she's also lives here and works here and has a New York driver's license since when she works here in Li um she said she's been living and working here for 3 months residental um exemption yes yes um another charge for a fail to update address on the T it's not her car it's his car well she says it's his car but it actually comes back to somebody named Kim so I still don't know who he is but if he's not part of my stop and he's not part of my stop um Hunter yeah do you want to see if she'll submit to some field sobriety exercises all right go ahead and get a packet so you can articulate I'm not receiving mail here he said it looked very bad for me to be receiving mail in a different state and not here so you lived here for 3 months yeah okay and you know when you establish a former residency within a different state or a different address within 10 days you have to update your address I didn't establish it though I literally just packed a bag and I've just been staying here and anything else okay so you don't want to you don't want to submit to field Sprite exercises no I don't feel that I should okay not submitting to field spry exercises will be held against you in court if she would like to submit to field Bri exercise F my relief um said no rather not or could be used against court she yeah rather not okay um we have the charge of the non-resident zemp as well which is an arrestable offense so even refusing everything it's a good arrest it's a good charge um I guess you know we have two breath tests operator South so you know still give her the um opportunity to submit to a breath test if she refuses she refuses okay go take a step back all right you got anything that's going to poke stick or hurt me anything like that okay do you have anything on your person I asked them to go over and speak to her see if she'd submit to field sobriety exercises it was her decision not to um so she's being arrested for DUI and non-resident exemption which means she still has a New York driver's license she's living and working in Florida so what happens from here um she'll be able to contact you at the jail it's the only reason I told you as much information as I did is because she's driving your vehicle um although whoever Kim is that's my mother okay she driving your mom's car no we're both registered to the title there's only one person on it we're both on the title and uh if maybe she's the only one on she's the only one registered we may both be on the title you're not on that registration maybe not the okay um either way um that's what it is she'll be able to call you and tell you um she has a mandatory first appearance tomorrow in court um I don't know what time does that normally happen around 11:00 12:00 it depends it it it depends tomorrow's part of the holiday weekend um but if she doesn't have a criminal history in most cases the judge will release it tomorrow um on a uh a self Bond or a small Bond you can go down and pick her up okay so you just have to to take her in just because she refused to do the sobriety test yeah well not because she refused to because we think she's intoxicated driving a motor vehicle um if she had done the field soety exercises and we had hey she's okay then no she would have just gotten a criminal Citation for the non-resident or she could have been taken to jail for that that's another thing being this is your car and you're operating it you guys live here you work here I do um you got to have it registered in Florida Okay got to have a Florida Driver's License in 10 days uh registration within 30 all right um so my other question was going to be can I like send my phone number with you on piece of paper just case she doesn't have it memorized by heart she'll be allowed to write down phone numbers out of her phone when she gets down there okay um so she has to stay overnight and go to court yes sir it's just a lot um it's just really weird because like she just got off work and it's a 30-minute drive and she just got here so I just don't see any she's admitted to drinking and there's an open container in the car right there and there's another empty one in the back so I mean we're not going to you know solve the case here on the side of the road but the clues are to me seem fairly obvious I I mean yeah I kind of I understand if there's if there's nothing containing in the car it just sucks I wish I literally she stopped at the gas station for me to get a six-pack and I always tell her I'm like just wait till you get back it's literally a [ __ ] 5 minute drive well I don't
