none of myself because every time I wanted to do something for my baby, every time I want to say something for my baby, every time [laughter] it's I'm overreacting, I'm overreacting. I'm overreacting. >> No, you're not. IT'S OKAY. [screaming] >> LISTEN TO ME. Are you all right? >> Jacksonville, Florida. November 2011. In an apartment on 103rd Street on the city's west side, a 5-month-old boy stops breathing. His name is Cordderero Weber Jr. A 911 call goes out. He's taken to Baptist Medical Center and he dies there. The medical examiner finds blunt force trauma to his head, bruises on his face, his chest, his ear, and the back of his head. Five fractured ribs at different stages of healing. No body fat, no food in his stomach. Two adults were responsible for him. his father, Cordiero Weber, and his mother, Carara Hayes Leair. Both are interviewed by the Jacksonville Sheriff's Office. When Cara sits down in this room, the detectives have already spoken to the medical examiner. For the next 40 minutes, they will not tell her what she found. This is the interrogation of Kiara Hayes Leair. Remember my sergeant on Corsy that taught you the other day? He was fine. >> No. Where was where was the dad at? And the girls >> the girls I think they was in the room [snorts] >> or outside. I know he was in the house. He was in the house. >> Where at in the house >> when you left? [clears throat] >> When I left I think he was in the kitchen or in the living room. In the living room or in the kitchen. >> Don't know cuz I was like whatever. I go to the store. I had school. >> What? Y'all was arguing or something? You and him? >> No. I just be tired. Yeah. I just, you know, cuz I be [snorts] tired and I feel like I got to go to the store and I just got off from work. But if I don't, >> he don't go to the store. >> Yeah, he go to the store. But I >> He's just tired from work. >> I know better. I know how to go to the store. >> I'm not about to send [clears throat] this man to the store. >> And we only have a little amount of money for him. He don't even eat meat. My baby sleep with his eyes open. >> Mhm. >> So, I never He was sleeping. He was fine. >> He was sleeping. Did he move? Did you see him move after that? >> I didn't move. I went to the couch. I got back on the computer. I got off the computer cuz I was tired. So he I'll cook. So he's in the kitchen cooking. >> How How did your son How was your son moving when you got home? When you said he was moving, you said he sleep with his eyes. >> He sleep his eyes open. Like if you walk past him, he like like do that. >> Did you see him do that when you got home? >> He did that. >> Okay. >> And my boyfriend said he did that before he brought the computer in the room. He move [sighs] >> Okay. When you got home from the store, >> he was he was >> he was still in the same spot in the floor. >> He was on the same spot. So I thought he was sleeping cuz >> Where where was the girls at? >> The girls they be in their room. >> They were still in their room. >> They was in the room watching Little Ponies. >> Where was your old man at? Where was the daddy at? >> Getting ready to cook. >> When you got home, was [snorts] he in the living room, the bedroom, or the kitchen? >> He was on the computer. >> Where? Where the computer? Where? Where was he? >> My computer was I think he was on the couch or I knocked on the door. >> On what? The front door. >> Mhm. I went to the store. I knocked on the door. >> Why'd you knock on the door? >> Yeah. In your own house? >> Because the door was locked. >> Okay. Okay. >> The door was locked. >> I can't walk through the door bag. Yeah. You can't open it. And then he sat back down cuz No. I took the bags and he was like, "Do you need help?" >> He was like, "What you want to do? Cook." >> I was like, "Man, I want to cook. I just can't. You could cook." So, I just seasoned my chicken. Season my chicken. I put it in the oven. I went to the couch. I got on the computer. I didn't think nothing cuz he was he was sleeping on the floor. And his eyes were open. >> He always sleep. >> Okay. Listen to me. I understand. >> He popped them back open. When I picked him up, he popped his eyes back open. But he was just so Yeah. >> And when did you do that? >> When I picked him up. >> No. After you got home, listen to what he's telling me. >> I'm sorry. >> That's all right. Listen. Hold on. Take take a minute. Just take a deep breath for us, okay? >> And think, okay? >> And just calm down [snorts] as much as you can cuz all this is important for us. And we'll go over that. Just it's very important that we kind of slow down and we articulate things the best we can. >> That's why we're trying to find out. Okay. >> Just take your time. Get expose yourself. >> I'm sorry. >> It's all right. Just take your time >> cuz we're moving. We're moving all over the place and we need to >> Sorry. >> We need to >> I came home. Girls can't mommy's back. >> Girls were inside. Yeah. Mommy's home. Mommy's home. Hey, mommy. Hey, mommy. We got [snorts] I got some chips. I got some stuff for the house. Cook back. I got the chicken. He said, "I seasoned the chicken." I said, "You don't want me to do your meat?" He said, "No." He said, "My salmon only take 10 minutes." So, I was like, "Okay, well, I'm about to put my I put my chicken on 375." I went to the computer. I was like, "I don't really want to do nothing." So, I scooted the computer away. [snorts] And I just laid on the couch and kind of just dozed off. And then he was like, "Dinner's done." And I was like, "Oh, okay. I kept I'm a light sleeper, so anything like you call my name, I'mma pop up." So I [snorts] popped it. He's like, "Hey, you want me to make your plate?" The girls was in his daughter was in her seat. I went in the room. He He came, he made my drink, put my plate. I went in the room to sit down >> in your bedroom. >> And then he was like, "Hey, Justice." He put my That's my favorite. He said, "Hey, Justice, you know I know you." Cuz she always like, "Can I feed Papa? Can I feed Papa? I want to feed Papa." And so it's like, you know, when you finish eating, bring papa in there and you go feed him. [snorts and gasps] And but she fell asleep. So by the time I got up, she's on the bed sleeping already. And my other baby is in her seat just eating. And I go, "Oh man, we about to be here. Let me go get papa." And then I picked him up. And I was like, "Oh my god. Oh my god. My [laughter] baby." I said something wrong. Cuz I went to I went like cuz I picked him up and when you pick him up he he jumped cuz he he he be he bought his fist up tight and he jumped and he didn't jump and I said papa papa I kissed him like that when he kissed him he move he didn't move I said oh my god he not bre and I went there I said oh my god because I thought I could have been tripping because I panic >> I panic I I freak out and I panic everything makes me panic think I'm I'm I'm not my nerves is not good. So I was like, "Oh my god, [sighs and gasps] man." And so he gives him he start blowing in his mouth. I'm like, "I'm about call 911." Cuz right before that, my friend Charlene, my friend Charlene had called me and she was like, [clears throat] she she's like, "Can I come over real quick because I need you to look out?" I was like, "Yeah, come on. Come on. Come on over." And then finally, that's >> Charlene, your friend. turning >> him over the house. >> Yes. And I slammed the door in her face because that's by time then is when every when he was blowing in the baby mouth and I said, "Oh my god, it's not good time." And I slammed the door in her face. [snorts] >> You mentioned you were on the computer at some point. >> Yes. >> What What were you doing on the computer? >> Uhhuh. I >> Facebook or >> either Facebook or Media Takeout or World Star. >> When you got home, was anybody else in the house? >> Um, it's fine. Everything was fine. Everything was fine. Everything is fine. >> And you was home the whole day. >> Get me the closest point cuz we got a receipt from Walmart. Give me the closest time frame you could think. >> It only take me about 5 minutes to get from Walmart. >> And how long do you shop in Walmart before you got that receipt? >> Um I probably was in there maybe 20 minutes. >> Okay. So 20 minutes before that timed receipt. >> Your son is fine? >> Yeah, my son was fine. Brought me in the living room. >> So he's up when before you left. >> I brought me in the living room. I brought him in there. >> Okay. >> Cuz I was like, "Well, if he love a ceiling fan, he loves ceiling." >> Do a lot of people come in your house all the time. >> Just um >> I have friends in the apartment. Baby Charlene came. >> Um while you working, you said your um the baby daddy usually watch the your son >> and my daughter and my two-year-old. >> Do they usually pick them up? Your daughters pick their up at all? Yeah, my um my daughter does. >> Which daughter? >> My 5-year-old. Yeah, I let my I let my 2-year-old I hold her this and I say she go, "Let me see papa." And I like this and she like papa and then she just goes like that to him. >> Does she know to ever pick him up without y'all or my 2-year-old, >> 5-year-old? My 5-year-old I let my 5-year-old pick him up cuz she's >> I mean, would she ask you first or will she just go grab him sometimes? Sometimes she'll just grab him by herself. >> Has he ever left the house with anybody? Like spend the night anywhere? >> No. No. >> Has he ever been with your sister before? >> Has she ever watched him on her own? >> I want to say she has, >> but I don't want to say she has. >> I mean, has she ever watched him before? Either she did or she don't. >> I don't think so, cuz I never really let nobody watch my baby cuz that's my baby [snorts] boy. >> So, you never let your sister watch? I got my baby. >> This is um just consent to search. Remember we searched your house the other day? >> Yeah, you can search. Do >> you mind if we search >> all day? My baby keto all day. >> Do you know what your your son had to eat prior to all this going on? >> I think a milk bottle. I had milk bottle before I left. >> Is he any solid foods or anything like that? Y'all feed him solid foods? Yeah, we feed him the food in a jar. Mashed potatoes. >> What kind of mashed potatoes? Did y'all make up mashed potatoes and feed them? >> Yeah. >> Y'all use gravy or anything? >> No, we don't see them. We feed them the little thing them bars I showed you. Little babies with the Elmo on them. We feed them those. >> What else? What kind of baby food? >> We feed him the applesauce, the the chicken, the beef. [sighs and gasps] We feed him that. We feed him vegetables. We feed him fruit. He don't like cereal, so I don't give him the cereal. >> Juice. >> When you said you dozed off, >> how long do you estimate you were sleeping? >> Um, long [clears throat] enough for some Alfredo to cook. >> I'm not a good cook, so help me out. >> Probably around 30 minutes, maybe. >> You say you're light sleeper. Did you hear anything going on or? >> Yeah, I hear people call my name. I'll wake up. Like if my kids is playing, I be like going back in. >> But you I mean what about when [snorts] you're when you do off this time, you didn't hear nothing until >> when I got back from Walmart and then I went to him and I seen him on the floor sleeping. I didn't think nothing about it and then I was like, let me get him out of there. >> Okay. Before you said you seen him sleeping, right? You said that you did you see him see him move at all then when you first came back? So when you came back from the store? >> I'm such a No, you're [laughter] not. IT'S OKAY. >> LISTEN TO ME. You all right? >> Help us out. Okay. >> Listen to Okay. We just trying to find out. Okay. [laughter] We're trying to help you out. Okay. Get you some clos before I went in the room. >> It's all right. Just listen to what he asking you. Okay. All right. Give me There's nothing wrong with that. >> Give me a number between the time that you that you >> eating around around 8. I'm going to start eating. [sighs and gasps] I don't know what time he finished cooking around like 8. I want to say towards the end of 8 cuz then I called I called the I called the ambulance cuz >> we we got all that. >> Yeah, we know that. We know where >> when you found [laughter] that when you listen to me >> take a deep breath. >> I never even thought about that. I didn't check my baby. [screaming] [gasps] Listen to me. Sit up, please. This is in this is hugely important. Okay, take a deep breath. [sighs] Okay, look at me. Okay, we're not judging you on this. Okay, hold on. Get [snorts] this. But this is important because I had to talk to the doctor. We're still trying to figure out what's going on. Okay, come on. Take a deep breath. Don't hold your breath. >> When you picked him up, when you left before you left and he you saw him, you know, looking around. Hold on. and and then you did your business and you came back and picked him up and found this going on that he was on responses. >> Give me a te time frame. Estimation is huge. >> About an hour. >> An hour. >> Probably about an hour. >> Not even an hour. Give me more than 30 minutes, but less than an hour >> because I went to Walmart. I went to Walmart. That probably took about Walmart took about 20 minutes. At Walmart it took me about 5 minutes. So maybe 30 minutes between my trip to Walmart and my trip home. And then my boyfriend cooked. I told y'all he cooked probably about 30 minutes for 5 minutes. 30 minutes where my man probably an hour and 20 minutes. [laughter] >> But your son was up before you left to go to the store for >> cuz I brought him in there cuz we all >> the baby sleep like >> and then so we closed and >> is when he sleeps and you say his eyes are open. Are they wide open or they just crack? >> I can show you. No, no. He's asking. >> No, they're open. And then I my mom cuz I was telling my mom like, "Oh my god, mom, I'm so scared." Like his eyes is open. >> We're saying the time between when you last saw him moving to when you found him, you discovered that something was wrong. Is about an hour and 20 minutes. That's correct. >> Yes, sir. >> Okay. [snorts] Okay. >> I thought because of his help, because when he wouldn't keep his milk down, you remember I was telling you he wouldn't keep his milk down. So, I changed his milk. >> How long ago was that? I start working 9:24 August. August I got his milk change. And ever since I got his >> couple months ago. Is that what you're saying? >> Ever since I got his milk change. He's been getting his weight up. >> You got the [snorts] milk change. That was when you went to where? >> Mhm. >> I went to Tim I went to um Timuana to to the clinic right there. I went down there >> and I was running late. >> Is that the wick office over there too? >> Yeah, I went to Wick office. I went to wick office and um I got his milk. The lady [clears throat] didn't even want to change it at first, but she was like, "You need a doctor's note." And then I was like, "His doctor wouldn't change it." >> You ever noticed at any time in the past [clears throat] when your son, you know, you may have thought something happened to him, but he ended up being fine or what? What's that? >> Well, his milk situation >> injury wise. >> Injury wise, no. >> Did he fallen anytime or one of the kids dropped on >> him? When he was in the room with my baby, she he was sleeping in the bed with her. I I never like caught it. I thought he fell off the bed, but I never asked. She said he was right there the whole time. >> Your daughter? >> Yeah, my baby. And then she said he was right there the whole time. But like >> who was that? Lyric >> Justice L doesn't talk. >> Well, she talk she talk so well for her to be real girl. She's so smart. >> How long ago was that? maybe about like maybe um I want to say about a month and some change. But I was always concerned because he has he had a fraternal soft spot. Like it started he had a back one and then that one closed and then this the fraternal one came and then every day I used to check it. It just closed on Friday. >> How often did you feed your son? him like every [snorts] 3 to four hours. >> And how many ounces of food? >> Sometimes he would only eat two. Sometimes he would go to four. [snorts] And it's the doctor told me as long as he drinks something and he's peeing and bow movements, everything is fine. >> West jack. >> Yeah. So I never thought nothing else of it. >> I got start. Yeah, he's throwing up everywhere. I even called I even called them people. Has your son ever been to any other doctor appointments since he was born? >> Mhm. >> When was that? >> He went to Neomores. I can't give you the date. He's been to Neomores. They were going to do surgery >> for what? >> Cuz he has um hypospidius. His um on his um on his private area, his um hole, his pee hole was too long. And the doctor said, "We got to come back. Got to come back when he's six months." [snorts] anything any um kind of injuries that he probably received in the past. >> He had bed bug bites on his face. >> Why you think it was bad bug bites? >> I had my sister gave us a couch and lately probably I want to say this last all of October and stuff. I was like I'm getting bit out of nowhere and found out we have bed bugs [snorts] and cuz I found one just crawling and I was like oh my god. So I got the couch out of my house. I just kept the little cushions. I washed the cushions. They said you wash the cushion. I brought some bed bug spray [snorts] spray in my house. >> How long he had the um sores on his face? How long I'm talking about? >> How long How long has they been on his face? How long? >> I'mma tell you right now. [snorts] [sighs and yawns] They been there for some weeks. See, it was just one week. >> Yeah, it was just one about >> Why don't I take this picture? >> Yeah. How long was the first one? >> This is not far enough. It's not far enough. It's not far enough. I never >> just approximate time was the first one there. About how long ago? >> See, he didn't have them. I'mma tell you, man. He got them after he got them after the eth. >> After the eth. You said one. You said he had one at first. How's it? >> Okay. >> We had it after the eth >> the 8th of of I guess October. October. How about the second one? When did >> he just showed up and I was like I [snorts] came home from work and I was like this what happened. I even pointed out to him cuz he was like [snorts] I was like dang. I said dang papa got bit and he got bit and then it just kept >> that's his nickname. >> Did your boyfriend tell you that or you noticed it? >> No, we both noticed it. He said, "I was going to ask you the same thing." And I was like, "You think pop?" I said, "You think this is You think it's in his bed? You think it's biting him out of his bed?" I said, "Cuz we putting cream on. We put A and D and it just was bleeding and we never like >> How long have you been putting cream on his face? Since about >> probably about a week and a half we've been clean cuz he had got a diaper rash because my boyfriend be there by himself and you know he do >> second in November. >> What's that on it? [snorts] >> What's that on his forehead? >> That's a knot. We never knew where it came from. We asked him like we know that was November. >> We asked the babies. I ask my little baby all the time, but I don't know. She sometimes she got >> recent pictures. [snorts] >> Um, they had a whole photo shoot. This was him right there looking grouchy sitting there looking at me. >> You see that? Not >> when was this picture? Yeah. >> The second. All of this is the same day we had a family photo shoot. See, that's me and him right there. >> Oh, this the same day. >> Let me get those, too. Okay. He's going to get them. >> This was the second picture. >> Okay. Giving whatever you can on the second soaking. So that's a mirrored shot show showing that mark on his head from the to this one. >> Yeah, it's okay. >> See, and this is him in his bed. That bed I was telling you about. This came from that bed, too. You see that? >> Let me tell you the date. Let me tell you the date. Let me tell you the date. Let me tell you the date. That was on the 8th. You see that? >> Let me get that. >> You see? >> Okay. >> That bad. [laughter] My sister gave it to me from this bed. >> Why are you saying the bed? >> It had to come from all this stuff. The the stuff the bad bugs and make no sense. My >> date was that 108 also. >> Look at my baby right here. Hold >> on, sweetheart. Listen. You got to focus on what I'm >> September the 9th right now. >> No, the one with the bed. Was that October 8th or He all time slept with his eyes open. >> I always slept with him eyes open. No matter what, no matter what I did, I [snorts] closed them. Papa, got to tell my mom all the time. He been scaring me with them eyes open. I don't know. >> Go back to this one here. This slightly open there. You got >> this one here. Is he blinking or [snorts] >> he was he was he was eat >> eating with the ball. It's like earlier I asked, "Are they slightly closed?" Whatever. You said they're >> not. Okay. Well, they're both >> Well, I mean, that's not what you said. >> I'm sorry. I apologize. >> I mean I mean I need to apologize, but I need to I need to know. Hold on, sweetheart. I need to know when he sleeps are his eyes closed. They do. >> They're both. I'm sorry. They're both. >> Well, it wasn't both earlier. >> They're I'm sorry. Okay. >> Because they majority of the time they are wide open. >> All right. Well, we ask you need to tell us straight up. Okay. >> Yeah. I'm sorry. >> What happened when he when your son um used to sleep in the bassinet? >> Oh man. He used to get hurt all the time. Stuff used to pop like he'll be like sleeping and like you you think like we thought it was messing with his soft spot right there. like we thought that was what it wasn't growing in because until I did the research I never knew. So I was like oh my god. >> Okay. You say this and that. What happened when he used to sleep in? He used to um hit his head on side of the bassinet. He used to push off. He got too tall. So we took him out of the bassinet. We put him >> when he used to hit his head in the bassinet. Did he have any bruises or anything like that? Anything that he hurt? Did he hurt himself at all? How >> he had some bruises on his bruises? He get like little bruises. I just thought cuz he was so red. >> Okay. Wait. I thought he was so red that it was just >> when he was in the bassinet. How long ago was that when he used to sleep in a bassinet? >> He just started sleeping in his bed. He used to fall asleep in a bassinet. He probably just stopped when I got concerned. I haven't even like I still like sometimes they put him in there. But >> he still sleeping there sometimes. Sometimes because if he in the kids' room, >> where's the bassinet at? >> In the white bed in the kids' room. >> Yeah. So, he still sleeping there sometimes. >> Yeah. Sometimes he still will go in there just if he's sleeping or if I need to get his bed ready, if I'm doing something real quick and I'm like, I'm cooking. I'm like, listen for papa. Babies. Listen for papa. >> And I have a one-year-old >> and she just turned two. >> Okay. Listen. When he sleeps in the on bassinet, okay, you said you can hear him. Did you ever see him bump his head? You think it's a bassinet? >> No, I never seen him bump his [snorts] head. >> Bassinet um padded or anything? >> No, it's a wicker bumper. It's wicker. >> But then you said what happened? You kept pointing to your face. What happened? >> Because he'll get bruises on his face. >> Where at? Just show me. >> Like in the picture, you seen the pictures like on the side of his face and I was like something in his bed or something? I never I never took the time to think. >> What did the bruises look like? Like like at first like the way it started off like there like light like the one on his head >> like that. >> Mhm. >> Let me ask you this cuz the bruises were there over different pictures. I mean if he's getting bruises on his face and all that. I mean why get rid of the wicker basket? I mean that's >> I put him back in his head. But I never really just I never >> Yeah. But you said you still you still put them in. never took the time to really just be like just going to throw this out and still it was there. I [snorts] used it. >> We usually put him in a wicker basket and take >> probably my 5-year-old. She'll put them in there. She >> She'll pick She'll take the baby out. >> Yeah, she's If you talk >> How tall is the wicker basket or bassinet? >> It's probably about >> How tall is Okay. How tall is Now leave your hand right there where you're saying how tall is your daughter? >> Probably about like that tall maybe. >> Wait, hold on. My 5-year-old, right? >> My 5-year-old. >> Okay. Hold. Give me the height. >> Right here. >> Probably is about right here to me. >> Okay. And where's the whiffer basket? >> 5-year-old can't pick up a kid out of wher basket like that. >> I've seen her do it before. She's never >> not not safely. Do you you know what I'm saying? >> For 40 minutes, the detectives have held the medical examiner's findings and have not mentioned them once. Every question has been about the clock. when she clocked in, when she got off, the time on the Walmart receipt, how long the Alfredo took. That was the point. She has now given them, in her own words, a window, an hour and 20 minutes between the last time she says she saw her son move and the moment she found him. And she has placed herself at Walmart or asleep on the couch for almost all of it with his father in the apartment the whole time. Notice what they have not done. Each time she offered an explanation. A 5-year-old who picks him up on her own. A handme-down couch that brought bed bugs into the house. A fall she never saw. They let it stand and moved on. The only claim they pushed on was one they could test against her own phone. She said his eyes were always wide open when he slept. Her own photograph said otherwise. The wicker basket is the first time a detective answers her instead of asking her. He does not argue. He has her hold her hand at her daughter's height. That closes the one explanation that put the injuries on a child. Everything that comes next is delivered into a much smaller room. >> Okay. conclusion of the autopsy was is that um that your son passed away from blunt trauma to his head. [snorts] >> No, [screaming] I didn't get it. How do you get the trauma? I don't I know. Is he sick then? Has it been there? Has it been pouring out? >> Blunt trauma means >> not sick at >> Not sick. Somebody caused it. >> Somebody co-caused Do you know what blunt trauma means? Seriously. >> No. No. You got >> Somebody put force to your head. >> Somebody put force. >> It's a It's an impact of some sorts. Blunt force trauma is an impact to your child's head. Now, you know why? Do you know why we're we need to be so specific to what you said? Okay. Now, >> listen to me. Listen to me. >> Put your hands down. [snorts] >> Listen to me. Look at me. >> Oh, I'm so mad with them. >> I know. We're trying to find out. [screaming] Listen to me. >> I don't even I'm not real mad because right there. OH MY [screaming] GOD. I'M SO MAD. I WAS SO >> YEAH. [clears throat] >> LISTEN. >> So mad. >> Understand? But listen, you'll be so mad. That's why we talking to you to find out what happened to your son. Okay? That's why it's important that you let us know everything we ask you. Don't beat around the bush or none of that. Okay? You see this is this is a ser serious situation. Right. Right. >> Listen to me. [snorts] Also sure that your son was injured in the past. Tell us about that and you need to tell Listen to us. Listen to me now. >> You understand? Listen to me. >> When I ask you these questions, you need to be straightforward. You understand? >> Cuz we already know what's wrong with your son. We already know that something happened to him in the past also. Now look at me. You need to tell us everything that happened to your son in the past right now. I have told you everything. >> Hold on. Hold on. You first of all, look at me. >> We asked you about your kids and all that stuff. First, let me tell you about Hold on. Listen to me. You got to listen. You got to listen to me. >> Okay. >> You got to listen to me. I know you heard, but you got to listen to me cuz you're you're really stretching this. You're really overdoing it and you're gra listen to me. This isn't the result of your kids playing with your son. >> Oh, I don't >> Okay. Well, hold on. That's the first thing you said. Do you realize that? >> Cuz I never >> Hold on. And And what I'm concerned with is you said you kind of said something that got me just a minute ago that when you were sleeping. This could have happened between you sleeping and while you're at Walmart. But you said when you were sleeping. >> Cuz I just I never cuz my boyfriend was alert when I was at Walmart. He was alert. >> Well, what did he say to you? >> What did he say to me? >> Yes. >> When I came back from Walmart. >> What did he say at home during the day? >> Nothing. We just normal. >> Look at him and say it. >> We were normal. We was just >> there. There's not Was he acting different? Somebody listen. >> Nobody was acting different, but baby was fine. >> Listen to what he telling. >> Baby wasn't fine. Okay. >> Kids didn't do this. Look at me. Kids didn't do this. These things under his cheeks, they're not bed bug bites, sweetheart. They're not They're abrasions. They're >> They're doing this. It's like when you fall and skin your knee. They're abrasions. Okay. The little bruises you saw over your your child, this is this is an ongoing pattern. >> Look at me. I can tell you know what's going on. >> How did your son Listen to me. Internal injuries your son received in the past through the autopsy. Tell me how that stuff happened. Cuz the injuries that he had had, you had to know about him. That's how ser I understand you. Sorry. Well, let me know what's going on. >> I'm sorry. I said, "Are you serious?" >> I am serious. You think I'm playing? I'm not playing. What happened to him in the past? >> I don't know nothing. >> You got to know from them injuries that we saw. >> I don't know. >> You got to know something. >> I just Every time I just thought they were bites. I I swear I thought they was fight. >> Tell me the about the injuries that he received in the past, man. Let's start from there. >> He's hurt. He's gotten hurt in the past. We'll tell you that right. >> A few times. >> Just the time I thought he fell off the bed. >> Okay. When was that? And I asked my daughter and I [clears throat] and I went in here. I said, "Oh my god, the baby fell off the bed." And I So I woke up. >> Did she come and get you? >> No. I woke up that morning and seen that morning. I seen >> and that morning I seen my baby on the floor and I asked her. I said, "Oh my god, did the baby fall off the bed?" She said, "No, mama, he ain't fall off the bed." She said, "No, he never fell off the bed." >> Did uh do you have carpeting in your bedroom? >> I have carpet. >> Okay. >> I have carpet. It does. >> Okay. Well, a fall off the bed is not going to do these injuries. Okay. Look at me. Need to chill out. I'm telling you right now, this is way too overdramatic >> and it's going the wrong way. >> Way wrong. >> I'm sorry. >> I'm sorry. You got to >> No, no, I understand it. But you Yeah. Like you said, you got to understand it. Let me tell you what you're looking at right now. Okay. What this is right now, this went from Hold on. This went to just being tragic. This is murder. Okay. Look at me. This is murder. This isn't an accident. This is murder. And what you've got to answer right here and right now is first of all, your child had existing healing injuries. Your child had old fractures. Okay? A baby lets you know this stuff's going on. A baby let you know they're fussy, >> crying. >> They're crying all the time. Listen to me. This child was, first of all, Okay. >> Yes, sir. >> You've had two other kids. Your daughters seem fine. This child was not fine. This child was malnourished. >> I was feeding. >> He wasn't eating nothing. This child was skin and bones. >> I was feeding. >> He was skin and bones. He was underweight. No muscles. He had muscle atrophy. You know what that pretty You know what in a nutshell that means? >> His muscles were deteriorating. They were they were they weren't there. Okay. That's why he was so weak. >> He's weak. Exactly. His muscles so weak. He wasn't eating. >> I thought he was eating a little the food. I didn't >> You don't feed a child jar of food when they're 6 months old ever. Fruits. >> No. >> Come on, sweetheart. >> I did my >> You maybe go rice and cereal. Maybe rice and formula. And I don't even agree with that. You're supposed to go formula until I would say at least eight months. Then you start moving them to more solid food. But you don't give them jar of food ever. Especially a child that's underweight. You knew that child was underweight. >> Yeah, but I thought if I gave him the food, it would help him gain the weight. >> You didn't know. You didn't take him to a doctor. >> I thought it would help him gain weight. >> You're not a doctor. >> Google's not a doctor. >> You see where we're at now? Look at me. Things Things weren't fine either when you left to Walmart or when you came back. Things weren't fine. He's got to know or you got to know. It ain't the two. It ain't your daughters. It's you or him got to know. >> You got to know. You gotta answer that today. >> What he said. But look at me. Everything we ask you in here, I'm going go in there and ask him. >> So something better add up cuz if you don't tell me what's going on, he tell me something different. Listen to me. Let me finish. Who do you think I'm going to have to go with >> him? Because if he tell different to me. >> Well, you better tell me what's going on. >> I don't have to. >> Okay. We have to move to this realm here. Okay. >> Okay. What this is is your constitutional rights. I'm going to read them to you. Okay. All right. I'm going to tell you as an experienced mother. The things that we got to ask you and get answers for, you should know as an experienced mother. [snorts] Okay? So, just listen what he's got to say. If you got some questions after that, we'll be glad to answer. But you we got to go over this. Okay. >> Yes. >> Yes, sir. Okay, >> I'm tingling. >> Okay, listen to me. Okay, you know how to read and write? >> Yes, I know. >> All right. >> Spell your first name. >> K I E R R A. >> Last name? >> H A Y E S. >> H what? >> H A Y E S hyphen L A I R T. Midday to break >> 2789 >> forward. The interrogation has exactly two suspects and she is one of them. >> What he said, but look at me. >> Everything we ask you in here, I'm go in there and ask him. So something better add up cuz if you don't tell me what's going on, he tell me something different. Listen to me. Let me finish. Who do you think I'm going to have to go with >> him? Because if it tastes different to me. >> Well, you better tell me what's going on. [clears throat] >> Okay. We have to move to this realm here. Okay. >> Okay. What this is is your constitutional rights. I'm going to read them to you. Okay. All right. [sighs] >> I'm going to tell you as an experienced mother, the things that we got to ask you and get answers for, you should know as an experienced mother. Okay? So, just listen what he's got to say. If you got some questions after that, we'll be glad to answer. But you we got to go over this. Okay. >> Yes. Yes, sir. >> I'm tingling. >> Okay. Listen to me. Okay. You know how to read them, right? >> Yes, I know. >> All right. >> Spell your first name. >> K I E R A. >> Last name. >> H A Y E S. >> H what? H A Y E S hyphen L A I R T. >> You can read and write, correct? >> What's the last grade you completed? >> Some college. [sighs] >> Are you taking any medications at all? Any prescription medications? No, I need to >> I can't hear you. >> No, sir. >> Listen to me. Do All right. >> You have any mental problems at all? Anything like that? >> No, I don't have any. >> Um, you had any alcohol today? >> Yes, I've been drinking. >> What you been drinking? >> I don't know the name of it. I just been drinking. Just >> alcohol. >> Okay. So, I know that you can read. Read this top line for me. right here starting at you. >> Read it out loud. >> Yes, please. >> You do not have to make a >> No, this one. >> You have the following rights under the United States Constitution. >> Okay. What I'm doing, I'm going read you each sentence. Okay. And I'm going ask you if you understand it. Just tell me yes or no. Okay. You not you don't have to make a statement or say anything. You understand that? >> I can't hear you. >> Yes, sir. >> Okay. Anything you say can be used against you in court. You understand that? >> Yes, sir. >> All right. Yeah. Right. Just talk to for advice before you make a statement, before any questions are asked of you. >> Yes, sir. >> And then have a lawyer with you during any question. You understand that one? >> Yes, sir. >> Okay. >> If you cannot afford to hire a lawyer, one will be appointed for you before any questions if you wish. Okay. You understand that one? >> If you do answer question, you had a right to stop answering questions at any time. Consult with your lawyer. You understand that one? Okay. State. I went over that with you. Did let me ask you real quick. When your child had these whenever he injured himself according to you by the wicker bassinet or what and the bruises and the bed bugs and all these multiple injuries that were I've seen on these pictures. Whose idea was it not to take him to the doctor? >> It was never nobody's idea. We had called >> who? >> But I saying I called my doctor's office. I talked to the after hours people like I was saying before I >> Wait, you tal You called them and they said don't bring them to the doctor. They say no make an appointment or >> No, >> cuz we're going back to November 2nd. We're going back to September 9th according to pictures at these various times. What did the after hours service tell you? >> I caught them. When I first caught them, I said I was concerned about my son's head because he wasn't holding his head up. >> Your son can't hold his head up. Yeah, that's why I said I >> Well, that's not a concern. A child that age can't hold his head up. >> But some babies are holding their head. >> Hold on. Let's let's let's stay on that real quick. Why are you concerned that he couldn't hold his head up? Your child can't hold his head. >> Because my daughter start holding their head up faster. >> No, but why did I mean that's that may be just development? Why did Why did you think it was >> important enough where you had to call the doctor's office? >> Because my mom said he could have a water head. He could have been waterhead because his head was so I was concerned cuz his head was so big. I was like, why is his head so big? And I was like, "Mommy, he can't hold it up." I told my mom he couldn't hold his head up. >> Why did you call your mom? >> Um, because I was concerned because he can't hold his head up. And I call my mom for advice all the time. >> If you felt that way, why didn't you just take him to the emergency room? >> To the emergency room? Because when I said something about it, it was I was told I was overreacting >> to Who said that told you that? Let it out, baby girl. Who told you? It's important. >> But I don't think he My My boyfriend told me I was overreacting. >> Okay. It's very Listen to me. That's fine. It's very important to tell us that. Okay. Did he say why he said that? Why did he get >> He said Papa was healthy. He said he healthy. Nothing wrong with my son. Nothing wrong with my son. >> When did he tell you that? >> He told me that when I was trying to take him to the doctors and then his mom came again. She was like, "I'mma take him to the doctors." And cuz he's sick cuz he's so skinny. And that's what his mother said. And I said I thought he was sick but I went with my boyfriend gave him the benefit of the doubt and I never I was like I didn't go to the emergency room because I I didn't want him to say you overreacting. You overreacting overreacting. >> You said that you scared of him or something. >> No. I'm just asking you. >> I'm not scaring him at all. Oh wonder my baby stop moving. He was moving fast. [screaming] He was moving fast. And then one day >> Well, look at your pictures. I I just was and I said I said I never paid attention to my baby. >> I know. I'm so mad at myself though. I'm mad at myself because every time I wanted to do something for my baby. Every time I want to say something for my baby. Every time. It's I'm overreacting. I'm overreacting. I'm overreacting. Yeah. His mama even came and said we need to take him. He not eating. We can take him to the hospital. like you'll take me the next day, >> right? [snorts] >> I end up having to work, man. >> Even his mom noticed the baby didn't have enough food. >> Yeah, we was feeding him. >> No, you weren't. Not enough. Do you know what was in that baby's stomach? Let me tell you. You know what was in the baby's stomach? Nothing. >> Oh my god. >> Nothing was in that baby's stomach. >> Okay. And that's not anybody making something up. Have I ever met you? >> Never. Never met him. I don't still haven't met him. >> But he told you that nothing happened to his head. >> Oh my god. [screaming] I ACCEPT IT EVERY DAY. IT'S my baby. I ACCEPT IT EVERY DAY. I just accept it every day. I never I NEVER FALL FOR MY BABY. I never fall for my baby. I I should have stuck up as me being weak. I should have said, "I'm taking him. I don't care how you feel. I'm going to take him to the hospital. I never spoke for papa. Oh my god. And my baby is my 5-year-old is in a state of shock right now. >> This is what they were trying to make. You understand? [laughter] >> They told me I was I need to touch him. I need to I need to I need to say I don't want to even see him. I can't because I'm too can't I can't I can't even f I can't look I I can't even take him seriously if I tell my mommy my mommy going to die she never got to meet my baby none of my family got to meet my baby never even met him and they tell me some stuff like this like [laughter] oh my gosh oh my gosh I just I couldn't I can't even fast like you know what I'm saying. >> Does he work a job? >> Does he work at a job >> at at the house? Right. Okay. The understand [snorts] >> No, I'm not judging you. It's not my job. >> Judging myself because I for my baby. I didn't I tell me something% agree with you. >> I let them tell me something. Oh my gosh. It's hitting me too hard right now. God, let him take me forever. And I just believe because I just wanted I wanted it to work so bad. I wanted this to work so bad. And I always Google Oh my god. [clears throat] [sighs and gasps] >> But no matter what Google told you, >> I never Googled the right. >> I never went to the hospital. I never I [laughter] didn't trust my mind. I let somebody tell me I was overreacting. I NEVER OVERREACT. I'M I NEED TO start trusting my God. I submit myself to [laughter] him. I MISSED THE SIGNS. I MISSED THE SIGNS. I didn't miss them because I pointed them out. I pointed them out. >> Did you tell your mama about this? Did you tell your mama about the bruises on the baby's head? >> I thought they was bad bugs. [gasps] Yeah, I told you he got bit cuz I convinced myself these bad bugs. You mean to tell me somebody get MY BABY WHEN I'M GOING to work? He got more than one entry to his mom. >> [snorts] [gasps] >> So when I went to Walmart, oh my [sighs] god, let me show you my baby. Let me show you my man, man. I mean, [clears throat] this Oh my gosh. My papa just accepted. I accepted the Oh, look at look. You can see the different. I'm going through the pictures and I'm seeing the difference. Look at my baby right there, dog. Let me show you one more. Let me show you one more. Let me show you one more, man. My babies, man. My babies. Oh my god. My babies. A healthy papa. Look at my son. >> Mhm. You see how [laughter] >> Look at MY SON. OH, THOUGHT HIS EYES MADE HIM LOOK [ __ ] I KEPT SAYING WHY HE ALWAYS Why he always tell him? I said something wrong with him. Oh, AS A MOM, I DIDN'T trust me. Oh my god. I didn't trust me. My baby, I just let it go. I'm going to be okay. I'm so stupid. I'm so DUMB. [screaming] OH MY GOD. I'M SO DUMB BECAUSE I CAN'T SAYING THIS. I'M SAYING IT. Oh man, it's Oh my [screaming] god. I let people say it's okay. And mom told me I need to take him to the hospital. I said I need to take him house. And I say I need to take papa to the hospital. Papa to the [clears throat] hospital. Oh yeah, man. Tell take papa to the hospital. I'm sorry. Sorry I couldn't get this out to them, but they had tagged me. And >> but listen, now is the time [sighs and gasps] that you got to when they come back in to ask you questions, okay? Because now they have had a chance to talk with what's his name? Is it Daryl? >> Cadero. Yes. >> Cadero. Okay. When they talk to Cadero, they might want to come in and ask you some questions that help them put this together. Put this together. Okay. So, I know. I know. They told me I said I don't know how to react right now. They said they said you should have been jumping up trying to kill him cuz my heart was like it wouldn't let me believe it. But then it was like why it be why it couldn't have been me cuz I I drive I try for my kids. I got two. But yeah, >> I can't believe somebody murder my baby. Look at the order the last 20 minutes arrived in. The medical findings came first, then the accusation. Only then the rights form read to a woman who moments earlier told them she had been drinking. After it the questions change shape, not what happened on Friday, but whose idea was it not to take him to the doctor? That is a question that can only be answered with a name. Her language changes with it. For the first half, the phrase was, "He was fine." Now it is, "I pointed them out." Every concession she makes is about what she failed to do. She did not go to the hospital. She did not trust herself. Not one is about how a five-month-old came to have those injuries. The lead detectives told her what they would do. Everything we ask you in here, I'm going go in there and ask him. They have been in the other room with Cordera Weber. While they were gone, she told a different detective something she had not told them. That conversation is not in this footage. What is in it is what they do when they walk back in. They do not ask her anything new. They ask her to say it again to them. >> We're talking to Detective Simpson came in here. >> The female detective >> said you decided to tell her some things that we asked you to tell us before. Is that correct? Okay. >> Am I being charged with anything? >> Let's Let's get Let's get around to this. First of all, >> I need to see my pies. >> Hold on. Let's do Hey, now you need to answer questions from us. Do you do you agree with that? >> Yes, sir. >> Okay. Cuz we talked to him. This is >> Wow. >> Okay. This is [clears throat] What did you tell Detective Simpson that you should have told us when we asked you about it? that he said he was worried >> about >> if it looked like we hit him because of his bruises on his face. >> When did he tell you that? [gasps] [panting] [sighs] >> Oh my god. Am I going to jail? >> You need to answer these questions, okay? You need to tell the truth. >> We'll know the answer to that when we get the truth. >> We got to have the truth. Okay, go ahead and finish tell saying what you were saying. >> This is your time. >> He just said he was worried that they was going to take >> We got to get more than that. I'm going to tell you right now. We got to get more than that from you because we asked you. That's something that should have easily come out of your mouth. Hold on. So, how is that making you look >> No, like >> how is that Listen, how no let me talk. How is that making you look after me and this detective talk to you and ask you questions? >> So, look look at me >> like this right now. I'm upset and don't even care. You better tell the truth right now or you're gonna hurt yourself. Straight up myself right now. >> Straight up. Why do you hate yourself? >> Because I should have I should have said I should have been there for my every time I thought something. Every time like I was telling her every time I thought something I should have just trusted me and not trying to go over what you said. All right. Now, straight up. Nothing around running around beating around the bush. Just tell them what you told her and tell us everything. >> I just told her that. He told me that. told me after he said I don't want to think and I told her I didn't think that way. I never thought that way. That's what I told her that I never thought that way. >> Tell me what he was telling you. >> He just was said he was worried that he didn't want nobody to say that we did nothing to the baby. >> Keep going. >> Cuz he had bruises on his face. >> Yeah, cuz he has bruises. We can't think like that. He said, "Yeah, you right. I know. We can't think that way because we didn't do nothing." I just >> When did he tell you that? >> I He was just saying. He kept saying, "I don't want them to think that we the night it happened." >> Why? Why was it that he kept calling me? Got to get worried about >> I kept calling. >> He called me, too. >> I called cuz I was I I called. It was more me saying, "Can you call and find out anything else?" >> But I told you find out when I come, right? >> Yeah, but I just was I knew you knew something. I knew you knew something that you wasn't telling me. >> Listen to me. Not just now. This This was happening in the past. >> I >> He even told me he asked you about it. He never asked me about that. >> I'm asking. >> Never. He never asked me about that. >> So, you didn't feel nothing. Your son had any um >> I I >> bumps on his rib and nothing never before. >> No bumps. Like I told her when she told me that his skull I told her exactly where it was at. >> Mhm. >> Cuz I said it was right here cuz I felt it. But I just I didn't I >> Okay. When did you feel that? >> I've been feeling it like all of October. I felt it >> through October. >> Mhm. I never I never He never told me if I don't bump on his ribs. >> You see, >> I want to go see my babies. Can I go see my babies now, please? >> Can I go home? >> We trying to find out what's going on. >> Can I go home? >> Listen to me. We trying to listen to >> I want to go see my baby. >> I know you want to go home. >> I need to go home. Okay. >> I like you. I want you to go home, but listen. >> Can I go home? >> Listen to me. We got some questions right now that need to be answered. >> Yeah, >> for sure. >> For sure. >> Okay. >> Ask me. >> Listen to me. the blunt trauma that happened to your son's head. The doctor said it had to be it was fresh within 30 minutes, right? Was you at home during that time? Yes or no? Right. >> I never done that. >> Right. I'm just asking you, was you at home? >> I was sleep. >> That's what I'm saying. >> I was asleep on that. >> But what happened? You got to listen to me. >> I got I was sleep. >> That's all right. What the girls tell you? >> They told they said, "I don't know. Mommy, we don't know nothing now." >> Mhm. >> And they would say they seen your own boyfriend had the baby.
