I had to carry him from US Bank to Third Avenue Motel pretty much like I had to hold on to him. >> So just when when you got back to motel, did he have a phone on him? Did was he talking to anybody when >> I don't know. I just set him down and I emptied out my backpack looking for my cigarettes. I couldn't find him. So then I I was like I literally ran upstairs and came right back and he was gone. On August 24th, 2015 in Duth, Minnesota, Janessa Lynn Peters was interviewed in connection with the death of Harley Joseph Jacka, who had died as a result of a stabbing at an apartment in Virginia in April 2014. Spoiler details are in the video description, and the full results of all charges in the case are laid out at the end of the video. and talking about people that were present that night along with Bart, yourself, and um Jamie Aisham. >> Yeah. >> Okay. And why don't you just start with who all how did you end up going over there that day? >> Um Bart asked us and All right. So me and Harley were just getting back together after being broken up for a couple of days. >> Okay. >> And um >> Harley is Harley who? Jacka >> J A C >> K A >> K. Do you know his date of birth? >> Okay. >> I don't I can't even think right now. I don't know. And we just got back together and um Bart didn't like him cuz Bart I don't know why Bart didn't like him. He was ri I don't know. Apparently, he ripped his mom off or stole her money like $300 or something previously or >> from Bart's mom. >> No, Harley did that to his mom. So, they they confronted him about it when we got there. >> Harley or Bart confronted Harley about it. >> Yeah. >> Okay. They as in who? >> Um or so it was Bart drift and it was some Stace some Stacy was there for like like 5 minutes. >> Okay. Okay. She lives down at the end of a block. I don't know. >> Would it be uh I know I heard a name brand, I think, or something to that effect. >> I don't know if that weird. >> I think her name was Stacy, but I don't know her last name. >> So, we have Bart Drift. We have a Stacy. >> Yeah. Um >> last name unknown lives at the end of block. >> Mhm. >> Yourself and Harley. >> Yeah. and Jimmy Aisham and um um that Jeff Oj I think that's his name. I don't know if his first name is Jeff Oja is his last name though. >> He said Oj or Oja. >> Yeah, we call him OJ but his last name is Oja. >> Okay. I don't know for sure. >> So like OJ anyways for O short for OJ or >> Yeah. >> Okay. >> First name on certain of describe him. >> Describe what he looks like. >> Yeah. >> Native. Um maybe like 5 to six. Um he had longer dark black hair down his shoulders. Um he had some he has gray in his hair too. It's like gray here and there. Um I don't know. He's missing his front teeth. >> Okay. And that's the guy's house where we drove by on the way here over at 306. Was it third? >> Yeah. >> Okay. And he lives in the upstairs of that residence. >> Yeah. >> With his mother. >> Yes. >> Okay. So that's the guy that you refer to as OJ OJ or something like that. Was anybody else present? >> The guy that lives there regularly. Was he gone? >> Yeah. >> Okay. >> That was really weird, too. >> Yeah. So, you went there with Harley? >> Yeah. So, it was weird because I have I don't have the text messages anymore cuz now I got a new phone. But, um Bart had texted me and said, "Why don't you and Harley come over?" and Harley was at his NA meeting over at the detox building. >> Okay. So, Bart texted you and invited the two of you. >> Yeah, the two of us over there. Um, and Harley had thought it was weird that he invited Harley over there also. He, you know, I he had called me and called me from Third A Motel and I was out with my friend Tim and Eve live and he was like, "Well," he's like, "I'm home now." you know, I'm like, "Well, do you want to go over to Barts and maybe have a couple drinks or over to your uncle Jamie's?" And he's like, "Well, I don't know." He's like, "Why or why?" >> Okay. >> And then so he's like, "I'll just talk to you more when we get home." So I got home and and he's like, "Yeah, sure." You know, let's go have a good time, you know? He's like, "We're I mean, just long as we're not doing drugs, that's what matters." And we walked over there. We were drunk within like maybe 15 minutes. And then I walked home. I don't know. We weren't there that I wasn't there that long. >> Was it dark out when you guys got over? >> Yeah. >> Okay. So, you walked over there and Harley had been at an NA meeting. >> Yeah. Over at the detox building. >> Okay. >> Or by, you know, like range of mental health kind of. >> Okay. >> They have like a detox or whatever. >> So, when you walked when you got there, did you have to get let in or did you just let yourselves in? >> We had to get let in. Yeah. Bart let us in. >> Okay. And who was present in the uh apartment? >> People Stacy Bart um yeah and Jamie I show. >> Okay. So four people were there before you and Harley arrived. >> Yeah. >> Okay. And how did things go when you guys uh entered? So, we walk in the door and it's all good, you know? I mean, Bart, he like I go to him with any of my problems and he'll protect me against anything. Okay. >> I mean, even if I did bad. >> And um >> so we walk in there and that Stacy started lecturing Harley like almost instantly. Um you robbed your mom $300, she said. >> Okay. >> And and I and I'm like, "No, he didn't." I'm like, "He wouldn't do it. He wouldn't do something like that." When was that supposed to have happened? >> Like almost right away. Like it was almost like as soon as we got there. >> No, but when did the theft supposedly happen with the $300? >> A couple weeks prior, I think. I don't know for sure. >> So Stacy's lecturing Harley about supposedly stealing $300 from >> his mom. The one that lives in Pine Mill. I don't know if it's his real mom or his stepmom. I think it's his real mom. >> From Harley's mom. >> Yeah, Harley's mom. >> Okay. Okay. Did anybody else interject about the theft of money from Harley's mom? >> Well, I told her that no, he didn't do it. Like, I was like, no, he didn't [ __ ] do that. Like, he wouldn't do that. >> And Bart kind of came in between me and her and it was like, no. He was like, no, don't worry about it. >> How long did that go in that interaction? >> I don't know, like maybe five minutes. And Bart split it up. He made me stop. >> Okay. And literally like the next thing I know is Jamie Aisham is stumbling around the apartment and I was kind of having some conflict with Oj like like I was informed or told that he you know killed like two people or something like but then I talked to my um friend Ron and he's like no that's two thirdderee assaults or something. He's like, "It's not murder." >> Okay. >> I don't know. It's just um Anyways, like No, I lost myself. I don't know. >> You were having some conflict with OG. >> Yeah. And I >> What? >> Because I I was like, "I heard that you killed two people." I'm like, "Is that even true?" He's like, "No, that's not true." And >> Okay. >> And I was drunk, so I kind of had a big mouth, you know? >> And that was it. That was the problem. And then Jamie Aisham is like, "Let's go." Like he was blackout drunk though, I think. Like but he's like, "All right, let's go." He's like, "Will you walk me home?" And I'm like, "Yeah, you know, I have no problem walking you home." >> And um so we didn't find him in an alley drunk like I don't know, you know, whatever. You never know what could happen. I mean, you could pass out, whatever. So anyways, I'm like, "Harly, do you want to help me walk him home?" He's like, "No." He's like, "I'm going to hang out and [ __ ] a little bit longer." I'm like, "Okay, you know, that's fine." >> I'm like, "Meet me back at the place." I'm like, "Try to be fast." You know, and so I get back. I don't know. That was it. That was the last of the Well, then Bart came out in the, you know, there's like this entryway to Jaime's or James Royy's house. >> Okay. >> There's like the little walkway and then a portrait here. Well, I was in the couch with Jamie and um Bart came out and he's like, "Go home with him. He has a lot of money." And that's the last thing I remember from that house. We I then I stumbled him back to Third A Motel. Jamie back to third motel and I went to bed. >> Okay. >> Actually, well, I went up to I brought him and I left him like in my room. >> Mhm. >> Cuz I was going to go upstairs in my friend Dave Peterson's house and get a cigarette. >> Okay. >> Third motel. Yeah. >> Yep. So I went up I left Jamie in the bedroom 29 and I went upstairs to Dave's and I got a cigarette and I came back down and he was gone. >> Was Dave home? >> Yeah. >> Okay. Do you know about what time this was? >> No, I really don't. >> Okay. >> I honestly don't. I was I was under influence. I look all bad. >> Okay. How much do you think you had to drink? >> I don't know. I had like a bottle a whole bottle of patrol myself. >> Oh, okay. How about uh Harley? Had he been drinking much when he was over there? >> He did like maybe three shots while I was there. That was it. >> So, he wasn't even intoxicated or drunk. >> Oh, he was intoxicated off that. We don't drink. >> Okay. >> We're not drinkers. I don't know. He was kind of buzzed up. I don't know. I just remember him saying like, "All right, I'll see you home soon. Love you." And and then I went out in the hallway and left. >> Okay. And Bart was saying or who was saying for you to go that had the money. >> Bart was like, "Yeah, go with Jamie. I you know this." All right. Bart told me to go with Jamie Aisham. I was out in the hallway holding up Jamie and he's like, "Yeah, go with him. He has a lot of money." >> Okay. And uh did he >> I don't know. I didn't >> Okay, >> I didn't pay attention. >> Did Harley have any money? >> Okay. How much would Harley have? >> Okay. >> I know of nothing. >> No money. >> Okay. >> But my friend Cat Mackey was telling me that him and his friend were robbing people >> when >> I don't know. Like back That was the same day. That was the day before I went and partied. It was the day before I went and partied. >> Okay. So, maybe Friday. >> Yeah. That him and his buddy were out robbing people. Okay. Taking their money, but I knew of no money. >> Okay. All right. And so, how do uh do you know what John was wearing or >> Jamie? I mean, >> he was wearing like a baggie kind of like I don't know for sure, but I think it was like a white long sleeve shirt or like a maybe it was a tan. It's kind of like a whitish tan. Kind of like a flannel kind of shirt. >> Okay. Like a button-up shirt. >> Mhm. >> Okay. >> You know what he has for footwear? >> Yeah, he had some They were I can't remember. I think they may have been they were like newer. They were like I think they were like gray and they were either Nikes or Jordans. They were newer. >> Okay. >> That's all I remember. And he had jeans on I think. I believe. >> How about he had I'm trying to think. No. He had jeans. Um I think he was wearing a black long sleeve shirt. Um you know what kind of footwear? >> They look like white jogging shoes if I remember correctly. >> When you guys go into that house, do you take your shoes off? Leave them on? >> We leave them on. It's dirty. Okay. And Harley would have been wearing what? Um, he had his jeans on. His shoes, they were like um DC's. They're like black. I think they were DC's. I don't like black. They had like some red on them. >> Okay. And he was wearing like a a gray fox racing hoodie. >> A fox racing hoodie. >> Yeah. And >> what color? >> Gray. And he has and he was he had on another sweater, but I can't remember which one it was. It was a dark blue one cuz it was really cold. They were wearing two hoodies. It was a dark blue. >> Okay. But I can't. >> Was that the outer one or >> That was the inner one. >> Okay. >> Um, >> see a fox racing hoodie. A dark blue hoodie. >> Dark blue hoodie. I don't know what what was on the dark blue hoodie. >> Okay. >> Um, and there was and I had bought him a sweater like a couple days prior to this. Okay. And I left it over at James Royy's house and it was a tan it was like a gray one. It was like that shiny gray material like >> Okay. like the Under Armour >> so and it had like a bison on it. Yeah. And it kind of was like matched this except it was for a man and it had a bison on it and it said bison and >> Okay. >> big letters. So I don't know. He could have changed into that cuz >> Well, he have a phone. >> He had a phone. >> Okay. Do you know his phone number? >> It wasn't active. Okay. >> Cuz he just got it that morning. It wasn't >> Okay. All right. Do you know Bart's phone number? Yeah. >> Okay. He only has texting, but um um >> um Tony 410 6862 >> 6862. >> Yep. Okay. And he had called or texted you to say, "Why don't you and Harley come over?" >> Mhm. >> To Royy's. >> Yeah. >> Okay. What was Bart wearing? If you can recall, >> I don't know. Like his tener shoes, they're like they're like blue DC's with yellow like sewing or whatever. Um he was wearing jeans. Um, and he was wearing I think he was wearing a black t-shirt, but I don't remember what was on it. >> Okay. >> And a necklace. >> Okay. >> Oh, it was like a little like deer. It looked like a deer skull kind of like it had like the rack and the horn. It was kind of I don't know. >> Okay. Deer skull. >> Yeah. >> Back to Harley real quick. Would he have any jewelry or anything like that? >> Yeah. Um, it was just a silver necklace. Just a plain silver. Is real silver. I believe it's just nothing fancy about it. >> Yeah, it was make I got it. >> Hey, sure. >> Okay. >> You want those in individual folders, gentlemen? >> Um, >> I can get them for you in just a matter of seconds. >> Those are sequential. That's They're on Yep. >> Okay. >> Thank you. >> Thank you. Anyways, um it was like for my kid. It was I got it. It was a mother's necklace. >> Okay. >> But I gave it to him. Uh it was just like a normal. >> It wasn't just like a chain. It was like a circle kind of silver. >> Okay. >> I don't think he had any other. >> And >> he had earrings. >> Okay. Earrings. >> Diamond earrings. They weren't real diamonds. two on each side. >> And he also value on him or >> just like his wallet with like his ID would have been in it. Who knows if they would have >> Did he have credit cards, stuff like that? >> Yeah, he had a debit. He should have had a debit card in there that he gets his social security on. >> Okay. >> Any other kind of cards? >> Not that I know of. >> Maybe his social security card might have been in there, too. find his ID, but I don't know if he even had it on him that night. >> No cash? >> Mm- >> Okay. To your knowledge, anyways. >> Yeah. >> Okay. >> Okay. And Bart, what level of intoxication would you put? >> He was blackout drunk. >> Pretty drunk. >> I got a hold of him the next morning. And my friend Tim was going to bring us up to Net Lake. >> Uhhuh. >> Why Bart wanted to go to Net Lake, I don't know. So, did he call you or did you call him? >> No, I texted him to see what he was doing the next morning because I was like, I just got kicked out of Third Avenue Motel. I'm like, I don't know where to go. And Bert let me go over to his friend Harry's house. >> Okay. >> He's like, "Can you find us a ride up to Net Lake?" And I'm like, "Yeah." He's like, "Why?" You know, I was like, "Why?" And he's I don't know. So, anyways, we're on our way. >> When he said us a ride up, who's he talking about? >> Me and him. >> Okay. >> Okay. Who would he want to go see up there? >> I don't know. I guess he was going to go to his sister's. They He told me that they had a new duplex up there and we could live up there and stuff or >> Was he thinking that you two were a couple at the time or >> he No, he always he always acts like that though. >> Okay. >> He likes you or something. >> All right. So, he texted you. Did you guys uh get together and talk in person that morning? Yeah. >> Okay. >> And then we got my friend Tim's car >> and started headed up to Net Lake. We made it a little bit past Britney. He started pulling my hair. >> He started pulling your hair? >> Yeah. >> Okay. >> So, you and Kim with? >> I don't know who Kim is. >> Is that her car? >> Tim. >> Tim. >> Tim. Okay. Bart. Was Tim in the car with you? >> Yeah, he was driving. Okay. I was in the passenger seat and Bart was behind me. >> He started pulling my hair. Tim said he was looking out the window while he was pulling my hair. So he >> So he didn't >> he didn't think he was Yeah. He didn't tell him to knock it off. >> Yeah. And he didn't listen. So we had to pull his hands off my hair. That's when we turned around and I dropped him back off at Jamie's James Royy's house and I went >> But what time of day was this? Was it dark out still or? >> No, it was maybe like 3 300 p.m. >> in the afternoon. >> Yeah. >> Okay. You dropped him back off at >> No, it was probably like 1. >> Okay. But right in the middle of the afternoon. >> Yeah. >> Did you go inside? >> Yeah. >> Ro. Okay. Now, what was all going on in there? We just stopped back over there. >> I don't know. I didn't I just left. I sat him down on the porch. I couldn't do it anymore. Like, I can't babysit a 40-year-old man. A drunken 40-year-old man. I'm 19. I'm 20 years old now. >> Was he still drunk at 1:00 in the afternoon? >> Yeah, he was [ __ ] shitty. I don't know if he was under the influence of delotted. >> Okay. >> I don't know. He said I don't know what he was doing. I honestly don't know. >> So, anyways, you stop back over and and uh you go inside. I left. Yeah, I brought I put his crap in the porch like his bag and his hoodie and I just left him like I just I sat him down in the chair there and I'm like I have to go. I'm like I can't do this. I can't take care of you. I have to find a place like I'm I was I'm homeless, you know? I'm like I have to go somewhere. I can't I'm like I can't just be walking around taking care of you drunk as hell. I'm like And Jamie James Roy >> he was mad at Bart for some reason. >> Was he home at the time? Okay. >> He didn't answer the door or anything. And all I know is that he was mad at Bart. I guess he kicked Bart out. But Bart was like, I don't know why he's mad at me. I don't know. I don't know. >> Okay. Was anybody home at the time? >> I don't think so. Cuz the door was locked and nobody answered the door. >> Okay. >> But you never know. >> Okay. >> All right. And then did you and Tim leave together or did you leave? >> I left with Tim. >> Okay. >> I left Bart. I told him to sit down. >> What's Tim's last name? >> Hamblely. >> What is it? >> Hi. Hi. H A M B L Y. >> Okay. >> Don't like he's on parole and stuff. So, >> he's not in trouble for nothing at all. >> Okay. I don't want him to be >> He might have heard Bart pulling your hair but not seen it. >> He watched Bart pull on my hair. >> Okay. >> He had to pull Bart's hand off of me. >> Okay. So, he protected you basically and then said, "All right, kids. We're turning this bus around and brought you back to town. >> Yeah. >> Okay. All right. Okay. And then did you talk with Bard at all after that? After you left with Tim? >> Yeah, like after like I think it was the next Yeah, it was the next day. >> Mhm. >> And he told me he just got out of jail. I don't know if that's true or not. >> Okay. >> Um but and I told him I'm like, "You pulled my hair." I'm like, "I didn't do nothing." I'm like, "You won't let go of my hair." And he's like, "I'm sorry." You know? >> Yeah. >> Did he come see you or you just talked to my phone? >> Yeah, we just were texting. >> And you reminded him of his assaulted behavior towards you. >> Mhm. And he apologized. >> Okay. >> I really don't think he was um coherent. I don't know if he knew what it was he was doing cuz Tim will tell you. I mean, he told me that I was sitting in the front seat like this and all of a sudden he just started like pulling on my hair >> and I guess he was looking out the window while he was pulling on my hair. So kind of like >> Bart was looking out the window. >> Yeah, like he was looking out the window and like while pulling >> Okay. >> I never seen him act in such a manner. He's usually really respectful, >> but he apologized. >> Correct. Yes. >> Sober at the time at least or more sober. >> Yep. >> Okay. All right. Where does Tim live? >> Um, I think he lives like he's in the country past Gilbert. I think he doesn't have a phone. His phone's disconnected right now. >> What kind of car is it that you guys rode in? >> A Buick Cutless. It's an old like 95 Buick Cutless. Just old like red kind of like smaller. >> Okay. But redder in color, >> you said. Okay. >> All right. We'd mentioned that we've got some pictures of some guys. >> Mhm. >> That may or may not be the guy that we think might have been over there that you're describing to us. >> Yeah. >> And I've got a series of photos here. This person may or may not be in these photos. I don't know who all of these people are. >> Yeah. If you want to just go ahead and look at these photographs and if you uh see somebody that you recognize as being somebody that was present over it, >> I'll tell you. >> Okay. >> Yeah. >> And just here you go. >> This is him. >> What number is this? >> Number three. >> Okay. And this is a fellow that you would refer to as Yes. >> Okay. Can you just uh >> His hair looks way different than that. He looks way different than that now. I mean, not like way different. I mean, you can tell by his face, but his hair is much longer now. >> Okay. So, you're now his hair is longer. Is the last time you saw him anyways? Okay. Can you just uh maybe sign your name on the bottom of that? >> My name >> or your initials? >> And then today's date >> 30th. 2014. Okay. >> Okay. All right. >> So, the day you guys went over when you got the text from Bart, was that the same day that Harley finished his appointment or >> his appointment? Like, what do you mean? Like his NA appointment or meeting? >> Yeah, an NA meeting um at the detox building here in Virginia. And he had called me and told me he was home. So, I told Tim that I had to go home because I was in a roof of Tim. >> Then I came. >> What's Tim's number? >> You don't have a number. It's disconnected. >> Okay. >> I don't even know his normal cell phone number. >> Okay. >> I just only know his I He has a home phone number, but it's this old He lives with an old man. >> The Stacy. What was Stacy wearing? H. It was like a white It was a more fitted like t-shirt kind of thing like and it cut down and jeans. >> Was she still there when you left? >> No. >> Okay. She left before you? >> Yeah. >> Okay. >> She has a She has I don't know. They were going to drive to Dave's. >> Okay. >> Pizza or something like that? >> Do you remember what you were wearing that night? >> Um, yeah. black pants. Like black dress pants. >> What kind? >> Black dress pants. >> Okay. >> And a white just like a normal just plain white loose white t-shirt. >> A white t-shirt. >> Yeah. Um I was wearing a black zip-up hoodie and that's it. >> What kind of footwear do you have? >> White Nike. White and black Nikes. We wearing the same ones today. >> Yep. >> Okay. And did we go over everybody's clothing and stuff that they're wearing? >> I think so. But can I maybe I'm the only one here that's not Here's the Can you help me out here? >> What? >> Um now you talk about he was at We're talking about Harley. >> He was at AA meeting or detox. Yeah, it was. >> So, here we are today, the 30th Wednesday. Was that on a Monday, Sunday, Saturday, >> or Friday? >> Or Friday? What What day was it? >> I don't know. It wasn't Sunday cuz that's the carpenters building. >> So, we're out Sunday. >> I think it was Saturday. >> Okay. So, we believe it's Saturday is when aa and that was later in the evening. >> Yeah, he was done about 8:30. >> 8:30 p.m. Okay. And um so after 8:30 p.m., did he get a ride or do you pick him up? >> He got a ride >> back to Third A Motel from his friend Joe. >> From his friend Joe. >> Yeah. >> Who's that? >> I don't know what his last name is. He drives around a white. It's like a red It's a red like convertible thing. I can't remember what the >> Okay. So, he gets a ride and he comes over Third Avenue. >> Yeah. >> And is that where you meet him? >> Yeah. >> Okay. I mean you there >> it was way before midnight. >> Midnight. Okay. >> No, it was like probably like 11 11:30. It was early compared to >> compared to bar closing time and stuff like that. >> It was really early. >> So you leave there with Aishams or you >> Jimmy? >> Jimmy. >> About what time you think it is that they notice this uh guy's truck stolen from your apartment building? >> Um I don't know. They started pounding on my door the next day. >> Okay. >> At like noon. Okay. >> And then then I didn't even Yeah. I don't >> So that would have been on a Sunday afternoon. Okay. >> Okay. And then by about 1:00 or so, you guys are heading up to net lake. >> Like two. >> Tim, you and >> Yeah, like around two. I'm going to say I >> And Jamie's already gone. >> Jamie Aisham is gone. Yeah, I guess he was up on the res. >> No, let me tell you. I didn't find that out or even when they kicked me out on the 27th. >> Uhhuh. >> I didn't know what the reasoning was for. Like I was still kind of maybe kind of intoxicated. >> Okay. >> So, I didn't know why I was getting kicked out. I didn't even think to ask. But I called later on in the evening when I was with Tim Hamley at my friend's house. We just were like sitting there and I called I asked my friend Dylan Zer. I'm like, "Why was I kicked out?" And they said, and he told me, he said, "Because Jamie Aisham, stole Derek, that's the owner's truck, and went up to the res." >> Okay. So, they never really gave you an explanation. They just kicked you out and then you find out the reason afterwards. Okay. >> I So, I called later said they >> And then, uh, coincidentally, he had also gone up to the res. >> Yeah. >> Where Bart wanted to go. >> Yeah. >> Okay. Okay. After he left, after you got back to the >> your apartment, do you think Jamie would have went back to hang out with Harley? >> I don't know. He was so drunk he didn't he couldn't even walk. I mean, I had to carry him from US Bank to Third Avenue Motel pretty much. Like I had to hold on to him. >> So just when when you got back to motel, did he have a phone on him? Did was he talking to anybody when he >> I don't know. I just set him down and I emptied out my backpack looking for my cigarettes. I couldn't find him. So then I I was like I literally ran upstairs and came right back and he was gone. >> Okay. So about how long were you upstairs? You figure? >> I don't know. Like 20 minutes, maybe 15 minutes. I don't know. Cuz I had to stop at the bathroom to >> He might have been gone before midnight even. >> Yeah, he might have been gone before midnight. >> Okay. >> I don't I honestly don't know. I was I was I was intoxicated. I >> Mhm. >> I don't think >> Okay. Would he have forgot anything back at uh where Harley was with Bart? >> I don't know. >> I honestly don't know. >> Okay. >> All right. So then on Sunday you get woken up about the the car is kind of what we figure from the day because you say that Saturday here is when you guys head over to see Bart. >> Yeah. That's when all that drinking. >> So then you go to sleep >> Sunday morning late Saturday night >> and you wake up Sunday around noon. >> Yeah. to to the >> to them everybody pounding on my door telling me where is >> um who was with you last night and I'm like Jamie Aisham >> and they were like oh okay well then I don't know then I went to bed I went to the bathroom and I was walking back and they were like well we need to give you this no trespassing order >> okay then was it after that that Bart called you or texted you >> no I texted him >> okay you texted him after that cuz you're homeless basically wonder what to do >> usually He helps me out. >> Okay. >> He always He always does. >> And he suggested >> I go over to his friend Harry's. >> Okay. Did you go to Harry's? >> Yeah. >> Okay. So, then you go to Harry's on Sunday. >> Mhm. >> How long are you at Harry's? >> I don't know. Maybe an hour. >> Okay. And then you meet up with >> Tim. >> Tim >> to get a ride up to Net Lake. >> And then you guys pick up Bart. >> Yeah. No, Bart was already at Harry's. >> Bart was already at Harry's. Okay. What's Harry's last name? >> I don't know. >> You know where he lives? >> Yeah. Seventh Street South. >> The house number? >> No. >> Okay. You know what color it is? >> Green. >> Is it Is it a Does he live in the whole house or is it a >> No, it's in a It's in a garage apartment back. It's like a garage. So, >> okay. >> Does he live alone? >> No, he lives with his girlfriend or wife. I I think her name was Jan or Jim. Okay. They live like in upstairs above the garage. >> Okay. They have a big gray cat. >> A gray cat. >> A cat. >> I don't know. I didn't see a cat. >> Okay. But you went over there with uh Bart. >> Yeah. >> Okay. >> I met Bart over there. >> Okay. Bart was already there. >> Yeah. He met me out front. >> Okay. >> And I walked down there to meet him. >> Okay. And did you talk to Harry and and that lady that lives there? >> No, cuz Harry was drunk, too. He was sitting in the recliner pad just drunk. >> Okay. >> And that older lady, she didn't >> I know. She maybe like toast and stuff. >> Okay. So, she's nice. >> Yeah. >> Okay. And then Tim came over. >> Then we met Tim on Fifth Street in front of Jame Jamie's house because >> How did you get there? You walked. >> Yeah. >> Okay. >> So, we walked from Seventh Street South over to Fifth Street by one of our, you know, James Roy, right? That apartment. That's where we met Tim because I like I just fear it would be easier than having him like give him directions to all these new houses and stuff. So >> So we walked back to Fifth Street. >> Okay. Sunday afternoon sometime. >> Yeah. Like him. >> Was uh Mr. Roy home at that time? >> No. >> Okay. Did you knock on the door or anything? >> And there was no answer and it was locked up. >> Okay. >> So >> was um Bart was his attire. attire. Were you guys wearing the same clothes from the night before? >> Mhm. I was wearing this thing, I think. Yeah, I was wearing this sweater and it's a black pants I was wearing from the night before. >> How about Bart? What was he wearing? >> Uh, he was wearing like these weird like bright blue sweatpants and a black shirt with like a white skulls on it and designs kind of. Okay. >> Is that different from what he was wearing the night before? >> Did he say anything about what happened after? >> He said his pants were really dirty and muddy from the night before. >> Okay. >> So, he had to put on these other pair of pants over them jeans. So, he still had his jeans on from the night before, but then he was but then he thought he said he had to put on them blue sweatpants because they were muddy and stuff. >> Okay. All right. Um, did he say anything at all about what happened after you and Jamie left? >> No, he said that he said that he left and that he went up to North Side and he passed off at >> Did he tell you at one point that he left before you did or try? Yeah, he tried to tell me that, but I corrected him because I No, I No, that's not how it was at all. It was It was me and Jamie Aisham left and Bart and Oj and Harley were still there. >> Okay. Are there any weapons or anything like that around that apartment building or that Jamie's place? >> Yeah. >> What kind of weapons? >> Knives. I mean, no, I don't think there was any guns or anything, but there was Well, hold on. Wait, no, no, no, no, wait. O told me because when I was yelling at him, or not really. I wasn't really yelling, but whatever. He said he said, "Grab my gun to Bart." >> He mentioned that to Bart. >> He mentioned a gun. >> Okay. >> Okay. >> Where was everybody situated in there? >> Um, you walk in. Here's the kitchen. You go around the corner and there's like a living room. >> Yep. >> And there's like a couch right here. >> Oh my god. >> Yeah. >> I am more of a visual person. >> Okay. So, like here's the hallway that you go down and here's his door, his main entrance door. >> Now, this is the kitchen right here. And there's like a bathroom over here. But anyways, there's a living room right here. And there's a couch. >> Yep. >> And a recliner. And a recliner. And then this is where Harley was sitting. This is where I was sitting. Okay. So, I was sitting and OJ was right here. And that's Stacy. And then Bart was right here. And this is Jamie Aisham. So, >> okay. >> And Harley was sitting right here. And then Harley. And so we got up in this confrontation and I was like, it was me and him, right? I don't know. And there was the coffee table. So it was me and him and we were fighting and he told Bart to grab his gun and they went behind the couch. >> Okay. Me and him as in who were fighting? >> Me and O. >> You were arguing. >> Yeah. >> Okay. Was he standing up and arguing in your face? >> Mhm. >> Okay. And he told Bart to get his gun. >> Mhm. >> From where? I don't know. They start going back here. I know in this back corner there's like a little shelf in the corner kind of like crooked [ __ ] whatever >> and I don't know they start going back there and that's when I told Jamie I'm like come on let's go. >> Okay. >> Did anything I mean did the the argument deescalate or were you guys still arguing basically up to the point you left? >> Yeah. >> What was Harley doing during the argument? >> He was just sitting there. >> Okay. So he didn't >> I think I don't know if he got involved. I don't know because I went out in the hallway. Jamie took me out in the hallway and and then Bart came out there and he's like, "Yeah, you can leave." He's like, "Just go. Just go with him. He has money." >> Okay. But Harley went there with you. >> Yeah. >> Okay. >> And Harley said he wasn't ready to go when I I asked him if he want to help me carry Jamie home. >> Okay. And I was like, "All right, well, meet me at home and like try to hurry up." >> Okay. >> So, when you um return, you say you return to the apartment Sunday, it' be twice, correct? Cuz you returned initially when when Tim picks you up. >> Yeah. >> Okay. And do you guys try to get in the apartment then? >> Yeah, cuz Harley was there. >> Did you guys try the the uh >> Wait, try to get to where? Which whose apartment? >> This one here. >> No, I never. I only went there once. >> Okay. >> Yeah, >> cuz earlier I you guys walked in front of it to get picked up by >> Tim. That was Sunday. >> Yeah, that's what we're talking about. Which door was locked? >> Which door? I only know about this door. >> Okay. There's a hallway, a long hallway. They go Is there an upstairs apartment above that? >> Yeah, I think there's a lot of them up there. >> Okay. >> There's a couple different apartments up there. So, when we talk about a locked door, it's not an exterior door that leads to the hallway. It would be the door that leads right into the kitchen that's locked. >> Yeah. >> Okay. >> There's like a porch out here. >> Okay. >> And there's a couple doors. >> So, what I'm just trying to clear up because we've talked about multiple different things, you know, throughout, you know, our conversation today. So, we're trying to clear up is, you know, that the door you're talking about when you said earlier was locked is this door going into >> uh Royy's apartment. >> Yes. Okay. >> And when you guys returned the first time on Sunday when Tim was going to pick you up >> out front. >> Out front. Did you guys try and get in? >> Yeah, we tried opening the door and it was locked. >> Okay. So, the handle was locked. Okay. So, it doesn't have like a pad lock across the outside or nothing like that. It's just the door lock. >> Yeah, it was just a door lock. It had a It has a chain on the inside, you know, but usually that's how everybody gets in. Like you can slide it up. Bart Bart would slide it up cuz Bart lived there with Jamie. James Roy. >> So he has permission to come and go whenever he wants to basically. >> Yeah, he did up until that night and then he said he didn't know why. >> Okay. >> I don't know. >> Okay. So that's why he couldn't get in there to to get in. It's cuz the door is locked. The door lock itself. >> Okay. >> Yeah. >> All right. Well, that's pretty good. Good info. But uh >> so >> do you think Bart would have talked to anybody else besides you? And uh you said that guy that he's staying with where you met up with him, he was really drunk and passed out. >> What? >> That hairy or whatever? >> Yeah. He was just sitting in his recliner like he was [ __ ] used to. >> Okay. Where would Bart keep his clothes that stay at Roy? >> I don't know. probably in the bedroom somewhere. >> He was wearing the jeans from the night before, but he had this these weird blue sweatpants over him. >> Okay. >> Too like >> he said that they were dirty. >> Could you see any obvious signs that he'd been bleeding or anybody had been bleeding? >> No, he had all new clothes on. Like he didn't have the same t-shirt on, I don't think, from the night before. He had different t-shirt on. And then is there other people? I don't know. But he put on a these weird blue sweatpants over his jeans. >> Okay. >> Like if your pants are muddy from the night before, wouldn't you take them off? >> Sometimes. Depends if it's cold out and stuff. >> I don't know. >> Are those sweatpants have pockets on them or are they just like >> Yeah, they have pockets on them. >> Okay. Like cargo pockets or uh or just pockets to put your stuff in up high? >> Yeah. >> Okay. I don't know. They had they were cut up inside. So, >> yeah. >> I know. >> Um, >> who else does uh Harley hang with? >> Nobody. >> I mean, like when we're together, it's just me and him usually. >> And did we get his phone number? >> Who? >> Harley's. >> He didn't have one. >> Doesn't have one. So, you just have to meet up with him in person. stuff like that and you know his schedule holds for us. >> No, he'd just be home with me, right? >> You know, or he'd be like, "I'll be back in a little bit." He'd always be calling me from weird numbers, you know, like, >> "Okay, I'll be home in 20 minutes or whatever." >> Okay. Then you and Cody went yesterday to pick up Cody's friend down in Brainard. >> Yeah. Tiffany Jenner. >> Okay. with Jared for So Jared Overton gave us money and we gave him a ride over to Brainard to pick up Tiffany Jenner who just got released from the hospital. >> You find her? >> No. >> Can you call her or does she not have a phone? >> She doesn't have a phone. I don't know. I don't personally talk to these people. Okay. Like >> I only talked to Jared's brother Joe Johnson. We got in trouble together. I don't know. But I don't I we me and Cody, we were literally thrown into it like here you go. All right. Here's some money. Give him a ride. >> Okay. This fight that happened right when you and Jamie left was between you and Oge basically verbal and him threatening you. >> Okay. Have has uh Harley ever been physical towards you at all? >> No. >> Towards anybody to your knowledge? >> No. Harley's like he's really nice. Like he never >> Has he ever been in trouble with the police at all? I guess I don't really I haven't met him before. >> Not really. >> Okay. Where's he from? >> Hibbing. >> Okay. >> Hibbing area. He's kind of everywhere. He was living here in Virginia over by Saigon Cafe with his ex >> because they have a kid together. >> Okay. >> Up until like a couple months ago they broke up because she found out he was using drugs again. >> I don't know. Ashley maybe her name is or something. What kind of drugs would he use when he uses >> myth? >> Okay. >> He don't do nothing else. >> Not a pill person. >> Okay. >> I mean, he liked Oxy. Oxy Cotton. >> Was anybody around the house? >> Nobody. >> Were they anybody doing pills or >> No, it's just booze. >> What kind of booze did we had? Patone. >> We had Patone. We had UV blue and some vodka. I don't know what kind of vodka. It was just clear vodka. >> Was anybody cooking food or anything like that while you were there? >> Nope. >> Okay. Was anybody playing games, cards, watching movies, stuff like that? >> No. Everybody was just kind of like doing their own thing, you know? Like I was talking to Bart most of the time. Harley was talking to Jamie Aisha most of the time and then OJ and that one lady were talking. But then she left and that's kind of when everybody kind of got crabby towards each other. Kind of >> hostile after Stacy left. >> Yeah. Because Oh, I don't know. >> Did Stacy left right after she confronted Harley about about the supposedly stealing $300 from his mom? >> Yeah. >> Okay. Did OG get involved with that argument at all or Bart? >> I don't think so. >> Or was it just Stacy confronting? It was just Stacy confronting Harley. >> Okay. All right. How What's your impression of Stacy? She decent >> stupid [ __ ] She's mean inconsiderate. >> Okay. Of all the people present, if anybody was going to be mean or violent, who do you think would be most likely to be >> Okay. Okay. Um >> cuz really after me and Jamie left, it was only OJ and Bart and Harley. >> Okay. >> And Harley doesn't hang out with them. He's not a regular pale of those guys. >> No, cuz Bart and OJ are Well, I mean, Bart's my friend and OJ is Bart's friend. >> Okay. >> Bart. Yeah. I don't know. >> Okay. >> So, and it's But see, James Roy is Harley's uncle or so Harley told me. I don't know. >> Oh, okay. So, he's kind of related to the guy that owns the place basically. So, his nephew. Okay. All right. And then after that, I haven't I didn't hear from Harley. I figured he got mad at me or something. >> Why would he have been mad at you? >> Because I walked Jamie Aishim home. >> Oh, I think he'd get jealous. >> Probably. But he didn't really care at the time. But it's like I don't know. Like we quit talking. Like that's not normal for a couple quit talking, >> especially when you get along just fine. >> So So >> Okay. So did you And you tried to get a hold of him through Bart and stuff. >> Yeah. I'm like, what happened after I left? I'm like, where did he go? Did someone else come over? Did He's like, I don't know. He's like, I I went to Northside and I haven't talked to OJ. >> Okay. >> I won't talk to OJ. >> Okay. Would Cody have talked to Bart or Oj or Jamie? >> Cody does not talk to them. >> Does he know those guys? >> He knows of them. >> Okay. Not a friend or associate or Facebook pal or something like that. >> Okay. >> If Bart was going to North Side, do you know who he'd go see up there? >> I can't think of what the name is called that he said. Would you be able to show us? >> Oh, no. I don't know. I don't know anything about the people. I've He refers to them by their last name, but I can't even. >> You know what? He'd been going again up in North Side. >> Pot probably. >> Okay. >> He probably He said he fell asleep. I don't know. >> If Bart doesn't know, who else do you think would know how to get a hold of Oage? >> I know. Didn't I give you his phone number? Did I give you guys phone? Yeah, you guys did. your phone for a reason. That's what it was. >> My mom does not understand this. >> And he used to basically want you to go over to use drugs at his place. That apartment above 306 third. >> Oh, yeah. He was always We'd Oh, I don't know. We did some stuff up there. >> But that was when I was with Bard. I don't do anything when I'm with other people because I'm scared >> of other people. >> Mhm. >> But he would try to talk you into that or go away. >> OJ would. Yeah. >> Um OJ's number is 20248 11195. >> Do you think that's a good number for him? >> Yep. >> Okay. And I haven't looked at the obviously we look at people that walk in and up the sidewalk there and stuff. What kind of shoe tracks do these Nikes? They got like a great big star or a circle type thing and some Okay. Okay. I'm going to go see if these guys have any anything else going on. Um, obviously, you know, we're talking about probably something bad that happened with Harley, right? You know, cuz of the call we had earlier. >> Yeah. >> But we think it's him. >> Who else? I mean, who his closest relative other than you being a girlfriend? >> His I don't know. I don't know any of this stuff. I don't I told you guys everything I know. Okay. >> I don't want to be here anymore. >> I don't want to talk about Harley anymore. >> You want me to run you back home? >> Yeah, please. >> I don't want to be here anymore. >> Give me about two seconds. I just got to let the guys run. >> Yeah, that's fine. >> Janessa Lynn Peters was charged with seconddegree murder in the April 2014 death of Harley Joseph Jacka in Virginia, Minnesota.
