This Wendy's worker calls 911 to report an assault. But there's one thing she forgot about. The CCTV cameras. I mean, blacks have to be told their color for God's sake. I mean, I'm 61 years old and I'm white, too. You want to explain this to me? Wait, give me my phone. Deputies respond after a Wendy's employee claims a customer attacked her during a debit card dispute. But check this out. Investigation takes a turn. Deputies uncover evidence that changes everything. Take a look. Come here. You see this? You see this? I got him right in front of that one. You see this? Come here. Put your hands behind your back under wrist. Did you hear what I said? No. Put your Don't do this. You have another one? Yeah. Actually, hold on. Relax your arms. I can't because you're purposely doing that. I can't react to my arm with you on my foot. Okay, that's not related. It could be. Okay, you're just being difficult. Where are we going? Come over here. To the car. Why say that? Why don't you say that? Tell me. You want to go on that side? I think for the RTC photo they added in there, but you going to bridge me? Yes. I don't know if they can come in my camera and check. Okay. Spread your feet. Watch your I can't get in. Yes, you can. I got to watch my head. What's going on? You tell me. You arrested me. You're You're not arrested. You're detained. Under apprehension. You're detained. Detained. Yeah. All right. Let me read you something. Okay. I'm waiting. Why? Okay. You have the right to remain silent. Anything you say can be against you in a court of law. What is What is this called? My rights. Correct. Well, say that first. I'm sorry on Chuck one, man. For the first time, I kind of like this arrestee, you know? Like, tell me what it is, man. It's Miranda. Ever heard of him? Say, I'm going to read you your rights. Okay. You going to listen to me or you just want to talk the whole time? I like talking. You like talking? Yes. Okay, cool. Let me read you this and then we can talk. You're going to read me my rights, correct? Say that. Okay. You have the right to remain silent. Anything you say can be used against you. Tell are you you have the right to talk to a lawyer and have your lawyer present with you while you are being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you for questioning. Do you understand these rights? You're very beautiful. Okay. Do you understand what I just read to you? Read them again. Do you understand them? No. Okay. What do you not understand? You have to read them again. Okay. You have the right to remain silent. Do you understand that? I am a silent person. Do you understand? You have the right to remain silent. Yeah, I understand that. Okay. Anything you say can be against you in a court of law. You understand that? We're not in the court of law yet. He's got a point. Okay. Anything you say can and will be used against you in the court of law. I'm saying something is I'm under a tape recorder or what? How you You're being recorded. Absolutely. All right. So, you can use that in court. Correct. Anything you say. Okay. So, it's better I say nothing. Do you understand that? I'll give it some thought. Okay. You have the right to talk to a lawyer and have a lawyer present with you while you're being questioned. Do you understand that? Yeah, I understand that. Okay. If you cannot afford to hire a lawyer, one will be appointed to represent you before questioning. You understand that? Public defenders suck. Okay. Okay. Not only is he my favorite arrestee, and again, you know what? It's there's a lot of humor in this. This is funny. Uh but with that being said, I mean, could you agree? And why is it that uh public defenders get such a bad rap? They really do. It's a noble profession. No any different than being a cop, man. I mean, think about it. You get a stack of cases just piled up every single day. Your docket, right? And you're willing and dealing. You're like a I wouldn't say you're a used car salesman, but it's very very important job. But you know what? You're getting a lot of experience and you definitely got to have some good uh communication skills. Do you understand that if you cannot afford to hire a lawyer, one will be appointed to you? Well, I have no choice either. I can't afford and the defenders suck. So, I'll represent myself. Okay. If you decide to answer questions now without a lawyer present, you still have the right to stop answering anytime you speak to a lawyer. You understand that? I love questions. You can ask me as many questions as you like. I Yeah. Do you understand what I just read? Fully understood. Fantastic. What happened today? I walked in at 10 minutes to whatever they were opening. Walked into where? The Wendy's. It was I was there early. I said, she goes, "We are not open yet." And I said, "What time is it?" She said, "10 10 to 8 or something." She goes, "Have a seat. You're welcome to have a seat." So I sat there like a gentleman. Mhm. She said, "Sir, come up. You're ready to order." I got up and I presented my debit card and I said, "I'm not sure it's working. Can we try it first?" She said, "I don't know how to do that." I said, "Ma'am, use your head. For God's sake, is she's the easy hell." I mean, it's not hard to test your debit card, but she's there for a reason. I don't I said I mean, blacks have to be told their color for God's sake. I mean, she got heated, really heated, and started calling me an [ __ ] Mhm. So, I ran made a ran for it. She chased me out the door and threw a sign at me, and that was the end of the incident. She was he she was I was a gentleman. She said, "You can have a seat." I said, "Thank you, ma'am." And I waited patiently and I presented my debit card without any I didn't throw it at her or push it at her or poke it at her. I said, "I'm not sure it's good. I you know I have money in the bank but it's acting funny. So and she didn't know I don't know how to do this. And the managers to her right I mean she didn't even bother to look around or ask or she looked at me and said I don't know how to do this. So I said you're you know you got to call blacks when you're out in the field just take and that's their color. All right. She's she's new or something and I that's about it. I'm going home. You want to take I Okay, look. I'm going to stop right there. And even though he brings up some good valid points regarding Miranda, right, when you're reading my rights, you know what? I got to call him out, man. You know what? You shouldn't be calling people names by that and get angry and just go there. Just don't do that. If you feel as though that someone is incompetent, your remedy is, well, get a hold of your manager. You know, keep talking to her. But to get angry and start dropping an Mbomb, you know what? That is totally totally 100% unnecessary. My I I met my first friend in jail. I like jail. Okay. It's a I make my friends in jail. Okay. I want to go. What'd you go to jail for? That's beside the point. Okay. So, you went to Wendy's a little bit early. They said, "Can't order yet." So, you took a seat. I said, "M, thank you." I said, "Thank her kindly." I mean, then she said, "Ready to order. called to the counter. I said my I wanted to get cash at the presto at Publix. That's how I know and it wouldn't work. That's why I said I told her I didn't tell her my the presto to give me cash. I knew it already. So that's why I said let's test let's give this a test. And she goes, "Yeah, I I don't." She had like a really heated look, mean look on her face looking at me and I was like, for God's sake, just I mean, she's fairly bright, you know? She's got a job at Wendy's, of course. I mean, she's got a must have a high IQ. She's got to handle cash. And I'm an older man, too. I'm 61 years old. Okay. So, I'm I mean, Wendy's is my favorite restaurant uh fast food, you know. I like going there. I wanted to get some milk and something at Publix, but I decided on Wendy's. I wanted to give my business to Wendy's. Okay. So, once she said she couldn't figure out your debit card, you got a little upset, I'm guessing, that she couldn't figure it out. I told her to use her head. Okay. And then did you like I called her Okay. Did you like throw anything? Did you hit her? No, I grabbed my debit card and started headed to the to the door. Okay. Grabbed your debit card off the counter from her fing in her fingers. Okay. Um, you didn't grab her like at all. Just just the car. Okay. Didn't touch her. I wouldn't I never would have never heard a woman. I don't joking set aside, it brings up a good point when um you don't get what you want, then you one up her and then next thing you know, you're dropping Nbombs and it's just it's total disrespect. There's no need for all that. I hope that this man right here kind of watches this video and maybe get some lessons learned, right? And get some takeaways when you decide to get pissed off because someone's incompetent. You just can't go there. You can't do that. All right. Well, give us a few minutes. We'll figure this out. All right. There's a guy. There's Just let me go. I mean, it's the incident's in the past. It's over with. She's still got her job. I'm sure she's going to make a great cashier at Wendy's. If what you're telling me is all good and true, then I'm sure we will let you go. But for right now, we have some other We've conflicting stories. So, see, she's not telling the truth. Let us figure it out. I'm sure they have cameras. Come on. I'm an older man. I'm 61 years old and I'm white, too. Okay. Okay. So, before we go talk to I guess we can say it's the victim, right? Because again, remember when I say that when you call 911, you're either the PR person reporting RP, reporting party, depending on what state or county. And then you also have uh a victim calling 911. And sometimes when you call 911 and you happen to be the victim, you can turn out to be the suspect as well. And so it's part of the uh deputies here to kind of figure out, you know, which story is pretty much valid, accurate, and based on the evidence, right? When you investigate, just follow the evidence. Hello. Who's her? Who is her? Yeah. She's in the office back here. Okay. Hi. Hi. Excuse me. Oh my god, it hurts so bad. Hello. Okay. What happened? Um, so we wasn't open yet, but whoever the manager was, I guess, never locked the doors, so he came in and I was very nice to him. I told him, I said, "We're not open yet, but you're more than welcome to sit down in the lobby, and once we get ready, I'll go ahead and help you." Okay. Uh, the ambulance should be coming in if you don't mind grabbing them really quick. So, um, when we got started up and stuff, I called him up to the front and, um, I was like, um, what would you like to order? So, when he came up, he seemed nice normal. So, I was like, um, what would you like to order? He was like, I want to try my card first because I don't know if my card is going to work. So I was like, "Well, sir, you got to in order to for me to run your card, you got to either order something and that's the only way I can check your card." So he was like, "Um, you need to tell me you you can't just run. You can't just check my card." And I was like, "Hold on now." And it kind of spurred from there. We just we kind of started arguing. Talk to me about when he touched you. He like um he he didn't really touch me. He just like threw something at me. I don't know what it was. And I like went to charge at him. Like just went to he when he threw it, he took off running out the door. So when he threw it, did he actually hit you? It like hit my shoulder. Okay. So he did strike you. Yeah, it like hit my shoulder and then I um I grabbed the tray and I started running at him with the tray and when I um when I hit the corner right there, that's when I kind of fell on my shoulder and I dislocated my shoulder. Okay. Oh, I can't move. Okay, time out for a second cuz who here has dislocated their shoulder? I can tell you uh when I used to play soccer back in the days competitively in LAPD with soccer tournaments, I remember my boy Jimmy once uh my goalkeeper, shout out to uh Jimbo, you know who you are, was uh playing goalkeeper and I think at one point he must have dove for the ball and completely dislocated his shoulder out of the socket, went up to the u poles of the goal and wham and just put the shoulder right back up and it's super super painful. You know who you are if you had that uh type of injury. Do you guys have video cameras that might have captured this? It is anyone else able to access that while he's taking a look at you? Okay. Um my my GM is on his way. Okay. If you if you support that just like it is, can you walk with me? Yeah. Okay. I'll tell you what. Oh my god. Oh my god. Oh my god. Wait. Wait. It is definitely [clears throat] dislocated. I'll just what we here we'll wheel you out. Take I'll tell you what. Take one of your clipboards. Put it up underneath there. Okay. Okay. So, don't push the BS button just yet, but you know, get close. Okay. Cuz I don't know if those are like fake. Uh, I don't. Okay. Now, remember, I've said this in the past, or maybe I haven't, is this quote that I learned in LAPD is today's victim is tomorrow's suspect. Just remember that. Do you have your driver's license anywhere in here? In my car. Okay. Can you have one of your employees grab it? Oh, yeah. Did either of you two saw what happened? I did. Okay. So, what happened uh when I was coming out? And are you able to grab the her ID? Her driver's Yeah, it's from her car. Oh, okay. I got you know where her car keys are? All right. So, what happened? Okay. As I was coming from the back, I heard him calling her. Okay. And stuff. And um then she told him to get out. Okay. Then come around and he hit her. He hit her on the shoulder and she picked up the trays and was So he hit her first. Yes. What did he hit her with? His hand. Okay. So she's saying that he threw something. He probably did because when I was coming up there was already arguing. Okay. Like did he punch open hand? Did he have something in his hand that he hit her with? It seemed like he had something in his hand. Okay. Cuz he kept going up underneath his shirt. I thought maybe he had a gun or something. Okay. All right. Yeah. If you can grab his ID. Okay. I'll tell you. So he made the first move to hit you. What did he hit you with? I don't know what it was. I don't know what it was. I just when we were arguing back and forth, he kept calling me. I called him. Did you scoot back and sit back? I don't know what he hit me with, to be honest. Okay. But that's the only time that you and him made contact. Yeah. And then when I ran out to him, when I ran out, I grabbed those trays right there. Mhm. I grabbed like two trays cuz I was going to bump him in the face with him. I'm being And I ran and I like slipped right there on that on that rug. [screaming] And when I slipped on the rug, give me my phone. It's in the office. When I slipped on the rug, that's when I fell and hit my shoulder on the wall. Okay. Yeah. So, he didn't dislocate my shoulder. How bad did he hurt you when he threw something at you? It didn't really hurt me. I was just mad. Okay. Yeah. Yeah. But the trains was outside. So, he took the trains outside. Okay. Oh, you took the trains? They was on the um outside on the ground. She picked them up. Oh, yeah. Cuz I tried to hit him with the tray. I should show you that ID still. Okay. Stories are changing. They're all over the place. You got trays. He hit you. Well, you know what? I slipped and that's how I dislocated my shoulder. But in the beginning, you said a completely different story. Yeah, he hit me. But when you get these conflicting stories, ah, you know what? I'm going to tell you right now. I've been there where you start wondering. Just make sure that let the evidence lead you. Uh, my partner has it. He's just running the name down real quick. Okay, go. You grabbing your ID, too, ma'am. Her story and a witness. It's still a little vague. The GM's coming so I can get video of it. He wanted her to test. Don't leave with her ID, please. I'll be right out. We'll be here for He came in, didn't know if his credit card was going to work. Wanted her to test something before he ordered. She said, "She can't do that. I need an item." And then he started calling her the n-word. Both of them started fighting verbally, just verbal fighting. Apparently, he [music] picked up something, doesn't know what, threw it at her, hit her right shoulder. That's when uh the other witness came in and saw the guy hit her with something. Neither of them know what he hit her with, but she felt the pain in her shoulder. She started grabbing trays, screaming at him to get out, ran after him, and then slipped and dislocated her shoulder. That is what I got. So far, she admitted to hitting him with trays. So, I mean, she's claiming some type of battery on it. And he's not even saying he got hit with Trey off. No, he's never got physical. And there you have it. You know what? Flush it out. Talk to the sergeant about it. But at the same time, she's also claiming a battery, right? So, you have you have battery on both the victim and the suspect, right? But then again, yes, she is the victim for sure. The only physical contact was him hitting her with something first. He made the first move according to those two. Hit her with something. She was attempting to hit him and like chasing him out cuz he wouldn't leave. No, he didn't cause a dislocation, but he did throw something or hit him in the right shoulder. The GM's coming so I want to see like exactly what happened cuz there's no proof of anything that happened before the dislocation. Nobody knows what he No, cuz it all happened so fast. Did you throw something at her? No. Hey, I said before I was I grabbed a debit card. She had my debit card in her fingers. I said use your head. Okay. Grab the debit. She Mr. Obviously, they have cameras in here, right? So, like I'm going to go look at them. That's why I'm just asking you before I go look at them. Can you throw something at her? Absolutely not. Well, like what? There's no objects in a Wendy's. Like a rocker. A rock in Wendy's or something. What? I don't know. Anything. Well, what would I throw at her? I mean, I know. It could be a a cup, a tray. Uh, well, a cup's not going to hurt her. I break her shoulder. Check the cameras. I'm These handcuff hands are kind of hurting me a little bit. All right. I mean, I 6' three guy cramped in your car here. How about it? I'm not Well, I'm not going to run off. I mean, you want me to come into the Wendy's and watch the camera with you? I'll watch a camera with you if you No, I don't need you to do that. Okay, that's fine. While I was using her phone, that popped up that Yep. I'm going to ask her about it, but that's kind of She can see you from back here better. She said she wanted to give you a phone number or something. Hold on. You want to explain this to me? Wait, give me my phone. Wait, what that says? Oh, about the I'm I'm going to give you one warning, right? You know, filing false police reports crimes. I'm not f I didn't even want wanted to call y'all. I wanted to just go to the the hospital. Okay. Did he hit you? He didn't physically hit me. No, he didn't. Okay. Then why are you trying to get us to arrest this guy? I didn't want y'all to arrest him. I never wanted y'all to arrest him. That's not what that says. But I never wanted y'all to arrest him. You know what? Push the BS button. I'm going to call you out on that because look, you have two witnesses. You have your statement. So that's three, right? And you said that he committed a battery. And from the get- go, right when the police arrived that scene, we already went ahead and detained him, you know, and he's telling you I never hit her. Now, he's condescending and he's rude, right? Very inappropriate. But with that being said, you took it to another level. That's just my thinking. I just told Oh, I got I'm drugs. You're on drugs? We just Okay. But I don't even want I didn't Okay. So, he didn't hit you at all. He threw something at me. He never hit me. I never said he hit me. So, then why did you not want us to look at the cameras? Because I did run at him with the trays. That's how I failed. Oh god. Okay. I ran at him with the trays. Okay, that's fine. You can look at it. Don't matter to me. But um Oh god. Jesus Christ. Okay. So, your boss is I'm guessing on the way. He didn't answer, I don't think. Yeah, his phone is Wi-Fi only or something. I don't The dislocated shoulder is my my problem. You feel me? I fa I ran ran at him with the train. I tried to hit him to get him out the store. I I understand that. But so the crime of battery is if he hits you at all. So I had I told your officer he didn't touch me. He threw something at me and that's why we're where at my shoulder on my shoulder. I don't want the man to go to jail or anything. But But that's a battery. That's what you're saying. You're saying he threw something at you. Come on. He don't have to go to jail. You can trespass him away from you. Okay. Are you able to call the boss? We were having a problem getting a hold of him. I don't have his number cuz I just started. Oh, okay. Get him number. The boss. No, you don't know his number. No. I Yeah, I have to see the camera footage. He want to see the camera footage. If not, we're going to close the Wendy's and write a warrant for the cameras. Oh, okay. He said he's on his way. Okay. Good morning. Why was Why was she telling you not to let us look at the cameras? I don't even know. I was home. I was sleep. She just told me something happened and she text me. So I run run to cuz they can't leave nobody store. Mhm. Yeah. She slipped on her own at the door. It's not even the right shoulder. It's the wrong shoulder. She fell on her left shoulder. She's all wrapped up on her right shoulder. Yeah. Okay. Um I'm going to need copy of this. Yeah, [screaming] dude. Everything he said was true. So, we're releasing you from custody. However, you are going to be trespassed. Okay. So, I'm going to need you to sign this. That basically says that you understand the above trespass warning. You acknowledge that you can never return to this property. You understand I won't be back. Okay. I'm going to finish reading. Be respectful. You understand that your failure to comply with this warning will result in your arrest. This trespass is permanent and applies to this Wendy. Okay. Got it. All right. You can exit. Kill me. Can you Okay. Yeah, please. Let's get out of the vehicle and I'll take them off. All right. All right. So, I appreciate you. Okay. Um, here's the deal. I went back and look at the video footage. Like I said, I was going to everything she was telling us is basically a lie, right? So, she's going to be going to jail. Okay. This why I understand this isn't the best thing, but we we got to let us work through this. I'm going to leave you. I'm going to take your bus. Let's get Hello. Hey, Sheriff's Office stops being audio and video recorded. You're raising up for your window tent, the windshield on your side windows. Oh, I just got a um I just went to court for it. Okay. Well, they So, they gave you a ticket for it? Yes. What happened in court? Okay. After the call, um what happened in court? Um they gave me into the paper. No, wait. I just my lawyer just sent me the um the paperwork, but they just gave me until Yeah. August 14th. Okay. Do you have your registration insurance on you? I think I have a warrant for her. She's not answered yet. Can you come here? How you doing? Good. How are you? Everybody in a rage, I guess. Who's in a rage? I got everything under control. Who's in a rage? I said just didn't say everybody cuz it's like talking about who's in the rage. Um, why did you have pulled over? Why? Yeah. Her window. Oh, okay. You're right. I don't know cuz I I got th on mine, but it ain't that dark. Yeah, her windshield and all her windows. Okay. All right. Okay. And step out for me. Okay. Turn around and face the car. Y my my shoulder. My shoulder out of your phone real quick. Ma'am, she has a warrant. Okay. So, she has a warrant for She has a warrant for arrest. I'll give you two sets of cuff. Just relax. Okay. Thank you. Wow. I was trying to reach out to you so I can turn myself in. I didn't want to do it like this. Put the handcuff in the front. I don't want my shoulder to come out of Okay. I gave you two sets of cuffs. Two sets of counts. Okay. Our policy is 18. And what is what is my charges? Filing a false police report. Do I have a 5,000? Oh, I ain't going to let you fall. Okay. Okay. Okay. Yeah, I see the key right now. Are you going to drive now? Yeah. I'm not going to pull over. Okay. Let's go ahead and wrap this up. Final thoughts. First and foremost, like always, big shout out to Indian River County Sheriff's Office. Thorough investigation. You know what? Follow the evidence. You did that very well. Respectful, professional, all that good stuff. Now, the biggest lesson is this, and this is what I got out of all this. Look, both parties are at fault. Okay? the bail white arresty or the detainee I should say in the beginning look there's no need to be condescending rude inappropriate dropping mb bobs and the whole nine but you know what the arrestee right the female black woman you know what she clapped back doubled down and said you know what for you dropping m bombs I'm going after you and you know what there's got to be other ways to handle this and I hope that you know they watch this and they understand that both parties because both parties are really at fault and remember what I told you earlier when I said that today's victim could be tomorrow's suspect. Should I? What I did say is today's victim is tomorrow's suspect. I guess in this case, yeah, today's victim is today's suspect, right? And don't lie to the police. $5,000 bond in the state of Florida. That's what's going to cost you. But you know what? More than anything, it's going to ruin your future if you keep lying to the police. Don't do that. Okay? Hope you learned something. Be safe out there. Up next, I'm watching two brothers execute a random guy in a hitstyle murder. So, I went to the stairs and that's when I sat down. Step out now. Step outside. Hands high in the air. Know you're not going to say that. You're not going to say that, bro. But that's over on my second channel where I'll be covering some of the most extreme incidents in policing history. She was charged with filing a false police report which later became a warrant for her arrest. Now, 9 days later, she was pulled over during a traffic stop, at which point deputies discovered the active warrant and subsequently arrested her. Okay, you know the drill. Click that like button.
