[Music] Um, do you want to see my intro? I'm sorry. I'm sorry about that. Okay. So, I mean, you almost hit this guardrail back here coming around the turn. Why are you Why are you crying? I just This is what you do. Okay. All right. Give me just a second. Okay. You all right? Oh, boy. I see. I can smell it. All right. Probably shouldn't have poured that out, huh? [Music] I'm sorry. Well, I can tell that's an alcoholic beverage you just poured out. What's What's your phone number [Music] again? All right, Savannah. So, listen. Your driving pattern, the odor of an alcoholic beverage, and the fact that you just poured this beverage out here. Before I can let you drive anywhere else, I need to make sure you're safe to drive. So, are you willing to do field sobriety exercises? Absolutely. All right. Go ahead and step out for me. Can you go? Would you mind walking with her over there? All right. Savannah, are you wearing contacts? Do you wear glasses? No. I got LASIC. You got LASIC? Okay. Do you have any like traumatic brain injury or anything? Military, nothing like that? Okay. Do you have anything preventing you from seeing me right now? Like, can you see my face? Yes, sir. What I'm going to do is I'm just going to check your eyes. Okay. So, if you can just put your feet together, hands down at your side. I just want you to stay just like that until I tell you to do something else. Okay? So, when we begin, what I'm going to have you do is just follow the tip of this pen. Can you see it? Yes, sir. You're going to follow the tip of the pen with your eyes and your eyes only. Okay. Don't move your head. Don't move your hands. Okay. All right. All right. You good? Yes, sir. I just am getting nervous cuz you're putting some of this content from me. Well, I'm just trying to explain everything. Make sure you understand. I understand. Okay. So, feet together, arms down each side. All I want you to do is watch the tip of the pen with your eyes and your eyes only. Okay. You understand that? Yes. You ready to begin? This one. Yeah. Well, I just got to keep make sure you're all right. Keep watching it. Almost done. Here's the actual side. Okay. Almost finished. Keep watching the thing. All right, keep watching. Okay. [Music] All right, you can relax. Okay, so any problems with your feet, knees, hips, ankles, back, anything like that? I saw you walk over here, so you I mean, I had a femur fracture when I was younger, but I'm fine. You're fine. Okay. So, are you think you're able to walk on the line? Yes, sir. Okay. So, if you could just come over here. So, what I'm going to have you do is just put your left foot on the line. The white one. The blue one. We'll use the blue one. Left foot. Now put your right foot in front. Hands down at your side and just stay just like that. Nope. Go back. Sorry. That's okay. Left foot. Right foot. Arms down. Nope. Don't. Just All I want you to do is just put your left foot on the line. I'm not very good at balance. Do you want to try without your sandals or you want to leave your sandals on? I guess I'll try without them. Okay. [Music] All right. So, just left foot in front, right foot, arms down at your side. Stand just just like that. Don't move. [Music] All right. So, when I tell you to start, you're going to take nine heel to toe steps. You're going to count each step out loud. And when you finish with those nine steps, you're going to turn around and you're going to take nine steps back, counting each step out loud. And while you're walking, I want you to look at your feet. Do you understand those instructions so far? Yes, sir. So, it's going to look like this. You got your left foot, right, left foot on the line, right foot in front. Hands Go ahead and keep your hands down. I'm not going to be able to do this, sir. You're not going to be able to do it? No, sir. Do you want to try it at least, or no? It's okay. It's up to you. [Music] All right. So, you don't you don't think you can do this one? Yes. Okay. But what about what about standing on one leg? You hang on. Well, if you're going to do it, we need to we need to finish. Okay. I mean, heel to toe, I can't do it, but if I'm going to have space, I can. So, feel pressured a little. I'm not I'm not trying to pressure you at all. I'm not. I'm just I just want to just want to make sure you're safe to drive. I mean, I almost saw you crash like three times when you when you pulled out of the parking lot, you went through the the center median and then you drove over the median right there in front of Publix. You almost went through the lead red light. You almost hit this guardrail up here. So I I personally can't let you drive from here knowing that Yes. So the field sobriety exercises, they're up to you. You don't have to do them. However, I I mean I just I don't want to push the criteria. I don't I know you guys are just doing your job. I just I mean I've admitted to everything I've done. I just don't want to like tell you I can do something and fall over. You know what I mean? Yeah. Well, I mean, we're not going to let you fall. You know what I mean? Like, I just I can't put my toe on my toe. Like, I just I don't do that when I walk. I can walk nine steps, but I can't like sit here and I mean, people don't do that. Okay. So, so I just want to be clear about Would you like to try like the one leg stand? Absolutely. Or I can do the nine walk, but I'm not gonna be able to like, you know what I mean? Well, I mean, it's really, you got your left foot on the line, right foot? I mean, that's fine, but is that That's fine. I mean, I can do that, but I'm just not going to be able to like put my foot on my toe. I just I guess I was just trying to be a little more technical at the beginning. I got you. I'm sorry. Do you want Do you want me to continue the instructions? I'm sorry. I'm sorry. I just So, just left foot online, right foot in front, hands down at your side. That's all I want you to do. Don't move. Don't do anything until I tell you to do something else. Okay? So, as I said, you're going to take nine heel totoe steps down, counting each step out loud. While you're walking, I want you to look at your feet. Yes, sir. When you get to the end of the nine steps, you're going to take a series of small steps, and you're going to take nine steps back, counting each step out loud, looking at your feet. Does that sound fair? Right. Yes, sir. So, left foot on the line, right foot in front, hands at your side. One, two, three, and so on until you get to nine. You're going to keep this foot down and just take a series of small steps and take nine steps back. Does that make sense? Yes, sir. Okay. Count each step out loud. Keep your hands down at your side, and watch your feet whenever you're ready. If you if you understand those instructions. Yes, sir. 1 2 3 4 5 6 7 8 9 1 2 three I guess two one two three four five 6 7 8 9 Yes. I don't Okay. All right. So, we're we're going to move on to the one leg stand. Okay. Yes, sir. So, you can you can stand on one foot. It's okay. I got to explain it to you. All right. I'm sorry. It's okay. You're fine. Just go ahead and just put your feet together, hands down at your side, and just stay just like that. Okay. So, essentially, all I want you to do is you're going to keep one foot on the ground. Either one, doesn't matter. and you're going to pick the other one up approximately 6 in off the ground. It's about the height of a soda can. Okay? You're going to keep your arms down at your side and you're just going to count out loud 1,001 1,002 1003 and so on until I tell you to stop. Do you understand that those instructions? Yes, sir. All right. So, go ahead and put your feet together. Hands down at your side. While you're doing this, I want you to look at your feet, okay? And count out loud. 1,00 1,002 1003 1004 1006 1007 1008 1009 100 112 I mean 1 1002 1003 100 I [Music] Mhm. [Music] You You want to start over? I mean, okay. So, do you understand how many seconds it was for the first time? So, listen. I just want you to keep your feet together, arms down at your side. Okay, that's it. Arms out at your side. I did that. Okay, you're going to pick either foot up approximately 6 in off the ground. I want you to look at your foot and just count out loud until I tell you to stop. That's it. I mean, I did that. Okay. [Music] Whenever you're ready. Oh, sorry. Looking at my feet. Look at your feet. I apologize. I can't look at my feet. All right. I mean, I had like 11 seconds the first time. Yeah, I got you. So, listen. You're going to be under arrest for driving under the influence. Okay. You got [Music] this. Is there somebody local that can come get your car? Is your friend awake? around the corner. I'll call somebody else. Huh? I said I will call somebody else if I can't get my key. We We'll give you that opportunity. My car is still running with my person locked and my keys to my house. My your person keys are in there. Yes. Can Can you grab her person and and uh turn off my vehicle and lock it if you don't mind, please? Well, we can't leave it right there cuz it's in the road. So, Well, that I will call my mother-in-law if I can get my phone back. How far is she? She's just a few miles. She's behind the hospital. Okay. You just hang out with her for a second. Can you search her before I transport her? Is it okay if I leave the key with the car? Sorry. Can I take the key off so your mother-in-law can get it? My mother-in-law can't get it without that key that's hanging on my Yes, ma'am. I understand that. That's what I'm asking. So, as long as she can come pick it up and get it, that's fine. All right. Yes, sir. Okay. I just don't have another extra key is what I want you to know. I got you. I understand. Here's your phone if you want to try and call your mother-in-law. I appreciate you. [Music] Do you have anything in your mouth? Can you open your mouth for me? Say h. Okay. So, we just got to sit here for 20 minutes. Okay. And then I got to read you read you some paperwork. Okay. Okay. How'd you get to you from Belasta? Dad was not there. Oh, good. Stacy in high school. Yeah. Been here ever since. Huh? My high school sweetheart got divorced. 15 years later. 15 years later. So essentially what kind of is going to happen from here once we finish the this 20 minute observation period. Yes sir. I'm going to ask you to provide breast samples into the intoxilizer. I breastfed. No not breast like breath. So I'm just going to breast. No no no. I'm just going to like seven years. Yeah. And they uh essentially it's the breathalyzer just okay but I'll I'll read you uh what's called the implied consent just so you understand everything. Yes sir. Essentially why we got to sit here is to get rid of any like mouth alcohol that's like might be in your mouth so it doesn't like skew skew the numbers. Yeah. Absolutely. And thank you. Uh, I've been here since the beginning of 2018. Where'd you come from? All over. Originally, I grew up in Missouri, but moved around or just My mom was a law enforcement officer. So every time she took a new chief's job or assistant chief job moved moved to Tallahassee promotion in 2003 and then moved over here in 2018 like that and stay Yeah, I like Florida. Florida's nice. Yeah, definitely like the girls like you get the inland Florida like country vacation when you go to freaking Disney or Orlando and then like go to the beach and Jacksonville always something to do. This is a good area up here. Crest view. Dustin lots of stuff to do. Usually I was super pumped when they closed the roller ring and cross cuz I just got both of my kids um Yeah. I don't know why they closed it. But I know there was a lot of like fights between juveniles every weekend. Every weekend there's always some some fight. You guys must be a perk by sometimes. It's not generally as bad. It's more of like noise noise compliance marijuana smell of marijuana coming out of their trucks and vehicles and yeah I feel like I can see that I guess my mother's my wildest back there. So, a lot of times I go might just drop off the boys or whatever. They're going to sleep at the sleep out there and it's um it's like big drops, you know. And I did not. It's okay. It's okay. Thank you. Do I have any Did she call back? Doesn't look like it. Okay. She might be asleep. It's okay. She doesn't sleep cuz she takes sleep medications. Oh, okay. It's fine. Yeah. Sheriff matters. That's true. We did try and call her. So, okay. No, I appreciate. All right. So, this is what's called uh the implied consent. Essentially, when you get your driver's license, you sign, you know, like you sign up for this. Okay? So, just listen carefully to what I'm about to say. Now, because you've been arrested for an offense committed while you were driving or in actual physical control of a motor vehicle while under the influence of alcohol and/or drugs, I'm now requesting that you take a breath test for the purpose of determining the alcohol and/or drug content. If you refuse to submit to this test, your privilege to operate a motor vehicle will be suspended for a period of one year for a first refusal or for a period of 18 months if your privilege to operate a motor vehicle has been previously suspended for refusing to submit to this test. Yes. Additionally, if you refuse to take the test I have requested of you and if your driving privilege has been previously suspended for refusal to submit to a lawful test of your breath, urine or blood, you will be committing a misdemeanor in addition to any other penalties which can be imposed by law. Your refusal to submit to this test shall be admissible as evidence in any criminal proceeding. So, have have you you don't have any Okay. All right. uh you don't have a CDL. This next portion is for the CDL. I'm going to read it anyway cuz it's on the paper. Uh if you hold a commercial driver's license or operating a commercial motor vehicle at the time of your arrest, a refusal will result in disqualification of a commercial driver's license for the period of one year, you don't have one. In the case of a first refusal or permanently if you have previously been disqualified as a result of a refusal to submit to such test. Do you understand what I just read to you? Uh will you submit to the test? Yes, sir. Yes. I have to keep your driver's license. Okay. Cuz technically it's suspended. But, uh, once I get done with everything I'm doing, the citation I provide you for driving under the influence, essentially, it's going to be a temporary driver's permit, for the lack of better words, right? There's going to be instructions on the right hand side for what's called a DL hearing. So, you need to follow those instructions, okay? And don't forget about it because if you don't do it then like you're not going to, you know, be afforded like the business purposes only or or a driving permit. Usually the people it affects the most are the ones that like refuse that test because when you get your Yeah. when you get your Florida driver's license, you sign that saying that you're going to do it. And if you don't, you know, you're so uh I don't know if you want to know. So, looks like the first test we did was an interference, which was probably my Apple Watch because it has Wi-Fi. So once I got rid of it like it we had no problem. So the your sample the first sample you supplied was uh.149 and the second one was.156. So the you know the legal limit like you're about twice the legal limit to operate a motor vehicle. Okay, if that makes sense. Doesn't change like the citation. It's still just a traffic misdemeanor, right? It's just driving under the influence is essentially the charge. Okay. So, what what I'll do now is we'll just I'll take you over to the county jail and then I have to finish this packet and bring it over to them and then, you know, based on your breath samples, they have like a matrix. Yes, sir. You know, cuz they can't just let you walk out into the street and, you know, because be on them. So, I don't know how long you'll be in there. Okay. Uh, you're not on probation or parole or any silly thing like that. Yes, sir. Yeah. Okay. All right. Got your phone on. Thank you. Want to stand up? I'll just put these back on you real quick. If you put your hands together like you're praying, it's a little more comfortable. Thank you. I appreciate that. A They're not made for comfort, unfortunately. No, for sure. I didn't expect it, but it's a little bit difficult. You're trying to adjust yourself and then you get in the uncomfortable position and you're like, "Oh my goodness, what is this?" All right, so we're going to head out to my car. Your purse is in my trunk. I got your phone and my license is there. Got you. Thank you. Yes, sir. Want to go around the passenger side. [Music] Just was expecting more padding at first. Pardon my No, you're fine. It's I'm sure it's much easier to clean up this way. You're kind of messy sometimes. Okay, let me get you over there so I can get you out of here.
