This sergeant cut her a break only to regret his decision minutes later. Is she supposed to be wearing these? Put your feet back in the car. It's an antiscychotic medication. That checks out. Cops conduct a traffic stop on a vehicle with expired registration tags. But that was only the beginning. Take a look. Hey, officer pops police department so I know you're getting audio video recorded. Reason for the stop is the tabs are expired. Oh, and the owner of this vehicle has some warrants. Are you Brianna? Yeah. Are you worthy on some warrants? No. Okay. I'm going to have you step out for me. Okay. We can deal with calling somebody in a minute. Any weapons? Anything like that? No. Okay. I'm going to put you in handcuffs. Okay. We'll grab it. We'll grab it. No, we'll grab your phone. Stop. Reach in the car. Please stop. I clearly told you to stop. Okay. Why did you do that in the other hand? I got one to two. Can I get my purse? Go ahead and stand up. Oh man. Yep. Can I grab one? No. My You injured? Yeah, I'm going to go off. For what? I'm on my way to the doctor right now. Is that why you tried to dip out on me in the apartment? No. I take a seat. Like I said, everything's audio on video recorder. Okay. For what? I have I can feel your I feel like I'm I'm from an emergency. The doctor's bleeding right now. I'm not lying. You're not getting out of going to jail. You have a Noville felony DV warrant. You are not getting out. Okay, that's fine. So, the whole going to the hospital thing is not going to change. Kick your foot in. Um, I need to go to the hospital, though. I I for kidney failure. No, my knee hurts. You just pushed me on the ground. I need Yeah, I did. Just a reminder, everything's audio video recorded. I'm really not Brianna. I didn't know that. You are. I looked at your picture. Come on. Come on now, Brianna. you're not getting out of this arrest whatsoever. Uh you can claim that you're going to the hospital. I don't necessarily think that's the story. I mean, you have a knee injury already. You're claiming uh the fact that you got warrants. That's already a done deal. And you're saying that you have dialysis. I don't know. I'm thinking I'm going to go ahead and push the BS, but I don't know. Let's see what happens. Let's just stop lying. I'm not lying about anything. You are, Brianna. Okay. You are going to jail for your warrants. All right. We're done with it. Okay. Okay. Hey, sir. Hey, sir. I need Can I have the window down, please? I'm having really bad anxiety right now. Yeah, I'd be having anxiety, too, if I was going to jail. Can I make a phone call real quick, please, just to come get my car? No. Is my car getting impounded? Um, I haven't decided yet. Hello, sir. What? Can you talk to me, please? Can you unlock? Can you open this, please? No. I need to go to the hospital. For what? Kidney failure. My knee. And I got pushed down. I You did get pushed down cuz you were Okay, I know. I have to go to the hospital. You hurt me. Okay. I'm sorry you feel that way. We can have the fire department come look at you if you feel that you're injured, but nothing that you've given you've stated is going to be to that level. They want your fire records. Have a name to run for more confirmation. Hey sir, can I outside just stand outside with some air? No, I'm What did you say? Can I just stand outside with some air? You got air coming. The wind's blowing, too. Just I need to go to the hospital for what? Um, he pushed me. He pushed you down and it hurts really bad by me. Okay. Yeah. She wanted to go play games. She's not getting out of Can I stand outside? I need a fire department to come. Like I said, these the sergeants on their way. They'll they'll address that. And like I've already told you, the hospital game is not going to work. You have a I need to go to felony, no bill. I understand that. So, you will be going to jail today? fine. I need to go to the hospital, sir. I'm not lying. For what? Because of my knee, I got pushed down and I have kidney failure. I'm on my way to a doctor's appointment. I can't even prove it to you. Okay, just hang tight for now. No, please don't roll that down up. Please, I'm sweating. Yeah. So, went up. I said, "Hey, you're going to step out. We're going to go in handcuffs." She immediately reached for the phone, started messing with it, grabbed her right hand. She dove back in. And I couldn't see her left hand, so I pulled her out. I've been looking for her for a while. Oh, really? Yeah. Probably wouldn't be drinking energy drinks and things if I had kidney problems and various other things, but Hi. Can I stand outside? Not yet. No. Um, I'm Sergeant Valley. We use body cameras, so we're being recorded. What's going on? Um, apparently I'm getting arrested for some wounds I have and I'm on my way to a doctor's appointment for my kidneys and I um I just got pushed down and I'm really bad right now. Okay. Why did you get pushed down? Um because I was trying to grab my phone. Okay. Where was your phone at? In my car with me. Okay. Did Did you have an opportunity to get told not to do that? I think so. Probably. So, I'm sorry you got pushed down. Me, too. Yeah, I need the ambulance. Reaching for things. Oh, you need an ambulance? Yes. Yeah, I'll have a fire department come look at you. What What's the condition I'm reporting to them? I got pushed down really bad. Okay. Are you injured from that? Yeah. My knee and my elbow. And I have a broken elbow already. Oh, you already had a I have metal in it. Can I please stand outside? I'm sweating. No, we'll get windows down for you. Why are you sweating? But I don't know. I'm just having probably anxiety a little bit on top of it. And then I have renal failure, you know, I just done. So, yeah. Okay. What I will say is that we're stacking up the charges and we're stacking up these injuries. And I don't know, I'm just thinking just a little bit. I'm thinking, you know what? I'mma push that BS button cuz I don't believe her story. And a big shout out to the sergeant explaining and you know building that report to explain, hey, I got to come over here and do a use of force investigation, which by the way, I haven't done many videos where when a use of force has occurred, a sergeant automatically has to arrive at scene to conduct a use of force investigation. So, we're constantly used to having uh traffic stops where the vor says, "Give me a sergeant. Give me a request a supervisor. Bring me your sergeant." This uh video is a little bit different with a sergeant response uh because he has those duties and responsibilities. All right. Stand right here. Like no. Can we just let the door open? I'm good with that. Seat belt stay on. Door open. That's fine. When you are given lawful instructions, especially as they pertain to reaching, grabbing, or doing, or not doing, those need to be followed because they are given with our and your safety in mind. Okay. So, I don't know what's in your car. No. Yeah, I understand. You're reaching for something I can't see. You're not stopping when I tell you to stop. Yeah. It could be anything. Now, I am afraid that you are reaching for a weapon. I understand. If you immediately stop reaching and comply, I have no reason to use any force or push you to the ground. Yeah. So that's to me is what sounds like occurred is is how she's describing it and my explanation of what I would do in our training. Does that match what you were seeing? Yeah, she had a couple opportunities not to grab the phone. And as long as there's one, but yeah, so we'll get them out here, but it's a felony order violation, which is domestic violence. If you have to go to the hospital, we'll go to the hospital. You're going to be seen at the hospital while we wait and then we will be taking you to jail. I understand that you need to be seen. Okay. So, and I need to take some pictures of you cuz force was used so I'm going to Yeah. I don't have my camera so I'm going to get some pictures. We're going to have this report for your arrest. Are you sticking to resisting or obstructing on her or just for warrants? Probably just go for warrants. Okay. So, he understands that while you didn't follow his instructions, he's not trying to be a jerk and stack a bunch of charges on you like resisting, but we're going to go with what we had initially. Mhm. And do a use of force report to make sure and that means that I'll review videos and all that type of stuff. It'll go chain of command to make sure that what he did was in accordance with our training and the law. Mhm. Okay. So, are you comfortable leaving the door open? As long as we're here. Okay. And you know you're under arrest. Yeah. Any attempt to leave is going to be an escape. Okay. Another felony. Wow. So, keep your butt seat belted and in the car. I'm not trying to get in any more trouble. Okay. And I'm just trying to make sure you completely understand where we're at. That's all. But it's not fair for me to leave a door open and walk away without telling you if this then this. Right. Yeah. I'm just making sure we're all on the same page. So, I'll be back in a minute. You couldn't have asked for a better explanation from a sergeant to explain to the arrestee exactly what went down, what's going to happen, and what the outcome should be, right? Cuz he's going to review body warn video, etc., etc. So, do his job. You know, it's refreshing to see those kind of incidents. Not to say that there's other body cam videos that probably have a lot of supervisors, which is a good thing to communicate and to have that talk with the arrest so that we're on the same page to let them know that you know what, your actions have consequences. So, I'm going to do full body just to show what you're wearing and then I can tell you were on the ground cuz you got wet spots from the pavement. Can't like see any injuries. And then elbow I can probably Which elbow is the broken one? This one? I the right one. Mhm. And you think that hit the ground? Mhm. It's okay. We didn't roll. But policy says I'm supposed to. Tell me if I hurt you. Okay. Yeah, that's a good surgery scar. How high does that go? So, she's supposed to be wearing these. What? Jesus Christ. Strange. I thought she I thought she was cuffed cuz her hands her wrists were right together. Acting as if she was. Don't like that. Collar ones on. I was looking. Yeah. I kept looking and then I was like looking at that and I'm like, "Whoa, that was those ones shouldn't come off as easily. They're a little smaller. That's me, the sergeant. And you slipped your handcuffs." No, I didn't. How did they Were they on you? No. They were. You are not my friend. You will not be at my house for Christmas. I know. Your credibility is in the toilet. I know. Hey, officer. The cuffs were too loose and they fell off. That's what I would do. Yeah. Did you? No. Put in your front pocket and act like you still had cuffs on. Turn around so I can I'm still going to do my job. I'm just going to do it while I'm annoyed at you. Did you hear I want obstructing or resisting on top of almost an attempted escape. All the statements are trying to get out of the car with no handcuffs. No, I need to go to We're going to be forward to you. I am overriding his discretion. You are way less than cooperative. Sit down. You are feet in the car. No, that was sit back so I can seat belt you. It was from a No, turn your head to the right. Can I please have the window open? You will get the window open. This door is being closed cuz you are an escape risk. Hey, when's the ambulance going to be here? I appreciate that. Like I said, unless the fire department tells me you objectively need to go in an ambulance, we are not going to. I know. I'm going regardless. Oh, no, no, no. That's not the case. No, that's not the case, honey. So, if the fire department tells me there is a medical need for you to be evaluated at a hospital, we will go to the hospital. If they do not, we will go to Pierce County Jail and book you on your felony warrant and now your new charges. So, it's up to the fire department. I see you're still trying to slip your cuffs. If you slip your cuffs again, you're going to go in what's called a wrap, and that's really uncomfortable. So, I suggest you don't do that. Okay, Brianna, I suggest you don't do it either because that wrap, which by the way, thank you for letting me know that it's called the burrito wrap. That thing is solid. I mean, you're going to be wrapped around like a burrito from head to toe. And it even has like a helmet. We used to call it a spit sock, you like a mask over your head where it doesn't even allow you to make any movement whatsoever. And that's coming next. So, I would suggest that you cooperate and comply from this point forward. Don't slip the cups again. What day are you going to use? I broke my finger. What? My finger's broken. I think your finger's broken. Yeah, because of me. Is that what your complaint is? I'm swollen. Um, why? What did you do? I didn't do anything. I need her. It's coming. Yeah, it's coming. I call my sister. Please. Please. I can't get my That is up to him. I don't know what [ __ ] Put your feet in the damn car. Sorry. I can't do anything. No, you're trying to. What that mark on your wrist is is from you trying to get out of the damn handcuff. That's from my wrist. Doing that and moving around and turning your stuff like that and trying to break them and do all that weird stuff. You're causing your own injury. You're doing it to yourself right now. It's okay. You did that to yourself. If you disagree, when you are released, you go to the police station, tell them, "Sergeant Valley used excessive force on me, and I want to file a complaint." And then somebody higher ranking than me will investigate that. All right. All right. I understand. But I know what I did. I know what he did. I know what your behavior is. Stop trying to get your hands out of the cuffs and it won't do that. No, I'm not. That's where we're at. I mean, the ambulance is coming into me cuz you are an escape risk. Put your foot in the car. And you're doing it again. Trying to get your hands out. No, I'm not. You guys, I'm literally going to faint. You what? I'm going to faint. I'm sorry. I cannot hear. I'm going to faint. Okay. If you faint, I will tell fire that you've lost consciousness. But there I I literally can do nothing else for you. The window's down. The window's down on both sides. So the breeze that's out here is coming through as best I can. I I I cannot do anything for you. If you faint, I will tell fire you fainted. I will check your vital. Will you try to save me if I? Absolutely. I I am trained in CPR and other life-saving things. The handcuffs will stay on, but yeah, I'm not going to let you die without trying to stop it. If she needs, I can put her in a recovery position outside. Pass the test. So, Officer Wellman has offered that if you are having whatever difficulties you are and feel like you're going to faint, we can lay you down on your side on the pavement right here, which is the recovery position for somebody having difficulties. I do feel like I'm going to paint. and you want to lay down on your side on the ground. I don't mind. I feel like I'm going to paint if that's what helps. That is something we have available to you. You are able to choose what you would like to do. Yeah. Okay. She wants to lay on her side. She wants to lay in the recovery position. Okay. Go ahead. There you go. And on your side. on your side. There you go. Yeah, there you go. Perfect. I'm sure that's nice. I would think the car would be more comfortable. It is. Okay. More comfortable. Not. There you go. All right. I'm going to die. I'm going to faint. Okay. Pretty impressive her being able to get up off the ground like that unassisted in handcuffs. I can't [laughter] I can't get up off the ground unassisted without cuffs. Since she's getting booked on the felony warrant, can you please call my sister? No. Hey sir, can you put my keys back in the car? Put them in the door and leave it unlocked. No. No. That would be an unwise decision. We're responsible for your property. Sergeant, I'm going to please call my sister. No. Did you put the keys in the car? No, we're not going to put the keys in the door of the car. Somebody will steal your car. No, they won't. I have someone that lives here in this complex. What number? They're just They're at work. They're in the building back there. Well, then how are they going to get your car? Because they'll be here in 2 hours. I'll let him sort that out. Your credibility right now is absolutely zero. I don't believe that you know anyone in here. I believe that you pulled in here to try to evade me. Yeah, I'm going to call BS on that, too. I don't think so, either. She's just making up all these excuses because she doesn't want to get her car impounded, you know, call my sister. She's crying out for help. You know what? I'll address it later that it's more than just the arrest. Uh, and before uh the RA, the rescue ambulance, and the medics get there, let's kind of play this out. So, let's just say that the medics say, "You know what? Yeah, her vital signs are real, real bad. Low pulse, increased heart rate, and her blood pressure is skyrocket high." and they happen to admit her at the hospital. Guess what? You're going to have to use resources to babysit her at the hospital until she gets clear. That could be the next day, 24 hours, 48 hours, who knows? And then you continue the booking procedures. So, I don't believe that you know anyone in here. I have to do best under community caretaking function for your property being your car. At this point, the keys are going to go with you. It's going to be locked when we leave. If you want to give your keys to someone while you're in jail, you can. But the other option is if you say, "Hey, I want you to impound my vehicle." I will. You have that option. Otherwise, it's going to stay here locked as it is right now. I'm literally on my way to go get dialysis, you guys. You understand that? I don't believe you. Do you want my phone? It's in my phone. No, I don't. Where's your doctor appointment at? It's at Seymour right there. At Seymour? What's the doctor's name? If I go to Semr, are they going to have an appointment for you? Yes, I promise you they are. What's the appointment for? It's for medication in my kid. Well, you're not getting dialysis. Yes, I am. I Tomorrow I have an appointment for diialysis. I do. Tomorrow, I promise you. Where's your appointment? At the kidney failure center in Auburn. Okay. What's it called? It's called kidney. It's called kidney. Yes. Okay. I am going to start charging you with false statements cuz you're going to you're making statements that are provably false. No, you didn't go like going to a kidney center in Auburn on Christmas. I don't think that's true. That's for dialysis. I can't miss my dialysis. I go to the kidney place in the Auburn hospital. Okay. Well, the jail the jail will provide dialysis for you if that's actually a need. Where's the sergeant? So, let me add on to that, too. So procedurally what's going to happen is RA is going to get there. They're going to take her vitals to all that. Probably going to say, "You know what? You're cleared." Then we're going to go to the Greybar Motel or the Sheriff's Hotel. Either or. And we're going to get cleared. In other words, we're going to go see a nurse. And in that particular assessment, evaluation right there and then, you know, when she gets triaged, who knows if she does have dialysis and she's suffering from these major injuries, chances are we're going to have to transport her from the jail facility back to a hospital and probably end up getting admitted. We don't know. Where's this sergeant? He's calling the jail so he can get you booked into jail. Okay, but I need the ambulance. No, you don't need an ambulance. Yes, I do. Please stop talking to me. Please stop talking to me. Okay. Hello. This is Brianna. Uh Brianna really is not wanting to go to jail first. She says she uh has kidney failure. Um she is adamant she needs to go get her blood checked. She's had a couple different stories. Said that she had dialysis today later. She's also a major escaper. She's already slipped cuffed once and we had to use force to get her into cuffs. Um, we'll take her out if you guys need it, but we just need it. Oh, and her knee hurts and her right thumb. Your right thumb still hurt? I have kidney failure. Okay. And I'm on dialysis. Great. Did you dialysize earlier today? Is that No, I'm supposed to go to Auburn Hospital tomorrow for it. What What arm is your port in? Well, I go this way. I go there. Okay. I need to go to the hospital. I'm sweating and I'm going to do like pain. Okay. We'll check you out. I need to be checked at the hospital. We're checking you right now, dear. Uh the Pierce County Jail nurse just advised me that renal failure is not something that requires a hospital to the visit. I'm not going to the hospital right now. Correct. That's what I'm saying. I mean, I am I need to Well, we're going to I my kidneys hurt and everything right now. Okay, we're going to check you out. I'm in pain. Shoing it. Sugar's 91. Is it 91? Yep. Is that bad? No, it's perfect. It's 220 right. Oh, it is 220. Couldn't be better. Well, right now, dear, everything that we see looks good to go. Okay. Your blood pressure is fantastic. You get plenty of oxygen. Your heart's not working too hard. Your blood sugar is fantastic. I need to go to hospital. I need to be checked. I probably We just did check you. I need to go to the hospital. Can they take me to the hospital? I am declining to take you to the hospital. I need to go to the hospital. You guys cannot decline me medical. I just did. Seriously? Yeah. I am declining you. Not medical. I have brought medical to the scene. No, I need to go to the hospital. I need to be checked for what? I have kidney failure. I'm going to die. I'm going to fail. So am I. One day I will. Can you believe it? Your claim of renal failure is not disqualifying from the jail. I'm going to go to the hospital. You don't look jaundice to me. This is crazy. Yes, I'm super whiny. I'm don't You are super whiny. I agree with that. You guys, I need to go to the hospital. Put your feet in. I need to go to the hospital. Put your feet in. I'm tired of this. Can I call? No, you can't call anybody. No. I need to go to the hospital. We're not doing that. I need to go to the hospital. You guys cannot refuse me this. We can't. No, you can't. I can't. I have that authority. Where's your medication at? In my purse. Where's your purse at? In the right passenger seat. Can you leave my keys in there? You did you search her out there, Officer Phillips? No. You want to search me here? Stand out. You should probably search me. Put your feet back in the car. You should probably search me. You should probably search me. Did you? I don't know. I I did back out. No, she No, you didn't. I did. No, you didn't. No, you didn't. Not at all. Here, lean in for me so so I can put your seatelt on. I need to go to the hospital. Okay. I'm going to give you the same opportunity I give you. Okay. We are going to jail. If you have any contraband on you, it will be a felony charge and I will charge it. Do you have anything on your person right now? I need to go to the hospital. It's a yes or no. Okay, you can have the charge then if you don't want to. I need to go to the hospital. I don't have anything on me. Why did you want me to search you so bad then? Because search me. Search me. Why? Because you should. Do you have anything on you? Yes. Why? Everything. She's now demanding that we search her. I'm not going to pull her out because she wants me to pull her out for some reason. She's said she does and doesn't have contraband on her. So, I'm just going to call the jail and say, "Hey." Yeah. We don't She's doing all playing all these games. She knows. It's an antiscychotic medication. That checks out. That's You're not going to believe this medication. Casper is Can you put those keys in the car door, please? No, I'm not going to leave the keys in the car cuz that's how cars get stolen. No, there's not someone coming to get them in 5 minutes. As soon as I make a phone call in the jail, please, can you leave the That's like 45 minutes away. No, we're not doing that. Just kept going. If I would have kept going straight, would you have still pulled me over? You were going to get pulled over in a minute. Really? And if you ran, you were going to get chased. I wasn't going to run. Why did you pull me over? Cuz I know you have warrants. How did you know my car? I've been looking for you for a little while. Really? Mhm. Why? Cuz you have warrants. How do you know me? That's not really relevant, is it? What the officer is saying is that when you run that plate, it comes back to warrants. Okay. And apparently there's more than one. So that gives you enough PC to pull him over. And here you have it. Right. The situation that's uh a bit dramatic, but hey, you know what? That's what police work is all about. I won't have court tomorrow cuz it's Christmas. But Friday, um I don't know. You can ask I'm trying to suck her up. I'm not. You are? No, I'm not anymore. Promise. I'm not getting out of the car. Why are you trying to ruin people's Christmas? Oh, I'm not ruining anybody's Christmas. You are. You're ruining mine. Well, you did that to yourself. No, I didn't. A crime. What? I didn't commit a crime. You did. You committed the crime of obstruction. What does that mean? It means you obstructed me when I told you that. I didn't hit you. No, you obstructed. That means they're hurting you. That means assault. Assault is hurting. Obstruction means I told you you're going to go in handcuffs and you decided to do exactly the opposite and try to reach into your car and lean away from me, which required me to use force on you to get you into handcuffs. That is obstruction. She's on my side. Hi. For now, because she just lift the cuffs and we caught her before she tried to make a movement. Uh, but the horror board's going to get bored as they can choose to add whatever they want. Uh, it was also I use the horse to get into the cup. Hi guys. Yeah, I'm going to be calm. I'm fine. I'm not freaking out. He's over exaggerating just a little. Okay, so some final thoughts. Uh, first and foremost, like always, big shout out to Lakewood PD. uh the officers and the sergeant spot on with the explanation uh the ability to communicate what that use of force investigation is going to look like and these officers for having that tolerance uh to a situation where the biggest lesson of them all is Brianna please get the necessary treatment and the help that you need because it seems as though like you were having somewhat of a mental episode. You you got to get right and that's all that matters. It's beyond warrants. It's beyond obstruction. It's the fact that you just you just got to get better. Okay. Hope you learned something. Okay. So, Brianna had four active warrants when they stopped her. Two of them were no bail holds for assault and domestic violence. There was also a $15,000 traffic warrant and a $500 assault warrant. In addition, she picked up new charges at night, attempted escape in the second degree, obstructing a law enforcement officer, driving while license suspended in the third degree, and operating a vehicle without an ignition interlock device. They booked her on the felony warrant, plus the new charges. She was held without bond. However, no final conviction or sentencing details have been released yet.
