I'd like a real officer here that understands the law. When your own mother no. >> Ma'am >> No hell no. >> to walk to the car, okay? >> Then I hope she's under arrest, too. >> She's not under arrest. >> Why? >> January 28th, 2025. Police respond to a domestic dispute, but what begins as an argument over a phone quickly turns into a battery investigation with visible injuries. One woman says she [music] was attacked, the other claims self-defense. Subscribe to Redefining Justice and let's see what the body cam reveals. >> What happened after we left? >> She's gathering [ __ ] all over the place. She wants now she wants the cell phone that that she turned off and won't let her have it. You called 911. >> Uh-huh. >> Which is a good thing. >> Did she do that? >> SHE DID THAT. >> WHAT WHAT WAS she doing when she did that? >> Well, she was gathering [ __ ] on my side of the bed, to you know, to charge the phone and [ __ ] And um [ __ ] and um I was trying to take it back away from her so that she can't get it. Um and then after that didn't work, she took her forehead and she slammed it right into the end of my nose and I'm still >> a headbutt? >> Yeah. >> Okay. >> And I'm still seeing stars. It hurts so bad. >> Okay. You want the fire department to come check you out, make sure you don't have like anything weird going on? >> Um if they could. >> Okay. >> I don't think I need an ambulance, but paramedics or somebody to look at it. >> Did she try to fight you for the phone? >> Um but she's in the house and I don't know if I press assault charges on her if they could do a um medical check on her while they have her? >> Well, well, medical checks and charges are two different things. You know, the criminal and mental health is >> Yeah, that's what I was afraid of. >> Mental health people sometimes commit crimes but it's not like you go to the hospital instead of going to jail type of thing. Do you mind if I take a picture of your your bite marks there? That looks pretty >> Yeah, and it hurts really bad. >> And then she got you in the nose right there you said? Anywhere else [snorts] that she hurt you? >> No, just those two places. I left the room and came to call you guys at that point. >> Okay, and you were able to get the phone that works? >> Well, well no, I have the one that doesn't work but I can still call 911. >> Oh, okay, I got you. >> Yeah. >> And this was still all over the phone? >> Yeah. >> She still arguing about the phone? >> Yeah, she wants this phone from me. She don't want me to have it at all. >> what side of the bedroom was it? This side or that side? >> It's this side. >> This side right here? >> Right inside that where the air conditioner's at. Those two windows is where the bedroom is at. >> Okay, and so she was you guys were fighting over the phone. >> Yeah, she pushed me. >> pushed you and then Did she bite you? Did she bite you? >> Well, I WAS REACHING FOR THE I HAD MY HANDS ON THE PHONE, the charger and she had her hands on the charger and so she so she just bent over and she just bent down and bit my arm trying to get me to release the charger. >> So she So you were just holding the charger and that's when she bit you? >> And she just bent down and bit me. >> Okay, it wasn't like you were like pulling her hair. It was you were holding the charger and she just jumped down. >> And she bit me trying to get me to release the >> And then after she bit you she That's when she headbutted you? >> Yeah. >> Okay. >> So I had the charger the whole time. I didn't have the phone at all. >> And and who had the phone? Was it you or >> Yeah, the phone's been in my pocket but she wanted me to give it to her and I wouldn't give it to her. >> And then you wanted the you needed the charger. >> But I need the charger to be able to charge the phone when it goes low. >> And then she wanted the charger and not let you use it. >> She wanted to keep a hold of the charger to make sure that I can't charge the phone. >> So [snorts] she's kind of trying to hold it hostage KIND OF. >> YEAH. >> OKAY. AND WHEN it wasn't going her way, she bit you. >> She bit me. >> And then head butted you. >> Yeah. But she'd already tried to get a hold of my purse. She was going to steal my purse. And I got that back away from her. And it's just been >> One thing after another. >> Yeah. >> Well, do me a favor and hang out right here. I have the the fire department to come check you out. They can run some like vitals. They could probably clean up your your bite mark cuz you know, you don't want to you don't want to get it infected or something. >> down further cuz there's even um like holes down here. >> Yeah. Well, you hang out right here. Let me do some stuff on my computer real quick, okay? Hello, police department. Can I come come talk to you over here, okay? Is it okay if I come over here? Okay. Any weapons in the home? Anything I should know >> She has some guns over there. >> Okay. >> Um how do I know know >> No. Okay. Just do me a favor. Just don't >> Um I really want to keep my cell phone on so that I can make sure that I'm being treated for at least this time. >> That's fine. You can put the phone down whenever you need to. Just make sure you don't reach for anything, okay? And we'll be good. Okay. What do you have right here? Is it like a bag? >> It's my purse. >> Okay. Just don't reach in there. I know. I'm asking you not to reach in there. I'll put it right here, okay? >> to reach for anything. >> Okay. I know. So what's what's going on today? >> She bit my face after you guys came out the first time. >> Okay. >> I told you she assaulted me. She jumped out onto my back over a cell phone. >> Okay. And this happened the first time we came? >> Yeah. Right before you guys came in the first time. >> Okay. >> And the officers thought it was funny >> [snorts] >> because I think [clears throat] she really needs to be put on a psych hold. I mean, she has to label her meds as to what they're for. >> Okay. >> Um >> So what happened after they left? >> I came in to grab on phone cuz I was going to go up to Nissan and straighten out what's going on with my car. >> Okay. >> And when I asked her for my cell phone, she looked at me and she said, "You don't need it." >> Okay. >> My account is in my name, my name only. All the devices are under my name and my name only. And I've already reported the tablet stolen, because she would not hand that over, either. I don't need it. >> So, you came over here to charge your phone and >> I came over here to get the cable to charge my phone. And that's when she started getting on top of me, trying to yank stuff out of my hands and claim that I did not need to do anything, that I paid for everything and all this other crap. She refused to get off me after I told her to several times. >> Okay. >> And when she still refused, yeah, I bit her to get her off me, on her left wrist. And side. When she still refused to get off me, I head butted her in the damn nose to get her off me, cuz she was physically sitting there. >> So, where were you guys exactly? In this spot, right here? >> Yeah. >> And she was How was she? Like >> Over the top of me. >> Like sitting straddling over you? >> She was damn near laying on top of me. >> Okay. What was What was the purpose? What was she trying to get from you? >> She was preventing me from charging a phone, so that I could call you guys. Because the first time you were out here, you thought it was so funny. And I told you if she assaulted me again, I was going to defend myself. >> Okay. >> So, I did. >> So, I guess what I'm not getting is So, we left and >> understand. >> Okay, well, that's why I'm asking you these questions, okay? So, we left and you were going to call us right back and she just started jumping on you. >> was going to go up to Nissan to get my car. >> Okay. >> Because Nissan's been holding it. >> And she was refusing to let you call Nissan. >> refusing to give me any kind of phone, period. She has my phone. >> Okay, that makes more sense. I was trying to figure out why you were calling in the first place. >> to give me any [snorts] of my property. >> Okay. >> Back. >> All right. >> because she had If you look in that um middle pocket there the stuff that is loose was in her purse. >> Okay. When you bit her, you said it was her left wrist? >> Left inside wrist. >> So she must have She was facing you or how did >> was facing me. Literally like facing me right here. >> And was she like sitting on this desk? >> Damn near, yes. >> Okay. And so you bit her and then what happened after you bit her? >> She still refused to get off me. And I kept telling her to get off of me. And she still kept fighting over a stupid phone cord, not wanting me to charge this one so that I could call you guys for help. >> And then >> And after that since she would not get off me, you're damn straight I head butted her in the nose cuz her face was right here. >> Okay. All right. So initially she was stopping you from calling Nissan and then you told her you were going to call the >> me from calling anybody. Said I did not need a phone. I did not need my tablet. I did not need anything. >> Okay. All right. Uh let me wait till the other officer's done talking and then he'll come in here and we'll figure everything out. What's the plan after this? Like are you going to >> I want her arrested. >> For? >> Really? If I have to head butt somebody to get them out of my face, there's a reason. >> Okay. Oh, I'm just asking cuz you said you want her arrested or if there's anything else that occurred, right? >> I think she needs to be put on a psych hold. >> So let's I'm asking you this. If there is if we do have to leave without charging anybody, are you >> be leaving without charging anybody, officer. >> Okay, then. Well, I'll come back and talk to you then in a little bit. I'm trying to help you out as much as I can. >> trying to understand why she can assault me. >> I get it, but I'm trying to figure out what >> also a disabled adult. >> Yes, ma'am. So, you're trying to contact Nissan, right? >> I'm trying to get up there to get my car. >> That's what I'm asking. So, if if any worst-case scenario, we can't arrest anybody, you can I give you a ride to Nissan? Would that be a possibility? >> Yeah. >> Just so we can separate you two. I get it, but again, I'm trying to figure out the end game here and how we can help you out as best as we can. Okay. I'll be right back, okay? So, what looks like is going to happen now, okay? Is based on what happened earlier today, the threat she made towards you, and calling dispatch saying what she did to you, you telling what she did to you, and you have a bite mark and a red nose, consistent with everything that you've done, we have probable cause that she committed battery against a household member, okay? And in New Mexico, it it it it doesn't matter if the victim wants to pursue charges or not, the state is the one that actually pursues charges because it's a family deal, okay? Um so, she's going to go to jail. All right. She's going to get charged with battery against a household member. I know you brought up the fact of like maybe she can get some mental help or something like that. Maybe this is what could be ordered by a judge or something when the judge reviews this case. Maybe they can look at it and be like, all right, cool. Instead of jail, maybe she needs to go get some type of treatment or maybe she needs a therapist or maybe the judge can actually look at the case and be like, instead of jail, we need to look at a different alternative thing to make everybody better. You know what I mean? Cuz you are mother and daughter. You guys have a relationship. You live together, all that stuff, okay? So, you know, we're not just trying to throw people in jail and forget about them. >> Is Is there any way that you can make sure that she leaves her cell phone here? >> Um I can ask, but I can't like start pulling stuff out. If she wants to take the stuff I went through to the jail, we can take it to the jail. >> Um the reason I'm asking is since mine is turned off, >> Mhm. >> that way I can call and try and get this started, and that way we can maybe move forward with I'm getting her car. >> Yeah. Like I said, we we ask if we can leave this stuff in here, but I I can't with property we can't we don't have any say so really. >> Yeah. >> Um, if she wants to take it with her and you don't have a phone besides the one that you can call 911 with, I would recommend like maybe go to the neighbors, call a friend, be like hey can I borrow your phone, I need to make a phone call real quick, blah blah blah blah and >> Yeah. >> just get something set up in the meantime, okay? >> Yeah. >> Um, do you have any questions what's going to happen right now? All right, well I'm going to go talk to my partner and we'll we're going to get her put in handcuffs, okay? If you can just do me a favor and stay out here when we bring it out don't look at her, don't just pretend she doesn't exist cuz we don't want her to >> My dogs. >> Yeah, we we don't want her to get more ramped up and cause a bigger scene than what it needs to be, okay? >> And you'll need to clear down the driveway. >> Yeah, I figured. >> Yeah. >> All right, well all right, you can stay out here, okay? Um, can I have your cell phone number, ma'am? >> Do you mind me asking why? >> Yes, can I have your cell phone number, please? >> Oh, hell no, you are not going to arrest me. >> Yes, for battery against a household member. >> Excuse me. My name is on that lease just as much as hers and the next time she gets >> It's not anything about a lease. >> She got on top of me and assaulted me. So I defended myself. And you're going to arrest me? >> Is there anything else you would like us to do? >> Yeah. I'd like a real officer here that understands the law. When your own mother no. >> Ma'am. >> No, hell no. >> You need to walk to the car, okay? >> Then I hope she's under arrest, too. >> She's not under arrest. >> Why? >> Because she did not commit battery against a household member. >> I live here. >> I understand that. >> Check my ID. >> It doesn't matter. I believe you live here. >> I have lived here longer than she has. >> And household member doesn't mean that you live together. It's your guys' relationship, it's a mother-daughter relationship. >> And she never should have been on top of me attacking me in in first place. >> All right, ma'am. We're going to walk this way, okay? >> Then I would like another officer here, please. >> It's not how this works, ma'am. >> Female officer now. >> how this works. >> Yes, it is. I am a female. [ __ ] no! Ah! Somebody help! Help, you [ __ ] That's assault from an officer. No, you are not. >> You can get charged with resisting, so you >> Then arrest that [ __ ] right there. Cuz I press charges on her. She's going to be in the middle of arresting me. >> For what? >> Because you are assaulting somebody I am in my own home. >> Are you having a medical emergency right now? >> I'm about to. >> All right, have a seat inside. Have a seat inside. >> No. >> I'll explain you why exactly you're getting charged. Have a seat inside. >> I shouldn't be charged with anything. >> Have a seat inside. You're going to get charged with resisting. >> Then take the cuffs off cuz I can't get in there without my hands. >> So pick up your left foot, you can get in. Pick it up. >> Really, sir? >> Yes, ma'am. Put it in the car. Ma'am, I'll help you get in. >> No, you will not. >> So you want to pick up that charge of resisting? >> Then arrest her as well. >> Yes or no? >> I cannot get out. Cannot get in that car without use of my hands. >> We're showing you the easiest way to get in. >> And the easiest way for me to get in is with my hand. >> Well, that's not going to happen. >> You want to recuff me then cuff >> You have two options. You can get charged with resisting and I'll help you get inside the vehicle, or you can get inside the vehicle now. >> Officer, I have a heart condition. >> This is the last time I'm going to give you this this option to get inside on your own. Either way, we're taking you down to >> an ambulance now. >> You're not going to go inside an ambulance. >> Well, when I pass out >> You want to call one? >> Because my heart rate's getting too high? >> So we're calling one, but you still need to sit inside. We're going to ask you to do the same thing. We're not going to sit you in their car. >> I can stand here just fine. I'm no threat. >> Well, then you >> don't need an ambulance if you can stand here just fine, right? >> You guys want to keep back talking cuz you know what you're doing is illegal. >> Yes, ma'am. >> Um I was wondering if she's taken in taken in now >> Uh-huh. >> how long will she be in for? >> Uh it's hard to tell. Uh what we're going to do is we're going to let the DC know that you're the victim and give them your phone number and they'll call you when she gets released. Usually it's like a few days. >> Okay. >> Maybe they she could be released tomorrow depending on if she finds somebody to pay her bond or what the judge says. >> Pay her bond? >> Yes, ma'am. >> Uh well, it would have to be um the 507 phone number because she turned my number off. >> Okay. That works then. >> Okay. >> All right. Thank you. >> After documenting the mother's injuries and hearing both sides, officers determined they had probable cause to arrest the daughter for alleged domestic battery based on the physical evidence and witness statements. While the courts will decide the final outcome, the arrest marked the end of a family dispute that spiraled out of control. Subscribe to Redefining Justice for more real police body cam breakdowns.
