on. So yes, I have issue with cop. But I yell, I scream, I call, I >> Yeah, but you know, when the like windows are up, it's hard to hear it. >> when he finally sees me going again, but >> Sir, you need to understand >> That's me being bad? I will [ __ ] take a damn Uber home. I'll take a Uber here and pick it up because my battery is dead. Yelling and screaming like this. >> Okay, can you listen? Sir, I think your problem you're not listening. LISTEN, BUDDY, SHUT UP. STOP. I got to [ __ ] put you in handcuffs. That's arrest for DUI. Do you understand that? Have any questions? >> Have I driven? >> You're in possession of this vehicle. I have the keys in your hands. >> They're in my hands? >> I observed it in your hands, right, buddy? >> Have you >> You can stop talking. >> seen the vehicle driven? >> No, it doesn't matter. You You're in the possession of this vehicle. Oh, yeah? Are you [ __ ] lawyer? >> No, my father is. >> Yeah. Listen, buddy. >> I'm not trying to argue with you. >> I'm trying >> Listen, you are. All right, have a Have a seat right now. Have a seat or I'll put you in in in in in the handcuffs. Have a seat right now. I don't need your [ __ ] wallet. Have a seat. Have a seat right now. >> Okay. >> Sit down. >> It's very simple. You need to listen and stop. Like I get like you had whatever history you've had, but that's not right now. This is tonight. So you've been drinking, you're trying to start your car, and it didn't start. >> Okay, that is nobody's problem. That's but that's nobody's problem except your own problem. So yelling at me, trying to get my attention, what do you want me to do with your vehicle? It >> I wanted to ask you whether or not the tow company would charge me full price >> Yes. >> or freaking regular >> Why and why I don't work for the tow company. Why would I one why would I know that and two >> Cuz you deal with them all the time. >> More I don't deal with what they charge. >> Oh. >> All I do is I call cars to get towed and they tow the car. I don't know what it cost. >> now. >> But screaming and yelling is not a way to get somebody's attention. Not when you want if you want some sort of >> a cop car doing this isn't a way to get >> sir. Again, put your hands up. Listen. >> Again. >> That's all I'm saying. I just tried to get your attention. >> How do people get your attention when they need work done by you? Do they stand out in front of your shop and wave in front of your in your front of your shop and you stop whatever you're doing to come running out out in front of you No, they come in, they say something nice like, "Hey, I need some help." or "Hey, I have a question for you." Sitting over here, yelling, slamming stuff until I take my eyes off of what I'm doing to pay attention what's going on behind me. What what kind of response do you think that elicits? >> I was just trying to get a response. >> Well, now you got one and now you're not happy with the response you got. >> No, not really. >> So okay. So obviously your car is not like he said, you can you can be you showed us the keys to the car, right? >> On camera but >> On camera. >> Yeah. >> You showed us in your hand. So that can that can But that that constitutes control of a vehicle. So that means you can be Yes. No. >> the ability >> Yes. >> a vehicle. >> That's the control. By the Florida state law, that's control of a vehicle. Having the keys. >> So if you have the keys to an airplane, that someone else can drive into a building, it's your fault? >> Yes. Okay. I'm not going to I'm not going to debate weird questions with you. Where's the open container? >> And I was trying to get his attention. >> That's been there, though. >> Attention. >> Don't do that. >> Towed car, man. >> So I didn't >> Don't reach in. >> pay 584 dollars. I was just trying to get his attention. >> So and >> So I can pay the private tow. >> Yeah. >> Can you Can you stop? >> Going on. >> Sir. >> Now. >> Can I Can I speak, please? >> Now. >> So if you if your >> Now, I cannot drive. >> Okay. If your vehicle were totally fine, were you were keep driving, right? >> I would have been home 22 minutes ago. >> were behind the wheel intoxicated, right? >> Under the limit. >> Do you know Okay. >> Can you prove it? You can't. That's the point. >> Okay. >> And I'm telling you, that's why I asked for your help. >> But again, >> you didn't ask me what I wanted. >> When I got out of the car, >> and ask me what my problem was. >> Yes, and then I came over, walked over to you. >> was. >> Then I walked >> Hands out. >> Hands out? Your hands were up in the air. I walked over and said, "What's your problem?" >> And my hands were up and your hands were out. >> My hands weren't out. >> [ __ ] off, [ __ ] >> What the What's the hospital? >> Watch your own video. >> Oh, trust me. >> to do. Just be quiet. I would just stop talking. >> Yeah, I that's probably your best bet. >> You're not running the show right now. >> Yeah, this is not >> I'm not running the show. >> No, but you're showing hostility towards me. I'm not >> not >> Yes, you are. >> You just told >> Okay. >> to anybody. >> Okay. >> My hands are together. They are not attacking anyone. They are not aggressive to anyone. I am not aggressive under the definition of Florida law. What I am is somebody who doesn't like to be told that when I ask for help again for the second [ __ ] time in my life >> Stop cursing and yelling. >> Who said you were being arrested right now? >> You did. Am I detained? >> Yes, you are. >> Yes, you are. >> So therefore, am I being arrested? Am I being arrested? >> Am I being arrested? >> You are detained. >> For what? >> Detaining is different. >> Am I being All right. What crime >> Listen. >> am I being detained >> Listen, sit down. What crime >> Sit down. >> am I being detained for? >> Sit down. >> I have yet >> Sit down. >> Can you JUST SIT DOWN? >> HOW hard is it to sit down? >> All right. >> down? >> Somebody with a [ __ ] leg might actually know. >> Listen. Are you done? Listen. >> Can he stop pushing >> stop talking >> and then I can tell you yes. >> All right. >> Back the [ __ ] off. >> All right, so listen. All right. >> Well, when you're told to sit down, then sit the hell down. >> I was not sitting. Perfectly fine. Watch your own video. >> I just explained to him about the >> Oh, you don't live here, do you? >> Sir, don't don't don't worry about her. She's You're very nice. I'm I'm not I'm not a nice person. Listen to me, buddy. >> You're actually nicer >> Listen, we have a reasonable suspicion to believe that you are in active control of this vehicle while being intoxicated by the drugs or alcohol. All right, that's why you are detained. >> Yes. >> Because you were aggressive. You were in handcuffs. Of course you are. You are in handcuffs. >> Yes, that is exactly the opposite of what you just told me. >> Officer Keffeler will ask you a couple questions. >> You just told me I was not detained. >> Okay, we're going to step back. >> We told you you were detained. >> That's all >> You're not arrested, she said. >> All right, we're just going to step back, all right? So So you cannot >> I am detained. >> Yes. >> Okay. >> You're in handcuffs. >> so right now you're detained. >> Well, just because I was in handcuffs doesn't mean I was legally detained. You have now declared I'm detained and >> We told you that before. >> detained under statute. >> All right. >> Thank you. >> Talk to him now. >> So, listen, pay attention here. So listen, >> Can I ask is whether or not you get my goddamn truck >> Will you submit to sobriety exercises to dispel my belief that you are under the influence of alcoholic beverages or chemical or controlled substances to the extent that your normal faculties are impaired? >> For what? >> Being under the influence of alcoholic beverages or chemical >> me operate a vehicle? >> You had the keys in your hand. It's >> Did you see me operating a vehicle? >> No, you're you're not asking me the questions. I'm asking >> asking you. >> Will you submit to field sobriety >> me operate a vehicle? >> need to. >> Oh, you don't need to see me. You're going to arrest somebody for DUI before >> You're not under arrest. >> I'm asking you, will you submit to field sobriety exercises to dispel my belief >> you, how do you justify that under law? >> Because you pulled your keys out and showed them to me. That is constituted as the control of your vehicle. >> and ownership of a vehicle that was here on property when you showed up. >> And if you would have done it running, >> when you showed up, has not moved the entire time you have been here. >> What were you trying to do with this vehicle? >> Asking you to get it towed. >> All right. So, listen. Listen. It's very It's very simple. Are you going to be participating in those exercises >> going to walk away with a [ __ ] DUI when I'm asking to get towed. >> you ask Can you answer my question, please? Are you going to participate in those exercises to dispel his belief you were in immediate car possession of the keys for this vehicle, were standing right next to the vehicle less than 3 ft from the vehicle >> Attempting to start the vehicle. >> The fact that I'm able to commit a crime does not mean I have committed a crime. >> or not? That's all I'm asking you. >> Absolutely not. I am not forcing you to get proof that I have the ability to create a crime. >> Okay. >> So, refusal to complete these exercises can be used against you in any future court hearings. Do you understand that? >> Yep. And you have nothing because the vehicle was not moving. >> Okay. Also, >> Your shit's off. >> It's on. >> It is not. Your light is off. >> Mine doesn't light up in the front. That's on purpose. >> So, what you're telling me is that somebody who is near a vehicle who asks a cop for help >> What? >> I am under arrest for DUI >> for not driving drunk. That's your charge. >> So you refused. So I'm going to ask you one more time. >> you I refuse to drive drunk and you are charging me with drunk driving. >> No, I'm asking you to >> You are charging me with operation of a vehicle because I have the ability to do it. >> Just stop. >> I chose not to. >> We're done. We're done. Okay, stand up. You're under arrest for for DUI. Stand up, buddy. Don't resist. You get another charge. >> Stand up. >> Nope. All right. We can we can do it like that. No, let us Is that is that your car? >> My car. >> Yeah. Put you on the side. Where's your car? >> car. I'll get it. >> So >> All I asked for is for >> a DUI and a couple counts of resisting without a sir. >> All I asked for is for a [ __ ] tow truck. >> Don't don't drive intoxicated next time, please. >> I didn't. That's the [ __ ] point. >> Okay. All right. >> Are you going to stand up? >> Are you going to comply? >> Why? So you can get some photos for your >> Listen. >> Facebook pages? >> Listen. You're going to to jail anyway. >> Oh, I know. >> Why? >> That's the first time. >> I know. >> I know. Last time you guys dropped me at off the [ __ ] bridge. >> We're not going to the bridge. We're going >> Really? How do you get into the [ __ ] >> No, without hitting the bridge. >> How do you get into the bridge? How do you get into the jail without hitting the bridge? >> No, wait. >> Yeah. That's the The bridge they worked my ass off. Stop. I'm not I have my hands together. Holding my hands together. I AM NOT >> STOP RESISTING. >> I am not resisting. MY HANDS ARE HOLDING EACH OTHER. I AM NOT RESISTING. YOU CAN TAKE ANYTHING out of my pockets. I AM NOT RESISTING. TAKE YOUR [ __ ] I don't [ __ ] CARE. SEE? ALL THAT NEEDS TO COME OUT OF COURT. ALL OF IT NEEDS TO COME OUT OF COURT. ALL OF IT. EVERY SINGLE ONE OF YOU. EVERY SINGLE ONE OF THOSE BOOKS BELONG TO ME. You steal those mother [ __ ] you're on a god damn list. My parents are weird like that. They're going to ask me where the hell I got the [ __ ] books. What the [ __ ] DO YOU PUT IN THAT SACK? SO, WHAT happened to my personal property that you guys stole? That isn't an answer. No, you telling me that you're going to just take it isn't an answer. What happens to my property? >> It's turned over to the people at the jail, and they they take inventory of it and put it in their whatever they do with it. They keep it safe. Is that good enough of an answer for you? >> They take a vehicle and stick it in jail. That is my personal property. You took me off of public property for being too intoxicated to drive a vehicle I was not driving. I'm not blaming you. I am complaining about the system because you have yet to prove I unlawfully operated a vehicle or was intentionally trying to operate a vehicle. The ability to turn an engine on and the ability to operate the vehicle are not the same under Florida state law. there is maritime law and look at my driver's license. Oh, no, wait, you guys took that. I never physically moved against any person trying to restrain me. That is the legal requirement for refusal to commit. You arrest me for resisting arrest for resisting arrest for resisting arrest. That's a circular argument. Even Judge Jones dropped that [ __ ] 22 years ago and he still convicted me. >> As a result of the incident, the man was charged with DUI, refusal to submit to a breath test, two counts of resisting an officer without violence, two counts of assault on a law enforcement officer, firefighter, or EMT, and refusal to accept and sign a citation.
