got a picture of it my mom has a trespassing warrant warrning warning against syester apparently it got withdrawn withdrawn okay magically um with all of this craziness that's going on mhm she didn't withdraw this um that water over there this this entire Pro is 100 people are living here without very very long discussion last night M okay and this is where I'm at I am not going to go to court and fight her to stay here I I don't want to stay here if it's going to be this kind of life I I don't want it so is all I am going to court to fight her on is ample amount of time to get my finances to where I can move that's all I want that that is all I need I I mean I poured everything I had into this I mean I had $40,000 in the bank when I started this and I had to redo the floors redo the electrical redo the plumbing redo the walls redo everything I built the porch and then I ran out of money before I could finish it but I you know I was slowly doing it but I I'm just I'm just over it I just need if you can tell her that I look he's not even gonna I don't want to fight her to stay here permanently I'm not doing that I I just need time I mean it's hard to move with five kids and and that's understandable but from unless she's changed her mind she doesn't care I I Sylvester can fight to stay here I I don't care that's that that's that's going to be his fight I mean you could sue you could Sue Sylvester I think I think he has a leg to stand on with the property somewhere along the line because it never went through probate and it's a air property that he didn't sign off on only the two sisters did well it's his trailer too so yes that that's going to be his battle to fight um it just sucks for you and your family cuz you're you're in the middle of it I took my letter and had it uh my unlawful detainer response letter to judge Plains this morning so I did all that I recorded all that so now I'll have a court date to go stand in front of her and judge Plains where I'll make it very apparent that look lady I I I don't want this life I I but I I I honestly think that you put a bunch of money into this place possibly I've been working on it since June I mean you could Sue Sylvester to get the money back yeah I've been working on it since June and they watched me they watched me work on it they watched me gut the entire house I threw all the sheet rock right there I'm still picking up pieces I everything they watched me completely redo the floors they watched every bit of it and then when the work stopped it was right around like December 2nd I had to pull back and focus on Christmas for the kids when the work stopped then she wanted it then she wanted me out so I mean I get it I understand um I I I get it but but she she was cordial with you up until then well I never even talked to her never even had any dealings with so you so you had no no knowledge that there was any issue between her and him none so I don't know you I think I think you've got I'm going to have to sue them both yeah yeah I'm pretty sure you can I mean I'm not I'm not a lawyer but I say you have a good chance with Sylvester but I don't know about her but I I would sue both of them yeah we're we we'll go over there well the things you can sue people for these days you'd be I mean you could also sue her for the surprised exactly and she could sue you back but I mean you could sue her for the well cuz this is her property yeah that that would be him as a landlord her as the property owner is kind of like a joint he's brought her into it but I think part of it is according to her last night he was supposed to have hooked up to Jefferson County Water 10 years ago and just never did do we know if she's connected to Jefferson water no it's a well it's just a it's not through the city actually I know the guy cuz I paid freaking guy for the will was part of my contract with Vester yeah oh so he's not renting to you he's renting to own with you yes that's really bad on him if that's the case cuz I mean I have Paper Trails for all of it most of it was done you know through my bank account so I don't know he's talking about his sister didn't have the right to sell to the other sister but then he's selling to you when he doesn't have the right to sell it well he wasn't it states in there it's not property it states in there that it is a air property and it is for the trailer only oh okay it does state that he was not trying to sell me the property he I did not want the property I wanted to pay this off and then I wanted to move it my father also died this year uh in May and I have that was financially all me well at least you still have the hitches so you can honestly move pretty easily and he left me the property in Lloyd acres and I I mean well I mean Mr James not for nothing but um if you're lease to own with Sylvester is for the residents and the residents only move it to your property in Lloyd Acres it doesn't quite matter where the piece the trailer is as long as you keep but I mean that's up to you no I mean but here's the problem is it if you're going to have to deal with her because if you move this trailer she's going to say that it's hers and then you're going to have a well he has the title Sylvester has the title it is in his name I witnessed it I actually put my eyes on it before I agreed to anything and I never wanted the land so I didn't even you know he told me it was an air property I said okay it'll take me according to my contract it'll take me 3 and A2 years with monthly installments to pay this off and my plan was to pay it off and then move it I did not want to be here for that now I definitely don't want to be here another 3 and 1/2 years absolutely do well or another 3 years I'm sorry if her gripe is solely the cost of running the well well her gripe is also her gripe is also the fact that you guys are here on her property yeah and she doesn't want you to be I and I get that I had no idea it's not like I'm like spitefully like oh you know to hell with you Miss Dorothy I don't even know you you know I just I messed up honestly well and you didn't mess up because it what you didn't know anything I tried to do everything I took it to the notary and they said yeah this is all fine this is good I said okay now now is there a front to this house off of yeah 69 West there should be yeah okay then we need to go to the front door and knock on the front door and make contact with her I would I don't want to through the backyard yeah I'm not going to family was over there so it no one well it it was from over there yeah oh yeah we can ride over there to that side I would be feel better going to the front door so I called so I called and he said go over and look at the pump I said the hell would you but no you come go look at the pp absolutely not yeah yeah she she definitely isn't going to budge with him no see and they I so you're the bottom line is technically she can't state claim to something that's air property without the signature of all the people Sylvester was involved and his signature is not there so that he has a some kind of Court issue with her as far as documents go that we have available to us today she is the owner of oh I looked this address yeah this address ties back yeah it's public it's public information I looked it up through the proper the only ties he has to this property is this trailer in in the claim that his parents said this is yours this is yours this is yours um and that he's been living here ever since whether that holds up in court is to be seen to the court yeah that's that's to the court uh I would rather not go over there until y'all come say it's okay yeah yeah absolutely or Y or nay yeah because I don't know I just don't know now if she says kick sand we kick sand but you can sue her yeah cuz she's in viol Technically she's the property owner and therefore the landlord and she is with holding utility from you which is a tenant landlord civil I have no contract with her though it doesn't matter is she still my landlord she is still your landlord quas yeah so she is she either you can sue her or she owes you 3 months of rent it it's it it's weird this is a [ __ ] storm of a problem really is and that's why we just want out of it at this point I mean it's going to take me I I know it's going to take you and I know it's stressful to think it's hard to even say how long it would take you to find a place and then but at the same time you know I mean it with her being the landlord of the property it it's her say yeah you can fight it in court I like you you have but I mean now you can ask or say hey if it's a if it's a matter of what it cost to run this pump for the water what dollar amount does that come out to I mean if you want to I will gladly pay that until I can leave or split it with her I mean no I will pay it I will just pay it just so that my family can bathe and I can cook and and and and I'm just Mr James I'm just throwing that out there you know for you maybe to her is that something you could could swallow for a short period yes oh yeah I mean it'd be a lot easier than moving in the next 5 days I I a lot cheaper mhm yeah well that's something that we'll we'll cross that bridge when we go over there there and then I just but if you could just make it clear to her that I have no intentions on fighting her to stay here long term I just and if she's if she's willing we could have you over there if she's okay with it and you can say that to or yourself so it's all it it's not a we're not the owls of the situation even if Sylvester goes in and they give him this side of the property guess what we're still living right there what in the [ __ ] there's what oh and the animal control thing uh I have on record that I'm actually the one that called Animal Control these have been here since I moved here my dog is inside and my dog is and then I she can have with place cuz he's not going to well you have a contract with Sylvester for the the residents yes but it also States in my contract that I would never have to move it ever really yes well it's also not something that he can give you yeah which is absolutely unlawful yeah the the paper you have is golden yeah it's almost some parts of it aren't lawful in my from what I've gathered so far cuz he he he he's given you Authority but he doesn't have it to give so he's it's kind of putting you in he of unlawful binding well maybe he did I mean well he thought it was air property I fully believe that I I fully believe he thought it was air I I I don't know I have no clue always try to think the best of people but yeah yeah I'm starting to yeah starting to go a different direction on that as well but I'm going to have to it like I I mean even suing someone that doesn't guarantee I'm going to get my money I mean he doesn't they're not going to force him to but you'll never well if you win the lawsuit he will have to how well he could be faced with I mean he'll he'll he'll it'll be the court will be able to dictate that if it's if you win a lawsuit like that they have to pay you it's not just something it's by the judge's order so at that point that's that's almost binding now if he refuses to pay he could be faced with some sort of Court judicial punishment yeah I think so I'm not exactly that that's civil that we don't deal with yeah but if you win a monetary amount of a suit's yeah then they're obligated to pay that okay so once once that hits will that go into like a uh I don't know what the word what the words are almost like a garnishment um to where he owes you the money kind of thing well he brags he's got a nice little retirement stacked up so maybe they'd garnish it from that maybe I don't know it's up to the judge yeah that's that's all civil stuff up to the judge anything I mean anything else we can no I I mean I mean we can try this again later but yeah if she I'm just going to go to Walmart and buy a bunch of water so we can at least flush the toilets and stuff like that just keep records of it even the receipts you buy from or even the water keep your receipts mhm get your little wedger and start writing it down it wouldn't even be bad to take that ledger back to the to the very beginning keep it in like chronological order CU at this point if she's the landlord of the property and everything that we've seen she is she's in violation of landlord tenant law so keep records on all of it so by her turning the water off she is in violation it by the documentation that we have presently it yes she's the landlord although she wasn't in agreeance because it was Sylvester's doing so it all ties into their issues their civil stuff but by the letter of the law she is the landlord of this property and therefore the well being turned off is in violation of your tenant law so that is once again civil and you can sue her for all of the the mon value that you if the judge writes a statement saying she has to turn the water back on then she won't be able to touch it when we go over there I mean she could stop paying it but they the you know if that depending if that's a separate service or not it's uh it falls under the electric bill her residential electric bill yeah she apparently stated though no documentation was given that she is paying the electric bill for both residences no she's not no cuz there's there's a power meter when it comes to when it comes to the power when it comes to the the meter insted when I got here so this the power to this residence is in your name yes sir okay well there you go there's another it's another thing that that's not quite true well all I'm saying is it's another foothold on this piece of property because now you have place is this place is there's no reason that there should be nothing that ruins Christmas well but there's no there the weird thing is even though technically by property appraisers that shouldn't be there because this on property appraisers is all one piece of property yeah have two homes on one but if it's but you can but now because it is because on property appraiser as of December 2024 from West caps Highway all the to this road is 649 I looked it up but your address now has its own 911 and it has its own meter which shouldn't it shouldn't be that way there should be one meter and one well which there's only one well but there's two meters and two 911s which is not they have got a conundrum here so I it's it's a big legal something something's going on that's between her and Sylvester based off of what we see cuz it's all kind of assumption at the moment but this this is confusing as hell document wise this is annoying and I'm glad I'm only about 8 months into it and I'm getting the hell out of there but like I said think about stopping up there and talking to her you know say hey what's it going to take she might tell you to pounce in maybe and then at that point you say Miss Dorothy have a great day then it's all up to the judge from me yes sir yep it's always comes down to the judge
