I mean, it was weird because when I fell out of the garage, like I fell onto the ground and I'm kind of like I'm kind of like this and I have I'm trying to get him off of me and I have the gun. I had my gun pulled. I didn't point it at him. I had it pulled and he kept coming towards me and that's when I pointed it at the grass and fired one just to show him like and he's pushing me, you know, backwards and trying to pull the gun out of my hand and that's when I pulled the gun out and you know, I'm like this and he's on top of me and that's when like the gun was almost next to my ear cuz I'm like this >> I think there might have been things that happened differently than what you're telling me cuz I mean we've had several witnesses tell us a slightly different story and a couple of the wit- their stories all match. >> Spoiler details are in the video description and the full results of all charges in the case are laid out at the end of the video. >> Okay, realizing that you have these rights, are you now willing to answer questions or make a statement? >> Yes. >> Okay. >> Um >> Sorry. Walk me through it. I mean, I wasn't here. I want to hear what you said what what happened. >> Well, it totally [ __ ] threw me for a loop. Like I had just went to work. So, it's our week. >> You mind if I take notes just >> Yeah, yeah, yeah. And uh me and him had a little altercation in the morning. >> Who's him? >> Uh his name is Andrew. I don't know his last name. I just know his first name is Andrew. >> What's Andrew look like? I'm sorry. I didn't help identify him. >> Black male, 6'4", maybe 200-210 lbs. >> His name's Andrew? >> Yeah. >> How old is he? >> Um I think he's 27. >> 27? >> Yeah. >> 27 national geographic for a maybe 27. >> That's what she told me, my roommate. That's >> Oh, okay. >> the guy that she's talking to. >> What's your roommate's name? >> Samantha. >> Samantha, do you know her last name? >> Yeah, Trepcheck. >> No, Jesus. How do you >> Yeah, it's t r e p c z y k. >> Okay. And she said she's your roommate? >> Yeah. Yeah, she rents out the basement from me, so she stays in the basement. >> Oh, she rent You own the house? >> No, I rent it from a guy that I work with. And then she rents out the basement from me. >> And then you said she's friends with Andrew or >> Um they've been like on and off talking, on and off. >> They they been talking or >> Yeah, for like the last 2 months. Romantically involved, whatever. >> Okay. So anyway, yeah, what were you saying? >> So this morning because I already told her previously like this guy he likes to drink and drive. He's really aggressive. He's got a attitude. So I told her like I don't want this guy around the house. Like it's not good for the house. They fight and argue all the time and I'm like I don't want to get brought into this. >> You told her that this morning? >> I've told her that multiple times previously before today. >> And then today you did as well. >> Yeah. >> Okay. >> And then even like yesterday I told her like I don't want this guy at the house anymore. And she said that she had him come over at 1:00 in the morning cuz he was drunk and driving his car and she didn't want him to go home. So when I woke up, I was going to my brother's house to bring my motorcycle trailer over there and do his oil change and everything to get ready for the trip. So I I'm getting ready to leave and then I notice his car is parked in my driveway blocking me in. So I just go in the living room and I kind of hit the floor like, "Yo, you know?" And then I go in the garage cuz I'm getting my stuff ready and then she comes out and she's like, "I only told him to come over because he was drunk." You know, I didn't want him driving home. And I told her like like I don't want him here. Like if you don't want to be here either, like you got to make that choice, but I told you that we have rules. We're not supposed to have random people and outsiders like in the house. >> Mhm. >> And uh she said that she understood, but he was drunk. So then she walks back in the house. I'm in the garage. And then he comes out the door and he asked me to He was like, "What the [ __ ] your problem?" And I was like, "Bro, like don't talk to me. Like don't talk to me." And he was like, "No, what the [ __ ] your problem?" He was like he's stomping on the floor like a big baby this and that. And I was like, "Bro, you are at my house right now talking to me." I was like, "You need to leave." I told her like the issue isn't between me and you. It's between me and her because you're not supposed to be here. And he started yelling at me like, "Ain't this her house too?" This and that. And I was like, "Yeah, but we ain't supposed to have outside people. Rules are rules." And uh he started getting real aggressive and kind of He started calling me names, calling me 40-year-old virgin and a bunch of weird stuff cuz he was just trying to like >> Mhm. >> like get to me. And I told him like like this ain't between us. Like you have to leave. Like you have to go. This is my property. You have to go. Like you're not welcome. And then he asked me if I wanted to fight him. And I said, "No, I'm not trying to fight you." This guy's 6'4" over 200 lb. Like I'm not a big guy, you know? And he towers over me. So I told him like, "No, I'm not trying to fight you." And that's when he started coming towards me this morning. And I I always have a pistol I carry pistol. I have one in my house. And you know, so I pulled my gun out and I told him like like this is not a game, bro. Like I'm not playing. Like you are not coming to my house and trying to physically assault me. And that was this morning. So all this happens, I go to my brother's, I do the oil change, I come home, I go to work. >> Where you work at? >> At Jimmy John's right on like four blocks from my house right there on Silver Spring. >> Oh. So so sorry. You argued with this morning. >> Mhm. >> Okay, and then he goes home or he leaves or >> They both left together. She said that >> out and you guys leave together? >> They left together. Yeah, Andrew and Samantha. >> Hey, sorry. >> Yeah, yeah, yeah. They left together because she was going to hang out with family. I don't know what he had planned, but I know she was going to hang out with family that was in town for the day. >> All right, so hold on one second. Together. >> Yeah. >> So, then you go to your brother's. What time about? >> That I went to my brother's to maybe 9:30. >> a.m. >> 10:00 this morning, yeah. >> Where does he live? >> Who? >> Where does he live? >> Nobody knows. >> No, your brother. Sorry, my bad. >> Oh, um he lives in Greenfield. He's off like 47th and Forest Home. >> Okay. And then after that you work. When do you work at on Silver Spring? When do you work from? >> I'm salary. So, I always work. >> No, like what hours today did you work? >> Oh, I went in there probably 6:30 or 7:00, something like that I went in there. >> p.m. >> Yep. >> Till So, you work from 6:30 p.m. to >> I was only there for maybe like an hour. >> Oh. >> Yeah, I just had to stop in. I checked on my night manager cuz we didn't have a driver tonight. I had some scheduling stuff to update and I had to post my schedule, so I did all that today. >> So, you worked from 6:30 to 7:30 p.m. >> About today. Yeah, cuz today's my day off, but I'm >> Yeah, I'm general manager, so >> Oh, okay. >> the store, so if they call I'm there, you know. >> Mhm. >> So, it's a real pain. And that's when everything really [ __ ] took the turn for the night. >> So, you got home at >> Everything starts getting fuzzy cuz it's like everything happened so fast and crazy. Like I know the sun was still up. It was just setting, so it was maybe 8:00. >> You got home from work around 8:00, we'll say. >> Yeah, 7:30, maybe 8:00. >> The sun was just setting. >> Yeah. yeah, >> I don't know exact times. But uh I was working in the garage cuz I was moving my bikes around cuz I got rid of my trailer today. And uh my roommate comes in the house and she tells me she's like "You got to fix this. You got to squash this." Like because of the little argument that me and you had in the morning. >> So Samantha meets you in the garage to say you got to fix this. >> This was in passing between the living room and bathroom cuz I was going from the living room back to the garage. >> Oh, you were working in the garage, come in for whatever. >> Grab a cigarette. >> And then she mentions you got to fix it. >> Yeah. >> Between you and >> Angeline. >> Angeline, I got you, okay. >> And then she tells me that she's leaving and that he's showing up and I tell her like like calm down, like I'm not sitting here alone with this guy, you know, I don't know this guy. So then I walk back through the house cuz she was walking around to the basement. You know, so I go back to the garage and when I go out to the garage uh he's already in the driveway and she went out the side door. >> She said she said he was coming over for what reason? >> To talk to me. >> To talk to you about >> the altercation in the morning. >> Okay. You said something about leaving? >> She said that she was going to leave and that he was going to come over and I told her like >> But just for the night? >> No, to talk to me. >> You said she's going to leave, I'm sorry. >> Yeah, yeah, she said she was going to leave and this random dude was going to come talk to me. >> Okay, I got you. >> And I was like >> Mhm. >> Like if he's here, you need to be here, like you're not leaving me here with this dude to talk, you know. I don't know what he exactly has planned, you know. >> Mhm. >> So when she said that, like I'm going back around to the garage and like I said, he was outside she met him out there. And uh I come into the garage and that's when he's like uh you know, what the [ __ ] was that earlier? And I told him like I told you I ain't got no problems with you. It's between me and her. And she don't follow the rules. And if she don't follow the rules like me and her have problems, I don't have problems with you. And he says, I think you do have a problem with me. And I told him like, I don't have a problem with you. And that's when he started coming closer to me. And I'm still in the garage because I was working in the garage like all afternoon. And I was still in the garage and that's when he tells me that like, I do have a problem with him. And as I I sensed him, you know, he was coming closer to me. I sensed like he was going to do something. And that's when I look over my motorcycles are because they're right behind me. And I look and I come back and that's when he's grabbing me. And when he grabbed me, he swung and I ducked down and that's when he started punching me in the head. And then uh When he was punching me in the head, that's when I reached for my weapon, you know, cuz obviously at this time he's already pounding on the back of my head. And I reached for the gun. And that's when I shot the first couple times I was still in the garage. And even after I shot the two three times, that's when he still wound up pulling me out of the garage and onto the ground outside and he was trying to take the gun out of my hands. >> So, he's punching the head with like both hands or one hand or how's that working? >> I It's hard to remember cuz like he's a big dude. He was hitting me hard as [ __ ] But all the all the damage is on this side of my head. So, I think he was hitting me right-handed. >> So, he on the left. >> Yeah. Yeah, left head and then in my ear, right above my ear and stuff like that. So, when he was hitting me on this side, that's when I was ducked down and I reached and I grabbed the pistol out of my waistband. >> Mhm. >> And uh you know, I stuck it straight to his abdomen and I pulled the trigger and he kept hitting me. And that's when we wound up on the floor and he >> times do you think you said in the abdomen? How many times do you think you shot him? >> Um, right away I know I fired like three rounds, but he was punching me, so I think one of them missed in the garage. But it was probably two or three shots and then we wound up on the ground outside. >> How did that happen? >> Uh, he pulled me cuz I flew back onto the motorcycles and he was punching me and then that's when I reached down. I grabbed the pistol out and then, yeah, he still had me. He was on top of me the whole time. Like I was more like this and he was punching me in the head. So, when I grabbed it I was already down and then we ended up on the ground outside of the garage. And then when we were outside of the garage on the ground, he was trying to take the gun out of my hands. And, you know, with every little might I had in me, you know, I pulled that gun back and he still wouldn't let go of me. So, that's when I put it back to his chest and I I probably pulled the trigger three more times until he stopped. But even when when he stopped like my back was covered in blood because he was still on top of me even at that point. Because at the end I was almost in the fetal position. And, you know, I shot up three times he was on top of me. >> Explain that. >> So, it's It's tough to explain, but like, you know, he was obviously still trying to hit me and strike me and he was on top of me hitting me. >> How did that cuz I thought you said he was in the front of you like going like this? >> Yeah, and then we wound up outside of the garage onto the ground outside of the garage, you know? >> So, he pulled you in outside of the driveway. >> Yeah. >> And then how did you end up on top of you on your back? >> I mean, he was on me the whole time. I couldn't get away from him. >> Okay. >> Like, he had my clothes. He had my shirt. He had me by the collar. Like, I had I don't know. They took pictures, but I had like scratches and stuff from him pulling on me. >> have Do you still have them? >> I should, yeah. Like, it just happened a couple hours ago. But, yeah, you know, I had two shirts on, a long sleeve and a short sleeve, and he just had me by my collar and everything the whole time cuz there was never any moment Like, if there was a moment where we would have separated, I would have got the [ __ ] out of there, you know? But, there was no moment that he ever let go of me until he stopped. stopped. >> Mhm. >> You know? >> Um So, you guys got pulled out of the into the the driveway, and he's like still punching you? >> Yeah. Yeah, and he was trying to wrestle the gun away from me at that time. >> So, was he like bear hugging you? Is that how he was on your back or on your back? >> Yeah. >> I mean, it was weird because when I fell out of the garage, like, I fell onto the ground and I'm kind of like I'm kind of like this and I have I'm trying to get him off of me and I have the gun. And he's pushing me, you know, backwards and trying to pull the gun out of my hand, and that's when I pulled the gun out. And you know, I'm like this and he's on top of me, and that's when like the gun was almost next to my ear cuz I'm like this and you know, I shot the couple more times. >> Okay. So, a total of maybe 60 shots? >> Yeah, it's hard to remember cuz everything happened so fast, but >> I mean, but roughly I'd say there was >> six or seven shots, yeah. >> What kind of gun was it? >> It's a 9-mm Taurus G2C. >> Those are nice. Is it yours or did you buy it? >> Yeah, I bought it from Dunham's. >> Right, which one? >> Uh 27th Street. >> On the main guys at or something on the south side. >> It's by the Walmart down there Franklin. >> Okay. How long ago? >> Well, I've had that for years. Probably yeah, 4 5 years at least. I've had that gun for a while. >> Okay. Um So, you're saying he's rolling around. Is and so you're and so that's his So, his blood is on you do you think? >> Yeah. I don't know. >> Well, that is probably >> Yeah, like my knee and stuff. Like that's none of mine. >> If you don't mind, what I'd like to do um I I might have some more questions here in a second, but >> Yes. >> Uh obviously we have your clothes right now cuz of the blood, right? I'd like to >> I mean I >> I want that someone's going to check to see if the blood on there is his versus yours, right? >> Mhm. >> If you're good with it, what I'd like to do is it's called a buccal swab where we rub a Q-tip inside your mouth so we can see if the DNA in the blood is yours or his. Does that make sense? >> Mhm. >> Would you care to close for you do that? >> Like I >> Like I'm grab I want to grab your DNA. What I'm going to use it for is to see if the blood on the T-shirt to make sure it is his or yours. >> The blood that was on my back? >> Yeah. You good with that? >> Yeah. >> Okay. Um >> I mean yeah, cuz I have no lacerations, nothing on my back. >> I see some on your neck here. >> Yeah. >> So, I'm trying to differentiate the blood that's his versus the blood that's yours. Does that make sense? If you're good with that. >> Yeah. >> And it's just a Q-tip. I'm not Some people freak out. I'm not like taking your blood. >> Right. >> I'm just taking your spit if that makes sense. >> Yeah. >> Um So, that is so you have the G2C. Okay. So, was it loaded like all the way in the magazine? How many rounds were in it? >> Um I I don't know the rounds in the magazine because it was a extended magazine. >> It was extended? >> Um but I don't know how many I kept in there because it was just kind of like a carry gun. You know, I keep it full enough, but I don't really care if it's full. Um but yeah, what I had, you know, at least like eight to 10 rounds in it. >> So, you didn't shoot them all is what I'm getting at. Is >> I don't think so. >> Okay. >> I don't think so. >> Um How well do you know this guy? Like how many times have you seen him coming around? >> I've only seen him maybe three, four times. >> Only seen him. How long has Sheila lived with you? >> Only since February 16th. So, it's been >> Also, only a few months. >> Yeah, only like going on 3 months, yeah. >> So, she moved in February 16th? >> Mhm. >> Did you know her before? >> Yeah, I've known her since I was like 20 years old. >> Were you guys just friends? >> Yeah, I've known her for a long time, yeah. >> Yeah, were you guys dating at one point or were you guys just friends? >> I mean, we've been just friends. We have been involved like more than friends, but never like dating or nothing like that, no. >> Um I want to keep I want to keep asking some more questions in a second, but I'm going to try to get you out of here as soon as I can after I take your DNA, but >> You want to do it >> All this All I'm doing here, all this form says is that I'm taking your DNA. And like I said, whatever you want to use it for is to show cuz I think there actually might be some blood on this shirt that might be yours, like up in the front here. >> Mhm. >> Um I'm not having you get naked now, but I'm just by looking I can see like right here might be your blood. >> Mhm. Yeah, I'm >> I'm just going to take your word on the other parts for now. Um I don't want to be stripped, but so I'm I'm going to differentiate what the blood like where it's yours and where it's his. That's the the purpose of that. >> Yeah, cuz as far as I know >> Read Read through that. I don't want you to think I'm playing tricks, but then all you have to do is sign right here, and I'll just I I can't swab your mouth. It's kind of anti-climactic. >> And today is the 19th. >> Today is the 19th. >> I'm going to write it down. >> Wait, 219? Yeah, it is. >> How long are you guys going to be gone? >> Uh 4 days. Leave Friday, come back Monday. >> You doing the ferry back? >> No, we're actually going through Gary and Chicago and all that. Everybody says take a the ferry back, but I'm like >> [laughter] >> I'm like I want >> How did I know? >> I want to go around and see the whole experience. >> Sure. >> But yeah, everybody yeah, they're like just hop the ferry back. >> Problem is and I remember this when I did it, it's the you can either do the Manitowoc ferry, which is a lot cheaper. But then it you cut like you said, it cuts a lot of the trip off. >> Yo. >> You can do the Milwaukee one, but they charge you like 600 [ __ ] bucks. >> Yeah. >> You're you're spending money. >> Cuz you got to pay for the you and the bike. So it's like yeah, two people, two bikes, yeah. >> Yeah, it ain't cheap. >> I'm like 600 bucks, but it don't even cost me that in gas to go all the way around, as you know. >> Yeah. I'll just park quick and then check it so we're free and All right. I don't remember what it was. All right, was it the Honda you're going to ride in your garage? >> Yeah, the the 1100, the big Shadow. That's the one. Cuz I got a 600, 1100, and then I got that little tiny bike. But yeah, the 1100's the the mile crusher. Does better on the freeway with the wind and everything like that. >> Sure. >> I got a big Ultra, which is what use for most of my trips, but then a little Royal Enfield just for fun. >> Oh, nice. >> Those are fun. >> Yeah, I used to have a a Royal uh like 535 Continental or something like that. Single cylinder thumper. >> It's exactly that. Mine is not a five, but mine's a just a 350. It's a nice small putter, but it's a single >> super fun, super reliable. I rode one of those for the Meteor 350 for my motorcycle >> motorcycle class. >> Where did you take it? >> Uh 7 Mile Fair. >> Oh, they're using Royals? >> Yeah. >> Huh. Yeah, they got a couple Royal Enfields >> and a couple of Rebels and stuff like that, but yeah, they had a couple of Royals. >> Oh, [ __ ] >> Um so, you've only known him a few or you've seen him three or four times? >> Yeah. >> Okay. Has it been confrontational in the past? >> No. >> No? >> No. >> Okay. >> No, the first time he came over like, you know, we were social. We were in the garage, smoked a cigarette together. We were watching little trivia YouTube stuff like >> So, what switched to make this time different? >> Um like I knew he was an aggressive person just by his nature. I He's a He's big into sports. He plays rugby. So, if you know rugby, that's a pretty physical god damn sport. Um so, I think it was just the fact of me He didn't like me telling him that he couldn't be there. And I told her that he couldn't be there. And I'm like, even after all this, like you have him come back to the house the same day. And I don't know if you talked to her if he if his intention was to come and physically assault me or if his intention was to talk, but when he came, his body language, his demeanor instantly it said like, "I'm not here to talk." And by that time, I'm already >> Tonight. >> Yeah. >> Okay. >> And by that time, I'm already in my garage. He is up to the door. I have motorcycles behind me. And by the time I realize like his demeanor is not I'm here to talk. It was like like [ __ ] like this is really going to [ __ ] happen. And then yeah, as soon as I look look back, he was already grabbing me and just right away I'm like [ __ ] because I knew like he started punching me. I'm seeing bright lights. I'm like there's no telling what this dude's going to do if he actually knocks me out. And then when I had to pull the pistol and I fired it, then he was still trying to grab it and I'm like I'm telling myself in my head if he gets this gun you're dead, you know. So in that in that moment I knew like you know, it's me or him, you know, and I and I hate to be put in this situation like I yes, I carry a gun, but it it's for protection. It's not like I'm out here, you know, driving around with it, you know, [ __ ] shooting [ __ ] up or doing something crazy. You know, I I own the guns for my personal protection and that's what I used it for. But I never thought like even today like I didn't want to be put in that situation. I don't want to have to have that thought of whether like it is this okay for me to use my weapon right now, you know, cuz you always got to have that thought because there's always like certain things like you can't do. Like if someone's breaking in your car outside, you can't just run outside and shoot him. Like you can't do that. You got to call the cops then, you know, you got to deal with it the right way. So it's like even when this stuff is happening, I'm thinking like do I just let this dude sit here and pound on my head, you know? But then I'm thinking like if he knocks me out, like the my roommate, the girl, she ain't going to save me. Like this dude's 6'4, big guy, you know, I'm like she's not going to be able to pull him off of me. >> How tall are you? >> I'm only 5'10. >> 5'10? >> Yeah. I'm not even 6 ft tall. >> 180 190 just looking at you? >> Yeah. Right between there 180, 190. >> Um I get what you're saying. I mean that makes sense. You said you've been carrying for several years, right? >> Yeah, I have been. >> Did you have your CCW? >> I used to. >> You used to? >> Yeah, I used to. It expired, so I don't have it anymore. But that's why the whole reason that's why I said I only carry at my house. You know, my gun doesn't leave my house anymore because I don't have a license. >> When did it expire? >> Uh [ __ ] It's been a couple years. 2022 maybe, 23. >> Wisconsin I take it? >> Yeah, it was a Wisconsin permit, yeah. >> Okay. So, I guess I'd like to go back and talk a little bit more about what happened this morning. Or can you report from some people you talked to that you may have fired a round in the morning, too? >> Yeah, when he was coming towards me, I told him like like you need to stop, you need to go, you need to get in your car. And that's when he was talking about fighting me, and he kept coming towards me, kept coming towards me. >> This is in the morning like at Was it Was it like the 8:00 a.m. or whatever time it was? >> Yeah. >> Okay. >> Yep, yep, yep. And I had the gun I had my gun pulled. I didn't point it at him. I had it pulled and he kept coming towards me, and that's when I pointed it at the grass and fired one just to show him like like this isn't a toy. I'm not [ __ ] playing. Like stop coming towards me. >> Mhm. >> And that's when he turned around, she grabbed him, they got in the car, and they left. But yes, this morning, yeah, I did fire one round into the grass when he was approaching me. >> Was it the grass? Was it the one >> To the left where that dead rose bush is. >> Like the fence line to the shoe store or by your front door? >> Shoe store. >> Shoe store. >> Yeah, yeah, it was the grass there. In the dirt right there, yeah. >> Okay. And was it that same Taurus 9 mm? >> Yes. >> What did he say when you did that? >> He just said I have [ __ ] problems. >> You do? Or he said he Sorry, he said you have problems? >> Yeah, that I have [ __ ] problems. >> Okay. >> And then >> And >> Okay. Um Tell me about these text messages between you and her then. Cuz she was telling us about some messaging back and forth. Or between you and her? >> Between her Sorry, um Samantha >> Samantha, yeah. >> You talking about today? >> Mhm. >> I mean, she was just basically trying to yell at me saying cuz I didn't want to talk to her over text messages. She just kept yelling at me saying like like this whole situation isn't okay and you know, I was in the wrong and this and that. >> What situation? >> Uh the argument this morning. >> Were you guys good up until that point, you and Sam? You and Sam, whatever. >> Yeah, yeah, yeah. No, we've always been like friends, like close friends, like even we go in on dinner together. We'll make dinner and, you know, socialize, eat together, stuff like that. So, we we've been close friends for a long time. >> How'd she meet this guy? What's his name? >> Uh they work at Honda together. >> What Honda? >> Uh Schlossman or something. It's the one on Metro Boulevard. That's all I know. >> Up north past Wonderland? >> Metro Yeah, I believe so. There's like CarMax and stuff. >> Wonderland? >> Yeah, yeah, yeah, that Metro >> What did you say? >> Yeah, Honda, yeah. No, but I didn't text her back much like this morning because she said she was all upset. She's saying that she has to move and I told her like, you know, we'll talk about this later. >> Like move out? >> Yeah, yeah, yeah. She was talking about moving out. >> Okay. >> And I told her like, we'll talk about this later cuz I don't want to uh have you upset when you're with your family and stuff right now. Like, we'll talk about it later. And then I didn't text her back after that. >> Where's her family live? >> Um well, she has a lot of uh family in the UP of Michigan and stuff like that, but these family members I have no idea where they came into town from. I just knew she had family in town. They were at a hotel. >> You all right? >> Yeah, I just got a little bubble there. >> Okay. >> Yeah, they were in town at a hotel and that's all I knew. >> Okay. Um Does she have any guns in the house? >> No. >> No. So, after this fight occurred She has no guns. Um after this fight occurred or argument, sorry. I heard this morning, she texted you saying she's moving out. >> Yeah, she was saying that now she has to find a new place to live. She's moved four times in the last year. And yeah, she was blaming me on her [snorts] having to move. >> And she wants you to move out? >> Because of my actions today. She was saying because of my actions and I told her like like you asked me if I wanted to fight and he kept coming towards me and she said like I must have been inside for that. I didn't see that happen. >> Okay. Do you guys have any cameras on the house? >> No. >> No cameras, okay. Not inside or outside? >> Mhm. >> Okay. Um and how long have you lived there? >> I've been there since same thing, mid-February. >> Oh, you guys both went in together at the same time? >> Yep, yep. Yeah, I moved in like the day before she did. >> Who do you rent it from? >> Um from one of my drivers at Jimmy John's. He is an employee of mine. >> Okay. >> [clears throat] >> What's your guy's name? >> Gholamreza Red Verzenia is his name. >> You want to spell that for me? >> I can't. >> Can you pronounce it slower? >> Uh Gholamreza >> Okay. >> It's like G >> G >> Yeah, G H something, but it ends in R E Z a. >> And then his last name? >> Rad Varzenga. r a d v a r z e n g e h He is Iranian. So it's an Iranian name. >> Okay. I was trying to figure out what that was and I couldn't put my >> Yeah, Iran. >> Okay. And he works at Jimmy John's. >> Yeah, he's a driver. >> And then you Okay, I got it. And I'm assuming he knows Sam lives there, too? >> Yes. >> He's cool with it? >> Yeah, he is. >> Where I haven't been in your house, but like where Like what bedroom's yours or what bedroom's hers? >> Uh she has the basement. >> The whole basement? Is it a finished basement? >> Yeah, it's a finished basement. Yeah, so she's got the basement. And then uh there's only two bedrooms upstairs. The one that goes through to the garage >> Mhm. >> and then the one across The one across that's my bedroom. >> So the bedroom on the south the south side of the house is opposite of the garage? >> Yep. >> Okay. Is yours? >> Yep. >> Got it. Um Do you know your landlord's your driver, do you know his phone number off hand? >> Mhm. >> No? Okay. I'm assuming you have it though somewhere. >> Yeah. Yeah, he is my employee, so it's in my phone and my computer. Like I have it. >> Okay. Um I'd like to get these You're all right? >> Yeah, I'm good. >> Okay. I'd like to get these text messages dates and stuff from your phone. They're between you and Samantha. Um Was that just this morning or this con this I don't call it an argument, but did it go back days? >> No. >> Between you and Sam? >> No. Just >> A couple of just this morning or just after the thing this morning happened? >> I mean, there's been times I mean, we've talked about him not being at the house before. >> Is there conversation like that on the phone? >> There might be. >> Okay. >> Um I'm not sure cuz I'm more of the type I like to talk face-to-face instead of back and forth on the phone. You can never tell people's like emotions and stuff on the phone. Um but yeah, I know before we've talked about, you know, not having outside people at the house. Um them two, they just broke up like a handful of days ago, and they weren't talking. And then yeah, he's he just shows up at the house again. So, I was confused on why he's even at the at the house, you know? >> Okay. >> And then yeah, he was parked in the driveway having me blocked in all that stuff this morning. >> And there's talk about that on the phone, too, about like the rules and stuff leading up to this or before this happened, I mean. >> I mean, you probably have to go way back like yeah, the last couple months, but yeah, I've definitely told her like like we have rules, no random people over. You know, I've discussed with her multiple times like this guy shouldn't be over. And then even she texted me today, I told her like I don't have I even told her today like I don't have problems with this guy as long as we don't have the same interaction that we had this morning where he's sitting here yelling at me, calling me names, and asking me if I want to fight him. Like I I don't do that. And I told her that, you know, and she said, "Don't worry, you won't see him again." And she told me that today, and then she walks in the house saying like, "Oh, I'm leaving. He's pulling up. He wants to talk to you outside." And I'm like, "He's not supposed to be here. You just said he wasn't coming back over. I won't see him again." And then all of a sudden he's at the house. So, I don't like I said, I don't know if if if he told her his intention when he was coming over that he's like, "Oh, I'm going to go over there and kick his ass" or something like that. But it's like like why would you bring him back to the house after already the issues that we had, you know? >> What's the passcode to your phone? >> Passcode to my phone? >> Mhm. >> Um I mean, I'd rather not give that out. >> You know, I give it out. I mean, I like I guess what I'm I My next question would be I'd like to I'd like to get those texts. And show like the rules and all that stuff. Do you know to this? >> You didn't get them from her? >> I haven't yet, no. And I will ask her, too. I'm going to ask her I'll have a whole lot of questions to ask her about what happened today, especially in regards to him and his attitude. >> Yeah. >> Um but I also like to get them from you. >> I mean, I I prefer not to give out that information, okay? >> Okay. Do you mind if I search your phone then or no? >> Yes. >> I can? >> No, you can't. >> Oh, I can't. Okay. Okay. Can I ask why? >> Um I feel like the text messages don't have much to do with the incident of him coming back to my house and assaulting me. >> Okay. >> Like he should have He should have never been back at the house. That situation should never happen. He came with the pure intention to assault me. You know, that is is He didn't come there to talk to me. >> Mhm. >> Even if she said like, "Oh, he deserves to talk." Like >> Well, I mean, I guess that's where I'm a little confused here cuz some of the witnesses are telling me the same story you're telling me. And that's I guess where I'm trying to put the pieces together. >> What do you mean? >> So, we have a couple different witnesses who are saying that I mean, obviously there was some kind of altercation. No one's denying that, right? >> Yeah. >> But that it wasn't as clear-cut as him like jumping on your back during this whole incident. That maybe he was already on the ground when some of those shots were fired. Does that ring a bell? >> On top of me. >> On top of you? >> Yeah. At At every point of the altercation, he was on top of me. That's why my back is covered in blood because he was on top of me. The only way I can get >> that's what I'm trying to ask. How do you get on top of you if he was in front of you punching your head? >> He was on top of me the whole time. So, it's like we >> What does on top of me mean? That's what I'm trying to get at. You can show me. >> Well, it it's hard to remember how everything went because you figure the whole incident took under what? A minute? Two minutes? You know, less than that. So, yeah, like the the first thing that I remember was like I'm here, you know, my motorcycles are behind me. I look behind me for a clear out because this guy's coming in my face. I go to turn, look, and I come back and he's grabbing me. So, I fall back towards, you know, onto the motorcycles and that's when he swung at me and I ducked down and that's when he started punching me in the head and that's when I pulled it and we fell on the ground together. There was no time to where ever I told you if I would have been on the ground that he would have let go of me, I would have been the [ __ ] out of there in an instant because he was trying to take the gun from me and everything like that. But at no time was he on the ground and I was not on the ground. There was no time ever. >> So, is his is his DNA going to be on your gun? >> On my gun? I mean, more than likely because of the close range of us and then even yeah, when he was trying to grab it, I'm sure that there was a print on there somewhere. >> Well, I mean, a print or just from him touching. You think his DNA is going to be on your gun? >> Yes, absolutely. Yeah. Our our hands were interlocked. >> Okay. Where is the gun now? >> I thought y'all had it. >> No, I'm asking you where you put it. >> Oh, I put it on the TV stand in my living room. >> Okay. Is it in a holster? >> I saw it through a window. >> Yes, it was in a holster. >> Did you put it back there after this all happened? Like you put it in the holster and put it back on the table? >> Yeah, as soon as I got off the ground with him, I immediately holstered my weapon. I went inside, I put it on the TV stand, I called 911 and they were like, you know, is this for the shooting with the male? I told them yes. They told me go outside, put your hands up, lay on the ground. And I >> So you called 911, too? >> I I called 911, yeah. >> Okay. >> I I I get what you're saying about about some of this phone stuff. I I'd like to show that you did all this and you called 911 and you're trying to do the right thing. That's why I'm trying to look at all this. >> Well, y'all can see that I called 911, though. 911 records will show my phone number calling 911. >> They don't keep 911 calls. >> What do you mean? If I call 911 and hang up the phone, you guys show up at my house. >> If you hang up, they do what's called like an emergency trace, but if you get connected, they don't. It's privacy rules. >> Well, go ahead search my phone, man, cuz like I said, I'm not trying to hide anything. >> I I I don't think you are. I'm I'm trying to piece this together cuz obviously the way it works is there's two sides, right? I mean some people maybe saw or think one thing, other people saw or think different things. And there may be some biases on both end because I don't know this person, I know this person or vice versa. And our job as a cop is trying to kind of figure out what like what actually went down. >> Yeah, no, you guys people >> Whether it be an officer involved one or, you know, what what you're at, the same thing. If she's not an officer, it's all the same. >> What color was the car? People say, "Oh, it was green. I think it was blue. I think it was black." Like, yeah, no, I know like when when situations happen like that, not everybody has a clear clear vision of what happened because things happen so fast. Like like I don't know what she saw, but like all the only thing I heard was her screaming. Like I didn't see where she was at. I didn't >> Was she outside when it happened tonight? >> Yeah, she was in the She was like by the front of the driveway by like her car in the bush. >> Okay. >> But when me and him started >> Huh? >> What car is her car? >> The Ford Escape, the one that was like half parked in the grass. >> I was going to ask you what what color is it? >> Yeah, it's like a a grayish dark black color, you know. >> Okay. It's a Ford Escape, you said? >> Yeah, I believe it's a Ford Escape. >> Yeah. Dark gray, I'll say darker Ford Escape. >> Mhm. >> What car was Was his there? >> Yeah, his was a black BMW. He pulled in the driveway. >> And what was yours? I mean, outside of the Mini. >> Mine is the Toyota RAV4, the red one. >> And that was up by the garage, right? >> Yeah. >> All right. >> Yeah, it was parked in front of that BMW. >> I was in the driveways, so I didn't go inside. That's why I'm asking. >> Mhm. >> Um Okay, so then you called 911 as soon as this was all all done. You ran inside, you called 911, and they said come outside. >> Yo, come outside, hands up, lay on the ground. >> Which is what one of the cops told me that. >> Yeah. >> at the scene. >> And yeah, they like literally I was coming outside with my hands up, they were pulling up, I got on the ground. >> Okay. >> You know, they ran up. They cuffed me right away. >> And this 322 number, that's the phone number for your phone? >> Yeah. 975-322 [clears throat] >> the one you would have the phone you would have used to call 911. >> Yo. >> Okay. And what's that passcode? And I want to get those texts. And I want to get the call log showing you called 911. >> It's 02 27 91. >> Okay. Um Are you okay with that? >> I mean, I don't want to >> know I don't I don't want to push you, of course, if you don't. I'm not trying to be a jerk. I'm just doing my job. This is one of the things I do. So it's it's your call. I'm not going to push it. >> I'm not trying to impede the investigation. I'm not trying to stop you from doing your job because at the end of the day like like I don't feel like I did anything wrong. Like like yeah, [ __ ] maybe shouldn't have ended up the way it did, but I can't stop someone from from coming to my house and and getting into a physical fight with me. Like there was nothing I could do. >> Well, it's it's it's your call. Do you want to or not? >> Yeah, yeah. I don't want to impede you from doing what you got to do so that I can prove that >> And how many times do you think he's been in that house? >> I mean that I >> three or four No, you didn't say three or four. You said one or four times in all of this. You said Or no, three or You only saw him three or four >> Three or four times I've seen him, yeah. Otherwise, like his car will be there and I'll be leaving for work in the morning and his car will be like parked on the street, but other than that, like I've only >> he stayed there more than three or four times? >> Yeah, yeah, for sure. >> How many times do you think he or is it like a weekly basis or how many times do you >> Yeah, maybe once or twice a week I'll see his car outside. But I didn't >> don't see him cuz he's in the basement and you're >> Yeah. And then, yeah, I'm I'm sleeping by, you know, 10:00 at night cuz I get up at 5:00. >> They get along there? >> I mean, I make like 75. >> That's not bad. >> So, it's not Yeah, it's nothing to be too crazy about, but it's definitely enough to be able to have an enjoyable life, you know? >> Yeah, I mean, especially if you got a paying rent, too. >> Mhm. Yeah, and that was all the thing about having a roommate is trying to cut down some of the the sting of life, you know? Shit's expensive nowadays. >> So, correct me if I'm wrong, one of one of my partners, this is just the It's the same form, but it's for the phone. Kind of like the DNA one, but one of my partners said your brother was on scene. >> My brother was on scene? >> Did he show up? >> He probably did show up because like the same time that I was calling 911, I called my brother just because that's my brother, that's my emergency contact. I knew something was going to happen to me today and I have my two dogs in the house, so I wanted someone >> as well after the shooting. >> Mhm. >> Okay. All right. Um I'm going to get to the brother scene in a second. This is the same form if you're okay with us searching through the phone for that. If you're not, don't say anything. I'm not going to hold it against you either way. But I can explain why I want to, so I'll leave it up you. Okay? I'm not going to push you either way, it's your choice. Um Did your brother witness what happened though? Was he there for like argument? >> How fast after I'm trying to think of what he would would have seen is what I'm asking. >> I didn't see him, so by the time like I was already taken from the scene, I was already gone when >> never saw him? >> I never saw my brother, no. No, no. >> But you called him, so that's why he would have showed up. >> Yo, yo, yo. >> I got you. Have you talked to him since that call? >> No. No, cuz literally yeah, they >> That was when you told him what happened, like briefly? >> Yeah, I told him real quick, you know, >> Mhm. >> Hey, you know, there was a shooting at the house. You know, I'm more than likely, you know, going to have some [ __ ] to deal with today. >> Okay. >> And that's when I told him like I'm calling the cops right now. I hung up the phone and then I dialed 911. >> I got you. Okay. Um Well, again, if you're okay with a search of the phone and getting that, then I will be signing that form. If you're not, just tell me and I'll take it away. I don't need to know either way. Um Do you think I mean, have you been thinking about this since it happened when you're sitting yourself? Do you think every I'm not saying you're lying to me, but you think there might have been things that happened differently than what you're telling me? Cuz I mean, we've had several witnesses tell us a slightly different story and a couple of the wit- their stories all match. >> I don't even know what witness you're talking >> I'm not I'm not implying that you're not telling me the truth. I'm just I'm trying to fit I have to as a cop explain why what the witnesses are saying is a little different than what you're telling me. >> Yeah, I >> That's what I'm trying to figure out right now. >> I don't know how there would have been witnesses because if you see where he ended up, there's three cars parked in the way. How was anybody even visually able to see what was going on between me and him? >> don't know, man. I don't live there. >> No, but that's what I'm saying. I I don't know the witnesses. I don't know where they were, but I just know that there was two people in the house and he came up. There was nobody else around and there was three vehicles parked in front of where we were on the ground. So, I have I have no idea how anybody would see anything. And like I said, as as soon as I got off of the ground, I holstered my weapon, I went inside, I called 911. There was no point to where he was on the ground and I was standing over him cuz I told you if I would have been up and had him off of me, I would have been the [ __ ] out of there. >> So, there you're you're 100% sure that you weren't >> I'm 1000% sure that there was no time that he was on the ground and I wasn't. >> So, when you were shooting, it's cuz he was on top of you. >> On top of me. >> And explain on top of me. Like I still am confused but I mean by back or front. That's what I'm trying to figure out. >> I mean, like I said, I was cuz you know what, I'm under his control. I don't have much control. He's a big dude. He can easily throw around 180 lbs. So, I was getting tossed onto my motorcycles, tossed from my garage onto the ground outside. And of course, like at this time, like he's still struggling with me on the ground over there because I had already shot him twice. You know, as as far as I know, I think he was hit twice at that point. >> And were they all in this area? >> They should have all been in yeah, chest, abdomen area because it was all point-blank. Like there wasn't a time that I fired my gun that it wasn't against his body. It wasn't like I wasn't from me to you. There was never even that far. You know, it was like like I don't want to get too close to you. But it was literally like like I had my gun and I put it to his body because I know how it is. There's people, there's other houses, there's my roommate that she's unaccounted for that I don't know where she is. If I just start shooting, I could hit anybody. >> You're saying she was at the end of the driveway when this all happened? >> Yeah, by where that her car and like that little tree thing is. There's like >> where the driveway meets the road or something. >> Mhm. Uh the sidewalk. Yeah, yeah, yeah. >> And what was she saying when all this was going down? >> I mean, at first, I heard her scream cuz when dude started hitting me, she screamed, "Andrew, you know, because he's attacking me." And then when I started shooting, you know, she started screaming more. And then like when I got up and you know, got him off of me is when she ran over and was like checking on him and I said right away like he's gone, you know, cuz I knew right away. >> He was dead? >> Yeah. >> So, you knew or After this all happened, the shooting stopped, she runs over to both of you guys. >> Yeah, I was getting him off of me. Yeah, I was getting him off of me. I was getting up, holstering my weapon, and going in the house and she came over to him. >> And then you told her he's gone, meaning he's dead. >> Yeah. Yeah, I was walking back in the garage and I was like, "He's gone." You know. >> And you know he's dead. I mean, you do know, right? >> Yes. No, I I knew right away. I knew right away before it even ended because like I said, he was holding onto me the whole time and it wasn't until, you know, I shot him that last time and I felt his body start to go limp that I was able to get him off of me cuz I told you I shot the guy twice and he's still hitting me. I still can't get him. He's still grabbing me. I still can't >> marks on your neck? Explain those to me. >> I mean, it would have been him trying to grab me and wrestle me around. I I don't know exactly how it happened. >> Are there more on outside of those three? >> What? Like marks on me? >> Yeah. >> I mean, I see the elbow. I assume that's from hitting the ground, maybe? >> The back of my head is all full of blood from him punching me and then this side I have swelling right above my ear cuz he punched me. Yeah, like right here in my ear and everything. >> Okay. Anything I mean, you said were there more scratches on your like >> I don't know. They took >> No, I mean, like on your chest or something. >> I think so. They took pictures of everything. I don't know. Like, I haven't looked at myself much. But, I don't know. Like, you know, you can see on my side like something happened there when we must have hit the ground. This is from my motorcycle when he threw me against the motorcycle. That must be oil and stuff from it. But, um No, like I said, he was throwing me around. He was punching the [ __ ] out of me in my head, you know, and had he hit me one or two more times, I could be knocked out. >> what changed to go from you guys were watching Jeopardy or whatever whatever Like, what from like having a cigarette and being cool with each other, though? What happened today? Like, what what was the >> No, it was all today. It was just >> I mean, yeah, what start Like, what was what happened today that >> I mean, when he came out and he was asking me like what the [ __ ] my problem was. And I told him I was like, my problem's not with you. Like, it's with my roommate, you know? >> Well, I know I'm So, I guess what I'm getting at is you said rules are rules and you're not allowed to have outside people over. >> Yeah, yeah. >> But, he's always been He's been there before, right? Like, he stayed over. You guys have watched TV together, had cigs together. What changed to where all of a sudden that's not a thing anymore, I guess what I'm getting at. >> That was the first time he came over. And when she brought him over the first time, uh like that was her friend. They were friends. They met at work. They weren't officially dating at that time. So, I'm like, whatever. Dude that you work with, whatever, you know? We were chilling. >> So, there's no no relationships over. >> Not at that point. Not at that first time. >> mean, that the rule though was no relationships or no friends in general? >> No no no outside relationships. Like, I told her like, if you want to start dating someone and you have a reliable relationship that you've built for for like, yeah, then people can start coming over and stuff like that. But >> So, it's not Okay, that's right. So, it's not anybody. It's If you wanted to have a buddy over, she wanted to have a gal a gal pal over. That's >> That's totally fine. >> It's She doesn't want you bring girls over and she hears that upstairs while she's downstairs and vice versa. >> Well, and just always seeing like random people in the house. Like, you know, if she goes to the bathroom and there's some random girl in the hallway or if I leave my bedroom and there's some random dude in the hallway, how do I deal with that situation? So, I told her like we can't have random people in the house because I don't want to be walking through my house and running into some random person at 2:00 in the morning. >> So, that's what the switch was is when Samantha and him started dating where that's where it was like, all right, this is he shouldn't be coming over anymore. That's where the switch kind of happened. >> Yeah, like I told her right away, like, you know, you don't know this person and you're bringing them into our home. You don't know this guy. You You've known him for, you know, at the time it was, you know, maybe a month. But they hadn't known each other for a a while. So, it's like you're bringing this dude that you don't know over to the house. And that's what I told her. And the way that she'd be screaming on the phone with them and they'd be screaming at each other, I'm like, I don't want to get pulled in between this. You know, they're constantly yelling and fighting with each other. So, it's like I don't want to get in between this. I told her multiple times like this guy can't be at the house, you know. I don't enjoy dealing with this [ __ ] in my house that's supposed to be like my peaceful space. >> Mhm. >> You know, and then they're constantly bringing this negativity into the into the house. >> Okay. Do you think there's some sort of Like, I mean, obviously, what you're telling me is he got like something happened to you that made him act aggressively towards you, right? >> Yeah. >> Um that wasn't the case leading up to this when he was staying over or when you guys were having a sit or whatever the case may be, like watching TV or whatever. Is there some sort of jealousy aspect there, do you think, maybe cuz he knows you guys at one point, you and Sam? I don't think you were into it, or >> I don't think he ever knew that. She never disclosed that information. As far as I know, she never disclosed that information to him. >> How's that make you feel? >> I mean, I don't care. I have no intention of trying to have a relationship, anything romantic. I don't I don't Like, when we were young, we were like 20 21 when we were had our little thing. And it's like it's been what, [ __ ] 14 years? >> Mhm. >> You know, and we maybe slept together like once every couple years when she would be in Wisconsin. Like, she'd stop over, come to the house, hang out, and stuff like that. But other than that, like no, there's no I don't want to be romantically involved with her, or nothing like that. I don't know if he had like feeling jealous because she lived with another guy. I don't know if there was anything there that was like making his feelings come some type of way towards me. But no, there's no No, I don't have any type of feelings or anything for her. >> So, the argument tonight was because of the argument this morning. And the argument this morning be started out because of where his car was parked? >> Yeah, and like he's like they broke up just a couple days ago, and like he wasn't talking to her, told her he didn't want nothing to do with her, this and that. And then all of a sudden he's he's drunk 1:00 in the morning over at the house. Like Like, we can't do that. Like, that's not all right. And then even last night, I had my niece over my 16-year-old niece. And I don't enjoy an adult male that's intoxicated in the same house with my 16-year-old niece. I ain't saying that he would ever do something, or he's that type of person, but I don't like any opportunity for anybody, you know, like that. So, I even text her last night, "Hey, my niece is coming over, you know, if you see someone sleeping on the couch, that's my niece, you know. But, that should have been a clear indication like I don't want people over tonight because I have my niece over here, you know. I was trying to hang out with her and have a good time. >> Okay. Um So, he was upset at you because >> because I was upset with her. >> And then the car thing happened. >> Yeah. >> Where was parked in front of you like you couldn't get out of work or >> Yeah, I I couldn't get out this morning. >> Okay. >> And like they were probably up till 2:00, 3:00 in the morning. And it was probably like 8:00, 8:30 when I woke up and I was getting ready for the day and stuff. So, it was like I'm sure he wasn't happy that he got woken up. You know, after sleeping >> he slept over last night into this morning. >> Yeah, yeah, yeah. He was there this morning. That's why >> got up to go to work at what time? Or no. >> I was getting ready to go to my brother's. >> That's right. What time was that? >> I mean, I probably got up and was getting ready probably around 8:30 this morning. >> Did you talk to your brother when you got over there for the oil change? Did you talk to him about what happened this morning? >> Yeah. >> Yeah, yeah, yeah, yeah. Okay. >> Yeah. >> Um what's your brother's name? >> My brother's name is Shawn. >> What's his last name? >> Sweeney. >> Oh, same? >> Yeah, yeah, yeah. >> Do you know his phone number off the top of your head? >> 414 551 2666. >> And he said he was in Greenfield? >> Mhm. >> Okay. I'm assuming he'll answer this time of night just cuz he knows what's going on. >> Yeah, he did. >> Okay. So, what did you tell him? Like what does he know about this morning? >> Well, I just told him basically what happened. You know, I told him that dude was getting aggressive, asked me if I wanted to fight. He was coming towards me. I already had my gun out. He didn't want to listen. I popped one in the grass and that's when he left. I told him I was like I don't know if he's, you know, going to the cops with her right now or what's going to happen. So, I told him like, you know, I don't know what's going to happen. And uh that's when she had texted me, you know, and I told her like I still don't have a problem with you. My problem is with you. And that's when she said, "You won't see him ever again." And then all of a sudden like it's like an hour later or something and she's coming through the door telling me that I got to fix things with him. That if I want her to stay here and everything to work that we have to squash this. And squash >> between you and him? >> Yeah, yeah, yeah. >> Um So I ran your ran your record. What's this with you and I think it's Michigan? >> Yeah, they uh maliciously prosecuted me. >> What for? >> Uh for a gun charge. The same gun. The same gun. >> Oh, the same charge? >> Yeah. >> And Michigan, when was this? >> Uh I don't recall. I can't give dates on any of that stuff. It's been so long. >> What kind of gun charge was it? >> I was just uh possession of a handgun. But I had my uh concealed carry permit, but I didn't have the card on me. And I got pulled over during COVID. So during COVID they tried calling the state of Wisconsin and nobody was working. So nobody was working, they couldn't verify that I had my concealed carry. So instead of figuring it out, Michigan just put a warrant out for my arrest. And then I got arrested in Milwaukee. And then I got transferred up to Michigan. I went to Kentucky and then I went to Michigan. >> Why Kentucky? >> Uh cuz if you get uh extradited, everybody has to go to Kentucky before you go where you go. >> All right. >> And so they can't like track you and stuff while you're being shipped around. >> Um sorry. Weird rule for that. Are you a felon? >> No, I'm not. >> You're not a felon? >> No, sir. Those charges were dropped. I am not a felon. No, I am lawfully allowed to carry my handgun. >> Okay. You're not arrested anywhere else in the country that I haven't seen? >> No. No, no, no. >> So, what happened when you got to Michigan? >> When I got to Michigan, um I got a lawyer up there. My lawyer contacted Wisconsin. They got a copy of my CCW permit. They got it shipped over to Michigan. My lawyer showed the judge. The judge dismissed the case. >> In Michigan? >> Yep. >> Okay. >> Yep, yep. Yes, so that case was dropped right away as soon as they figured out that I actually had a permit at the time that they took my gun. Cuz Michigan had my gun. I went back to Michigan and got it back. They gave it back to me. >> The exact same Taurus? >> Exact same gun, yep. >> All right. >> Yeah, it was in possession by >> Okay. >> Michigan. >> That's it. Um and then that's that's your phone, right? >> Mhm. >> This one. Okay. Let me go check in with my partners. Um make sure they're I think they were at your house >> [snorts] >> just to grab the gun and stuff. >> Mhm. >> I mean, obviously there's there's stuff that has to happen on scene. >> Mhm. >> Um I'll see if they're back. Make sure there's nothing crazy they found like more dead bodies in the basement. >> Yeah. >> I know you won't, but I I got to check with them. >> She lives down there anyways. >> Too short. So, I should I should bring her in is what you're telling me. >> Yeah, right. >> Um so, it could be like 2 minutes. Do you need anything? >> Um some water. I ain't had nothing to drink since like 4:00 today or something. >> All right. Let me get some water. I'm checking in. Almost done here, okay? >> All right. Thank you. >> Okay. Is there any We have the gun. Um So, I have the gun. I appreciate that. We have your holster and all that. Is there anything else you think we need to know about what happened? >> What's that? >> No. Okay. Anything else you want to tell us about what happened? >> No, I think we went through >> Okay. >> just about everything. >> Okay. Do you have any questions for me? >> I mean not really, but like I can tell you like this afternoon like when I got off work and I went home like I never had any intention to ever hurt anyone today. And I feel like when he came back to my house, he had the intention to hurt me. He didn't come to talk. He had the intention to hurt me and that's why he attacked me in my garage. You know, I was still in my garage when he attacked me. And I never thought I'd ever be in this kind of situation. We carry guns for protection, not to use them. We pray for the day that we never have to use them. You know, we pray that that we never have to use it and today, unfortunately, I had to use it, but I feel like using it saved my life. Because had had he kept hitting me who knows what would have happened, you know? I still got dry blood all over my head from him punching me. So, it's like if he would have knocked me out, where would I be right now? You know, there's people get punched in street fights, punched once and die. Head hits the concrete, they're dead. We we we can't say whether like this would have happened or that would have happened, you know? So, it's just in the moment like I was scared and I did what I felt like I had to do to make sure that I I see tomorrow. You know? And unfortunately, like it's a terrible thing that [ __ ] happened. I never wish that on anybody, you know? Tonight, I don't know if it's you or one of your partners, but somebody has to [ __ ] call that guy's mom and tell her like like your son's not coming home tonight. And I never wish that on [ __ ] anybody. I don't [clears throat] wish that on on you as officer to have to call her and tell her that and I pray for that woman because she has to take that phone call tonight and have that heartbreaking conversation that that the baby that she gave birth to and raised with love and care and affection for 27 years ain't [ __ ] coming home. And I have to it's going to be here for the rest of my life no matter what happens. It's going to be here every [ __ ] day and I have to live with that. And it I'm not saying that's as bad as having to live without a child or you know, to live without a brother, a cousin, an uncle, whatever he was to anybody. But the only reason that I did what I did because I felt like it was the only thing that I could do to still be here today, be here tomorrow. You know, and pray that I never had to use my weapon against someone. I always pray that. You know, we all do. We all pray. Even you as officer, you pray every day that like you carry you carry extra clips just because [ __ ] might hit the fan, but you pray every day I'm sure when you wake up that like I hope today I don't have to use this weapon. And that's the same way I feel like I it it's a terrible [ __ ] feeling knowing that that you were in an altercation and somebody's not here. You know, there's a lot of ways that we could have solved that [ __ ] issue besides bringing it to physical physical violence to where now we can't go back. You can go back from anything, but once things get physical and stuff like that there there's no going back. And that like it makes me feel terrible right now just knowing like the situation for everybody. You know, Samantha lost a a boyfriend or the guy that she's talking to, you know, [ __ ] a mother lost a son, you know. And that's terrible. It's a terrible [ __ ] thing, man. And I never wanted to ever be in this position. >> So, how do you think we could have done this differently? >> I mean, I think she should have never had him come back to the house. She should have told him like like now is not the time. Like I said, I don't know what they discussed if he told her like, "Hey, I just want to talk to him. I want to have a conversation." Well, I don't know what he said to her, but he should have never came back to the house. And for her to blindside me and you know I'm already doing stuff in the house and she just tells me like you got to fix this. He's coming, I'm leaving and all this stuff. And then boom, I'm [ __ ] blindsided outside and he's already there in my face. You know, so other than that, like I I don't know much else that we could have did different besides him not coming back to my residence and assaulting me. You know, that's we all could have went about our days and not had issues. >> In hindsight, do you think there's anything you could have done differently? >> Me, I don't believe so because if someone comes to my house and comes into my residence, cuz like I said, I was in the garage. So, he came from my driveway into my garage to grab me. Like what can I do? I told you I looked around to see if I had a out. I did not have an out. I was backed up against motorcycles. So, like I don't think like in that in that moment in that position there was nothing else that I could have did. I don't I don't believe so. >> Do you have any questions for me? >> For I mean, you're going to tell me what what happens what transpires after this, but I mean, I don't have any any questions for you like personally about this stuff. No. >> John Sweeney was originally charged with first-degree reckless homicide by use of a dangerous weapon in connection with the May 18th, 2025 shooting death of Andrew Martin in Glendale, Wisconsin.
