Yes, 911 what's the location of your emergency? >> YES, I KNOW WHAT I'M SAYING. RIGHT NOW I HAVE A DYING BABY. PLEASE STOP. >> WHAT'S YOUR ADDRESS, MA'AM? >> HURRY UP! >> LISTEN, I I WE DON'T KNOW FOR SURE YET, BUT I DON'T THINK that's going to cause a school fracture. >> I saw the x-rays [music] and the cat scan. His entire skull is split open [music] in three different directions. >> This is Barbara Kendrick. She was 65 years old and for a little over a month she had been babysitting 5-month-old Cooper Debavic at her home while his parents worked. She told detectives she was family by marriage and that on this day she was alone with him. >> All right. I'm going to give you one more opportunity to tell me what happened, okay? And then I'm going to let the doctors tell me what happened. And then you're going to look like a monster for sitting in here lying to me. What happened to that baby? >> I don't know. >> Cooper was rushed to UF Health with a fractured skull in life-threatening condition and then moved to the pediatric intensive care unit at Wolfson Children's Hospital. Doctors found internal injuries consistent with some type of trauma. And by that evening the sheriff's office said the prognosis was not good. That same afternoon Barbara Kendrick sat down with Jacksonville Sheriff's Office homicide detectives. Her story was simple. Cooper had been sick for days, congested, feverish, teething and crying. She said she laid him down, started cooking and when the house went quiet she found him limp and unresponsive and ran for her neighbor. No fall, she said, no accident, nothing that could have hurt him, but the doctors were seeing something very different. The detectives would tell her the fracture ran in three directions across the baby's skull with a dent beside it. A 5-month-old cannot say what happened to him. By her own account she was the only adult in that house and in this room the detectives have one question that matters. How did a baby skull break on her watch? >> Um, does anybody else live there with you guys? >> Just uh me and my husband. >> Okay. How long have you guys lived there? >> Well, three years. Um two, maybe three years. >> Where'd you guys live before that? Here in town or >> No, um we lived in Orange Park. >> Okay. How long did you guys live there? >> [snorts] >> That's a good question. >> A long time? >> Too long. >> Too long. Okay. So, you're saying that you're from Northeast Florida then from Orange Park or >> No, I'm originally from uh northern Indiana up there around Terre Haute, Indianapolis. And he's from here. >> Okay. So, that's how you ended up here was with him? >> No, well, well, his was here. >> Okay. >> And I moved down here cuz they wanted me to be down here with him. >> Okay. How many kids do you have? >> We've got two. >> So, you mean your grandkids? >> Yes. >> Okay. How many? >> Four. >> Four. Do you babysit any other kids or just >> No, just Cooper. >> Cooper. And how do you know Cooper? How do you know his parents? >> I know his dad is um his brother was married to my daughter. That's how I got to know Cooper. >> Okay. So, Cooper's dad's brother was married to your daughter. >> Yeah. >> Okay. That's where we got it straight. I was just right. How long have you guys been babysitting Cooper? >> Around a month. >> About a month. Uh did you know him before then or >> No. >> Um what hours do you normally babysit? >> It depends on when he brings him. Sometime it's 7:30. Sometime it's 7:40. Sometime it's 8:00. Just depends on he gets him over to me. >> Okay. So, it's somewhere between 7:00 and 8:00. So, that range. How long does he usually stay? When does he get picked up normally? >> Um depends on what they're doing for the type of work. Sometime it's three, sometime it's four, sometime it's five. Okay. Just depends. >> And does your husband work or >> No. >> Oh, he doesn't work? >> He's on his disability. >> Okay. Is he home most days or >> No, biggest part of the time is um, okay. >> Um, did you babysit today is Tuesday, right? >> Yes, Tuesday. >> Yes, Tuesday. Did you babysit yesterday? >> Yes. >> Okay, all day? >> No, all day. >> How long did you babysit? >> He um, from 7:30 I think he got down about 3:00, 3:30. >> About 3:00, 3:30. What's the uh, how was he behaving yesterday? >> He was fussy, had a fever, he was congested. >> Okay. >> And I put some warm clothes on him cuz he was cold. >> Yeah. How long has he been sick? >> Uh, the worst I can tell you. >> Was it the first time you noticed he was sick was yesterday or >> No, they um, they told me he was sick. >> When did they tell you that? >> Last week. >> Did you babysit last week also? >> Yeah. >> Okay. Did you think he was sick last week or >> He was sick when they brought him to me. He was he was congested, uh, sneezing, pulling on his ears, >> Pulling at his >> he's teething. So, he does a lot of crying. >> Okay. Pretty crying baby? >> Yeah, he cries a lot cuz he's teething. >> Yeah. When did uh, what all days did you babysit last week? >> Let's see, they took uh, couple of days off last week. Cuz he was really sick. They wanted to stay home cuz his temperature was up. >> Yeah. >> They don't keep an eye on him all day. >> Yeah. >> He was still sick when he came back the next day. >> What days were that? Do you remember? >> Last week. >> Mhm. >> Tuesday and Friday back and Thursday cuz I had a doctor's appointment Friday. >> Mhm. So, you didn't have him Friday? >> No. >> So, he was sick at least on Thursday and when did you first notice he was sick last week? >> I noticed that was wrong with him cuz he was kind of um, sneezing, nose was running, and and uh crying all the time. >> Okay. I thought maybe this was his teeth. >> Yeah. >> And babies do get sick when they teeth out. >> Yeah, yeah. Um Yesterday you said he was he was sick yesterday, too. How How sick was he? Did he say anything? >> He was very sick. >> Did you check his temperature yesterday? >> His temperature was 99.8 all day long. >> Okay. Uh let me see. He had congestion with nasal and chest. >> Yeah, congestion nose and he had here and down here. >> Okay, he had a little rattle in his chest. >> Yeah. >> Okay. Um and you said what were the hours yesterday again? Um >> Uh 7:30 to 3:00. >> 3:30 to 3:00. >> About around 3:00 3:30. >> And what time did he come back this morning? >> About 7:30. >> About 7:30. Do you Do they get paid by the hour? Do they pay by the hour? Do they pay by the week? >> They pay by the week, like >> Okay, just like a set fee. >> Yeah. Okay. >> Um how much do they pay you per week? >> $75 a week. >> Okay. Um so he dropped him off about 7:30 this morning. What did you notice this morning? Just kind of take me through. >> I kind of noticed there was something wrong with him. I thought maybe it's it was just me, you know? So I really didn't think anything about it. So uh uh later on that uh later on today >> Did he eat at all today? >> He uh yeah, he ate a little bit today. >> What time did you give him his first Did he eat bottles or did he eat >> a bottle with cereal in it. >> Okay. >> Then I feed him uh he eats the other meals. >> What kind of other meals does he eat? >> He's eating yogurt, you know, stuff like that. Soft. >> Okay. What uh what time did he have the first bottle with you today? >> Uh I don't really I didn't really look. >> You don't know about what >> I would say I'd say 9:00. >> Yeah, and then I'd say at the end of the night exactly. So about 9:00 he had a bottle. [clears throat] Did he eat normal normal amount or normal amount? Uh did he eat any food or anything at that time or just the bottle and cereal? >> pudding. >> How much uh how much formula Does he do formula do you have? Yeah. How much formula and cereal did he have? >> A bottle. >> A bottle. What's the bottle like? 9 oz, 10 oz? >> I'm not sure. I think it was uh I think they're 10 if I'm not mistaken. >> Almost all the way full bottle? >> Yeah. >> He drank all of that? >> Pretty much all of it. And he got drank maybe three fourths of it, took a nap. He would get back up, eat some more, and drank some more milk. >> And then did he You said he ate some uh pudding or something at that time, too? >> Yeah. >> When would he have ate again? >> When he got from his nap. >> Is that Is that kind of normal? That's about his normal routine. He comes down and gets bottle at 9:00, takes a nap. When did he wake up from that nap? Do you remember about? >> As soon as he got the phone. Uh one of the game shows was on. Price is Right. >> Price is Right. So Price is Right was on at 11:00? >> No, sorry. Sorry. >> Price is Right was on at 11:00? >> Let's Make a Deal. >> Let's Make a Deal. I don't know what time that comes >> 10:00. >> 10:00. Okay. >> Uh I watched it regularly. >> So about 10:00, so he only slept for about an hour, less than an hour? >> Yeah, something like that. Sometimes a little longer. >> Okay. >> And then he he cried. Cried, cried, cried. >> day? >> Um yeah, there was nothing I could have done to appease him, to you know, entertain him. >> Okay. So what happens from there? And he just He just watched TV in his room. >> So after >> ends up wakes up at 10:00 and then what does he do at 10:00? >> Uh crying. I put him in the a little I got him in the little I put him in the little music rockers that rocks back and forth, playing some music. Like cuddle buttons. >> Cuddle buttons? Okay. >> He laid there for a while, uh cooing and talking and you know, a normal baby. >> Yeah. >> And he didn't like that, so I tried the walker. >> Okay. >> And he he played there for a few minutes. >> Okay. he didn't want to feed her cuz I thought to feed him out. So I just feed him and gave him a bottle. He didn't want that. So I took him and made sure he would if he was weird or poopy diaper or something. Was there anything wrong with him? He was fine all day long. >> Okay. >> I was just worried about his little congestion. >> Yeah. So then what happens next? >> Then I laid him down again. It was about 12 maybe, something like that. He didn't want to sleep. He was crying and crying and crying. >> Mhm. >> So I picked him up, held him, rocked him. Tried bottle again. Tried feeding him again. >> Mhm. >> And you know what I did was push the you know how they push the bottle out with their mouth? >> Mhm. >> He just cried. He cried and cried. I gave stuff for his teeth or his gums. >> Mhm. What did you give him for that? What's that? >> I don't know what I gave him. A little little tablet they got down for babies. A little little white tablet. >> Yeah. >> It's for um >> Is that something that the mom gave you or mom or dad gave you? Okay. >> Yeah, that's something in there for me. >> Okay. Um so then what happens next? >> I see you want to go to sleep. So I rocked him. >> Mhm. >> Turned all over again. And then he was dead. We have I thought he was tired. He was going to lie in the chair. >> Rubbing his eyes. >> And crying. >> Mhm. >> I said well I'll lay him down. >> Mhm. >> [clears throat] >> You know how babies do when they cry really hard you know? Like that. That's what he was doing. Cuz I didn't I started cooking. >> Mhm. >> And I hear nothing. So I went out. Okay, he's asleep. So I waited a few minutes. I went back over and I thought he was asleep. I said Cooper. >> Mhm. >> Then no no response. So I took him and I thought I shook him again. I said uh hard again as they woke up. Not that you know the eyes are half half way open. >> Mhm. >> I don't know. He sleeps like that sometimes. You know what? He's a sleeper. >> Mhm. >> And I hollered at him again. Like I I picked him up. He just went limp on me. >> Mhm. >> I don't know. Maybe I picked him up wrong. Like I picked him up holding him like I always did from my chest. He kept talking to him hollering hollering hollering. If his shaking his legs, his arms. You know. He didn't respond. So it scared me. So I laid him down. Looked at my next door neighbor. >> He was laying down on a >> On the chair. >> Okay. >> On like a baby. He was laying down. >> What what kind of chair? Like a what? >> It was a recliner. >> Okay. >> And I hollered at him again. He didn't respond. I said, "Oh my god. Something is wrong. What I do? What I do?" >> Mhm. >> So I ran over called my next door neighbor. She comes flying over there. He was doing CPR. >> You are? >> They told her to compressions like this here. >> Mhm. >> On him and blow blow blow. They they told her to do this here. >> Okay. >> Keep doing this here. >> Yeah. >> Keep blowing in his mouth. >> She doing that or you doing that? >> She was doing that. >> Mhm. >> I was screaming crying. >> Yeah. >> I don't know. What the hell happened here? What's going on? He He was just fine two three hours ago. >> Yeah. >> He was laughing eating playing cooling you know. >> Mhm. >> I was like Yeah. What the hell happened here? >> So did they He uh >> So the rescue >> rescue comes and takes him. >> Yeah. >> Okay. >> They uh She had him laid down. When she turned to the side a whole bunch of mucus came rolling out of his mouth a bunch. >> Yeah. >> And my floor was wet. >> Like throw up? >> Yeah. >> Okay. >> Where on the floor is that? >> The carpet there in the living room. >> All right. >> I got a coffee table here. I got another recliner there. I got a TV there. My couch is over here. >> What furniture is it nearest? >> It was near the coffee table. >> Near the coffee table and what would it be between? Coffee table and the >> The uh um He's a little um chair. He's a little walker. That's >> That's a walker. Okay, so it's going to be between the coffee table and the walker. >> and the walker and like I said there was another chair there, recliner. But it's more closer to the >> And it was enough that it was like near the hallway. >> Yeah. >> Okay. Um and that was after the CPR she turned him on his side and that's when >> Yeah, and then the bloody puke came out. >> Was he ever Did he ever start breathing at all that you're aware of? >> No. No. >> Um Was he cold to the touch? Was he still >> I didn't touch him. She did. >> No, no, when you picked him up. >> He was uh like like I said, he was limber. >> Limber? Was he warm at all or cold or >> Clammy? Was the color off or >> No, he he was all all pale. >> Real pale. Uh Uh >> I think it was just a minute or first uh that's down there. >> Was your husband home today? >> No. >> And what time did he >> He's got part-time job on the side. >> Okay. What time did he leave? >> He left about 6:30. >> So he was up before the baby. >> He was up long before the baby. >> What does he work doing? >> Um he goes down on Lang Avenue. He goes past the Langs Avenue. >> What's that? >> It's a bus company. >> So he leaves at 6:30. Was anybody else here today? >> Just Just me, the baby, and my little dog. >> Does she stay away from the baby? >> Oh, she comes and licks his head every morning. >> Doesn't jump on the baby. >> takes his little hands, you know, touches his hair and his ears. >> Does she ever jump on the baby at all? >> No. Oh, no. >> Um Did the baby fall today at all or anything happen where there would be any kind of injury? >> No. No, but it wouldn't hurt hurt a baby. >> I'm not saying I'm not saying it would, but sometimes accidents happen. >> Yeah, accidents happen. I got what's this one arm here. Sometimes it gives out. >> Yeah. >> I can't feel nothing. >> Yeah. >> But I I used to use this hand a lot obviously touching him >> Mhm. >> uh holding that. If this arm don't work, I grab this one. >> Okay. >> I always have hold of him. >> Yeah. But there was no no accidents today? >> No. >> Nothing happened that would cause any injuries? >> No. >> All right, so that's what we got to figure out how that happened. Uh >> I don't know I can't say. I said that I don't know how that happened. >> And And that's why I'm asking you is there any any accidents today? >> Yeah, I play with these toys and I throw them up in the air, you know. >> Did she Did she drop him today on accident? >> No. >> Cuz now I mean cuz here's the thing you know, obviously you know what we do. >> Yeah. >> And we're very good at what we do. >> Yeah, I saw >> our doctors are excellent at Shands. I know people talk about Shands, but if you're hurt real bad, that's the place to go. >> Y'all I can I can agree with Shands. They do take good care of you. >> hurt real bad, that's where you need to go cuz that's it's a trauma unit. And the doctors there I tell most of the babies it's a skull fracture. Okay. Now, a skull fracture is something that if that would have happened over the weekend or this morning before you had him, it would have been pretty obvious. Cuz the baby would not have been cooing or laughing or >> Right. >> Okay. So, something happened at your your house today, okay? And that's what we got to figure out what happened. Okay? And I know sometimes these things are hard to talk about. And [clears throat] but you know, the truth always comes out, okay? And I would much rather hear it from you than than to hear it from somebody else. >> So, yeah. >> Okay. So, if something happened today, now is the time to tell me to be 100% truthful, okay? Because even if even if you try and say it's it's one thing, the doctors are going to be able to tell that it happened. I mean, these doctors are good, okay? And they have all of the best equipment. Okay? That baby's in a bad way. Um in fact, he's being transferred right now to what's this NICU, which is >> What's that? >> That is the baby It's the baby's of the children's They are giving a better chance. Uh are you with help? Sorry, the name's changed a couple times. Uh And they'll they have even better equipment. They may be able to tell us a little bit more about what how this may have happened, okay? And that's why I need you to be 100% honest with me, okay? What happened today? >> Like I said, you know, I told you what happened. I put him down on the >> How how did the baby's How did the baby's head get hurt? >> I I don't know. That's what has got me uh >> And that's why I was asking you things. I was there anybody else there? Um So, it's I was just you and him there. So, and you're watching, so you would have known something happened. And you said to me you even said it at 10:00 he's he's awake and he's moving. >> Yeah. >> And then >> this afternoon he has a traumatic brain injury. So, something happens between the time you get there and this afternoon, and that's what we got to figure out, okay? And I And I can promise you that if you lie to me, it's not going to be good for you, okay? If something happened and you can explain it, now is the time to explain it. Not have the doctors explain it to me. And then it looks like you're holding stuff back and you hurt this baby on purpose. >> I didn't hurt baby on purpose. >> And And I believe that, okay? And I believe that, okay? You're a you got kids, you've raised kids and and presumably you had no problems with any of that. Okay? But something happened today that you're not being honest about. Okay? I've sat across from many, many people. Okay? And I'm not saying you're a bad person, but I do feel that you're holding something back cuz you're scared. Okay? And now's the time to tell me what that is. Okay? Cuz I don't think you're a bad person right now, but if if if it continues to go this way, I may change. >> Well, I understand that. >> Okay. What happened today? And I need to know every I need What happened What happened to the baby today? >> I don't know what happened. I might have put it down once on the the chair too too hard. And I paid 50 bucks to lay him down for a little while for a little while. >> like like I said, like I said, Barbara, this is the thing the doctors are going to be able to tell us. What exactly happened to that baby? Okay? So, they're going to be able to tell me if putting the baby down hard on a chair did or did not. Okay? >> Right. >> I know the baby was being really fussy today and I know that can be frustrating cuz listen, I have kids of my own. I have two. Okay? And I know sometimes that kids can be really frustrating when they're crying and they're teething and and I understand that parents and babysitters sometimes get frustrated and things happen. Okay? But you have to explain that to me and and it has to be believable. Okay? >> Yeah. >> Putting the baby down hard on a chair is not going to fracture that baby's skull. Okay? What happened? >> The baby's skull is fractured. >> What's that, sweetie? >> The baby that is fractured. >> The baby's skull is fractured. Okay? And you need to tell me how that happened. And I understand you're scared, but trust me, lying to me is not going to help. I want to know. Listen, I do this for a living. Okay? I talk to people for a living. I know when they're holding something back. Okay? And I'm not saying you're a bad person because you're holding something back. I think you're you're scared. Cuz I'd be scared if I was sitting in that chair, too. >> Yeah, I'm terrified. >> I understand. I would be, too. I mean, something terrible happened today. But, lying to me is not going to help you. Okay? >> Listen to how the account has moved. At first, nothing happened at all. Then she may have put him down on the chair too hard. But, the detectives keep returning to the same problem. The injury. They have been told it is a severe multi-directional fracture, and they say a short drop or a hard set down does not explain it. Her words and the medical evidence still don't meet, and that gap is exactly where they push next. >> Listen, I I we don't know for sure yet, but I don't think that's going to cause a skull fracture. >> I saw the x-rays and the cat scan. His entire skull is split open [music] in three different directions. There's no way. >> There's no way this is >> that it occurred. >> Kids get Kids get Kids get dropped from this to here quite frequently, and that doesn't cause a skull fracture. Might have a headache, maybe concussion, but that doesn't cause a skull fracture. >> That's when I really freaked out. >> Yeah. Then what'd you do? >> I went I tried to wake him up. >> He was still making that coughing noise in there. >> touched his hands, his feet. I touched his belly. He had power in his name. He wouldn't respond, so I picked him up, kept talking to him. I noticed what he had in his stall or whatever. He got it out. He was fine. That's when I laid him down on the chair. I could see that there's something wrong. That's when I ran across the road, got my neighbor lady. >> at that point? >> Huh? >> Was he breathing then when you laid him in the chair? >> But, I like [music] picked him up and I found out he wasn't breathing. >> So, then he's not breathing. Okay, so he's not breathing at that point. Okay. >> Like he didn't do nothing. >> Then you go find a lady and she comes over, she does CPR on the baby. >> She got him off the chair and put him down on the floor. >> Yeah. >> So, I did the this here, start breathing in his mouth. >> Now, that Pack 'n Play does it have a cushion at the bottom of it or what what is it? What's the bottom of the Pack 'n >> it is uh it's soft. I don't think those cushions are soft. >> soft. >> Not this one I had. >> That's a pretty significant injury for a baby's skull to get fractured, okay? So, I still think I still think you're trying to minimize what happened, okay? Cuz I can tell you even even on this hard concrete floor right here, if I dropped a child and I your waist is a little lower than mine, from here to here, that ain't fracturing a skull, >> [music] >> okay? Fracturing a skull, well, even on this it's got to be that, okay? And that's not a Pack 'n Play, that's a hard floor, okay? So, I've tried to be as understanding as I can, okay? And I and I do understand that you're scared, okay? But what I don't like to do is I don't like to be continued to be lied to, okay? All right? You need to tell me what happened. All right? That baby's over there struggling in a hospital right now, okay? And you're still holding back because you you're scared for you, okay? We need to be worried about that baby. All right? I'm going to give you one more opportunity to tell me what happened, okay? And then I'm going to let the doctors tell me what happened. And then you're going to look like a monster for sitting in here lying to me. What happened to that baby? >> a monster. >> What's that? Tell me what happened to that baby cuz that is not what happened to that baby. Tell me what happened to that baby and I'm this is one last chance cuz I'm not going to sit here and go back and forth. What happened to the baby? Tell me what happened that baby. I know it's hard but we need to know what happened that baby so we can help it. What did you hit that baby's head on? >> Yeah. There's actually a dent beside where [music] the fracture is. A dent? >> Yeah. Yeah. >> Like a dent? >> More consistent with a than a Okay? So again, I'm a mother. I understand getting frustrated, okay? My child had ear ache after ear ache after ear ache and cried and cried and cried and nothing would work to make that baby stop crying. So I have been where you are, okay? Being frustrated and trying to get that baby to [music] be quiet, okay? I understand that you got frustrated. [music] Again, did not crack that baby's skull almost completely [music] from the back of his head to his forehead in three different directions nor did it cause a [music] dent beside that fracture, okay? So, my partner already told you. >> Last chance. >> Last chance. You've got to show us exactly because you understand that that baby may not make it, okay? He's in critical condition in ICU. He may not make it. >> And what you tell us will help us. >> to let the doctors know exactly what happened to him so they can help save his life. Do you understand that? >> Yeah. >> Do you want to save his life? >> Yes, I want to save his life. >> Show us exactly what you did to that child. Baby skulls are actually soft. >> A lot of times they just dent. >> Yeah. They're actually extremely hard to fracture. >> Because they're soft skulls. It's not a fully formed skull like ours. Okay? I'm not going to sit here and debate with you. This is going to be my last opportunity to you to show me what happened. Okay? Show me what happened. And then I'm going to walk out that door and I'm going to call these doctors and I'm going to find out whether you're telling me the truth or not. Okay? Show me what happened. >> And what you show him needs to be consistent with what caused that dent in the back of that baby's head. >> Cuz I'm going to know. I'm going to find out. >> we're going to know. >> It's just a matter whether you told us the truth and tried to help this baby or you sat here and lied to us and tried to protect yourself instead of helping that baby. >> No, I want to I want the baby to to make [music] it. >> Then show me what happened. I want to go over a couple more things with you real quick. First of all, we got some pictures from from out there. And I just want to make sure we're talking about the same thing. Is this the the Pack 'n Play you were talking about? >> And the picture I'm showing you on the right, there's a blanket and then a blanket hanging over. Is that how it would have looked? >> Yeah. >> That's how it looked today before the baby got sick and without the >> I said without it. >> Without the blankets? Okay. >> Yes. >> Real quick, did you call anybody else? >> No. >> And let them know what was going on? >> I tell I I found out what was going on, then I called uh the baby's daddy. >> Yeah. >> Cuz he was at work. >> Yeah. >> And told him what was going on. I was having problems with my phone. >> Did you ever get a hold of your husband at all or >> No. >> Okay. >> Yeah, I want to He was at work. >> Okay. Did you get a hold of him or did >> No, I got a hold of him yet. >> Okay. Okay, he knows. I mean, we we talked to him. I just want to to make sure. Um the form I want to show you right now is a consent to search your phone. It's basically so we can download your phone and make Make what you're telling us is the [music] truth. Were Did you and your husband get in a argument last night or this morning? You were a little stressed out about it or something. You remember anything? >> I got argument with him one night over something stupid. >> Have you been stressed about that or has it been bothering you or >> I said my my son is locked up. >> Okay. >> He's doing time. >> Okay. >> And that put a lot of stress on me. >> Yeah. >> I'm taking care of him, sending him stuff. >> Okay. What you were telling us earlier about the baby having some congestion, is that true or has he just been teething? >> No, he does. Like my friend that came over there >> Mhm. >> said she could [music] feel it and hear him when she was feeding him the mouth. Yeah. >> Did you notice it before that or >> I said something to her. I said, "I think he's got a cold or maybe just cuz he's teething it maybe sounds like it." She says, "No." >> I mean before. Like not not while this was happening. Like this morning nothing nothing was going on until after he got hurt. >> Yeah. >> Okay. Um He just kept crying and crying and crying and crying. >> I rubbed his back. I sang to him. I rock-a-byed him. I did did everything. >> You did everything you could and nothing was working and and you were getting frustrated. >> Yeah, and I had a lot of stuff on my mind. It doesn't give me the right to do that. >> Okay. >> None whatsoever. >> By now, the questioning has moved from what happened to why. Barbara has described a baby who would not stop crying, a long morning of frustration, and a house where she was the only adult. She has admitted she was frustrated and that it did not give her the right. What she still has not given them is a physical explanation that matches a fractured skull. So, the detectives turn to the clock. >> Just like not long he he started crying. >> He started crying again? [music] >> Yeah. >> And how long did he cry that second time? >> I wish I would have timed [music] it. >> How long do you think? An hour or 2 hours? >> No, no. 2 hours. 2 hours. I don't know. Maybe 20 [music] minutes. Probably. I want to say five, maybe. >> Maybe 5 minutes? And then >> If it's It was If it was even then. >> And then put it How long How long until you picked him up? >> It was a few few minutes cuz I went back over to check on my dinner. >> Yeah. >> And so I heard that call. >> [snorts] >> So all this happened pretty fast. The time you end up ultimately picking him up, you're talking 20 minutes max, [music] 20 30 minutes. Does that sound right? And if I'm wrong, let me know. >> No. Uh you're you're you're You're pretty close. >> Okay. Uh and like I said, nobody expects you to be down to the minute. I mean, we're estimating the times here. >> I I I I I >> But so what you told us earlier wasn't true then. He didn't cry for an hour. All right? Cuz that's what you told us earlier. You said earlier you told us he cried for like 10 minutes and then he quit crying and then he started crying again for a long time, like an hour. And then that then after that he started making that funny noise like the noise. Am I right? >> Yep. Yep. And she [music] went out and hung some clothes on the uh on the line. Come back, checked [music] on her dinner. Um he was crying all day. You put him in a walker, a swing. You put him in a walker. Uh you tried to feed him several times and he wouldn't eat. >> And that's all before. >> That was all before. I gave him a bottle, he wouldn't take [music] it. You laid him down and you started cooking. Um started yelling at him. >> He spiked the food or threw it towards him in the high chair and then >> You said he was [music] still crying, so you left him there for about 20 minutes. He stopped crying then started again. You went outside, hung clothes up, come back in, the victim was still crying, so you left him there again and then you started hearing him make noises. And how far from your house is the clothesline? >> It's just out the back door. >> In the backyard. Did you have your door open or closed? >> it open cuz my >> Could you still hear him crying? >> No. >> Had he stopped crying or >> I thought he stopped crying. >> Okay. >> And then I guess he he still was. I just couldn't hear him out to the clothesline if he was. >> Okay. >> I left my door open cuz I got my dog out there with me. >> Okay. Okay. >> Have Have you ever been Have you ever had any issues like this before? Anything ever happened with the child where you got frustrated? Never before? >> I walked away. >> You walked away the other times? >> When he was doing that, I went outside, I counted. >> Was that today or was that >> time I did breath. >> Was that today or was that other times? >> That was another time. >> How many times do you think that has happened where you just have to walk away? >> Quite a few times. >> Quite a few. Is he pretty >> Cuz I felt it building up. >> Pretty difficult baby? >> Yeah, he is. >> Much more difficult than the other children you've watched [music] or you've been around? >> Yeah. Other than that, when he's it was like >> [music] >> uh he's uh but he's he baby, he really is. >> Yeah, until he starts crying and >> He starts crying. >> And then he gets real frustrated. >> Yeah, but then he's really good baby. >> Um And it just just to get back to here, I I think with There's nobody else here with you all day today. It's just you and him and the dog. >> Correct. >> Yeah, till later on like the >> Till when your neighbor came over to help out. >> came over and he stayed over with me. He drives there to work. And then he's in another big uh glass truck, we call banging. >> He goes and makes noise and >> out there and uh putting windows, setting windows out, building shelves, uh I mean uh frames. >> Mhm. >> Or whatever. >> Okay. >> They have to do doors, windows, doors and windows, except frames. >> Is he like just checking it all or not? She's got to walk away after that. >> got to walk away. I guess it's to see or this stuff. >> Yeah. >> What Why didn't you two call [music] the parents or someone else? >> That's a good question. >> I I mean it's >> Why? Why didn't you get night? >> Yeah, do you know why you >> I don't know. I guess I didn't didn't think about it cuz I was uh >> [music] >> trying to keep him quiet. And I was upset. And uh frustrated on top of that. >> Yeah. >> All right, you said you're disabled, correct? >> Yes. >> What's your What's your disability? >> Cuz Cuz of my I can't uh do stuff on my own. Um that's what [music] my husband's uh my payee. >> Mhm. >> He'll help me do what I have to do, so [music] I totally understand. >> What were you actually diagnosed [music] with for disability? Because you would have had to have been diagnosed >> Yeah, yeah, yeah, yeah, but this is what they called it. It had something to do with the retardness of the mind. >> Okay. >> Well, I freaked out [music] when they told me that. I go, "Well, what do you mean? Retardness of the mind? What the hell are you talking about?" It wasn't the family, but but I'm the one that got it. >> Yeah. >> Some kind of illness. >> Okay. All right. Where Where'd you go to school at? You went to school up in St. Indiana? >> Indiana, I went to um Montgomery in County and um can't think of the name of the school. >> You said you finished 10th grade or you >> Almost. >> Almost finished 10th grade. >> I think I told you I'm on the halfway. >> Okay. Why'd you drop out? >> My dad needed me on the farm. >> Okay. How'd you feel about school? >> Didn't like it. >> You didn't like it? Did you have a hard time with it or you just Okay. >> I got really, really upset in class. I said the principal this morning I was in class because I couldn't understand what they were trying to tell me of a problem. >> Mhm. >> I just I just lost it. >> Mhm. >> I didn't lash out at nobody. I just just lost it. >> Just kind of shut down? >> Just shut it down and just stopped my body. >> Okay. All right. Do you have any other questions for him? >> Um your your disability, has it ever affected your ability to determine right from wrong? >> No. >> Okay. So, you wouldn't say that your disability gives you the inability to say what's correct [music] and what's right and what's illegal and what's not? >> Or sometimes like I stop and think. >> Okay, but that's more on a technical term, like understanding something, but not understanding right from wrong. Okay, so you have a full understanding [music] of that. >> Yeah, sometimes like I question myself. >> Okay. >> On it. >> Okay. >> Is this right? Is this Is this right? Is this wrong? Yeah, I I got to question myself. >> Okay. >> [music] >> Thank you. >> In the footage that survives, Barbara Kendrick admits frustration and says she may have set Cooper down too hard. Detectives told her that could not fracture a baby's skull. According to the Jacksonville Sheriff's Office, during the interview she confessed to throwing Cooper with force into his Pack 'n Play because he had been fussy from teething and fever. That admission is the Sheriff's Office's account. It does not appear in this footage. Cooper Dubovic died late the next night at Wolfson Children's Hospital. Kendrick was first charged with aggravated child abuse, and the charge was upgraded after Cooper's death. In 2018, a grand jury indicted her for first-degree murder. In January 2020, she pleaded guilty to second-degree murder. But before she was sentenced, her attorneys moved to withdraw that plea, arguing she is intellectually disabled with worsening dementia. As of April 2021, that motion was still pending. A final sentence could not be confirmed in the public records available to us. Cooper Dubovic was 5 months old. His family has spent years waiting for justice. His life mattered, and this story is for him. Behind every interrogation is a life forever changed. Thank you for watching Stay Alert.
