some concern there all right this is what I'd like to do i' like to run series of roadside sobriety task on you and make sure that you're not impaired so that way you can get home and you can either make something at the house or figure something else out to eat because they're not serving you today I okay but before I let you get into your car and drive away from here I need to make sure that you are safe to be on the road cuz I have some concerns like I said all right are you willing to participate in the redside sobriety task should I be asking for a lawyer to be with me right now no lawyer can be present with you right now this is a DUI investigation okay so just like in a traffic stop just like any interaction with law enforcement out on the streets or anything like that you don't have the right in presence of a lawyer to be with you you know while we do that that that preliminary aspect all right time you get access to a lawyer constitutional right access to a lawyer is after you've been charged and arrested and you're you're basically getting arraigned okay at that point there you've been booked under the charges and stuff like that that's when you have your access to a lawyer all right we're we're not there okay we're nowhere near that so what do mean that means is no you don't have access to a lawyer right now [Music] okay so if I don't have access to a lawyer right now like so I'm asking you to perform roadside sobriety tasks to determine your Fitness to be operating a vehicle you're in actual physical control of the vehicle right now I need to make sure that you before I permit you to leave here before we leave here that you are okay to be in actual physical control and then take control and drive away from here okay that's why I'm asking do r at sobriety task should I be calling someone to have them here with me right now no because they're not going to be here with you we will not let them interfere in the investigation period whatsoever so let me explain this to you your refusal to perform the rotate sobriety task can be used against you in a court of law I'm affording you the opportunity to dispel my concern because I do do have concerns that you may be impaired as already stipulated I'm affording you that opportunity to spell my concern if you refuse and just sitting here not answering or anything like that will be considered a refusal or you plainly state that I don't want to do this I have to make a decision to place you under arrest based off everything up to this point in time up to that point in time that
