This drunk nurse hits a motorcyclist in a car accident and doesn't realize the injuries she caused ended someone's life. Take a look. He's strong. Blood or human flesh on your car. Get the out of my face. Officers responded to the scene of a traffic accident after multiple 911 calls. I got him. Yes. Yes. Watch out. Watch out. For our little guy, he's strong. For a little guy, he's strong. Got to be still. Be still. Leave your head still. Please stay still. Where's the other vehicle? Where's the other vehicle that was involved? That one up there? Okay. Ma'am, is this your car? Yes. I hit the involved vehicle and I'm a nurse, so I had to pull over. Okay. All right. And that's your car right there? Yes. All right. Did he have his helmet on when you got here? Helmet was on when they got here. I It happened so fast. I I hit Did you see what I hit the involving I hit the involved car? I don't know. I You hit the involved car, I believe. So, my tire was flat and I hit the involved car and I had to pull over immediately. Which vehicle is involved? I don't want the involved car. I'm not sure. So, like Are you in the Lexus? Yes, but it was the Mexican lady that was here. She's saying that's that's her vehicle. She's a nurse. She stopped the help of the other and it's all vehicle. I don't they might have left. Look at this. Yeah, I know. I saw it. She said that's really She said that she uh I don't know exactly how it all happened. That's possibly. She said there was a Hispanic lead here and when I got here there was I didn't see anything else. No. What was the red looks like? Uh, pushed to me. Right about here. She was halfway in his lane. I mean, I looked up. What direction was she going? She was coming this way. Okay. It was bad. Obviously, he went did a couple flips in the air. Did you ever hit the motorcycle? Oh, no. She She sang. She No, the Mexican lady that was here, I hit her. Okay. I didn't see any Hispanic lady when I got here. Okay. I went back and looked at your vehicle. Okay. So, there's like parts of your vehicle that are over here, right? And appears to be what could be like blood or human flesh on your car. Okay. Hold the phone for a second. If you have that imaginary BS button, go ahead and push it because she is not being truthful. That cop can already tell, and I've been there and done that back in my days in LAPD where when you're talking to someone, you know, when they're trying to be deceitful, okay, she's already mentioned that there's another vehicle involved. The officer just got done telling her there's human flesh. So, you know what? I need more of an explanation as to what happened. And this is where the truth comes out, right? This is where the fork meets the road, right? We need to know what statement you're going to give us. And by the way, I'll talk about a little later about these Miranda warnings that we've been seeing in other videos. If you're new to the channel, there's a lot of these breakdowns. A lot of police departments practice when they Miranda at scene. Okay. So, just kind of want to set you up for that because I don't know. I'm going to call BS on there. Let's see what she has to say. I'm I hit the I hit the vehicle in front of me. I mean, I don't know where we swerved. I stopped and helped. I don't know. I don't know where she went. Okay. Where are you coming from? I mean this way. I meant like before. I mean northbound this way towards the light. I was going straight like every other car. I know. I know which direction you said you were headed. Where were you at before this crash? Um Walmart coming from uh Orchard and the Back Bay. I don't I'm not sure. Walmart. Yes. Which Walmart? Where you at? The the the new one. were marked. So I went behind Safeway by Safeway. What's Safeway? Um Sam's Club. I'm sorry. Sam. Okay. Sam. Yes. Sam's Club. So I went that way. I don't I'm not sure what uh 20 seemed a little confused by what she was telling me. I don't know. She just Do you guys happen to see a cell phone? We're working for it, bud. If we just keep you up off the Oh, yeah. Um cool. We're trying to find it. Sorry. We just This is a pretty serious crash. We just don't want any evidence to leave where I hit her car while she was able to leave. Okay. We're working through it. Again, I don't know what you're talking about. All right. So, we have to investigate this in front of me. Okay. We're working through it. Okay. It was kind of a sporadic like turn almost like she was trying to avoid something, but there was nothing to avoid. So, it makes me think that she wasn't paying attention to anything. And he was dead in the middle of the lane. And he he didn't like fall off. He went Yeah. launched off the bike. Launched. He flew over this car over her car. Yeah. And the craziest part, dude, is I remember her reaction like it was yesterday. She went That's it. Like once she got out? No, like when when he when she hit him, she just like threw her hands up like he did something wrong. Like he was her fault. Yeah. And I promise you he wasn't. He didn't do a freaking thing wrong. Can I talk to you over here for a sec? Just over here. I was the one that put the tourniquet on. I am the one and I I know you're there cuz I took over to finish putting it on. Okay. So, what is your first name? Jayen. Kaylin. Yes. Okay. What's your last name? Okay. So, you're southbound 7th Street towards North Avenue. Which lane were you in? I don't I don't know, officer. I really don't. I mean, I just remember slamming on the brakes and hitting the car in front of me. I don't know if he tried to I don't know. I just know that I didn't I wasn't the one that directly hit him. I don't know if I did, but after he did I I know I wasn't the one that directly hit him. You You're saying you didn't directly hit him? No. No, sir. Okay. Where I don't know which I I mean I think I don't know, sir. Did you see where where he was headed? what lane he was in or anything. No, because there was a car in front of me. Okay. All right, Kayla. So, here's here's the deal. Um, we're still working through it. My other partner was able to get in touch that other other driver. We're going to get an officer to go talk with him. Okay. Why would she even leave the scene of the accident? I don't understand. Can you listen to me? I'm That's I don't have answers to that right now. That's what we're working I don't have answers to a lot of your questions right now, but I know for a fact that I didn't. Oh god, this is so disturbing. Let's go with why we should leave the scene of a car accident. If it was me, my next question would be, okay, well u describe the uh car. Give me the car description. Give me the person who was driving. What lane were they in? Right. Why don't you tell me a little bit about more about the car that left the scene? In my understanding that you hit that vehicle, right? and you're saying that you didn't hit uh the motorcyclist. Am I getting that right? Really try to lock her in on a statement because at the end of this all this is all going to court. Not directly hit him and she let she knew that she hit me and she left the scene and I'm concerned why while I was putting the tourniquet on that she was able. Okay, so we're working through this. Okay, this is going to be an evolving investigation as they all are. Okay, here's what I would like to do. All right. I'm talking with you and whatnot. Seemed a little bit confused on locations and stuff like that. Okay. Because of road numbers, sir. So, and just common common locations. You were saying that you were at Safeway, right? And and I confused that because I just watched a man hit himself over over at Safeway and I and I missed it for sitting. A man hit himself. A man got hit. I confused it for Sam's Club. Okay. So, here's what I would like to do. I'd like to be I'd like to do some voluntary roadside maneuvers with you to make sure that you're safe to drive your No, sir. I was safe enough to give him one on hand. No, I'm good. This is This is absolute [ __ ] that you guys just missed a car completely leaving the scene while I'm doing I'm putting a tourniquet on his leg. So, you're not willing to do any volunteer? No. No, sir. I'm not. I'm not. There's absolutely no reason why you're concerned about that than finding the car that I hate. Turn around. Face away from me. I'm detaining you in handcuffs. Face away from me. Put your hands behind your back. Let go. 3546. We have a female detained. Hold still. I'm not. Will you also note she refused roads? Okay. Stop pushing. Stop. Stop moving. Okay. No [ __ ] This is [ __ ] No, this is complete [ __ ] I would I would have left the scene obviously and not that. No, I would have left the scene. I I gave him a first a first one on theinging scene and you guys aren't listening to aing word I say because I'm confused about roads when I was born here. Are youing kidding me? Yeah. No that. Okay. Yeah. I went to school with your wife too. your wife so you can ask her about me. That's complete [ __ ] This is complete [ __ ] I'm Wow. I went to school for six years for this [ __ ] piece of [ __ ] Let's try to work on some deep. No, no, no. That I wish I would have left like this is complete [ __ ] You guys are going to ruin my career over this in 6 years that I worked. Can I call my attorney for advice? we're going to ruin your career. I think you have way more to worry about than just your career. You got to worry about your freedom because chances are you're definitely going to end up at the Great Bar Motel. Look, we talked about Miranda a lot in other videos and I've been learning along with you uh about the fact that yeah, you can Miranda and give that warning at scene. Let me give you the Miranda warnings. um you saw that told the truth about the whole truth, right? Uh you have a right to an attorney uh to be present. Um and all that stuff. I think it's like four questions or probably maybe even five. But here's the deal. Whether you mirandize someone at scene or not, it doesn't really change the outcome or it doesn't change the story because what she's telling you, it's exactly what the officer is going to be writing her statement on that police report and off it goes. all the way through the criminal proceedings. Any roadside test, please. What's your question? What's your question? Can I Can I call my attorney before I advise any roadside tests or can you call your attorney to ask them about roadside test? Yes, because I denied any roadside tests. Correct. So, we don't need to call an attorney about it cuz you already refused. Right. And then they're you're not under arrest. Sir, I'd like to call my attorney before before any of this [ __ ] goes on. No anything further than this. Uh-uh. No. I Yes. I'm not asking you. I'd like to call my attorney, Bryce Lee. Thank you. I'm not asking you to do anything else right now other than just sit here. I'm being detained for no reason, but that might be a quick look on inside of plain view. There was a like bottle cap upside down. Okay. Checked it. It's a dose cap. She has a white claw in there as well. Okay. a little bit of a faint odor. So, I'm going to tell at this point she's not detained. She's in custody. Okay. We're working through the investigation. No, sir. Don't talk to me like that. You just detained. You're not under arrest for anything. This is [ __ ] It's not [ __ ] It is. It is because I was there complain. I was there doing first aid. Very first on scene, applying a tourniquet while you while pe witnesses are leaving the scene. I understand that. And I'm detained. I understand that. You have to be No, you don't. You don't because you don't even know whiching witness left the scene. So, we have to work through this. Okay. And I understand that this doesn't seem right to you right now, but we're we're trying to do our best to figure out what happened. Okay? I promise you that's what we're trying to do. No, you're not. These handcuffs these handcuffs will come off as quickly as they went on if you are completely not involved in any of this. All right. Oh, I was involved. I was involved. I was I was giving first aid care to the victim while I understand that. I understand that. No, you don't, though. You don't. How do I not You weren't here. If you were here and you you understood that and saw what I was doing, then you would have seen the W. If I was here and saw everything, then I wouldn't need to talk to all these other witnesses, right? Can I complete your little roadside test instead of standing here like this watching people drive by my clients? Like, are you You said no. And you want to speak to a lawyer. So, Oh, but but I retain my statement from that. So, can you you retract your statement? Sure. Sure. I didn't I didn't go to police school. I'm sorry. I went to nursing school. Thank you. Can you can I retract my statement? And you'd like to do red science? Sure. Okay. I understand you didn't go to police school, but part of police school is you know what? Us investigating and you're just completely making up a whole story that's going to end up getting you in more trouble. Not just trouble, it's probably going to have the judge look at you when you're going through the proceedings to let you know why you're being so deceitful. That's what it really comes down to, right? What are you trying to hide? There is no accountability on your part. And for the audacity that you have to make up a whole story that there's witnesses that were letting go, they're not here. How come you're not doing your job, right? Or that phantom car that apparently is said that you hit or you didn't hit. You still haven't admitted to the fact that you were actually involved and you're the one that hit the motorcyclist. You know it's voluntary and you can say no. Right. I already did say no. And look where the he got me. We're stopping for first aid. Yep. You're not under arrest. I want to reiterate that. You're just detained. Right. And it's defamation from this. This town is small, sir. It's very small. Shuttle. I know that. Right. Right. And I'm seeing clients of mine drive by. Who knows who's driving by? And I'm This is what How can I mitigate that? You can you can undetain, sir. I'm not leaving the scene of the accident. You're You're just detained for the time being. That's not going to change. For what purpose? It's because you guys let the main witness of the scene leave the accident. The main witness? The main Oh my god. The main perpetrator of the scene. How about that? Was that better for you? I'm just No, this is this is defamation. I'm pissed the out that I stayed to help someone when I'm getting detained. Okay, stop it. Stop it with defamation. People throw, "Oh my god, I'm being defamed." I've heard it not too many times, but I've heard it before. You know what? When I was in law school and I went through the defamation theory when we had to study tors. I'm going to tell you right now I don't even know it till this very day and I know it's been a while since I graduated law school but I'm telling you not even in the California bar exam they actually ask you questions about defamation. Stop throwing out words uh that you think you might know when in reality you have no idea what they actually mean. You know words have meanings. I remember that. We're working through the investigation. If that's the case, we'll get you out of handcuffs. Have you had anything to drink? No, sir. No, sir. I'm I'm very upset with the situation. I understand that. I just watched a man hurt get hit and I tried to give care and this is what I get. So, you guys are going through my car without my consent? Yes. But I didn't give you consent to do that. Yes. So, sounds like an officer looked in through the window and saw a some sort of alcoholic beverage of some sort. And so now that gives us probable cause to search it. So now we're searching a car off probable cause. Okay. But I can send it to the roadside test. You refused. No, I didn't. I I can send it to the road. Did you not just ask me again, sir, whether I can send it or not? Can you Can you I'd like my lawyer here right now and I'd like to get undetained for the roadside test. Thank you. that I this is funny. So, I want to ask you some clarifying questions on you. Let's see how clarifying they are. Sure. Go ahead. Just hear me out. No, you were at I'm trying to work with you here. No, you're not. The you are. I gave first aid. Oh my god. Are you kidding me? I didn't know. So, Officer Diaz asked you if you wanted to perform them. You said no. I didn't know I was aing witness at this point. I was worried about the victim, right? Is that not the first obligation? You were detained based off of some other information we have. What if what other information not willing to disclose? The main the main witness, the main perpetrator that left the scene. And now that you are detained, you're asking to do those. You've since also asked for a lawyer. I told you your lawyer is not going to happen right now. Those handcuffs are not going to happen. You're not supposed to be a do to be able to do that without a lawyer or a blood? No. I'd like to get a blood sample. Thank you. You'd like to give a blood sample? to get. Is that not Is that Did I say give? I don't know what you mean by get. You'd like to get a blood miss. You'd like to get a blood sample from what? The way that you're talking about my miss I'm I'm honestly just trying to understand and you're mixing up words and it's really confusing. Is it? It is. Conjugations. Is that confusing to you? Yes. Yes. Yeah. I'm sure it is. I'm trying to treat you respectfully and kindly. The you are. I was trying to treat the victim respectively and this is where the it gets me. No, these are very tight, sir. Like, do you not understand? Like, look at Yeah. You know what? I don't think you're the victim. You're definitely the suspect. and they're being so respectful and having a lot of tolerance uh towards your behavior uh and your attitude, your disposition uh your demeanor and um kind of just makes me makes me wow. I've never really been in a situation like that when I work patrol in LAPD where I've had a suspect or someone involved in a traffic accident behave that way towards uh police. Uh, it just it it I'm I'm I'm shocked uh to say the least. So, Miss, it sounds like you are under arrest at this point for DUI. Yep. Okay. Good luck with that. Yep. Go ahead. You got me up now. Uh, we'll go put her in my car, I guess, and it can block traffic. Okay. Yeah, it's this one right here. Don't pull away. No, don't talk to me. Don't talk to me. Don't pull away. Thank you. I'm willing. 3546. Yes. [ __ ] We have this female in custody. So, I can't get without doing a test. Um, can I call my mirror now, please? I know. Oh my god, you guys are such juvenile. No, no, that you guys are juvenary. Oh my god. No spoiling this [ __ ] This is Yeah, you're welcome for saving a piece of [ __ ] community member from this. Wow. Let's see what the he was under. No, get the out of my face. I don't want anything. I don't want any of that. I'm not giving you microphone. Then get the out of my face. I have to read these to you. No, I'm good. I don't need my Miranda rights. Thank you. I'm not reading your Miranda. Yeah. Okay, then. What are you reading, sir? By the act of driving in the state of Colorado, you've given your express consent to take a chemical test if arrested for a DUI. No, I haven't. No, the I haven't, sir. Will you complete a blood? No, I have not. No, I have not. You got me up. I'm not one of those methheads that I That's not No. Nope. I'm not from No, I'm not from this piece of [ __ ] town. You know, I do not have my consent to complete blood tests. Sorry. Miss, do you have any questions? No, do not talk to me. I have to read you. No, you don't. Get the out of my face. Seriously, this is the last thing I said. No, no, I don't. I didn't contain I did not consent to anything. Get the out of my face by the accident. No. Get the out of my face and your police school. Get the out of my face. I don't know what you're saying. My second language is English. I don't know what the you're saying. Will you test? No. Get the out of my No. You will not complete a blood test. If uh if you refuse testing, you may lose your license and have further consequences before getting your license back. Do you still wish to refuse? Are you willing to take a blood test or are you going to refuse? And lack of response counts as a refusal. I just want to advise you of that. If you just sit here in silence and you don't answer the question, it's going to be considered a refusal. I don't want to do that without an answer. All right. Well, since we have some quiet, I'll reread it. Just go ahead and write your report. Imply consent. She refused to answer the questions. Let's talk a little bit about kind of protocol and process. Right. This is where you actually have detectives. You take her back to the station, go ahead and check in with the watch commander, let him or her know these are the charges, put her in the tank, and then since I I I want to say it's probably banking hours in daylight, right? Get some detectives, get some experienced detectives that are going to go in there and try to get a confession, right? They're either going to get a confession from her, one, two, uh she's going to lie and took to that story about, you know, there's other witnesses, someone else, there's another driver, etc., etc. And last but not least, she's going to invoke her right to selfinccrimination and she's going to call her attorney. They're going to go ahead and proceed with the booking procedures, end up in the jail facility at the Greybar Motel. She's going to have to bail out. Okay. Do you understand? No, sir. I'd like my lawyer. Okay. English is not my first language. I like my lawyer, please. English is not your first? Nope. It's not. You don't know a thing about me. I'd like my lawyer present for these being read. Thank you. But we're not going to play this game of I'm not speaking English when you spoke perfectly fine English this whole time. Did I? Because you questioned my answer. So apparently apparently I don't. You're right. It wasn't perfect. Yep. It wasn't. Is that a refusal? Have my face. All right. Thank you. Okay. So here's some final thoughts. Uh first and foremost, outstanding police work uh and investigation by Grand Junction Police Department. uh you couldn't have done it any better. The fact that you have a lot of tolerance for such behavior and the audacity to behave that way after you just got done hitting a motorcyclist, the injuries are so severe, right? But here's the deal. We do a lot of these DUI type of body cam breakdowns just to get the message that you know what, it is so dangerous for you to get behind the wheel after drinking. Okay? Please, you have to make better choices. When you decide to drink and get behind the wheel, you are risking the life of others, including yourself. You got to do better. Okay? Hope you learned something. Okay, so Kayn was charged with the following: vehicular homicide, DUI, and possession of cocaine. And she was ultimately sentenced to 6 years in prison. Okay.
