I'll go talk to her. Hello. What's your name, ma'am? >> Shyanne. >> Shyanne? I'm Deputy Summers. I don't want to I don't want to track through your house. I got snow over my boots. >> It doesn't even matter. >> What's What's hap- What's going on? What happened? Is it okay if I come over there? Is there anybody else in the house? Just >> No. >> You and the babies and him? All right. What's What's going on? >> A bunch of fighting. He's kind of a jerk and he does drugs and alcohol when he's not supposed to. >> Is this your husband, boyfriend? >> Uh fiance. >> Fiance? Okay. >> But then he likes to start fights and then he says it's my fault. And then he's slamming me against the window and a whole bunch of us and then he's constantly He's He's trying to He won't let me leave. He's trying to hold basically hold me captive. >> Give me >> I'm trying to pack my stuff and he won't let me. >> Mac 137, I'm out with a female. >> Copy that. You're out with a female. >> I'm sorry. I I let them know. Um >> I'm trying to pack my stuff and he won't let me and I don't have anywhere to go. He has my brother His address is but there's not really a room for It's a little one-bedroom apartment and he has him and my other brother and I'm not going to be able to fit there with me and two babies. >> So, you're just trying to get out of here and he's not letting you. Did he put his hands on you or the babies? >> No. No. I mean, I don't know if I would really pushing me up against the window and screaming in my face, couch. >> He pushed you up against the window? >> I mean, I smacked him in the face, but that was self-defense. >> Were you trying to get him off of you, and that's when you saw him? What window did he push you up against? This right here? How did he push it? Did he have his hands Just explain to me how he had his hands on you. >> Well, he was screaming and going like this, and then he just like pushed slammed me up against the window. >> Multiple times or >> I think like twice. I don't know. It was just I was against the window, and it was screaming at me. And his two kids were over here, too. And Phoenix was saying that I'm being mean to him, and then I'm going to hit and hit him, and then I and >> So, at any point did you fear for your safety or anything? Did you feel like that he could hurt you? Were Were you afraid? >> Not really. Kind of. I mean, I don't I don't know. I just don't want to be here. >> Okay. So, this is Sergeant Broker. Um she's saying that they were arguing. She was trying to pack up some things to get out of here, and he would not let her leave. He pushed her up against this window here twice, and was in her face with a finger, yelling at her, screaming. Um she did hit him in the face to get her off of him or get him off of her. Um So, that's where we're at now. The babies appear to be okay. He didn't touch them. He just pushed her up against this window twice, and cuz she was wanting to leave. Problem is, she doesn't have really anywhere to go. Um she's got a brother who lives in a one-bedroom apartment. She's got two babies, and >> My other brother lives there, too. >> Okay. She has another brother that lives there, too. Um Do you have any marks on you or anything? Do you need EMS for anything? >> No. >> You mind if I just take a look at you real quick? >> Can you sit right here? Can you sit? Can you sit? Sit. >> When he pushed you, where where did he have his hands at? >> Like on my chest. It was kind of like right here. >> Okay, do you Yeah, just >> There's nothing there though. >> [snorts] >> No marks? Okay. Wrist or anything? >> No. I don't think. >> What about right here? It's on the inside of your arm. Scratch. That wasn't there? >> No. >> Okay. Did he grab a hold of you like this when he was pushing you? >> No, it was like on my chest that he was pushing against. I don't know how that got there. >> Okay. Did anything get broken or anything like that? >> No. >> What started this argument? >> Uh I was playing a game with my brother and then he said I couldn't hear him and I could cuz I had a headset on and then he was saying I was ignoring him. And then I didn't He wanted me to go play a game with him and his mom and I told him Well, I said maybe but then he called his mom and said that he was talking crap about the fact that you know how she is. She might change her mind last minute and then he called I said I don't I don't really know because there's snow out there and I don't really feel like dragging her and him or his kids out in the snow with the snow up like this high. And then >> Is this either father? >> No, well he's hers but he's not on the birth certificate or anything. He's not his. >> Okay. All right. And you said that he has been doing drugs and stuff like recently? Today? >> not quite recently, no, but he does every once in a while. >> [snorts] >> And then he takes breaks because he's on parole or whatever it is. Probation. >> What kind of drugs are we talking? >> He's done meth a few times. He's on Suboxone, but that's normal. >> I mean, is he under the influence right now, you know, of of drugs or alcohol? >> I don't know. He lies to me a lot. >> He lies to you a lot. So, are you um Is this your place? Is this his place? >> It's his mom's place. >> It's his mom's place. >> We just rented off of her. >> Okay. >> But separate, we have separate leases. >> How long have you guys been together? >> Uh a year and almost 4 months, even though we fight. He try He threatens to kick me out even though we have two separate leases, and there is a lease made, so he can't just kick me out. >> Okay. >> I mean, my baby mama I've been talking to him for a while. I just want to get your side of the thing. Can you Can you tell us what happened? You don't need to tell me what happened. I already talked to him. >> Um We were fighting cuz I was on the game. I was on my on my Xbox playing a game with my brother, and I had a headset on and he was saying that I wasn't him even if I wasn't paying attention. And then I uh I said I did and he was talking about going over to his mom's house to play a game and I said I didn't uh I said maybe, I don't know, but I didn't really want to take them out in the snow that's up like this high. But then he he got mad about that, but then he uh Well, cuz I said maybe, he was talking crap to his mom about the fact that like, you know how she is, blah blah blah, she don't want to do nothing, whatever. But then um he uh After that and I said no he about about that, he said that I it was always going to be a no and called her and said of course she said no, she don't want to do nothing. And then [laughter] he uh They got off the call and then he just started getting mad and like yelling at me and then his kids were yelling at me because I'm mean and whatever else. And then he's just screaming in my face and then I ended up um like getting pushed into the window and he's like putting his whole face hand in it. He's going like this, pointing at me or pushing up against my chest really hard, but he's saying like he's just screaming in my face. >> She said he had her he pushed her up through here. She doesn't have any marks, but on her >> first pushed me. He was like >> Hold your arm out. He's like going like this. >> When he's saying >> I see a scratch right there. >> Is that from this? >> Scratch from the >> your elbow. >> It wasn't there earlier. But I don't know if it's from this or not. I'm not going to lie. >> I have to go closer to look at it to be careful. I just I don't Let me get this a little bit closer. This [snorts] definitely crushed so a little tiny bit of skin break there. >> Um I didn't Do you guys have to follow me? >> No. There's no one else here like you said, right? >> No. >> So I'm going to say something stupid. >> Yeah. >> Cuz we talked to the first fiscal court after they were finished talking. >> She said that she hit him in the face because he had her up against the the window and was trying to get her get him off of her. She did she hit him in the face. >> Okay. >> Oh, yeah. I forgot that part. >> She also said he's a drug user. She doesn't know if he's under the influence of anything right now. >> Mhm. >> Um but she's been trying to get out of here and he won't let her leave. >> How's it How's he not letting her leave? >> He just won't let me leave. He keeps standing in my way and then he keeps like threatening me and he says that we got to fix this and that I never cared about him and I just used him and a whole bunch of other stuff. >> Is he threatening you with like, you know, like threats of bodily harm or just like threats of like well, if you leave we're done, that kind of thing? >> Something like that and then he's like not really harming me. I mean, he threatens to take her away from me and stuff and he says that I'll take that he'll try to take him away from me, too, because I don't take care of him even though I >> This is his daughter, but it's not his son. But he You said he has kids, too? >> Yeah, he's got >> Where are they at now? >> In the next door. It's Phoenix and Payton. >> Is that his parents? You said [snorts] his mom? Were they here during this? >> No. Well, the kids were, not his mom. Phoenix and Payton were here, yes. >> How old are they? >> Uh Phoenix is 6 and Payton's 2. >> Did he Did he take them over there after you guys were fighting there or >> Yes, because Phoenix Payton was saying that I was being mean to his dad and Phoenix was saying I'm going to smack him in the face and whatever else. >> Okay. So, his mom Just yourself. You don't need to show me unless you just want to Would you mind just looking down here just to make sure there's not like a red mark in the middle of your chest or something? I I if you want to go Is there back bedrooms back here or something? >> Um, there's a bathroom in the baby's bedrooms. >> Could we talk to my mom in there? >> Yeah. >> We're We're going to separate you guys. It's too cold outside. >> My stuff Trash got thrown away. >> We just don't want to talk to both >> Huh? >> being this close. That's all. Trying to separate. Um So, yeah, can we just walk back here real quick? >> Can you sit up on the bed? You sit. >> Ma'am, just quick question. Do you have any firearms in the residence? >> Firearms? >> Yeah. >> I don't think so. >> Okay. >> I don't like guns. >> All right. I got you. Sir, you wanting us to leave. You wanting to leave, but you said you don't really have anywhere to go, right? >> Not Not really. Not other than my brothers, but I don't even have Even if they had the space, I mean, they said I can go there, but I mean, my one [snorts] brother's in the living room. My My older brother, whose apartment this is, is in his bedroom. So, I'll be in the living room with two babies with another one of my brothers, which is okay for a short time, but I won't even have a way there even if I did. >> We can We can help with that. It's probably not the best idea that you stay here with him. Now, I asked you when he was doing this to you when he was pushing you, had his finger in your in your face, if at any time were you Did you fear for your safety or fear Did you feel like you were in danger? And you said no. Is that still the case? >> Yeah. Kind of. Yeah, I don't know. I mean, not really. Sometimes he frightens me whenever he does stuff that. But, that's because I have a >> [snorts] >> a lot of trauma. >> Okay. Is this something that happens quite often? >> What? >> The fights and the pushing and the Okay. Have you ever tried to get away before? >> Uh >> And he doesn't He doesn't allow you. >> really lets me leave. I left once, but then he wouldn't really let me have my stuff, so I had to come back. And so, we said that we'd try to work things That was the thing. No, I wasn't able to have my stuff. Like, I needed I needed stuff for them. And all of it was here. >> Okay. >> Really, can we not play with the cord, please? >> So, he put his hands on you. Even Like you said, he pushed you up against the the window a couple times. >> Yeah. >> Possibly left a mark here. You said he did it up here. Yeah, I didn't see any marks on your shoulders. >> Yeah, I didn't I don't see any either. But, there's a mark right here from when he was going like this because like when he was doing it in my face, he >> That was his finger he was poking. >> He was grabbing at my chest. >> Yeah, but I don't see any other ones other than that. >> So, I mean, we have a battery. >> Yep. >> And possibly assault if you're in fear for your safety. And And did he make any kind of comments like he was going to hurt you, kill you, anything like that? >> No, he just says he hates me. But, that's not really >> Well, I mean, that's Telling someone that you hate them is not There's nothing criminal about that. But, if if he's saying "I'm going to do this to you. I'm going to beat you up. I'm going to hurt you. I'm going to kill you." Anything like that. Did he ever make any of those comments tonight during the argument? >> No. >> Okay. Did he ever say like if if you leave, was he going to do anything? Like, he obviously he said You said he didn't want you to leave. Did Did any comments about why he didn't want you to leave? >> No. Probably because of her and the fact that he uh he doesn't want to go back to jail. >> He's on >> [snorts] >> probation right now. Is that unregistered? >> Okay. >> He's on extended [snorts] leave right now. Whatever whatever it's called. >> I don't I don't know. All I really know is that he is a probation officer. He used to have to go to Clarksburg for these meetings with this parole officer but now he doesn't and now he's a probation officer or whatever. I don't I don't know. >> Yeah. >> You're good. >> I'm going to grab a D-like form, too. >> Okay. >> And uh >> What's um It's going to take a while to transport them back. I'll pull my car around too. I got actually actually just let me go out and grab them all my D-like. >> Okay. Yeah, you're good. I'm going to get their names and and uh Yeah, he's here. >> Yep. We got him. >> What do you want to break her now? >> No. I'll probably just transport her. >> He's anytime where anytime we are on a domestic call, there's a a paper. It's a questionnaire that we have to fill out with the victim. You being in this case the victim. And it's called a dangerous lethality information form. It just got some questions on it. Some questions may not pertain to your situation. Yes or no questions. We got to fill that out. Um it appears that he is going to be going with us for domestic battery. >> Is he going to be like getting stuck in jail? >> What is that? I'm sorry. >> Is he going to be like stuck in jail? >> He'll have to get processed and arraigned. I don't know what his criminal history's like. You said he's on probation and stuff, but >> I don't know if he's going to be stuck in jail. >> So he Ross has gone out to get a D-like form. Um she wants out of here. He will Will let her leave. This has been numerous times that they've argued and fought and she's tried to leave and he won't allow. This is his daughter. That's not his son. The his mom owns this place. They're both Okay. >> [snorts] >> She does have a mark right here on her chest where he was putting his finger and she pushed him up he pushed her up against the window. Um had his hands on her. So I kind of explained what we have there. She is wanting to leave though. Where does your brother live? >> Um I don't he just sent me his address. >> Is it Morgantown? >> It's in Westover, I think. >> It's in Westover, okay. How's she going to get there? Ross said that he would transport. The problem is Waco, Texas has called me 17 times in the past 2 days. Do you know anybody in Waco, Texas? >> know anyone in >> I don't either. Um >> 17 is a little bit extreme. >> Yeah. >> Nine. >> Yeah. >> Yeah. >> They have phones. But no offense, they like to take my phone and use it as a hammer. So I got them their own phones for Christmas that they just play games on even though they're not activated. You can still call the police. And then he said, "Oh great, you got exactly what you wanted. You called the police." And I'm like, "With what phone?" And he said about like not putting them in jail and I'm like, "So what? Like?" He's like, "Yeah." >> So he knew that you called 911. >> He's suggesting it but he has no proof I did it. >> Is our our dispatch said that he was outside but then the last thing they heard from you was that he was coming back in but they couldn't reach you because you have a 911 only. >> It was because it was their phone. >> Whose phone is that? >> Yeah, you can It's not activated. All you can get And then he was He was at his mom's house taking the boys and then he came back. And it kind of just got worse. But I wasn't able to get back on the call. >> [snorts] >> I mean, if he probably caught me on the phone, he probably would have killed me or something. Going back to jail is the last thing he wants. He said that he'd rather kill himself than go back to jail. >> Okay. >> Bentley, come here, please. Can you please leave [ __ ] alone? Sure, play with that. And he tried to stop things cuz I made this coupon book because we were always fighting and like so I made him a coupon book about like stop fighting immediately and he tried to give it to me and I told him no and then I wanted to leave. And then, you know, he got even worse meaner after that. It's not even that like I wasn't going want arguing. I did I stopped saying I wasn't saying anything to him. I was just walking around packing my stuff. >> What happened after that? What did he do? You said he got mean or what? >> Yeah, he wasn't letting me. He was standing in my way. He was telling me to stop and a whole bunch of other stuff. Just the same thing over and over and over and over again. >> But he didn't put his hands on you anymore after that? >> No. >> Be honest with me, too, okay? I mean, I don't want you to feel like that you have to protect him or anything. >> No, he didn't put his hands on me. He never really does, to be exact, other than like trapping me or pushing me up against the wall or something. I mean, like when we first got together I said that like that was really mean and he didn't listen. Cuz then when we first got together like a year or 4 months ago on Valentine's Day fight, he ended up like trapping me and slamming me on >> What's that? Do you have a handgun 10-15? So, yeah, she um probably for a battery assault cuz she said that she was when he did that she was fearful. So. Yeah. Okay. All right, so this is that form I was telling you about, all right? That we're going to fill out. Has he ever used a weapon against you? >> No. >> I'm going to use this case right here, all right? I don't want to use that one, all right? Has he ever threatened you with a weapon? >> No. >> Does he have a gun or can he get one easily? >> He can get one easily. >> Has he threatened to kill you or your children? >> Uh about a fight a while back and I was like I was I had postpartum depression, so I was talking like I was going to something and I was like talking about how they'd be better off without me and about like killing myself or something and he said that if I kill myself then he's going to kill himself and her. >> [snorts] >> I don't know if that counts or not. >> You good? >> Yeah, I'm good, sir. Yeah, thank you. >> Good luck to you. Do you think that he might try to kill you? >> No. >> Has he ever tried to kill himself? >> Not recently that I know of. I don't know. >> Well, ever? >> At some point in his life, uh I mean, he's talked about it before I even knew him, yeah. >> Has he ever tried to choke you? >> No. >> Does he follow or spy on you or leave threatening messages? >> I mean, we don't really go anywhere, but I mean, he does like to go through like my entire phone and if I'm doing something that he's not aware of, he gets pretty mad. He has to know like every single thing that I do at every moment, but that's about it. >> Is he violently or constantly jealous or does he control most of your daily activities? >> Yes. >> Has he forced you to have sex when you did not wish to do so? >> Uh there's sometimes that I've said it hurt or that I didn't want to and he'd beg me and I'd allow him to. I don't really know if that counts or not. >> If you didn't want to, but >> I didn't really want to, but he'd beg me and tell him okay I'll do it. >> Have you left him or separated after living together or being married? >> Uh yes, I went to my mom's house when one of her during one of her fights. That's when I tried to leave, but then I ran out of stuff for the babies and he wouldn't let me out of the house. >> Is he unemployed? >> Yes. I don't know if he has a contract or working for his mom, but it's not really real. I mean, he he helps clean up sometimes, but she just gives him money. He's kind of a spoiled baby child. He is the only child. He He had a brother, but his brother's dead. >> Okay. Do you have a child that he knows is not his? Do you have a child that he knows is not his? >> Yeah, him. >> Okay. >> But he I was pregnant and already done had him before we got together. >> Have your concerns of his behavior increased in the past few months? >> Yes. >> Are you concerned about his history with drugs or alcohol? >> Yes. >> Is there anything else that worries you about your safety? >> No, not really. I don't think I could have worried about any of them on the streets, but >> [snorts] >> I'm just going to put your name on this. Can you spell your first name for me? >> C H Y A N N E >> C H Y A N N E >> Yes. >> Last name? >> Yoders Y O D E R S and hyphen H A R R I But >> Harris? >> Yes, but if you guys look for me in the system in the system or something, it might be under either or or both. >> Okay. >> It's a very big complication with my name. >> I got you. >> [snorts] >> Today's the 7th. Okay. Buddy. >> Hi. >> Hi. Yeah. Just want to see if they're out here real quick. >> Why? Uh only What? >> Okay. So, do you have anybody that could come and get you? >> That's the issue. Hello. >> No other family other than your brother? >> I mean, my mom and my stepdad, but they don't have a car. >> Okay. Do you have car seats for them? >> She's sitting in her car >> Well, she's in hers. >> This is next to her. >> Do you have access to it where you could get it? >> I don't know. Not not really. I mean, if I go ask his parents, maybe. >> Okay. So, I mean, if you're really wanting to get out of here, I can give you a courtesy transport to your brother's in Westover. But, we got to get It's it's a lot easier if it was just you. We got two children that I we have to get the car seats into a cruiser and all that. >> I mean, he's got an infant car seat, too. He just doesn't like sitting in it anymore, so he just sits in a in a regular car seat. Um because his like I don't know. He just is too close, but um he still sits in it sometimes because like I don't know. In some vehicles, there isn't space. Like if like his dad has a Jeep and he fits in it like two big car seats and her car seat in there together, so we still put him in the infant car seat. But, anyway, that car seat is still here and it's much easier to find it. >> Well, let's go let's go that route, then. That way you don't have to go over to the his parents house and I don't know what the relationship is there, but if they find out that their son's getting arrested for domestic battery, then they might have another issue, so if you just want to grab some you know, items just to get you through with them and and all that. Um I'm not saying like taking multiple suitcases and stuff, just basic necessities. >> Beautiful, too, anyway. >> Yeah. >> Yeah, I know. >> Cuz there's not a whole lot of room in a cruiser, but >> formula and water. >> Okay. >> And probably their identification and >> Yeah. Well, I'll give you some time to go ahead and do that. Um is there a I'm parked up here. Is there an easier way to come down here with the cruiser? That way you guys don't have to walk through this all the snow. >> Probably not. We're going to have to go through it. >> Okay. >> Um because if you come down this way, you're not going to be able to get back up, not in this snow. >> Okay. All right. I'll give you some time to get that stuff together. >> I'll walk her around. Thank you, ma'am. Thank you. >> [snorts] >> Ma'am, I'll be right back. All right? I'LL BE RIGHT BACK. HELLO. IS THIS UH 1464? Looking for Missy Odder's, Harris Odder's. Got Can you step out here and talk to me, bud? >> What? >> So uh what Let's grab you some shoes. I'm going to pull you outside so I can talk to you. Come on. Put those guys on. What's uh what's going on today, man? >> Uh how did it start or what's >> What what was that again, yes? >> Just why are we out here? >> up here. Don't move. Who told you? >> She did. >> She did. >> Yeah. >> There was screaming at each other. >> Okay. >> I guess. >> Okay. What's I mean, what's going on, man? Like is What are you What are you guys fighting about? >> It started uh we were playing games and I called I asked her if we could go over there and play a board game with my mom. And you know, she didn't say yes or no. I'll give her that. She said maybe. And uh I asked her and said, "Okay. All right, what Which one do you want to play?" And we wanted to play the pirate dice game. And uh so I called [snorts] my mom, asked her if she wanted to play. She said, "Sure." And then uh you know, the time came where we were going to all go. She said she didn't want to. So, I called my mom and told her she changed her mind. She doesn't want to. And she called me a [ __ ] [ __ ] And and I was like I I I all I did was tell her what you just said. I don't And I was like, "Well, why are you calling me an [ __ ] I just Why How am I being an [ __ ] right now?" And then she put her headphones on to, you know, drown me out. Purposely ignore me. So, I took her headphones off. And she's still, "I'm busy. I'm busy. I can't talk to you." I was like, "Well, why'd you start a conversation if you're not going to talk to me?" And then still same ignore me. So, I was like, "All right, you want to see an asshole?" I'm going to turn the Xbox off on her. And then it was same old yelling, "I'm going to [ __ ] leave. I'm going to [ __ ] leave." And I said, "Okay, fine. Leave." Whatever. And she said, "I'm going to [ __ ] call the cops. I'm going to tell them you raped me." And all this all this other stuff. We scream. We fight. Sure. I mean, I didn't I don't know if she's going to say I did, but I didn't put my hands on her. I mean, this isn't the first girl we We're not good for each other. That is very clear. And we do need to end it. And I repeatedly have been trying to make that peaceful. >> Do you have your wallet on you? Your ID? >> Yeah. >> And so, did she hit you during this or anything or Did she come at you? Throw something at you? >> We got in each other's faces. And she I I I think it was an accident, but she she swiped at me. >> Did she get you? That's just swinging a miss. All right. >> I'm on probation. I'm I'm a sex offender and I'm on extended release right now. >> I got you. All right. How long you been out for? >> Almost 2 years. >> You've been keeping up and keeping up with registration and all that? >> Mhm. >> All right. >> I got an interface. I I don't I don't think I don't >> All right. >> She's going to say some crazy [ __ ] and I promise like I I don't know what she's going to say. I don't I try to talk to her. I really do. I try. I try so [ __ ] hard to make it an easy conversation. She knows what to say, how to press my buttons, how to get me to start screaming. She calls me an [ __ ] every day, all day. I've never I've never laid my hands on her. I've never done anything She I mean she's going to say that I held her phone for 5 minutes cuz I wanted her to talk to me. That's That's the worst thing I did. >> Was that while she was trying to call 911? >> I don't know. I didn't even She She literally right before you guys knocked the door, [snorts] she swore up and down she didn't. >> Okay. All right. Is that your child in there as well? Do you have that with him with her? >> The baby is mine. >> All right. So, how'd she How'd she take a swipe at you? Did you drop the phone and all that? Listen, man. I'm just trying to get a full picture of everything. >> want her to get in trouble. I don't I don't >> Listen, I got you, man. I really do, but we need to get everything here together so we can see what exactly is going on. I just need you to be truthful with me about all this. And forthcoming with information. So, what you Y'all were just screaming at each other after you took her headphones off? Just in each other's faces, yelling back and forth and >> Yeah. >> Like what she just swiped at you and missed? Okay. All right. So, let me ask this. What's What's she going to tell us? What do you What do you What do you What do you think reasonably that you can to tell us? >> The things that she was screaming in my face is like that I'm abusive, that I've kidnapped her, that I hold her phone hostage, [snorts] that I've raped her. I mean, she was saying all kinds of crazy [ __ ] that's not true. >> Mhm. >> I don't like that that I I mean, I hope not, but I mean, that's that's the worst. >> All right, true. Is this uh your place or hers? >> This is my Well, it's Technically, it's my parents. >> Okay. >> I rent from them. >> Okay. >> They're next door. >> All right, so they that house? >> Yeah. >> All right. >> Do you want to go get a jacket? >> Yeah, let's go inside and get your jacket. It's [ __ ] cold out here. Just uh we're going to We just have to come back out, okay? >> Yeah. >> You got one by the door or something? >> Yeah. >> You got to get a jacket. >> [snorts] >> Mom's switching off with me. >> [snorts] >> We'll be over in a minute, Bun Bun. >> [snorts] >> So, do you want me Is this your place or is this place? >> This is Mom's place. >> Mom's place. [snorts] >> We just rented off of her. >> Okay. >> But separate you have separate leases. I got >> How long have you been here? >> Uh >> [snorts] >> a year and almost 4 months, even though we fight. He try He threatens to kick me out, even though we have two separate leases, and there is a lease made, so he can't just kick me out. >> Ma'am, I'm Deputy Watkins. I've I've been talking to him for a while. I just want to get your side of everything. Can you Can you tell us what happened? Or tell me what happened? I know you've already been talking to Deputy Summers. >> [snorts] >> We were fighting cuz I was on the game. I was on my on my Xbox playing a game with my brother and I had a headset on and everything. I wasn't hearing him and then I wasn't paying attention and then I uh I said I did and he was talking about going over to his mom's house to play a game and I said I didn't I said maybe, I don't know, but I didn't really want to take the little one out in the snow that's up like this high. But then he he got mad about that but then he uh Well, cuz I said maybe he was talking crap to his mom about the fact that like you know how she is, blah blah blah, she don't want to do nothing, whatever. But then um he uh after that and I said no he about about that, he said that I it was always going to be a no and called her and said of course she'd say no, she don't want to do nothing. And [laughter] then he uh They got off the call and then he just started getting mad like yelling at me and then his kids were yelling at me because I'm mean and whatever else. And then he's just breathing in my face and then I ended up I'm like getting pushed into the window and he's like putting his whole face head in it. He's going like this, pointing at me or pushing up against my chest really hard when he's saying like he's just screaming in my face. >> She said he had her pushed her up through here. She doesn't have any marks but I don't know if >> when he first pushed me but he was also like going like this when he's screaming in my face. >> Scratch right there. Is that from this? Scratch kind of in your elbow? >> It wasn't there earlier. But I don't know if it's from this or not. I'm not going to lie. >> That's what Can I take a little closer look at it if you care? Like like your arm there. I'm going to get this a little bit closer. Thank you. [snorts] Yeah, that's just That's definitely fresh. There's a little tiny bit of skin break there. >> Um I can uh Do you guys have to follow me? >> There's no one else here, you guys can sit, right? >> No. >> So, it's consistent. I can't tell who took the first physical jab, but they were in a face-to-face each other. He said she did it like that. She said she hit him in the face because he had her against the the window and was trying to get him get him off of her. She said she hit him in the face. >> Okay. >> Oh, yeah, I forgot that part. >> She also said he's on drugs. He abuses her. She doesn't know if he's under the influence of anything right now. >> Mhm. >> Um but she's been trying to get out of here and he won't let her leave. >> Okay. How's it How's he not letting you leave? >> He just won't let me leave. He keeps standing in my way and then he keeps like >> [snorts] >> threatening me and he says that we got to fix this and then I never cared about him and I just used him and a whole bunch of other stuff. >> Is Is he threatening you with like, you know, like threats of bodily harm or just like threats of like, "Well, if you leave, we're done." that kind of thing? >> Something like that and then he's like he's not really harming me. I mean, he threatens to take her away from me and stuff. And he says that I'll take that he'll try to take him away from me, too, because I don't take care of him even though I do. >> This is his daughter, it's not his son. >> Yeah. I You said he has kids, too? >> Yeah, he's got uh >> Where are they at now? >> Next door. It's Phoenix and Payton. >> Is that his parents? >> You said? >> They weren't. >> Mhm. >> Were they here during this? >> No. Well, the kids were, not his mom. Phoenix and Payton were here during this. >> How old are they? >> Uh Phoenix is 6 and Payton's 2. >> Okay. He took them over there after you guys were fighting or what? >> Yes, because Phoenix Payton was saying that I was being mean to his dad and Phoenix was saying I'm going to smack him in the face and whatever else. >> [snorts] >> Okay. >> [clears throat] >> So, his mom >> Would you just yourself, you don't need to show me unless you have something there. Would you mind just looking down at your chest, make sure there's not like a red mark in the middle of your chest or something? >> He peed in the spot. >> Is there back bedrooms out here or something? >> Um there's a bathroom and a baby's bedrooms. >> Okay, could we talk to her maybe like >> Yeah, we can do that. We're we're going to step over with you. It's too cold outside to keep somebody out. >> You're wanting to leave, but you said you don't really have anywhere to go. >> Not not really. Not other than my brothers, but I don't even have Even if they had the space, I mean they said I can go there, but I mean my friend brother's in the living room. My older brother whose apartment this is is in his bedroom. So, I'll be in the living room with two babies with another one of my brothers. Which is okay for short time, but I wouldn't even have a way there even if I did. >> We can we can help with that. It's probably not the best idea that you stay here with him. Now, I asked you when he was doing this to you when he was pushing you, had his finger in your in your face, if at any time were you did you fear for your safety or fear Did you feel like you were in danger? You said no. Is that [clears throat] still the case? >> Yeah, kind of. Yeah, I don't know. I mean not really. Sometimes he frightens me whenever he does stuff like that, but that's because I have a a lot of trauma. >> Is this something that happens quite often? >> What? >> and the arguments. >> Oh, yeah. >> Have you ever tried to get away before? >> Um >> And he doesn't He doesn't allow >> Yeah, he never really lets me leave. I left once, but then he wouldn't really let me have my stuff, so I had to come back. And so we said that we would try to work things out cuz they didn't know I wasn't able to have my stuff. Like I needed I ran out of stuff for them. And all of it was here. >> Okay. >> Bradley, can we not play with the cord, please? >> No. >> So, the quickest thing is on you. Even like you said he pushed you up against the the window a couple times. >> Yeah, I mean he was like >> Possibly left a mark here. You said he did up here. Yeah, I didn't see any marks on your shoulders. >> Yeah, I didn't I don't see any either. I mean there's a mark right here from when he was going like this because like when he was doing it in my face, he also >> swing at you or did he just grab you and just drive it in the chest? >> Yeah, but I don't see any other ones other than that. >> So, we're going to leave it at that then. >> Yep. >> And possibly assault if you're if you're for safety and and did he make any kind of comments like he was going to hurt you? >> Hi. Hello. No, just that he hates me. But that's not really a crime. >> Telling someone that he hated on his mom. There's nothing criminal about that, but if he said it I'm going to do this to you. I'm going to beat you up. I'm going to hurt you. I'm going to kill you. Anything like that. Did he make any of those comments to her during the argument? >> No. >> [snorts] >> Did he say like if if you leave, what is he going to do with you? Like he obviously he said you said he didn't want you to leave. Did he make any comments about why he didn't want you to leave? >> No. >> [snorts] >> Probably because of her and the fact that he uh he doesn't want to go back to jail. >> He's on probation right now. He's registered. But was he's on extended leave right now or whatever whatever it's called? >> I don't I don't know. All I only know is that he has a probation officer. He used to have to go to Clarksburg for these meetings with this parole officer, but now he doesn't and now he sees a probation officer or whatever. I don't I don't know. >> Yeah, I I you're good. I'm going to grab a D line for one, too. >> Okay. Let's um If you want, I'll transport them back. I'll pull my car around. I can actually actually let me go out, grab them, I'll put you on D line. We'll get their names and necessary info. >> Yeah, put me down in 4 minutes. >> I'll I'll wait 5 minutes or so I can get this moving. All right. Hey man, I just want to ask you one more thing about all this. So, you told me y'all were up in each other's face screaming this and that. Anything else happening during that? Where where where did that like occur? Where was that happening? >> Right here. >> Okay. All right. So, listen, she's got some marks on her chest and some a scratch on her arm. How do you think How do you think that happened? >> Are you serious? >> Yeah, it was an accident. >> There's no possible way I did that. >> Okay. Did you drag Did you drag your finger on her chest while you were talking just heat of the moment? That kind of thing, something like that? >> I guess it's possible. I don't think I really don't think so, though. >> In the past when you've gotten mad, have you like saw saw red and not had a good recollection of what was happening? Just like after the fact. >> What do you mean? >> Well, you know, it's an expression, but somebody gets real mad, fights somebody, they say, "Oh, I saw red. I don't even remember what happened." >> I usually you the bulk of it? >> Okay. >> They didn't stop. They were just going to classify. They thought the four ways wrong with the vehicle. >> All right. I want you to face this way for me. I'm going to face that way for me. I'm going to detain you for right now. You see your probation officer up here or down in Clarksburg? >> Yeah. >> Okay. Who's your PO? McCoy? >> Yeah. >> All right. Well, we'll get a message out to him. I'm going to lift them out of the car. I'm going to walk you to the patrol car and then I'll put you in. All right. So, I'm Robert. I uh got him detained in the patrol car. I'm going to go pull my car around. >> Going to be off the northbound ramp at the 150 there. >> Yeah, I'm just I'm going to come by. Hand off the deal deal out, okay? >> 331 out. REMEMBER THAT CHILD CUSTODY DISPUTE IN ONE PUBLIC SERVICE. >> She's in the station originally. And possibly this is Summers' case. So, I'm going to get confirmation beforehand before I formally do anything, but I was stationed that that it was the case. Do you have an ankle monitor or anything? >> Yes. >> Okay. All right. So, for right now, I am hearing Deputy Summers correctly, uh you're going to be under arrest for domestic battery. So, I'm going to take you out to my cruiser. I pulled up so you're not going to have to walk through the snow, but have you put your boots on? Is that your phone? You got it. All right. >> Whose phone is that? Another female. That one is the kids. >> Okay. >> Yeah, you transport the weed wagon and >> Okay. All right, man. I'm going to take your boots off. Then I'm going to get into your property and just put it in a bag for you so nothing gets lost in the back of the cruiser. All right. It's going to go on the passenger side of that. >> [snorts] >> Just stand back from that. I don't want to put you in the road any more than we have to. Stand out here and face that way for me. Anything in your pockets is going to poke you so just be mindful of that. >> I need cleaning supplies. >> Okay. Are you going to need the car keys? >> Oh, those are my parents. Yeah. >> All right, I'll clean those off for you. YOU'RE GOOD TO GO. ARE YOU GOING TO NEED ANY OF THESE KEYS? >> HEY GEORGE. IF YOU'RE going back down, would you mind taking those car keys? Those are his uh parents' car keys. >> Yeah, I'll plan on it if I can. >> All right. I appreciate you. All right. I'm going to take you around to the front side. That's good. Sir. Yeah, he told me this was uh this was Yella's house right here. Yeah, I can't talk too much about it cuz it's not my case and he hasn't been arraigned yet or anything, but he is going to be going down to our station due to >> Due to what? >> an incident that occurred here. That's really all I can say right now, but >> They are all grown up. >> This is going to be Deputy Summers' case. That is Sergeant Broker. Uh probably talk to him when he comes out. He can fill you in. >> Okay. >> Yeah, I just I don't want to give out details about what's not my case. >> All right. All right. I'll just She has to leave. I'm going to send her a message here in a little bit. She's got to be gone by 5:00 p.m. tomorrow. She's caused too much trouble. >> She's on the lease with you right now. So, she's been living there? >> Yeah, but there's no lease. Not at least not with her on it. >> I got you. So, West Virginia, she's been living there for any amount of time, which means she clearly is, you have to formally evict her if she doesn't want to go. >> talk to him. All right. Just going going over eviction. >> Okay.
