Okay. So, okay, we we got that. So, you didn't plan anything, but tell me what happened. You get to Sodas. Can I tell you that I know that at 7:11 a.m. around 7:11 a.m. you arrived in Sodas, correct? >> Okay. Well, I'm [snorts] telling you that you did morning. You did >> 711 in the morning is when you arrived that around about then because we have cameras all over that village. So, we have you driving that vehicle all around that village. On October 29th, 2018 in Sodus, New York, Timothy Dean was brought into custody in connection with the deaths of Joshua Niles and Amber Washburn, who had died as a result of a double homicide. Spoiler details are in the video description, and the full results of all charges in the case are laid out at the end of the video. So, the first thing I want to show you, you and I both know that you probably don't believe half the [ __ ] we say, right? All right. So, this is actually an extraction report yourself. Are you familiar with that at all? >> No. >> Okay. So, this is a conversation with Charlie and your wife. And you know Casey Miller? >> I know of him. >> Have you ever met him? >> No. >> Okay. Well, I'm going to ask you to look at the dates on these and continue all the way to the dates which is October 22nd, which is a pretty significant date as we all know. And I just want you to see right here conversation between the two. Okay, there's the dates of who they are, dates and times. And go ahead and go through them real quick. >> [snorts] >> I know you don't read that fast, so just >> So Tim, have you seen those messages before? >> Be honest with us. >> Not these. >> Okay. So you have seen messages between the two of them before. >> But do you know do you remember what the date was? >> No. >> This is a date that you you rent a car, right? Correct. What about this date? >> October 22nd. >> Okay. >> Did you remember that date, right, Tim? I mean, >> you know what happened on that day? >> Yes, I do. >> What happened? >> What happened? >> Murders. >> Okay. So, on the day of these murders, when you get here, [snorts] when you driving back from New York to here, this is what your wife is talking to another man about. Okay? I want you to read it for yourself because there's no way that you're going to believe anything comes out of my mouth. Let's see. Casey, are you sleeping, love? Why are you sleeping? So shitty. Okay. I love you, Charlene. That's your wife, right? I love you. This is her talking to Casey Miller, right? >> Did you know that they had a relationship? >> I suspected. >> Okay. >> Did you already know they were talking about getting married? You [ __ ] that guy. That That's you. He's talking about you. Okay. Find the one about the rings. Let's see. We do everything together forever girl. Good morning, handsome. Did she call that to you? >> Anything she does to another guy? But look at the dates on these. October 22nd. Where are you on the 22nd? You're up here in New York and sodas, right? Remember having that conversation? You're doing these things and what is your wife doing? All right. So, what I'm doing, I'm taking away what you were You just told us she suspected this stuff. I'm showing you exactly what she's doing. But I really want you to pay attention to this one here where they talk about buying a [ __ ] marriage ring. Okay. >> I saw it. >> You did see it? >> Yeah. >> Okay. So, I'm showing you this because this is undeniable stuff. It's an extraction report. Okay. This is her phone numbers and everything else. You're familiar with this paperwork, right? You've seen it in a job. Okay. Now, knowing that you're down here, you're down here, let me show you this. This is Casey's house. Who's that in the door? >> I already figured that, too. >> Okay. But I just want you to understand it. Some people, and I'm one of them, sometimes you, you know, you don't want to believe something unless the hard truth is in front of you. Okay? That's your wife right there at this guy's house. We actually spoke to this individual. Both of them are right now in my office in New York. Okay? So, I'm leaving here right now and we're going to explain to you everything she just got done telling us today and what Casey's been telling us about you for the last few days. All right? Because can you look at me real quick? I just I have a hard time hearing people. I make sure you're looking at me and I'm looking at you so that I know you're listening and I know that we understand each other. Okay? So, you got your hearing aids on. So, I'm not bullshitting you. I'm telling you the truth. All right? I have conversation face to face. I'm going to give you this information that you understand. I'm not just blowing smoke up your ass. And I'm not blowing smoke up your ass because you've been here a little bit. I've been here a little bit and so is my partner. All right. So, we're going to shoot straight with each other. All right. I think we owe each other that. I got no reason to do that. Do you agree? >> I suppose. Why would you have any reason to lie to me? I've never done anything to you and you've never done anything to me. I'm [ __ ] being honest with you and I'm telling you I'm being honest with you and I'm demonstrating and my my proof so that you know that I'm not making [ __ ] up. Okay. >> Okay. Because I think that you deserve that. >> Tim, how do you feel about the relationship that she has that that upsets you? Right. >> It does. You you you said you you loved this woman. Correct. And to me it sounded like you were trying to do things for her to make a better life for her, for you, and for your kids. Correct. You were doing all the right things to try to get your children back. Correct. You left your home. Correct. Why did you leave your home? >> CPS said. >> CPS said so. But but why? You could have easily fought that, right? And then your kids would be removed. You chose to make sure that your kids could eventually come back home. Correct. You you were making the right choice, doing the right thing. >> You made a father decision. I think that's an accurate thing. A father decision, right? You made the choice for them and not you. You feel the same? I'm asking if you look at me cuz I I can't hear everything. >> She's up in New York right now putting this all on you. You understand that? And this is no [ __ ] Okay, this is no [ __ ] You You're not going to let her do this to you. And in my opinion, as a mother, okay, you would never do that to your children, what she's doing. What do you think of her as a mother? I always thought she was a good mom. >> Okay. Do you think these are good choices she's making right now about her kids? You were trying to do the right thing for them, weren't you? Is that is that why you went to Sodas? You were trying to make this right. You were trying to get your wife with her kids. I mean, to me, that's actually probably the ultimate thing you could probably do. Cuz I think we always tell our children, "I'd die for you. I'd kill for you. I stepped in front of a bus for you." You actually did that. You actually did that. you put yourself, you said I kill for you for this woman to be reunited with her children. I think actually in some way, shape, that's actually admirable. You know, unfortunately, our society is a little different today, but I think you're you're old school. Would that be fair? And you notice I'm not really asking about the soda stuff because I don't know if you you remember running by the mail lady. After the shooting, you ran through the back area. You ran right past the woman delivering mail. Okay. She saw you had a Hispanic woman that watched you change inside the car. >> Described your hat color to the the neon green the marker in her in her own hand. It was phenomenal. which is also on a door a doorbell camera when you walking down and back up and down Carlton Street in addition to seven hours of video footage we have you from the bank the schools the local police departments cameras all over that little village you remember the sheriff's car that was running license sirens after you got an 104 you were leaving you went around 104 and you saw a school bus you remember that school bus I got a really good picture of you off that and then a sheriff's patrol car come right behind You actually went right past each other. You don't remember that. But I got that in camera, too. >> Tim, you were you were you were >> That's why I'm not going to waste my time asking about this stuff. Okay. Can we reestablish that you were there? >> And and that's the biggest problem that we have. I want you to understand at this point in time, we're here. We We came 23 and 1/2 hours. You know how long that drive is, right? How long did it take you to get there? Not counting your crash day. >> Takes longer than that. >> So where did you leave from? You left from >> the cr where you crashed. The town that you crashed in or >> Yeah. >> And what town was that? >> Emporia. >> Emporia. Okay. So you went from Emporia, Kansas to to Sodas, New York. Did you drive straight through? >> No. >> Cuz you got to tell me how you did it. [ __ ] We took turn. We started asleep. >> Okay, here we are. It was 20 23 and a half hours the way the way that we came. Where did Where did you stop? You took off. You stopped. You took a nap. >> I sleep in the car. >> You slept in the car? You just pulled over on the side of the road or where were you when you did that? >> Wasn't keeping a log. >> Okay. I mean I mean did you stop at a rest stop, a gas station? >> Sometimes. >> Okay. Yeah, you did. You did both. >> Do you remember where you were when you stopped? >> I really don't. >> You don't? What was going through your mind? >> Did Charlie actually try to stop you from coming up? That's what she told us. She said that you crashing was was a bad sign that maybe you shouldn't come up here up to New York rather. >> Did she say that to you? Tim, >> you know we're not bullshitting. Did she say that to you? >> I don't remember what she said to me cuz my plan was to go put a bullet through my head. >> Okay. And things changed. >> Things changed. Correct. >> Well, I'm still here. >> Yeah. So, I think it's fair to say things are dynamic, things are fluid. They change all the time. I mean, honestly, in this whole situation, >> I mean, >> Josh is the problem, right? I mean, is this what we're thinking about when we're on our way to Sodas? Josh is the problem. >> How much money did you have on hand? Cuz I know you didn't plan on using credit cards, you know, to try to get another car because you weren't planning on crashing. Do you remember how much cash you started out with? >> Couple hundred. >> You know how you got it? Do you remember? Now, remember, we got your bank documents. So, like I said, Tim, we want you to be honest with you at this point in time. We know you did it. Now, now we need to know, like I said, if you're if you're going to if you're going to man up, if you're going to take responsibility and do the right thing, >> and I just proved you that I don't lie, but I showed you the documents to back up what I was telling you. Okay? And I'm also asking you questions that, and you know this because you you did the same thing before. We know the answers to the Ask questions, right? Ain't that how it works? [snorts] And why do we do that? because I want to make I want to make sure that you're being honest with me. So, if you tell me something that I know is not very true, then okay. Now, I'm not typically going to believe anything else comes out of your mouth because you just lie about something really simple. And my question really simply, you have to start out with where'd you get your money. >> I mean, like, who cares where it came from, right? >> It It took you more than 200 bucks to get down and back, right? >> Let's be honest. We I know it did. We We just did it. So, >> I mean, Charlie told her she had tried calling her your second round, but they wouldn't take it over the phone. I mean, she brought you there. She she she set up the uh the whole setup with your buddy there to get to the first car. You know what I'm saying? So, she's talking to us. Are you seeing a pattern of what's happening here? It sounds like to me you were trying to do the right thing for your family. And it sounds like to me all she was trying to do is just make you do something that that that you didn't want to do. Actually, like I said, somewhere down deep. I It's kind of admirable, but that you know what? You're probably one of the few people I know that would do anything for somebody. You don't see much of that anymore. But Amber, have you ever met her before? You know that she had a little kid, too? She was a mom. Did you know that? Can we We know that your wife bitched about them all the time, right? Let's be honest. She hates her gun. She [ __ ] about him, right? >> Yeah. >> Okay. So, you knew who she was, right? >> I knew of her. Yes. >> Okay. So, when you saw her up and soda, you knew who it was. >> I've never been up close and personal with that woman. >> She never She never came down with him to get the kids. >> Well, I think it's fair to say when you're in a driveway, you know who she is. It's probably a good [ __ ] estimate there. Cuz you want to know how I know that? And again, do you remember the house next door to North? There the woman sitting there in the kitchen window the entire time. >> Watch you in your driveway. Watch you drive. >> Remember when Josh Remember when Josh was leaning on the tailgate while you were talking to him >> and she was sitting in the car a little forward? How would I know that? >> And after you shot her in the head, car just rolled backward. You took off running back. Can you get the picture for me? So, did you know her little kid from the back seat? He's watching. I know you shot Josh first, then you shot her, and then you went back. Really good shot placement right behind the ear. And that's that's that's huge, dude. For somebody here, >> what's that? >> You had it right on top. >> I'm pretty sure that was on the desk in there. I never stop. >> Tim, I just proved to you uh all these things that your [snorts] wife, soon to be ex-wife, however you want to view it, you're not a good person. Hey, I got that. You got yourself in a real [ __ ] [ __ ] deep problem here. And I don't think it's fair to you to shoulder the whole thing. Okay, this poor girl. This poor girl right here with a child in the back seat. I got a picture of her at McDonald's 20 minutes before smiling and laughing. She had no idea 20 minutes. >> This little boy. This little boy. I know you saw him back there, right? >> Look at the bull hole behind you >> sitting in the backseat of the car. Are you going to do the right thing? Tim, if you've done if anything comes from this, you've got to do the right thing. >> She didn't do anything to anybody. Nothing. >> This tells me this wasn't personal. >> Her biggest mistake. showed up. >> Her biggest mistake was falling in love with a guy that your wife happened to hate his guts. Okay, so she might not have been the smartest thing, but she didn't do anything to you guys. >> Tim, did she show what when did she show up? Was she there just for a few minutes? How long was she in the driveway with you guys? >> Right behind the ears where your bullet went. Right behind the ear. Single shot. That was your second shot. The first one you shot, Josh. And then you know what you did? You did just like a failure Joe on the range. You said tap >> train >> tap >> trained. Mom and you tracked Josh on the ground. >> Do you know that we knew you were you were trained in what you did? >> Your shooting pattern showed skill. That's what we all do in range. >> Were you on you did it? But that's ingrained cuz you shoot a lot or you did shoot a lot. At some point you shot. >> Were you a range instructor? >> No. Do you ever take any courses in instructing and shooting? Yeah, if we could tell. >> In the academy, you shot quite a bit, right? You shoot on your own. >> Tim, how long was she in the driveway? Did she just Did she just pull in the driveway when you got there? >> I want a lawyer. >> Okay. Well, what's his name? Temp is asking you why you're letting your ex-wife take the let you take all the shoulder list. >> I don't think any good can come from continuing this without legal advice. >> Well, you know what good could come from it? Can Can you just think of these kids? Can you have some compassion for these kids? What good can come from it? I think all three of us in here have already established we can't change history magic. We can't change what happened and all right in here is trying to make it so you're not doing this alone because this ain't just you. I mean, are you going to be okay with that? With Charlie just not having any any ownership in this? Tim, you going to be okay with that? Answer me. Yes or no? I'm not okay with any of this. >> Okay. >> And you should be >> and you shouldn't be. >> But I don't know why you continue to let it happen. >> We're not going to sit here and scream at you. We're just trying to sell you see reason. >> Dude, we drove 23 and 1/2 hours to to to let you have a voice. >> Dude, we're being told a lot of stuff >> because like I said, you we have tons. They've told you what we've already taken. Now we've done a search executed a search warrant on your house. What have we gotten there? You know what's there? You came back to the house. You brought those things back to the house >> in your other house. In your cars, the rental cars, your financials, your phone. Come on, man. You've been through this. You know what we can do. >> Tim, how long was Amber in the driveway? Did she just pull up? Tell me that one. Did she just pull up when you arrived? Tim, can you do that for me? You didn't mean to shoot so hard, did you? >> Were you just trying to ask him to get the children back so that Charlie would be happy and the [ __ ] went sideways? Tell us it was a mistake. That can only help you. I get she comes out of family court all pissed off and just kill him. Okay, we can make that happen. [ __ ] people say steel all the time. >> When did you guys have family tour up here in New York? August what? >> I don't remember the date. >> Okay, well I can tell you it was August 15th. August 15th is when she starts her relationship with Casey. >> August 15th. How about rekindles? Because you know they had a previous relationship, right? >> You do. Okay. How do you know all this? Did she tell you this? >> Okay. What did she tell you about the relationship? >> She told me she'd dated him in the past. >> Okay. And then they just started talking via Facebook or saw each other. >> Okay. >> Did you know that he got arrested for dating her? >> Yeah. Yeah. >> So, that kind of weird to go back to somebody did she get arrested? >> She claimed her mom or dad got them arrested for it. >> Okay. I mean, it's neither here nor there. It was an age issue, right? >> Apparently. >> Okay. So, on August 15th, you guys leave court. Okay. She makes threats to the, you know, to the effect that she wants somebody shot. Correct. Did she say that? I'm not asking you if you said it. Does she say that to you? >> I don't remember what she said. She was mad. Yes. >> Okay. She was mad. Did she say anything about she she wanted somebody to be shot? We should just shoot them. They should just be dead. something to that effect. >> Possibly. We don't Who doesn't say [ __ ] like that when you're pissed off? >> Absolutely. And that's kind of kind of where I'm going with that. >> Did I write down everything that we said to each other? No, I don't know. >> But she was angry. She was pissed. She makes those comments and that same day she makes these comments to her husband who she's planting the seed in his mind right there and then and you have no idea. Okay. And then she's here talking to this some some other random dude. How did you find that out? >> Building this I love you relationship within days. Within days. I think it's two weeks that I love you starts coming out. Okay. >> Ringside. It rings. >> And then we're going to get married. Okay. >> Cuz I found out a couple months ago, >> okay? And >> I mean, I couldn't prove nothing. >> Okay. >> But we can't know. Oh, I got so many more. I have 346 [snorts] pages of communication between the two of them. I just gave you the the the first when it started and the most recent 346 pages of messages, video chats between the two of them over the last few months. You're not her white knight in shining armor anymore, man. She's throwing you on the bus. She said she tried to stop you. She told you not to do it anymore and you said, "Fuck it. doing it anyway. >> Was that said when when you when you got in the wreck in the car? Did she tell you this was not a good idea? Or is that a lie? >> Is she lying to us? >> Tim, the only way that this is going to get better is if you just I know you want to. You got here. You had to take a [ __ ] right? You want to know why? It's called stress, dude. So, I have [ __ ] flashbangs through my window and >> Okay, that's not going to make you [ __ ] >> Okay, ain't the first time you heard them go off. We all have our room. It's >> the first time I've woken up to him. >> Okay, I'll go with that one. >> Tim, it's like I said, it's not a matter of whether you did it. We know you did it. We drove 23 and a half miles. I'm going to keep saying that to you, okay? Five of us detectives from New York, we know you did it. We have plenty of evidence to prove. And now that we've executed our search warrants like we wanted to, we have a lot more evidence that to prove that you did do this. Okay. We know you did this. Now you need to tell us, are you a monster? Okay. Or did you you told me you were you were depressed, right? Is that what was going on? Thoughts of suicide, right? Your head wasn't right. Correct. What did she tell you when you finally turned your phone back on and told her on your way back? >> Was she Was she appreciative at least? >> Did she thank you for what you did? >> They 15, 16 minute call, something like that. >> Yeah. >> Yeah. Your first phone call is to your wife who you love that you just did something for to make her life better so she could get her kids back. What was her response when you told you when you told her? >> Was it what you expected? >> I think the conversation that you think we had isn't the conversation that we had when you >> this is your opportunity to tell us. >> You don't want us to jump to conclusions or guess. Why don't you fill in the blanks and tell us? Why wouldn't you do that? I want to understand. I want to know. And you should want to tell me. Hell was bells, man. When you asked your daughter if she ate a cookie, do you want her to tell you the truth or lie to you? Cuz you already know she did. You can count. You can see the crumbs on her lip. It don't help her none when she lies to you. It don't matter how old you are. It's all the same game. Just tell us what the conversation was. Was she mad at you? Tim, look at me. You can't even put your head up, man. >> Put your head up. >> And you're not going to be able to until you until you get this off your chest. Do the right thing. How many years did you interview people? It's a legit question. How many years did you do it? I don't know. >> Yes, you do. How many years you have on a job? >> If you're writing a traffic ticket, you're interviewing somebody, right? You know that. >> How many years you got? >> Eight. >> Okay. So, for eight years, eight years you did that. All right. I got 17. What I 18? She's got 20 going on 21. Okay, we got a little more time than you, a lot more experience. We know typically all the physiological aspect. The fact that when I ask you a question and you won't look me in the eye, it's not really a good sign. All right. So, I'm asking you to look at me, I'm asking you to please look at me in the eye so I can I want to leave you. All right. Was she mad at you on the phone call? >> No. Was she appreciative? That wasn't the phone call, man. >> Okay. So, tell us about the phone call. >> I told y'all I'm done talking. Why don't you want to help yourself? Let me ask you that. >> I'm trying to help myself with an attorney. >> Okay, that's not my question. The question is, you know, you got stuff that you didn't do, then tell us. >> You drove yourself. >> It doesn't matter what I say in here. >> Why is it? >> Yes, it does. Yeah, it absolutely does. >> You know that [ __ ] too. You talk to people that you've talked to people that told you the truth and fix my problems. You know this. Don't even start that [ __ ] So when le let's let's make it as basic as somebody getting a traffic t ticket. If they plead not guilty to something and they bring it to trial and they don't own up for something they've done wrong and you bring the law enforcement officer in. Who wins 99.9% of the time in a traffic ticket? If somebody doesn't own up to what they did, who wins? The law enforcement officer, right? And you're telling me you never investigated a complaint turned out to be a [ __ ] complaint? >> Yeah, it turned into a [ __ ] complaint. How'd you know? Because you investigated. That's what we do. We're here to listen to you and you ain't telling a [ __ ] So, how the hell are we supposed to do anything? And I can tell you right now that when we go to a judge, especially with a crime like this, you know what happened, okay? Two people were shot in the middle of the day in a very small town. Okay? They had small children. Okay? This is >> Jeffy's car. >> This is big. Okay? We know you get it. There's no doubt in our mind. There's nothing you could say. We know you did it. Now you need to take ownership for it. This is going to be a matter of okay, can we go to the judge and say, "Hey, you know what? He's remorseful. He was not his mind wasn't right. He was depressed. He was suicidal. Having issues with his wife, lost his job. I mean, seriously, you have a a [ __ ] sandwich just delivered to you day after day after day. Am I right?" >> Most men, >> this is your opportunity to make it right. If nothing good comes from what happened. Okay, cuz there's two people dead, right? Two people dead. One that I know you didn't mean to shoot. I know you did not mean to do this. I know you did not go here to shoot this girl. Did you go there to do this to this girl? And >> I know damn well Charlene shouldn't be walking around with Casey Miller. >> Tim, did you go there to shoot this woman? >> I didn't go there to shoot anyone but myself. >> Okay. Well, unfortunately, two people got shot. Okay. And you're not one of them. Did you mean to shoot this girl? >> You guys weren't even fighting when you were first talking to him. He was leaning against the person. >> Okay. Tell me about that conversation. Tell me about the conversation you had with him when you first walked up to him. What did you say to him? Was he shocked to see you? >> I imagine a little something along. Can you please get the kid back to my wife so she'd be happy? fix my life too and probably told you piss >> do the right thing. You wanted him to do the right thing. >> You made a mistake. She shouldn't be freaking, you know, have a result of her kids taking too. That's something along that we marked up the right tree here. Actually, we're very familiar with Josh, too. So, for him to lean against the tailgate and just be talking to you nonchalantly, it doesn't sound like you approached him all aggressive or nothing. >> Did you go there for a fight? Tell me that. >> Yes or no? >> No. You did not go there for fight. So, did you go there to try to talk to him about the children? Yes or no? >> And I want you to be honest. Here's your chance, Tim. Lying is not going to benefit you in this. [snorts] I'm telling you, it's not. >> And when we say we're walking out of here, we're literally going back to New York. So, not get a second chance at this. >> Did you ask him to return the children to your wife? which would be a legit conversation to have. >> Tim, >> we know this didn't go the way you planned it. So, tell us what you did plan. You're trying to freaking push [ __ ] back together. >> I didn't plan anything. >> Okay. Okay. So, Okay. We We got that. So, you didn't plan anything, but tell me what happened. You get to Sodas. Can I tell you that I know that at 7:11 a.m. around 7:11 a.m. you arrived in Sodas, correct? >> Okay. Well, I'm telling you that you did. You did. >> 711 in the morning is when you arrived that around about then because we have cameras all over that village. So, we have you driving that vehicle all around that village. Would can you tell me that you were driving around the the village for a while? >> Yes. Okay. A very distinct Hyundai. >> Again, in a small community, Tim, this is the unfortunate thing for you. In a small community where everybody knows everybody, you could tell it was a small community, right? >> Would you? >> Only a couple roads. Eight maybe. >> Would you agree that I mean, you drove a lot of them, didn't you? What was going through your mind when you did that? Be honest with you. Be honest with me. I don't care if it was I was thinking about where I was going to go shoot myself. I was thinking I was going to go, you know, uh, steal something. I was thinking about just going to take a nap. What was going through your mind? Just look for a spot. >> Okay. Did you find any spot?
