She just said, "No, it's okay." You know, and nice. It was normal, you know what I mean? And all of a sudden, >> did they get there alone? >> Just your mom and dad. >> And somebody else is waiting outside. I don't know who. Harvey was her husband. My sister Joselyn Harvey. >> Okay. Jas Joselyn drove your parents to your house. >> Yeah. I think so. I didn't see. >> Okay. So, they got there, went inside. >> Yeah. Which name was normal? >> All right. Normal. >> Did you say what your sister did? Did she go on that trip? >> No, she they all went >> The whole family went. >> Okay. So, you stay >> My mom said Yeah, cuz my mom said I was supposed to stay there and take care of house. That's what they said. >> Okay. bedroom. >> My bedroom is downstairs. >> All right. In the basement area? >> Yeah. >> Okay. So, you had the house to yourself for however long they were gone. >> Yeah. >> Were you okay with that? That you were the only one that didn't go to Mexico? >> I mean, at the time, like I said, I didn't have a lot of money with [clears throat] me for me to go to a trip anyway. So, I was told I was stay back. Do you remember what time they got to the house? >> Like I say 11:5 something. >> Around 5:00 p.m. >> Yeah. 5:00 p.m. >> Okay. So once they got there, uh, did something happen right away or >> No, cuz said it was it was it was normal when I went upstairs and talked to my mom and asked her, "Do you you guys need help to get some luggage out?" >> Mhm. >> And she said, "No, there my dad has it. He got it." Okay. So, I went downstairs to relax. You know, I got a video game downstairs. I was playing on it. Boom. >> And okay, I'm going just kept to the chase. And then my dad came a while back, like an hour or so maybe. And just what am I doing? And I'm like, what am I doing about what? And he says something about the dishes being dirty and some bull. You know what I'm saying? For me, it was some [ __ ] You know what I'm saying? For me to come and yell at me for some teddy stuff like that. >> Okay. >> And I was like, "What?" And I went to my mom. I was like, "Mom, what is my dad talking about commonly?" You know what I'm saying? >> Sure. >> And I told her, "What is he talking about?" Cuz he said, "I got to go find a place now because of the dishes." I'm like, "What dishes?" I'm like, "What dishes? I don't see him." And that's when my sister also came in and started, you know, also bullying because of my dad said. So I just got that up. You know, like I said, this is not just today, yesterday, a year ago. This is this is why >> something continuing. And what happened then? >> It was like I said, like I told the cop, I shot somebody. >> Do you remember who you shot? >> I shot my sister, maybe my dad, and maybe my mom. Is >> that something you meant to do? Like I said, man, I didn't want it to be like that. I want that's what I came to them nicely at first, like what is the problem? But my dad was really pushing it. And then, like I said, after he was pushing and my sister was pushing it, too. >> So, you were downstairs initially when your dad came down? >> Yes. >> All right. Um, where'd you have the firearm? >> Um, I already had it on me. Okay. Do you normally carry it on you? >> Uh, no. But I already knew what the, you know what I'm saying? What was going I already knew what I was going to do because I was fed up, man. >> Like I said, too many years. Too many years for this. >> What kind of gun you got, bro? >> It was It was a 9 mm hollow tip. And [snorts] >> do you know what kind of >> brand? It was It was a Taurus >> Taurus. >> Yeah. Is that your gun? >> No, I actually recently bought that from my friend's friend, you know. >> Sure. All right. How long have you had it? >> A couple months. >> Do you ever use it before? >> No, I've never used it. [snorts] >> Is that something you've kept in the house the whole time since you got it? Uh, >> kept it safely just in case, but I didn't want to use it for that purpose. >> Okay. And you feel that because of what they gave you [ __ ] about the dishes or anything else that they mentioned? >> Nothing else, man. But I'm just >> just years and years of >> years of building it up, man. And I got to kiss ass all the time. >> Do you feel Your sister gets special treatment. >> My sister just feeds off of what he has to say to me in front of her and then she thinks this is good to feed. Keep on feeding it. You know what I'm saying? >> She's younger than you, right? >> She's younger than me. Yeah. >> You're the oldest, right? >> You and your sister ever have any uh arguments and stuff prior to >> Yes, we did one time. And I'm going to say it again. Um it was not long ago. I think it was 2018. when this happened, uh, she got in my face talking about the same thing, money issues, money issues. And she pushed me that time and I said, "Why you pushing me? Why you putting hands on me?" So, I almost choked her, you know, >> things that would get physical between you and your dad or your mom. >> Uh, my dad is he had a drinking problem when I was little. >> Okay. And that's how I started because I wouldn't listen to him and he will abuse me while he was drinking off. You know what I'm saying? And that's why I said build it up to the point that I was fed up with his [ __ ] [snorts] >> What kind of abuse are you talking about? >> Physically, man. >> Like beat you. >> Beat me with a bell, whatever. He could. >> Was he like that with your other siblings or just with you? >> No, just with me. just for me. >> What about your mom? >> We uh he will hit my mom, too. [snorts] [clears throat] >> When was the last time he ever put hands on you? >> Yeah, it was last year also. Like around two years ago. >> Two years ago. >> We got into it physically. Also, >> you guys were still living at the same place. How long have you guys been there? Your family? >> About more than 20 years. >> More than 20 years at that same house. So you pretty much were raised there. >> Pass the house pretty much is what I'm saying. >> Did you go to school here? >> Yeah. Yes. I went to school in California when I was younger, but then I moved Well, we moved cuz they dragged me with me with them. So I started school over here. >> Where'd you go? >> My first school. I remember the first couple schools. And then I remember I went to my middle school which is down here Lincoln Arts. That was my middle school. And then I went to South Division right there. Late 10 and 15. >> Did you graduate there or no? >> Uh no I didn't. >> Okay. What last What was the last grade you was in? the junior. >> So, we're trying to piece together what happened. Um, I understand you were downstairs. That's where you keep your bedroom. >> Yeah, I was, like I said, I was my phone watching the movie, playing video game, and then I heard my dad is get, you know what I'm saying? Get out, whatever. And I was like, what you talking about? And he said, "Cuz the dishes are dirty all the way." And and I'm like, "Okay." And why you trying to kick me out? Cuz some dishes were dirty. The pl that this is the sink was clogged up. And I told him that you need to fix the pipes cuz they're old already and they're badly poured. You know, whoever put the pipes in, you know what I'm saying? Put them in properly. And he he didn't listen to that. And I was like, "Okay." So he says it again about the dishes there >> and this is still downstairs in your bedroom. >> Yeah. >> This conversation's taking place or argument at this point. >> Yeah. >> So he went upstairs and I I'm not chasing him upstairs. I wait to see what else is he's going to say or whatever. >> True. >> And I went upstairs looking for my mom and I was like, "Mom." And then my sister was like, "She's in the shower." And I was like, "Okay. And then I see my mom and I asked the mom, "What is my dad talking about?" You know what I'm saying? These dishes. And now he's trying to kick me out because they're dirty or something. >> Mhm. >> And >> And are you guys upstairs now? >> Yeah. Now we're upstairs >> in the living room. >> In the living room between the kitchen. The living room. Kitchen. >> Okay. >> And then I just got fed up, man. >> Where was your dad? All right there. All four. >> Yeah, they were all there except for my mom. My mom was in the room with my sister. My other sister Jasmine >> at the point at the time. >> All right. So, it's you. >> It's me and the two bullies that were Yes. Whatever. >> At what point do you take out your gun? >> At the point that I just went back and I just said I went back and just said now whenever. >> Okay. What do you mean by You went back back downstairs? >> No, I went I I was going to go downstairs and then I said, "No." You know what I'm saying? Forget this. You know what I'm saying? I'm tired. I'm tired. >> Now, you said you had it on you then? >> Yeah. >> All right. Do you carry it in a holster in your waistband pocket? >> Just on the my waist. >> Okay. Did anybody come at you? >> My sister did. She had a knife with her, but I mean that was after I pulled it. So, you pulled your gun off first. Did you shoot right away? >> No, that's when I seen her. She was coming at me with the knife. >> Okay. Did you shoot her first or >> No, I shot my pops first. >> You shot your dad first >> and then she was coming at me with the knife and then I think I shot him. >> Okay. Do you remember how many times you shot? >> I can tell you that part. I don't know. >> Do you remember shooting your dad more than once or at him at least? Well, I at least know that I shot couple two, three something that >> towards him. No, I don't know if it hit him. >> Okay. Where was your sister in relation to him when you shot at him? >> I say this is this is my pops. My sister was right in front of me. Right front of me. He was behind. >> So, in between both she was >> and this is in the living room kitchen area. >> In the living room kitchen. >> Okay. So, you shoot your dad first. She gets a knife. >> She gets the knife, starts chasing me, and I just I'm not going to get stabbed. >> Do you remember how many times you shot at her? >> No. Like I said, I don't know. I shot a couple. I don't know how many. >> At what time? At what point does your mom come into the picture? >> She comes screaming outside talking about to stop and I'm like >> outside just cuz she's in the bedroom, right? >> She's in the bedroom. She walks towards the hallway. There's a little hallway right there that connects, you know, connects >> the bedrooms to the living room. >> The bedrooms to the living room. She comes in between that one door that's right there. And I don't know. I just I just felt something like I don't know. I think I did shoot her too, man. >> Did she come at you with anything? >> No, she didn't. >> Do you remember shooting your mom? >> I remember pulling the trigger. I don't know if they hit her or not. >> Do you remember pointing the gun in her direction? >> Her direction? >> Yeah. Okay. >> Now, what about your other sister? Did she come into the area at all? >> No, my niece and not my sisters. >> Do you remember where they were when >> they were still in the room? >> And your mom's room? >> No, this my sister's room. How old is your niece? >> About four years ago. >> I'm assuming she's awake. She's not. >> She was awake. >> Okay. [clears throat and cough] Now, you mentioned that um your sister may have arrived with somebody. >> Yeah, I looked out the window and I think I seen the car out there waiting. Anybody in there or anybody? >> Yeah, it was somebody in there. I don't know who it was. >> That's your brother-in-law or >> maybe? Maybe maybe not. Maybe it was somebody else, you know. >> So, you shoot your father, your sister arms herself with the knife, comes at you, >> comes at me, I shoot at her, >> and then your mom makes it into the living room. You point the gun in her direction, and you shoot as well. >> Shoot as well. Okay. >> What happens after you shoot? >> That part. I don't know why I did it, but it's I just did it. >> What happens after you shoot out the door? >> Do you have the gun with you? >> I had the gun with me. Yes. >> Where is it at now? >> I got rid of it at some dumpster. >> All right. Near your house? >> Near my house? Yeah. >> Now, are you familiar with directions? North, South, East. >> So, I ran out the I need piece of paper. Tell you what, why don't we print out a overlay, okay, of the area >> because I'll be honest with you, we want to recover this gun because many times when this somebody else might have it, we don't want it to go into a child finds it in a backyard or wherever, >> especially the dumpster cuz anybody can just put stuff in there and look at it and never like >> Is it like a big dumpster? >> No, it's like the dump regular house. Yeah. Okay. Do you mind if we go print an overlay map just so we can >> the whole area? >> Yeah. >> Just like a a Google Maps overlay. >> Just if you could try to point as best as you can >> just so we can make a >> I know it's by the park somewhere. >> Okay. But [clears throat] what's what street? >> I think it's called I don't know what that street is called, man. Cuz I know it's Vera and there's another street that goes No, Vera. Vera. >> Okay. Vera. No, >> this is Cheyenne. And this is the other. I went up. So that's Vera. And then the park is over here. >> Okay. >> And it goes in a like a little angle like this. And I walked one, two, couple houses there. And then I put it in the house. >> Do you remember if it was a trash bin in front of the house or alley? >> It was in front of the house by the street. by the street >> and it was kind of fullish like full. >> Okay. Did you wrap it up in anything or you just >> I just took the clip off and the gun put the clip in the gun. >> Did you dissemble the gun? >> No, I just took the magazine. >> Okay. What color what color gun is it? >> It's all black. >> All black. Okay. And just a standard size magazine, not a >> or drum magazine? It's a standard one. You could say, but 16 rounds. >> Okay. >> 16. Yeah, 16 rounds. >> I'm sorry, D. Do you know if you said it like on top of the garbage or if it slid down? Could you hear it >> go down? >> I would. All right. I I would say I put it on top. Like the gar let's say the garbage is right here. I put it on top of it, but who knows what could have happened during that time. So you didn't like slide it? >> No, I just took it out and just threw it in there. >> Okay. >> The magazine was removed from >> Yeah, the magazine was removed. But I think when I when I left it there, it was sitting there on top >> the gun. >> The gun >> on top of all the trash that was >> Yeah. >> But you could still close it though. >> Okay. >> It was full, but you still you still close the lid. >> Do you remember if you had any more bullets in there? >> I'm pretty sure, man. Okay. Can you give us a couple minutes? >> Just one last question. Do you remember was it fully loaded with 16 or did you have >> It was Yeah, we'll get that. >> And again, you didn't wrap it up in anything. Gloves, hat. Give me a second. Okay. This I want [snorts] this. You know what I'm saying? But he got to go to the extreme and yelling and doing all this extra [ __ ] You mean mama? Who? I didn't want to do it, man. I'm here now, man. You know, a wanted [ __ ] on the street. Not for something like this. I'll tell you what, it took a lot of courage, but I said, man, when you know stuff like this happens where we know people get rid of guns and in a heat of a moment and panic right but the last thing we want is further violence >> I understand that part >> you know or a chamako finding it and hurt himself Now you going to ask what what happened. I don't know what I did was wrong, man. I said, turn myself in because I don't want to be running around and I do need some help. I know that man. I know that >> sometimes bro is true bro. You can say I already I already heard them whisper one time in my ear. Miss, it's not a coincidence right there. And that's why I stay away trying to argue with these guys. Takes a lot of courage, bro. Not too many people, man can come to terms with that. Yeah, to be honest, I was thinking of doing the runaway thing, but no, I came to my sentence and said, "No, man. I'm not going to go to somebody else's house and bring trouble over there with him for keeping me under the cover or whatever." Whatever. >> Did you thought about going to someone's house? >> I was. >> You got this. Are you >> No, took the bus on the way to taking the bus. I was thinking of it cuz it's a oneway shot towards that person's house with that bus, but then I was like, it's also the jail right here and I don't want to be fused, man. Tell you what, man. Thank you for choosing this route. Um, so Heraldo, there's one up to do. Um maybe might have some more questions once my partner comes back, but um are you willing to provide a DNA sample >> for >> for the firearm? >> We're hoping that we recover it, right? It should have your >> fingerprints DNA. >> Yeah, it should. >> Okay. But also if like I said I bought that for somebody never used it. >> So they I don't know what else that gun has. >> Okay. >> Under that circumstances and what I'm saying. >> You got it off the streets right now. >> Okay. >> Um obviously we have to deal with this matter first. Okay. Um but we're hoping that we recover it and it should have your DNA, right? So, it'll be served for that purpose. Now, once we obviously get the gun tested, examined, get a ballistics check on it, and if it involves any other matters, we'll probably come and talk to you first because you were the last person that had it. >> Right. >> And if if it does come up with something else, then we might have some questions at that point. >> Right. Right. Right. >> Okay. But right now, first things first is um I just want to collect your DNA. um just for the purpose of this gun once we find it. Okay. >> In the 2025 Milwaukee County case, Gerardo Jimenez Rico was charged with first-degree intentional homicide and two counts of attempted first-degree intentional homicide in the death of Joselyn Jimenez and the shootings of his parents.
