I've got paperwork here. Who's that? I've got some felony corporate warrants. Okay. So, I'll have you list So, what are you going to say except I refuse? Yep. No. Yeah. No way. Yep, I would like to say I already spoke to you yesterday. I'm sure. All right, I told you I have charges for you. I have them. You don't have charges for me. No. I do. No, you don't. Yep. What What was the crime? What was Charges for what? What crime? From the domestic that happened on the 27th. There's no domestic there. There was. Why wasn't I charged? Hello. My name's Dan. Hello. So, what happened today? So, it's his weekend. He has my little ones every other weekend. >> Okay. Um he was mad that I wanted them to stay again. So, I was going to get them and he um had stopped responding. He wasn't answering my calls or texts or me knocking on the door. So, I thought maybe he had fallen asleep. So, I opened the door and stepped inside and he was sitting right there and he came over like he came He was sitting in the chair. He came running over. He grabbed a hold of my arms and he raised his fist to me like he was going to punch me in the face and then let go and then re-grabbed me and turned me the way that it is the front door is here. He had originally slammed me into this wall and then slammed me into the open the door into the open the door to the open door and my arm hit the hinge. My oldest daughter was sitting in my car and watched the whole thing. My two toddlers are inside. Every time >> Inside the house or the car? Inside the house cuz I was trying to get them. He wouldn't answer for me to get them. So, like I said, I thought he'd fallen asleep. So, I just opened the door. Okay. And so then I'm I grabbed the kids. She My oldest jumps out of the car and she comes up to help me and says She asked me if I wanted to call the cops and with the kids were upset. I didn't want to do it in front of the kids. So, she helped me grab the babies and then I just put them in the car and drove them home and then I came down here. But, this is an ongoing thing. This isn't the first time. This is the reason why I left. Um and I had a restraining order and it had just expired a few months ago and I want that reinstated. I don't want to have contact with him. Okay. He And also I'm pregnant and he knows that. So. Do you need to go to the hospital or anything? I mean I'm very anxious. I'm not feeling right but it's I anxiety. The only thing that hurts is it just my arm stings and he grabbed Where he grabbed me was my shoulders. He was going to punch me in the face. He didn't actually. He stopped himself. But I don't need to go to the hospital but I don't I want a I want a restraining order back in effect and I I don't know how I don't I need to refile court papers for custody because I cannot do this anymore. Okay. Well, I'm just making sure. I'm not saying you have to go to the Yeah, no. If I felt I like I I feel very I'm crampy but I know it's anxious. I cuz he touched the front of me like in my stomach. Okay. Obviously, you know better than I do about any of that. So, I just wanted to make sure you didn't need an ambulance or anything. Okay. Are you guys divorced or >> never married. We were together for 17 years. There is a history of domestic. After I had originally moved out, it's been a little over a year now. He kicked in the door at my first house that I moved out to, went through court, through all that. There was a restraining order. For the sake of trying to co-parent, I reduced it to a refrain from which I think it just expired in September and I think his one-year conditional just expired. Um but he's clearly not learning and I'm trying to co-parent and I'm trying to be amicable and I'm trying to be the bigger person and I can't. I can't deal with him anymore. So. How old is your older daughter when you say older? >> She's 17. And my two younger ones that were with him the were 12 and 10. >> [snorts] >> So, we have 50/50 custody. Um but he his visitations are every other weekend. Only the younger two are required to go because my other three older children do not have contact with him. Okay. So, they choose not to have contact with him. My 12-year-old, she's iffy. She doesn't go there, but she'll talk to him if he reaches out. But my 17 and my daughter will be other daughter will be 15 tomorrow, they don't even have any contact with him. Okay. And just so I'm understanding, the 17-year-old was the one that was in the car and then how old are the two that were in the house? Three and five. Three and five. Okay. Those are the two that I was picking up. Okay. Were they Where were they when this occurred? >> Penelope was in the other room and she had come running out, my 3-year-old, and Elliot was right there. He was sitting in the chair that he was sitting in with him when he jumped up and came at me. So, Elliot saw everything. Okay. All right. So, Elliot fell asleep on the way to town. Um, so I took them home with my my oldest just cuz I wasn't sure how long I'd be here and I didn't want them to have to sit around. They're little kids. So. And there's Is there anyone else at the house with him right now? >> other At his house, I don't Not that I saw. I literally was right in the entryway. I just opened the door and stepped into the little footing area. If anyone else is there, I didn't see them. Okay. He is not pleasant though. Okay. So. And he just tried to call me, too, and I don't know what he tried to call me for. I didn't answer. Okay. You Do you think he would go to to my apartment? >> Well, I told him that I was going to have him arrested before I left. Okay. So, I don't think that he is that I don't know. My daughter would have called me if he was there. >> And that's here in the village. My apartment. I'm in the I just bought a house in Canandaigua, so we're kind of transitioning. But right now, uh, but if he was there, my daughter would have called me already. Okay. All right. Well, he's going to have some more questions for you. Okay. It's been 2 weeks, but we're here now, so I'm not going to They didn't want her child. No, you don't. What? No. I'm not going I told you last night. >> You called me last night to tell me that you supposedly have these. I did. I'll take the papers, you can leave. I do have these. It's off. What? Um I wasn't there, so I don't know what happened, but it's 4:00 now. If >> I'm not going down there. >> Hey, just just listen to us. Hey, we can either bring you so you can get a arraign to get home by 6:00. Okay, but that's what we're trying to help you out with, okay? If we >> go there, sit in jail, what's that? Like a slap on the What's that? Like a What's that for? And get a arraign. Why do I got to do that? >> to called you last night about that. >> No, you wanted me to go there last night at 8:00 at night and sleep there. >> That's what we're trying to avoid. That's what we're trying to avoid. If we can get you there now, we can get all the Is there Is there anyone who can come and help out with your kids? It's not happening, though. I'm not getting in cuffs or going nowhere for you guys. No way. But Paul, it's something that's It's not something that's going to go away cuz we we will get one. You don't have nothing. Right. >> You got nothing. All you got is hearsay and them pieces of paper. So Huh? I'm not going. It's not happening. We're We're trying to come out here and tell you what the options are, okay? You can come with us and have someone watch your kids for a couple hours until we can get you back home, or we will come get you with a warrant and then you won't have a choice. >> Next? How about 2 more weeks, come with a warrant. >> That's not how that works. You know that. I'll be back later. You just show up at my house and take me looking this crazy. Hey. Hurry up. You should have brought Dagan or somebody that I care about cuz you guys I've I've never dealt with you, Paul. I Like I said, I wasn't there. I don't know what happened, okay? But we are we are trying to help you out and get you home as soon as possible, which is why we're here now. So we want to get you there so we can get arraigned at 6:00 instead of being morning. All right? So you're only going to be there for basically as long as it would take to process. And then you're to arraigned and then you get really At 6:00. At 4:00. Correct. Instead of having to sit overnight Why would I have to go down there and sit for 2 hours? Cuz I Obviously, you got all the information you need, right? I don't think you do have all the information. That's why it takes 2 hours for you guys to get me. [ __ ] out of there, stop. For me to answer your questions, sit there in the little room like I have never been arrested before. I'm not going. You can't make me go. Get a warrant. You're not coming in here. That's it. That's all. Did you give him his stuff, okay? >> Get Is there someone who's going to be able to stay with the kids tonight? No. Okay. So, that's going to be an issue, Paul. Because if we come back with a warrant tonight, your kids are going to CPS. Okay. Okay. You're not scaring me. I'm not trying to scare you. You're not scaring anyone. I'm trying to give you all the options because we are trying to help you. >> the options. I will go. Wait. Wait. Wait. No, you don't. Go ahead. Go ahead. Go ahead. >> me up. I'm in the system. I've been there before. Look me up. It's the same. Papers like no. >> papers. This is just where you have to call the courthouse, okay? If this All right. That's why I'm doing it now. I can't. Yeah, but there's still verbal arguing going on. I'm sure one of one of the female parties does come. So, I don't know if my neighbor my old neighbors would be helpful. So, there's no way that he didn't see, but he is also friends with Paul. So, I don't know how helpful he will actually be. Okay. Yeah, cuz I was texting and calling when I I was there. Between 6:00 and 6:15. And I sat there in the driveway. Every time that I go to pick him up, he makes me sit in the driveway for 15 minutes before he brings them out. This time he just wasn't answering. So, like I said, I went up and knocked on the door a few times. He didn't answer. So, I just opened the door cuz I thought maybe he fell asleep. But he was not sleeping. He was He's ignoring me. Val Matt Hill Road. And that's in Branch Port. And I don't know if I can get in trouble for opening the door and going in. I mean Has he ever told you that you were not allowed to do that? No, and he knows that I was coming there and my name is also on the house. I own half of the house. But he also didn't tell me that like he when he brings the kids to my house, he just he just brings them in like cuz when he's not being like this, it's he just as long as we don't communicate, he just opens the door and brings the kids inside and then leaves. Yeah, no, if it's if it's commonplace for you guys to do and he's never told you that you couldn't do it. And like you said, if you're still on the deed, then Yeah, my name is on the title. Okay. I don't go in there because I try to avoid being in closed spaces with him. I usually wait outside, but he wasn't answering. Okay. I don't know if you're not there yet. Yeah, I'm not there yet. I will be there. Okay. Are you Are you injured in any way or I just have just this scrape on my hand. I don't know. It wasn't red at all. Other than that, I just hit the hinge of the door. Okay. I'll take a picture of that. Yeah, you can. I have my daughter took these two when I left. I don't know if you want these. You can I don't know what you can really see. It was a little bit more red, but you can't see as I mean Okay. I'll take a picture of that one if you don't mind. Which one? Um You can scroll. Feel free to scroll. That one. I'll do a Okay. [snorts] Do you guys have a child in common? We have five. You have five. That's why I was there also picking up my other two. And you guys are formally married? No, we were never married. You were never married? Just former dating partners? Yeah. See. And then did he make you feel fearful? Yeah. And can you describe that? I wasn't here. So, he just So, he when I when I opened the door and walked inside, he was in a chair in the living room and came up and [clears throat] came at me and grabbed a hold of my shoulders and slammed me into the wall. Raised his fist like he was going to punch me in the face, stopped himself from punching me, and then turned me and slammed me into the the door The front door was open, so he slammed me into the front door, and that's when my arm hit the hinge, and then pushed me out onto the porch. >> Okay. Was there any weapons used? No. No, okay. Does he have access to guns? I'm not sure. I haven't looked in about 2 years, and I haven't I don't go inside, so if there's guns there, I'm not sure. Okay. Did he make any threats to you or your children or anything like that? Did he? No. I mean, if previously has he ever made threats, yeah, but in this exact second, no. No. And you told him you were calling, so he's probably not going to answer the door if we go out there, right? Probably not. Was there any children that witnessed any of this or did you Yeah, my 3-year-old and my 5-year-old were inside. They were inside and they witnessed that. My 5-year-old witnessed all of it. My 3-year-old came running out um as he was like as he was shoving me out onto the porch, she came running out through the kitchen. Okay. We'll just do both of them. What's uh the first one's name? Elliot Carrick. He's 5. And then Penelope. And then my oldest daughter was outside, but she saw She didn't see the initial push into the wall, but she saw the push into the door and then out onto the porch. Okay. And what um the second Penelope? Is her last name Carrick as well? >> Yeah, all They all have the last name Carrick. And is their current address technically yours? Yeah, I have custody, yeah. Yeah, and then my 17-year-old also was She wasn't inside, but she was outside and witnessed it. Okay. That's Trinity Carrick. Um like I had an image of me in these things, so I lessened I asked them to like lessen it for the sake of the kids. Okay. And so they did they offered him a one-year conditional, but I don't know if it's still in effect or >> Like a conditional order of protection or conditional >> a one-year conditional for like getting in trouble and that we had a restraining order, but I think it that I got reduced to a refrain from, but I like I said I think it expired in September. Okay. All right. I will let I had a one-year conditional from court, but I think it just expired. Like what they had said is if he gets in any trouble for like the same thing within the one year then they would reopen what he was originally charged with from the last domestic thing, but I think that >> Okay. I understand [clears throat] what you're saying. >> [snorts] >> I'm going to go look into that order and just make sure it's not in effect, okay? Okay. And this first name was Paul? Yeah. Okay. All right. So, with these, all right? Um [clears throat] I do offer everybody the opportunity to write a statement about what happened. Yeah. Um so, if if you would like to write a statement, just kind of summarize what happened, um you're more than willing to do that. If you don't wish to, you don't have to. Um it does help with, you know, charges and stuff like that. It does usually help with that. So, that's normally when I try to you know, have people write them, but you don't have to. It's 100% voluntary, so if you want to write >> order last time. Okay. So, if you want to write what happened in there, um you just go through. If you want to stand up and use that, too, you're more than welcome to. Yep, I yeah. So, just write down here and start here and just go in kind of order of events of what happened, okay? >> Okay. Definitely if he does come to your house, we need to know about that. But we're going to end up going trying to make contact with him. That'll be our next steps and um see if we can get him to come out. It sounds like we do we would have a a charge to bring him in on to hold him to get a rain for a a order of protection. Okay. And that would happen if we were able to to make that happen. It'd be in the morning. Okay. Um and that's kind of how we would be going with that. And someone would contact me? The court. Cuz I'm not going to stay home tonight, so I'm going to take the kids out and I'm going to go to my boyfriend's house for the night. That's why we put your phone number on there, too. Yeah, we can give you a call if we can't, if he won't answer the door. Okay. Obviously, we're going to have to apply for a warrant. Right. And then my question is is so I don't know if you guys will be able to answer this, or if I need to call my lawyer. Um I he's not supposed to have the kids again for two weekends, like in not this weekend, the weekend after. This would be sorted out by then, so that I would know, cuz I don't want to get in trouble for withholding them, obviously. Right. I would suggest, no matter what we do tonight, that you go to family court tomorrow. Oh, okay. So, just go there. With the DA. And that's all I need to cuz we do have a custody, so I I would just need that to refile, right? Ask for an order of protection, and in safe harbors can help you with that. In that application, you can ask for a change of custody. >> custody. That doesn't mean the judge has to grant it. >> Yeah. But you can ask for it, yes. But at the very least, the even if he doesn't grant not they're not going there, the likelihood of him granting going through a third party would [clears throat] do they do that? This is all new to me. Um the third-party visitation is an option, but being that one of the charges is going to be against the two children that do have the visitation, I would think they would be included in the stay-away if that's what you're asking for. Yeah. Again, it's completely up to the judge, but that that doesn't I just want to make sure I'm doing what I need to do on my part to follow what the order already has, so I'm not Yeah, you can you can list the two little ones in the stay-away order if that's what you're asking. Is that what you're asking? Basically. >> I don't think that he's aware of the stay-away order right now, so Yes, because if the judge grants you a stay away, one of them puts you and all of those kids that was pursuing any custody Anything. Anything. Okay. Okay. All right. Thank you so much for your help. All right, that's right. I really appreciate it. Like I said, I'm not going to stay home tonight, so I will Make sure one of us calls you. Yep, we'll give it get contact. Yes. Yeah. For clarification, I get super emotional. I'm sorry. Okay, it's fine. So, on the 27th I filed a statement against my children's father because during the pickup he got physical with me. Um so, I filed the statement, CPS met with us. Um my 17-year-old daughter, my 5-year-old, and my 4-year-old were there. Um and when I followed up with Officer Lane, it was like a week later he said he had enough. He said that he was not Originally, he told me that they had enough to push charges. Okay. When I spoke to him a few days ago, he said that he no longer had enough to push charges because it was just his statement against mine. Um my 17-year-old daughter witnessed it, and I asked him He took a photo of my arm, which at the time was like a scratch. It turned into a bruise a few days later, which I told him I had photos of. Um and my 17-year-old, she doesn't have a relationship with her dad. She wanted to make a statement, and he said that even if she made a statement and even though that they have the photos that that wasn't enough that they had presented it to the judge, but the judge said it wasn't enough >> So, so It's okay. Do not do I just have a question. So, your the 17-year-old daughter, she witnessed this incident happen. >> Yeah. Okay. And I told him that she just I didn't she didn't make a statement, I just made a statement. Right. Were they aware of that at the time cuz you came down here to report this? Right? >> Yeah, I put right in there so that my 3-year-old and my 5-year-old were inside of the house. Um and my 17-year-old 17-year-old was in the car. So, what happened is he had slammed me into the wall, the front door was open, grabbed me, and slammed me into the front door, and then out onto the porch. So, she saw the door and out onto the porch. >> Okay, so so I'm just to clarify, she she was out of the car while this happened she saw from outside. Okay. >> outside, not the original wall but the door and then out onto the porch. She got out of the car and came up, helped me get the kids because my 4-year-old Penelope came running and then my son was sitting there and he saw it. They met with CPS, they told CPS and then when I spoke with CPS after the officer told me that they could no longer press charges, she told me that um he admitted. So officer So deputy So that one of the other officer went to speak with Paul that he denied anything physical and said it was all verbal. When I spoke with Kristen Plater, she's our CPS, she said that he admitted to her that um it did get physical but that I initiated it by opening my door and walking inside. Okay. So just to clarify for you, anything he says to a third party, we can't use that in court. So that is If he admitted it to one of us, we would be able to. But when it happened to a third party. So um I'm I'm somewhat familiar with this um So just to give you some clarification on how this all went down. Um they initially filed for a warrant based on your statement alone, which isn't enough. Okay. Okay, just so you understand that. So I saw that in the paperwork and I asked them to hold off on that and go investigate further and go talk with him. Okay. >> However, the information that you're giving me now is that your daughter is a potential witness to this and you haven't spoken to her yet. No, but I told them that he admitted that on the phone on Weds- Okay. Let me be correct that I give you the correct date. Probably that Tuesday maybe? Um whatever date he Tuesday or Wednesday? Okay. Shortly after 5:00 p.m. Um I know because I was very very upset and distraught over it. Okay. Well, so I think I think this warrants us looking into further at this particular case um and we'll do that, okay? Cuz I'm not So, this has been go It's This is a long time coming. Um, I protected him for a long time. We haven't been together in 2 years, and I am pregnant, and he knows that. So, clearly he's not going to He still thinks that he has the right to do it, but my frustration came from when I talked to Deputy William, and he didn't seem He made me feel like like it wasn't a big deal, cuz I said to him I said, "I have pictures, like cuz the original was just like a scratch, but a few days later you can see the scratch, but there's bruising around it." That's the door handle. Are there still marks there? Um, I don't think that there are, but I have the photos and the timestamps. Okay, so you you took some photos. You took some additional photos yourself. Right, but days later, yeah. I took photos. It I can show it to you. It just started to bruise around it, and I didn't realize at first cuz I couldn't really see it, but it got tender. So, I took those on the 30th. The 30th. So, this is the 30th. It just started to bruise around the initial scratch, which the photo he took you can see is the initial scratch. And I told all this So, who who took these pictures? >> My friend Elizabeth took it at work. >> Okay, okay. Um, because I couldn't get a good angle, but my frustration comes from I told Deputy William this on Tuesday. I told him that my 17-year-old witnessed it, and asked if like she's willing to make a statement. She doesn't have anything to do with her. And he said that it wouldn't be enough, there's nothing that he could do, that I needed to do it through the family court. Okay. Which I did file through family court. I filed an emergency modification to have all pick up and drop offs in the family law and case department. Okay, you guys you guys have a custody agreement? Every other weekend, and but I have like the court final in that we can't agree. Um, so I filed an emergency modification. It's very messy. Um, my CPS worker um, when she originally met with us with all of the things that my kids told her, she had originally told me when she was leaving that I didn't need to do an immediate modification because that CPS would be filing neglect charges on their own. So, I held off because I was waiting cuz if that was the case then I was just going to go for sole custody. Okay. Then she informed me when I reached out to her Tuesday that their attorneys didn't think that they had enough to go for neglect charges. So, then I went out with the modification on Wednesday. So, Was that granted? It was yesterday. So, it's just temporary until we have they just decided to court the 15th. So, you're supposed to do pick up and drop off for you here in our our department here in our >> In the municipal, the Penn Hills Police Department will do >> Okay. Yeah, that's fine. I got you. >> at 5:00 on Fridays and Sundays, um, that's what our pick up days are every other week. Is the police department aware that that'll be happening? I notified them that I submitted the order and Kristen was supposed to let them know. Okay. I'm just going to type them just to make sure that they know that that did get granted and that's going to be happening. >> So, that was temporarily granted until we and then he scheduled the court date for the 15th, but um, my worry is is that he's mhm, but to him he's just it's like just another day like and Well, I mean, so I I actually just started here. Um, I was a I was a sergeant with the police department for for 6 years. Um, I'm just transferred up here. That's why I have another sergeant here with me today. Um, so, Trenton's uh, filling in for my deputy, okay? So, sometimes getting started in this job it's difficult to understand how to navigate some of these more difficult conversations. I don't think he intended, you know, to to come off that way cuz like I said I have talked to him uh, personally about this case. I was the one that kind of instructed them to do some more follow up uh, to you know, do do their own investigation essentially. So, I didn't get the sense he didn't care about it. I think maybe it's just a sense of like, okay, things keep changing and he maybe he's not quite Yeah. keeping up with everything that keeps changing. Like, what you're telling me changes a lot about how we're going to look at this case. So >> told him too cuz it's in my statement that she witnessed it and that she can confirm Okay. So, that's something I will look into because that wasn't something that was initially very clear that there was a witness to this. So, we'll definitely look into that further. Um and I can talk to to Deputy Lane a little bit just about probably his delivery it sounds like was was what Yes, when I I told him oh yeah, because when I said, "Well, I have updated photos where you can see the initial scratch but there's bruising around it." My daughter >> Okay. I didn't initially bring her I didn't initially bring her. I didn't call the cops when I was there because I'm trying to shield my kids from as much as I can. So, I brought them home and then I just came to the station. >> Okay. Um so, I didn't bring my daughter with me initially. So, it probably would have been helpful to at least bring her as a witness. If she if she had to stay and watch the kids, I understand. But, okay. And that's fine, but yeah. Like I said, from the initial report I got, it wasn't clear that there was a witness to it. So, that was that was one of the limitations we were looking at in this case cuz it's like, yeah, it looked like it was just one word one person's word against another. So I understand. And I also did tell him our my ex-neighbor, Al, he lives across the road. He was outside but he is also a friend to Paul. So, the likelihood of him being of any help is not. Well, I mean, that's something we can look into, too. But, um so, if if you're satisfied with that, I'll have a conversation with Deputy Lane just kind of about his delivery with that and just making sure he's trying to give you guidance and of, you know, obviously this is an emotionally charged situation for you and your family and sometimes deputies can come off cold and uncaring. It's not necessarily how it was meant to be, but, you know, communication is important and verification and we need to make sure Sure. If it is possible because if it is, I want charges to be pressed. Well, we're certainly going to look into this this new information with the case and we'll we'll investigate it as as thoroughly as we can and certainly we want to talk to your daughter at some point it sounds like so um Can you spell it for me? T R I N I T Y Okay. Does she have a cell phone or anything like that? Yeah, well she's out of school hours so >> Okay. Well, we won't try and call right away but like I said we will try and reach out at some point. So she lives with you full time? Yeah, they all do right now. >> Okay. Okay. So what what I'll do cuz I I I'm not going to be 100% but I don't remember seeing her name on that initial report. So I'll verify that she's added to that and then we'll certainly want to speak with her probably at some point. Um Are you working tonight? Are you on this wheel? Yes. Okay. So I'll probably reach out to the sergeant of the evening shift. Uh we didn't have one the night you came in to report that. So I'll reach out to him and make sure he's aware of what's going on and he can kind of be on top of things to follow up and then at some point I'll I'll meet up with W. And you know, just explain to him the conversation we're having here about kind of how how that conversation came off on your end. Okay. And you know, the importance of making sure that you know, people understand that we you know, feel We feel something we're here to help them, you know, like that's not that's not that's not how we want to come off but if that is how it seemed we would like to try and rectify that. >> like he wasn't taking seriously was just my plea that like that someone witnessed it and that Okay. >> it wasn't just it cuz when I said that he's like I'm sorry there's nothing that I can do. Okay. And he may have misconstrued something I said to him about how this isn't very strong case as we had it. So maybe maybe that's it's something as simple as that. But we'll we'll kind of talk to you and we'll get it sorted out. If you're okay with that that's that's where it'll kind of go. Yeah, well I'm not looking to get him I was just um I wanted clarification because I've been struggling with the understanding of like I finally am like doing what I had been Yeah. scared to do for it was time. Well, and it's it's tightrope to walk for for someone in your position and and it's it's good for us to explain and and I'll I'll do that. You know, obviously we have to have a case we can present, you know, in court that's strong, you know, because we get a lot of reports of things like, "Oh, this happened, that happened." It's like, "Well, we have no evidence to support any of that." It's very difficult for us to take that in front of a judge or a jury, you know. No, I understand that. And so we try to make sure that we're we're being thorough and we have the evidence we need before we go into that. >> So that's really what this is all about. It's just making sure we're we're doing our things correctly and and W and and we're still learning a lot of things. So, you know, this just we'll chalk this up as a as an opportunity to improve and hopefully we can help you out, but we'll definitely look into it, okay? All right. Thank you so much. And the other kids other kids were in the house too, right? Penelope and Elliot. So they they are the younger ones? >> ones. Three and five, right? >> five. I think those are the ones that are on there already. >> Okay. Yeah. So, um, Penelope didn't witness it. She came out at the very end. She was in the other room. Okay. >> But my son, so the way it's set up is the doors are here. There's a chair right here. Uh, my son was sitting in the chair. So, um, I was there for pick up. He wasn't answering my calls or texts. So I assumed he had fallen asleep. So I just opened the door and stepped inside. He wasn't sleeping. He was sitting there just ignoring me and that he was very irate that I was inside and that's when he got up and came at me. Okay. >> But, um, so Elliot technically saw it, but he saw this. Right. Elliot, yeah. We don't we don't want to involve kids that young. >> No, and I don't mean to either. To that level, yeah. I don't want to upset them either, but Trinity, like I said, she didn't see. The way that it's set up is, um, that like the door is right here. So when he hit me the door and this that's when it he slammed me against the wall here and then when he turned me it was into the door and into the door hinge and then pushed me onto the porch. She saw into the door and out to the porch. She didn't see the whole thing. She only saw what she could see from the driveway. Okay. >> Cuz the front door was open. All right. Yeah, so like I said, I'll I'll talk with them probably tonight. I would imagine they'll probably try and reach out tonight to to talk to her. Will they be able to talk to her in person or That would be best. I think if she if she has that kind of information, they're going to want to have a statement form filled out and everything. So, yeah. If uh and you guys are right here in town, so it shouldn't be too hard for you. >> Yeah, she has she has plans tonight, but I'll see if she can push them off. >> it's necessary, one of them could stop by the house even. So, yeah. But, uh that's kind of how we'll go forward with this at this point, okay? Thank you so much for your time. Thank you. >> You're welcome. You can just go right out through that door. Yep. Trinity? Okay, how do you spell your name, Trinity? Oh, just before we get that far, uh the one thing I got to get over is you're okay with me talking to Trinity? Yeah, I consent to that. You consent to that, and do you also consent to her giving me a statement >> Yes. about this? I'm okay with her doing so. Okay. I T Y Okay. And do you remember what happened when you remember when it happened? Oh gosh, I don't remember the date. Okay. Um do you remember what day of the week it was? It was a Sunday. >> It was a Sunday. Okay, does the Was it last month or this month? Well, this is May, right? We're in May. So, it was last month. Does the 27th ring a bell? Sound about right? Right at the end of The day before my dad's birthday. Perfect. Yep, so 27th. We're We're on the same page. Okay, so can you kind of explain to me what happened, what you saw? So, my mom and my dad were arguing on the phone Okay. >> cuz my dad waited until we were like almost to his house to pick up the kids like we do every Sunday Okay. >> to be like, "No, I want them to stay at my mom's." So, my mom said no. Mhm. And when we got there, we sat in our driveway for like 20 minutes waiting for him to bring her out and he never did. Okay. So, my mom called him like three times and he never answered. Mhm. So, my mom went to the front door and knocked on it a couple times and he didn't answer. [laughter] So, she just like opened the door to go in and >> I saw him grab her by her arm and pull her in. And pull her in? I didn't see what happened while they were inside, but then I saw her get pushed into the front door. Okay. Obviously opens inwards, so the door got pushed back and then she came pushed out onto the porch. Okay. >> And then I got out of the car and I went up there. And you went up? And the kids were in the doorway with my dad and the dog and they were crying. Okay. And I picked up Penelope. Okay. >> No, my brother. Elliot picked up Elliot. I picked up Penelope and she and I picked up Elliot. >> Okay. And we took them to the car. Okay. And I remember my dad was yelling at her like get out of the house or something. All I remember is get out, but they were he was like yelling at her and I just took Mhm. And went back to the car. Okay. All right, so I can do this one of two ways. I can ask you questions and then I can just write down your answers or if you're if you want to, you can write it down, too. Either way is okay with me. Write down my answers to you. Um so, either um I can ask you questions and just write down your response or I can have you write down and like an order of events of what happened, what you remember and then I can read it and I can ask you more questions from there if I need to. Um either way is is fine with me. If you want me to write it or you to write it. Okay. So, I guess I'll give you this um and then what I'll have you do is um try to try to write down like um the date and then where you were. All right, like where it happened. If you don't know the whole thing, that's fine. I can just answer you. That's That's fine. Um so, we'll do that then. Then I'll once I'm done with all this, I'm going to have you read it just to make sure that everything is in your words. I'll let you read it, too. And then we'll go from there, okay? Okay. All right. Yep. So, the first question, um it's a simple one. So, was there a time on Sunday, April 27th, 2025, that you were at your father, Paul's residence >> on South Volunteer Road? When we were there to pick up the kids. Other than that, no, I did not. Right. So, you were there. Yes. Yeah. And then the next question, do you recall the reason why you were there? Yes. And what was that? To pick up the kids. My mom was with me. You were with your So, your answer is going to is it going to be were you by yourself? By yourself? >> We went to pick up my brother >> Perfect. Yep. And then the next question, what do you recall happening, if anything, that day? Um like at my dad's. Yeah. Okay. We [clears throat] went to pick up the kids, and my parents were arguing, and when we got there to pick them up, my dad was not answering the phone. He's not bringing the kids outside. >> [music] >> Okay. And then my mom went to the front door, tried going inside after knocking. He didn't answer. Before that, how long was it? Um >> You mentioned a time earlier, how long you waited. >> We just sat there waiting. >> Okay. After about 20 minutes, my mom went to the front door and knocked. When my dad did not answer, she tried going inside. I saw him grab her, pull her inside, and then saw her get pushed into the front door. And then she came out and got on the phone. You said you um You didn't answer the door, she went inside, I saw my dad grab her, and then what? I He She got pushed against the front door. Okay. And then like specifically she was against the like door frame between where the hinges are. Okay. And then she got pushed out onto the porch. So my next question is going to be what happened after you saw this happen? I got out of my mom's car and went to the front door. Um my mom was standing outside the door on the porch and my little brother was still standing in the doorway with my dad and the dog. His dog. And um I picked up Penelope and my mom picked up Elliot. And I took them to the car and left. >> [snorts] >> Wait 1 second here. We're going to go in here so we can talk in here. Come in here. >> [music] >> Does it matter to me? We're private. Yeah. All right. Yeah, if you guys want to, we can go in here so it's a little more private. Just in case people come in. Um I didn't know if they had court today, so see that door open. Thank you. Thank you. Perfect. Yeah, you guys sit wherever you want. Okay. So after that you said you got in my mom's car and went to the front door of my mom. And then you picked up Penelope or no, that's not what happened. You said you saw Penelope Oh, my dad and my siblings were in the driveway, yes. >> [clears throat] >> Is in the driveway? And after that you said I picked up Penelope. Okay. My mom had picked up Elliot. And we went to the car. Okay. Okay. I'm trying to think of how I would my question. Um Well, you're fine. I've been the same way lately. It's like my first day not being that way. It was in the tropical you had last weekend. Oh, man. That'll do it. Yep. So, we've had too much of it. >> [laughter] >> Um so the next question, do you recall anything happening after you guys went to the car? Not that I remember. I was pretty upset, so. Okay. I just remember telling my mom she needed to tell the police and I kind of just don't remember the rest of the ride. And then do you recall how your brother Ali and sister Penelope felt when you were in the car? Um when we were in the car after like 10 minutes they had stopped like crying. But when you got in the car? They were crying. Okay. So then after you leave in your brother's house, do you recall where you where you went? To my house. To Okay, it's your mom's house. Yeah. >> [snorts] >> Okay. Perfect. And the last question is going to be a very simple one. What is your mom's name? That's right here isn't it? Okay. All right, so I've got to do I'm just going to read over this just to make sure that everything is accurate to what you said. Just to make sure I didn't write anything wrong or miss anything, okay? If there's anything you feel like I missed or you want to add, just let me know. >> [clears throat] >> Mind the chicken scratch. This weather changes got the allergies going, huh? Oh my lordy. Mhm. I can imagine. That makes it tough, too. Goodness. So it takes out almost anything in the last 24 hours. Yep. No, it's so you just have to read it. Yep. That's That's your statement. Um [snorts] I like to tell everybody, too. Um so, just make a line here. So, this line I'm making just means that nothing else can be written in your name, okay? Um 1 2 8 7 9 2 May Okay. And like I tell everybody, um this is a written statement and a if anything's found to be untrue, um it can be punishable by class A misdemeanor. I don't think you're lying to me. I just like to tell it to everybody so they know what they're signing to, okay? So, what I'm going to do, in this line that I made, just write your initials on there. And then once you're done with that, where it says signed, just sign your name right there. Can you step outside for me, Paul? Can you step outside for me? No, I'm not coming outside. You are coming outside. I have a warrant for your arrest. I am going to jail, but I got to put my shoes on. You know, I'm not going to run from you. I'm not going to fight you. I got to put my dog in the cage. I understand that, but give me a No, don't grab me like that. Well, you've been elusive all my life. Okay. Hey, and what is the warrant? I got a copy in my car. You can see it. No, we're going to need to go get it, right? I'm going to put the dog away. Right. So, I'm going to jail. I got a copy, you know. I'm not going to run away. I'm not I want to see the warrant. Me ball. Me ball. He's not mean, dude. Don't worry. He's not He's not mean at all. Come on, buddy. I want to see the warrant you're doing. I'll come get you, okay? All right. >> [snorts] >> I don't know how I don't know how All right, see you. Me ball, get in there. Is that actually his name? Yes. I love that. He's a good boy. You don't have a warrant for my arrest, do you? >> We do, man. What's it for? The domestic dispute that happened a while ago. You'll get copies of everything, so you'll know what it's about. >> quick. Get you done. You don't want to freaking let this hang over your head, you know what I mean? We definitely wouldn't be here unless we had one, you know? Not our first stop in here. Yeah, and I get better at telling people. Yeah, that happens. How long am I going to be there? All night? Um probably. I'm going to spend the night there? I don't know. Depends on if we can get a judge out or not. >> What time is it? Spending the night there. That's [ __ ] We'll see. proof of anything, so I don't know how you got a warrant. >> I don't even know what it's about. All I know is it's a warrant. >> That's what court's for, man. Oh, he's so sexy. You guys can follow me. I need some socks. All right. Actually, I got socks [clears throat] right in this suitcase. >> [snorts] >> Yeah, it's our job. >> [laughter] >> You guys can't put me in that car without showing me the warrant. So, can one of you stay here and the other one go get >> We'll show you the warrant. It's not Then I'm not going out I mean, come on. You guys can't just do that. >> We wouldn't be here if we didn't have a warrant. >> people out of their home at 7:00 I obviously you do. Well, because we have a warrant. Where is it? Why would you not bring it? Why would you not bring it with >> We don't need to bring out a copy. >> It's a common we >> out in the car, I'll show it to you. I want to swipe your card. How about that? I guess that's it. I don't even know I'm afraid to do my wallet. I don't I don't even think you need that. >> Whatever you The less you got in your pockets the better. Nothing in your pockets is a stick up on you at all. Go ahead. We'll check you out at the car. I have nothing. I'll cuff you out by the car. I'm not cuffing you here. We'll cuff you out up front as long as you can. Hey man, I need the key. I do need that cuz my door doesn't lock. Shut up. Yeah, poor dog. I know it sucks but you'd rather take care of it than just a bunch of [ __ ] It's still the inconvenience no matter what day it gets taken care of. Uh this front front one here on the other side we'll go over here. I'll put him in the front for claw for me, all right? You need You need to have more room in this car. I believe you. I've been in both of them. Be careful now. I got bad wrists. I'm not going to fight you guys. I'll make sure they're nice and comfortable. Are they too tight? They feel good? They feel good there. All right. It's 1:22. I've got to check your pockets all. I know you said you didn't have anything. All right. I probably could hang it on the nail or under the porch. As long as I don't leave anything in there. And I got my [snorts] cell phone. Where's that at? Right here? I got you. Here but that's where I keep it. You got to slide it all the way over my head. I'm not going to take it off. I'll let the jail take it off you but Nothing on it. It's my buddy Mike Griffin passed away. I got you. Will it come off easily if I slide it to wait All right, I guess I'll do that for the jail room. I'll leave this [ __ ] thing. My buddy's in here. I'm clean. Thank you.
